Will the feds assassinate another wave of State licensed businesses serving State licensed patients. How can anyone (with half a brain) even compare State licensed medical centers to illegal drug trafficking. And who is surprised that prohibition proven to enrich criminals is still alive and well IN SPITE OF THE LESSONS OF HISTORY??? What is going on? Sadly, as the politicians argue about ways to create jobs and generate more revenue, the medical marijuana community is being terrorized. Those of you who know Mile Hi MMJ Patient are aware that we are decidedly non-commercial and run only a few ads enough to print. We lost 2 supporters to fed letters. We only run 4 or 5 quarter page ads inside the magazine so the loss of 2 ads hurts. None of us signed up to sell ads we are all volunteers so we are now faced with a dilemma. Let me ask what, if anything, you the local community thinks about keeping the FORUM alive, but not printing the magazine any more? It is a sign of the times until last summer we turned away ads in favor of content. If you haven t checked out our FORUM, it is time to see what you are missing. LOCAL news, events and stories from the community. In the next few issues, we will discuss some related health issues. Most of us involved in medical MJ have health concerns. This month is Monsanto and Frankenfood. Why most people are not alarmed by this corporate plot to control the food supply through patented plants shown to be incompatible with human health is beyond me. Educate yourself!!! Watch PBS, and foreign news like RT or AlJazeera to get better news about the US unless, of course, you are more interested in Lindsay Lohan, the Kardashians and Charlie Sheen you won t see that stuff on any REAL news program. We are fighting two wars, and a dog crying to Adele on YouTube gets more airtime on US news than our brave soldiers fighting and dying every day for years, now and for what? What did we get out of Viet Nam??? It seems we don t learn the same with prohibition. Follow the money corporate profits take priority Frankenfood is driven by profit, just like the senseless wars. Obscene amounts of corporate money is more important than the health of Americans. But don t worry some of that money will trickle down (Reagan emphasis on trickle ) and hopefully, your health will still be good enough to enjoy the few pennies left after the 100 million $$+ bonuses paid to CEOs ;-). The DUI bill is rearing it s ugly head, again. They want your blood. *SEE article on page 10. I was at the capitol on Feb 27, and was pleased to see a good turnout. The usual group of activists, mostly patients, was present and, also as usual, only a few MMC owners. The bill passed committee 4 to 1 establishing a 5 ng limit that would trigger per se DUI. Denver Westword pot critic William Breathes took a blood test, unimpaired in the morning, and showed up more than three times the proposed cutoff of 5 ng/ml. Most regular users will test more than 5 ng - even if they hadn t smoked since last night. Apparently, they need to lower the standards of conviction to match the IQs of the best legal minds in the prosecutor s office. 4 Colo. Marijuana Initiative Poised for November Ballot By Mason Tvert It appears voters in Colorado will have a chance to vote this year on an initiative that would end marijuana prohibition in the state. The measure would make it legal for adults 21 and older to possess limited amounts of marijuana, establish a system in which it is regulated similar to alcohol, and allow for the cultivation of industrial hemp. Along with generating state and local sales tax revenue, the measure calls on the state legislature to enact an excise tax on whole sales, of which the first $40 million annually will be directed to Colorado s public school construction fund. In January, proponents submitted more than 163,000 signatures in support of the measure but fell about 2,400 valid signatures short of the 86,105 needed to qualify for the ballot. The campaign was allotted a 15-day period to collect more signatures and cure the petition, and in February it submitted 14,000 additional signatures, all but guaranteeing the measure will appear on the ballot this November. At its second signature turn-in, the campaign was joined by former two-term Republican governor of New Mexico Gary Johnson, who formally endorsed the initiative and discussed why its significance extends beyond the state. Coloradans have the chance to end marijuana prohibition for the entire country, Gov. Johnson told KUSA NBC 9 News in Denver. There has to be a first, and Colorado has that opportunity. 420 Rally Bigger and Better!!! 5 MMJ Law & Policy Have you considered the LEGAL aspects of a visit to the doctor? Does a Physician s Assistant or Nurse Practioner assist you? Sign off on your doctor s orders? Write prescriptions? One more question: If the doctor, PA or nurse makes a mistake, could you be liable for fraud? Our public servants at the Colorado Department of health and Environment think so. What if it wasn t even a mistake, but a technicality over the legibility of a signature or initials? Submitted by Kathleen Chippi/ Account by Audrey Hatfield: PSA - CDPHE Ambushes Innocent Medical Marijuana Patients!!! by Kathleen Chippi on Sunday, February 26, 2012 at 3:54pm The CDPHE is ambushing innocent medical marijuana patients. On Friday, Feb 24th at 9 am, patient J, and two other anonymous medical marijuana patients waited outside a hearing room in Denver Colorado. The three patients did not know each other nor understand what was about to happen as they talked amongst themselves. They were there because they had each received letters from the CDPHE MMJ registry advising them to be at this place at this time. The hearing room was in the (DVR) Office of Administrative Courts, Denver Colorado. These patients had the mis-fortune of being snagged in the new nurse practitioner signature scandal or fraud that occurred in the fall of 2011 and is playing out currently. And apparently, it CAN happen to you. Until last fall, nurse practitioner signatures on medical marijuana recommendations had been accepted with the same significance as the doctors they worked with and all non mmj recommendations or prescriptions that are signed by nurse practitioners. More so numerous mobile businesses and non profits sprouted up between who provided patients access to doctors and nurse practitioners across the state. The CDPHE has no evidence of denying registry cards based on fraud over a nurse practitioner signature from Ron Hyman from the CDPHE revealed on recorded at the mmj advisory panel meetings and board meetings that there had only been 8 or 9 recommendations rejected by the CDPHE in total from 2000 through the summer of There were over 140,000 patients registered throughout that same 11 year period. So we have (lets say) 9 denials out of over 140,000 plus. History shows that for every 15,556 registry applicants, one was denied so a.00642% denial rate. Ron stated it was not a problem. What caused these 9 denials over 11 years? The CDPHE does not evaluate patients or their medical records. It has the authority to evaluate the application form being filled out properly. An example would be to confirm that the licensed doctor signed based on a qualifying condition. They can only grant a registry card if a licensed doctor or a (still to be resolved in court) nurse practitioner, has marked a qualifying ailment and signed and dated the recommendation. And the patient must provided legitimate picture id and personal information. The only reason a registry applicant could be denied is for submitting fraudulent info, ID, or doctors signature. Medical marijuana deadline update: Second wave of seizure letters coming soon by Michael Roberts, Mon., Feb at 10:42 AM Today is when 23 dispensaries receiving letters from U.S. Attorney John Walsh have been told to stop doing business at their current location or risk having their assets seized. At this writing, it appears that none of the targeted centers will fight this edict. Those that haven t been able to find a new home presumably more acceptable to the feds plan to close. Update, 10:42 a.m. February 27: Just heard back from U.S. Attorneys Office spokesman Jeff Dorschner, who tells us that all stores that received letters should already be closed. He can t comment on whether each of them has complied, but allows that to the best of my knowledge, no enforcement action has as of yet taken place. Dorschner can t discuss possible future enforcement actions, but he says if it turns out that all of the targeted marijuana stores did close based on the letter, there will be a point that I can share that information publicly, once we re comfortable with that information. In a past interview, Dorschner characterized the 23 letters sent to dispensaries by his office as the first wave, and he confirms that there will be a second wave. Parker12 i am BILL SMITH My name is Chaz Moore. I am a typical 17 year old kid who has lived somewhat of a normal life. I have 2 loving parents and a little sister. When I was in my freshman year of high school living the dream, things change. I had a wonderful loving girlfriend. No i wasn t the greatest student I probably had a D average but at least I was passing. I was into sports and band and loved life. Then something changed I started have seizure like spasms from my throat the whole way through chest and my abs. I was no longer a normal kid! No one had answers. All the doctors knew what to do is to shoot me up with Valium, Morphine, Ativan, and any other medicine they could think of to use to make it stop. I can say I don t remember a lot of being 15.. They finally figured out at one world renounced hospital that I had something called Myoclonus Diaphragmatic Flutter. I went through close to a hundred medications that only made me feel horrible. No longer was I loving life. No longer was I a normal high school student. With the love and support of my family and the suggestion from my wonderful neurologist we decided to try medical marijuana. I am now back to loving life, living as close to a normal life as possible and not in the hospital almost everyday. Since starting Mmj I have not been to the emergency room once for my attacks. I now go to normal doctor visits only. I am now a C to B average student who does online school because they won t except my medicine in public school My name is Shan Moore. Chaz is my son who has a rare disorder called Myoclonus Diaphragmatic Flutter was a hard year when this started. Watching your child go through something you can t fix is a gut wrenching feeling. You want to put yourself in their place and let them continue to live their life. With the support of my wife Janice, daughter Bree and the rest of our family we fought for answers to fix him. His neurologist suggested medical marijuana. Watching them shoot him up full of highly addictive drugs was terrifying. The thought of an overdose and the prescription drugs were slowly killing him was terrifying. At the time the thought of Mmj was also scary. After months of research we decided to try it. What a difference it has made in our lives. This is his rescue medication. At this point it is his only medication. We no longer fear him becoming addicted to the pharmaceutical medicine. After all of our research we are not in fear of him being addicted to marijuana either. After 10 months of not knowing anything for sure except his quality of life was not acceptable for a 15 year old who was extremely active in sp orts,band,skateboarding,hanging out with friends and living life to the fullest. Medical marijuana has given him most of his normal lifestyle back. His wish is to be back in public high school getting his education and social Life back. Now we work hard to educate others and support other patients to keep their safe access to their medication. without these dispensaries we are in deep trouble. 8 MMJ Seniors Patricia Troy, 65, of Santa Rosa, CA (2 of 8) When I was much younger I had a terrible migraine headache and on a lark someone gave me some marijuana. It went away and I was laughing and having fun. As it wore off the headache came back. Now, I have fibromyalgia. I have a drawer full of pain pills the doctors gave me. They turned me into a zombie. Medical marijuana is so much better. There are so many different kinds of marijuana; you find the kind that suits you. My family says, There goes Pat doing her thing again. With my daughter early on I told her there are certain drugs that were OK and certain ones to stay away from. I recognized it as a kind of a rite of passage for a young person. I think marijuana is perfectly safe. Medical Marijuana And Seniors The biggest users of our medical system are senior citizens, and it should therefore come as no surprise that when medical marijuana first became available in California, seniors were some of the first to try it out. Seniors are finding that medical marijuana works on a large variety of illnesses that modern medicine has yet to effectively treat. They claim it s effective for everything from asthma to the recurrence of polio. However, being legal and effective doesn t make it any less controversial. Seeing a grandparent smoking marijuana can be a shock. Chris Hermes of Americans for Safe Access says that 50 percent of medical marijuana users are over the age of 50 and fifteen states currently have medical marijuana laws. Marcy Dolan, 71, of Rohnert Park, CA I was diagnosed with multiple sclerosis at age 36. The MS drugs they have are for younger people. Over 50 years old, they don t work the way they should. The biggest issue is the nasty muscle spasms in the arms and legs. I have spasms internally as well. For the MS I had to take this drug Neurontin, which made me feel like I was underwater. I had to take larger and larger doses to do the simplest things. I couldn t live that way anymore, so I stopped. I was using marijuana at the time and I noticed when I didn t smoke the pain returned. I don t sit in a hole and float away listening to music. It s for my health and life. I m so glad to be able to use it. It has enabled me to live a normal life. I m not a person who sits at home. I m out there living a life. Then they carpooled to Temple Shaarei Shalom in Boynton Beach this recent Sunday afternoon trios of little old ladies with short white hair and thin 8 Mile Hi MMJ Patient

9 sweaters, and wizened men reading the Sun-Sentinel while wearing clunky black shades indoors. Now the 200-plus attendees most of them seniors are snacking on mushroom quiche and iced tea while discussing the myriad health benefits of getting high. I ve had a cookie, confesses Natalie, a gregarious, bird-boned 84-year-old woman with a Bronx accent. She means a marijuana cookie. It took away my nausea and my back pain. I grew a plant once. I had to throw it out because the gardener was looking at it. Billy Johnson, a 75-year-old fellow in a slick fedora and therapeutic sneakers, would like to take a Jack LaLanne approach to marijuana. I m wondering if I can find a few leaves and squeeze some juice out of them, he ruminates, to help my joints. The man who organized this gathering is a strange sort of rabbi. Stubby and charismatic with a crown of white hair, Robert Platshorn is stopped by a cane-toting elderly guy. You re a hero, says the 84-year-old, who s wearing a ball cap commemorating his Vietnam service. I was in [the military for] three wars, but you re the hero. Platshorn, age 69, is choked up by the praise. He s a convicted pot smuggler who spent three decades in federal prison as the leader of the Black Tuna Gang, as detailed in the recent documentary Square Grouper and before that in the pages of this publication. But these days, he s among Florida s most prominent activists in the growing push to legalize medical marijuana. Joint resolutions have been filed in the state House and Senate to put the issue up for a public vote. And in the most elderly state in the nation, seniors are front-and-center in the debate over legalized pot. The senator who sponsored the bill is Miami s Larcenia Bullard, a 64-year-old Democrat with heart problems. The purported benefits of medical marijuana including alleviating pain, quelling nausea, promoting sleep, easing the side effects of chemotherapy, and reducing inflammation seem tailormade to older folks. And it s a weed that can be grown in a garden. The main reason Platshorn is traveling the state on his Silver Tour, teaching seniors at synagogues and nursing homes about medical benefits and legislation concerning marijuana: Old people vote, Platshorn says matter-of-factly, as a lady wearing two pairs of glasses on her forehead tugs his blazer sleeve, trying to book him at her social club. Nothing scares a politician like an elderly constituent. Platshorn never expected to become an activist. He spent the 70s smuggling about 500 tons of Colombian skunk into Miami harbors. The Black Tuna Gang as his stoner crew was dubbed on DEA radio chatter used cigarette boats with modified hulls and wore gold medallions etched with impressions of fish. Platshorn is a former Atlantic City pitchman who claims that with Jimmy Carter as president, he was simply planting his flag in an emerging industry. I thought legalization was around the corner. But then came Ronald Reagan s War on Drugs. The Black Tuna Gang was the Gipper s first significant casualty. An informant was the key to a massive federal sting. During a 1979 trial, prosecutors claimed Platshorn plotted the assassination of a judge and bribed jurors. He was cleared of those accusations, which he calls completely false. He was sentenced to 64 years in prison and served 29 in Illinois s Marion supermax. That s the most time ever done in the States for a marijuana offense. Less than four years ago, Platshorn was stranded in a halfway house in West Palm Beach, unable to hold a 9-to-5 job. His first wife and 12-year-old daughter had died of lupus and an asthmatic condition, respectively, while he was in the can. When he married his second wife, Lynne, he told her not to take his last name. I didn t want the world to see her as an ex-con s wife, he explains. I would have never thought then that I d be called a hero. Platshorn says the issue of medical marijuana found him. After he self-published his memoir, The Black Tuna Diaries, folks would come up to him at Golden Lakes Village, the senior community in West Palm Beach where he lives. My wife has MS, Platshorn says one elderly man told him. The only good day she has is when we can find her something to smoke. Can you help me? A return to prison loomed if he named a dealer, so Platshorn denied the ganja-seeking gray-hairs. But he became active in his local chapter of the National Organization for the Reform of Marijuana Laws (NORML), where he is now a director. And about a year ago, he spoke at Miami Beach City Hall and collected signatures as part of the effort to decriminalize marijuana. Finally, Bobby Tuna and friends succeeded in getting an initiative on the ballot, though no date has been set for the vote. March 2012 Mile Hi MMJ Patient 9

Indictments allege Kemp was shot and killed by Lawyer after he and Firko repeatedly pounded and kicked at the front door of Kemp s Redlands home. The grand jury alleged the troopers attempted unlawful entry toward apprehending Kemp, the suspected driver in a non-injury, drunken-driving investigation. The legislature is re-introducing the MMJ/ DUI bill. They will take your blood by force - or kill you. David Fatal search illegal, judge rules By Paul Shockley Wednesday, February 8, 2012 The entry into the home of Jason Kemp in 2010 by Colorado State Patrol troopers was a violation of Kemp s Fourth Amendment right against illegal search and seizure, a Denver federal judge said in a ruling Wednesday. Even if the warrantless forced entry into Jason s residence to obtain blood-alcohol evidence could be deemed as justified, the alleged force used by Defendant (Ivan) Lawyer and (Kirk) Firko far exceeded their interest in obtaining this evidence in a relatively minor situation, U.S. District Judge Lewis Babcock wrote in the ruling. Likewise, the judge wrote, Defendant Lawyer s actions when using deadly force were clearly not objectively reasonable in light of the facts and circumstances alleged. Babcock s observations were part of a ruling Wednesday in which the judge denied a bid by State Patrol Sgt. Chad Dunlap to be dismissed from a civil lawsuit filed against Dunlap, Lawyer and Firko, in connection with Kemp s death in his Redlands home in July The lawsuit was filed in May 2011 by the American Civil Liberties Union on behalf of Kemp s parents, Connie and Keith Kemp of Georgia. Dunlap was the supervisor in charge of the scene during Kemp s encounter with Lawyer and Firko at 103 Glade Park Road, Unit B, on July 20, Dunlap was not charged by a Mesa County grand jury, while Lawyer and Firko are scheduled for separate trials in April. Dunlap argued through attorneys he was entitled to qualified immunity on the lawsuit s wrongful death claim, citing the Colorado Government Immunity Act. Babcock s ruling Wednesday rejected the claim. Lawyer was charged by the grand jury with criminally negligent homicide, second-degree assault, first-degree criminal trespass, illegal discharge of a firearm, prohibited use of a weapon and criminal mischief. Firko is charged with two counts of first-degree criminal trespass, attempted first-degree criminal trespass and criminal mischief. Indictments allege Kemp was shot and killed by Lawyer after he and Firko repeatedly pounded and kicked at the front door of Kemp s Redlands home. The Case for Treating PTSD in Veterans With Medical Marijuana The Atlantic, Martin Mulcahey, Jan 17, 2012 Studies have already shown the benefits of marijuana for those suffering from PTSD, but can our government agencies be convinced? Researchers are one bureaucratic hurdle away from gaining approval for the first clinical examination on the benefits of marijuana for veterans suffering from post-traumatic stress disorder (PTSD). The Multidisciplinary Association for Psychedelic Studies (MAPS), working under the auspices of the University of Arizona College of Medicine, are preparing a three-month study of combat veterans who served in Iraq and Afghanistan. The plan is on hold until the National Institute on Drug Abuse and Public Health Service (part of the Department of Health and Human Services) agrees to sell researchers the marijuana needed for research -- or until the marijuana can be legally imported. Social and political intrigue surrounding this research is far reaching, attracting opposing factions who must cede biases for the greater good and well-being of servicemen and servicewomen. The University-controlled study Sisley advocates calls for a triple-blind and placebo-controlled environment. A meticulously prepared proposal recommends a sample base of 50 veterans, whose PTSD symptoms have not improved under current standard medical practices. All participants must agree to abstain from marijuana use for 30 days prior to participation. 12 Focus on Issues: Monsatan Monsanto is poisoning us. But, first, let s just review the news from mid-february that there is arsenic in much of our food. Arsenic is poison, but the govt claims there are safe levels in our environment and in our food. Our govt supports profits over people. Arsenic was used extensively on cotton in the past. The argument was, partly, that we did not eat cotton. Millions of square miles of farmland that used to be for cotton are now used for other crops like rice. The soil and the crops are full of poison. Rice syrup has become a common replacement for the notorious high-fructose corn syrup that makes us all ill and obese. There are no tests that say what a safe level of arsenic is when combined with the dozens of other safe chemicals found in our blood and bodies that corporations produce for profit. We really need to stop poisoning the Earth, and ourselves. The air, water and soil are full of safe chemicals most of which did not exist before WWII. You probably have 100 or more post WWII chemicals in your blood/ tissues right now. Maybe we should stop using energy that poisons us like the asthma and other respiratory diseases in children from fossil fuels mostly car emissions. We breathe in and drink poisons every day. Sunlight is delivered to pretty much every rooftop and does NOT create poison!!! Imagine. 60 minutes or 20/20 had a staff member get their blood tested. 120 foreign chemicals were found in the employee s blood. Only one lead even existed before WWII. Is there really any doubt that this poison cocktail from the air, water and food we all consume as safe may have something to do with the increase in diseases like cancer and ADHD? Monsanto has created several patented crops (also tried to patent a pig!) through Frankenscience, and foods containing Genetically-Modified ingredients (Organisms - GMO), such as modified maize or soya. These are known as Frankenfood. Monsanto intends to control the world s food sup- ply. Monsanto motto (internal, not public) is No seed shall be sown that we don t own. Scary. Frankenfood is becoming far too common and the US consumer was not given an option. We were not asked do we want GM ingredients in our food but we got them anyway. Big companies like Heinz, for example started using genetically-modified ingredients years ago without telling us. In Europe, for example, consumer labeling is required, but not in the business friendly USA. In fact, our State department is lobbying for Monsanto demanding that France stop labeling GMO food. More than 75% of French people refuse to buy Frankenfood. It has become a staple in the US over the last 10 to 15 years. If you are over 50, maybe you ll die before you see the effects but, if you are younger, you will see ill effects as you age. 10s of thousands of farmers have committed suicide because of Monsanto. The mass suicide among the Indian farmers is known as the GM genocide. Here in the US, Monsanto takes family farms when their aggressive Roundup Ready crops cross pollinate into an unsuspecting farmer s property maybe miles away. Why Monsanto is a threat to life on Earth Banned in 27 Countries, Monsanto s rbgh Inhabits Many U.S. Dairy Products Are you consuming Monsanto s genetically engineered growth hormone known as rbgh? The synthetic hormone is created using molecules and DNA sequences that are a result of molecular cloning, which has been linked to breast and gastrointestinal cancer. Unfortunately, it is estimated that around 1/3 of cows in the United States are injected with this synthetic hormone, which means that you have most likely been highly exposed to rbgh if you live in the U.S. or have eaten U.S. dairy products.
