Internal Medicine Issues to be discussed will include various hot button topics such as hypertension, sleep apnea, gastrointestinal and urinary complaints and deep venous thrombosis. The panel will discuss the medicine behind these claims, causation issues, as well as permanent disability and apportionment. 4 compensation can spiral out of control faster than a termination. Suddenly the attorney is flung into the land of 132a and temporary disability litigation amongst other issues. A workers compensation attorney needs to understand how to litigate a good-faith termination claim. The attorney must know how good-faith terminations interplay with workers compensation benefits. Applicant s attorney, Eric Ledger, will explain step by step how to prosecute and defend against a claim of good faith termination for cause. Using recent case examples, he will cover how terminations interplay with workers compensation benefits with a special focus on temporary partial disability issues following a good faith termination. Networking Break 3:00-3:30 PM Identifying and Protecting Your Clients Third Party Case 3:30-5:00 PM, 1.5 hours of MCLE credit Seession PowerPoint - UPDATED Plaintiffs attorneys, D. Bryan Garcia and Patrick McNicholas will discuss how a thorough investigation of a work accident can sometimes lead to the identity of a potentially liable third party. For example, when an employee is injured on a construction site, on another s premises, in a fight, in an automobile accident, or as a result of a defective product or piece of machinery, someone other than the employer may be legally responsible for the employee s injuries. If a third party case exists, an employer can benefit from seeking the assistance of a Plaintiffs attorney as such a scenario will allow the employer to potentially recoup some of the monies it paid to the claimant, with no additional risk being born by the employer. The employees themselves will also benefit as they will be able seek compensation which is not available in the workers compensation arena. The speakers will discuss how early discussions with Plaintiffs attorneys are imperative for preserving evidence for a civil case, and how collaboration between the employer and Plaintiffs attorney can result in a beneficial result for all involved. SB 863 made some significant changes to rating permanent impairment in California. Learn the effects of SB 863 on ratings and what to look for when reviewing medical reports. Focus is on sleep dysfunction, sexual dysfunction and psychiatric impairment.
