5 Legal Push Section 504 of the Rehabilitation Act of 1973 No otherwise qualified individual with a disability in the United States, shall, solely by reason of her or his disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance Americans with Disabilities Act of 1990 Prohibit discrimination on the basis of disability by public entities

6 What Do These Laws say about Online Course Accessibility? Well, nothing just yet.

7 June 29, 2010 Dear Colleague, Requiring use of an emerging technology in a classroom environment when the technology is inaccessible to an entire population of individuals with disabilities is discrimination prohibited by the Americans with Disabilities Act of 1990 (ADA) and Section 504 of the Rehabilitation Act of 1973

8 Lawsuits & Civil Rights Complaints Filed for: Inaccessible college/university websites Inaccessible hardware and software Inaccessible LMS s Inaccessible online content Inaccessible enterprise tools ( , calendar, etc.)

9 Bottom Line: All Online Courses Need to Be Accessible to Students with Disabilities

10 Isn t that Disability Services responsibility?

11 The Feds say No All faculty and staff must comply with the nondiscrimination requirements of Section 504 and the ADA in their professional interactions with students, because these interactions are part of the operations of the school. Dear Colleague follow-up Q & A, May 2011

12 So, what s Web Accessibility? 1. Web Accessibility Standards do exist, even if a legal definition doesn t: Section 508 of the Rehabilitation Act Web Content Accessibility Guidelines (WCAG) Accommodations accommodations or modifications that permit them [students with disabilities] to receive all the educational benefits provided by the technology in an equally effective and equally integrated manner.
