Purpse f Plicy The purpse f the Child Prtectin and Safeguarding Plicy is t prvide a secure framewrk fr the wrkfrce in safeguarding and prmting the welfare f thse pupils wh attend ur schl. The plicy aims t ensure that: All ur pupils are safe and prtected frm harm; Other elements f prvisin and plicies are in place t enable pupils t feel safe and adpt safe practices; and Staff, pupils, gvernrs, visitrs, vlunteers and parents are aware f the expected behaviurs and the schl s legal respnsibilities in relatin t safeguarding and prmting the welfare f all ur pupils. Plicy Statement This plicy develps prcedures and gd practice within ur Schl, t ensure that each persn and agency can demnstrate that there is an understanding f the duty t safeguard and prmte the welfare f children and yung peple including thse wh are vulnerable. It prvides evidence f hw this will be implemented within ur Schl and within multi-agency wrking arrangements. 3
4 Intrductin This plicy has been develped in accrdance with the principles established by the Children Act 1989, the Educatin Act 2002 and the Children Act 2004 and in line with gvernment publicatins and lcal guidance. The Gverning Bdy takes seriusly its respnsibility under sectin 175 f the Educatin Act 2002 t safeguard 1 and prmte the welfare f children; and t wrk tgether with ther agencies t ensure adequate arrangements within ur schl t identify, assess, and supprt thse children wh are suffering harm. Where a child is suffering significant harm, r is likely t d s, actin will be taken t prtect that child. Actin will als be taken t prmte the welfare f a child in need f additinal supprt, even if they are nt suffering harm r are (sic) at immediate risk. 2 Eths Imprving utcmes fr all children and yung peple underpins all f the develpment and wrk within this schl. Safeguarding is everyne s respnsibility and as such ur schl aims t create the safest envirnment within which every student has the pprtunity t achieve. Our schl recgnises the cntributin it can make in ensuring that all registered students r thers wh use ur schl feel that they will be listened t and apprpriate actin taken. We will d this by wrking in partnership with ther agencies and seeking t establish effective wrking relatinships with parents, carers and ther clleagues t develp and prvide activities and pprtunities thrughut ur curriculum that will help t equip ur children with the skills they need. This will include materials and learning experiences that will encurage ur children t develp essential life skills and prtective behaviurs. Gverning Bdy Respnsibilities Our gverning bdy has a legal respnsibility t make sure that the schl has an effective safeguarding plicy and prcedures in place and mnitrs that the schl cmplies with them. The Gverning bdy has appinted a Designated Safeguarding Lead (DSL) wh has lead respnsibility fr dealing with all safeguarding issues in ur schl. The schl will ensure that there will always be cver fr the rle f DSL 3. Our Gverning Bdy recgnises that fr this plicy t be effective, it is essential that staff have an understanding f what safeguarding is, knw that safeguarding is everybdy s respnsibility, knw hw t access safeguarding infrmatin, knw f any pssible cntributin that they may be required t make t safeguard children, yung peple and vulnerable adults and hw t access further advice, supprt r services. 1 Safeguarding (as defined in the Jint Inspectr s Safeguarding reprt) is taken t mean All agencies wrking with children, yung peple and their families take all reasnable measures t ensure that the risk f harm t children s welfare are minimised and where there are cncerns abut children and yung peple s welfare, all agencies take all apprpriate actins t address thse cncerns, wrking t agreed lcal plicies and prcedures in full partnership with ther agencies. 2 DfE Keeping Children Safe in Educatin DfE Keeping Children Safe in Educatin March
5 Designated Safeguarding Lead s (DSL) Respnsibilities We will fllw the prcedures set ut in the Suth West Child Prtectin Prcedures ( and take accunt f bth natinal guidance issued by the Department fr Educatin 4 and lcal guidance. Our Designated Safeguarding Lead (DSL) is an apprpriate senir member f staff wh has the status and authrity within the schl t carry ut the duties f the pst including cmmitting resurces and, where apprpriate, supprting and directing ther staff 5. All child prtectin cncerns WILL be reprted t the apprpriate authrity and ur Designated Safeguarding Lead (DSL) is respnsible fr: Managing referrals Refer all cases f suspected abuse t the lcal authrity children s scial care 6 and: The designated fficer(s) fr child prtectin cncerns (all cases which cncern a staff member) Disclsure and Barring Service (cases where a persn is dismissed r left due t risk/harm t a child); and/r Plice (cases where a crime may have been cmmitted) Liaise with the Headteacher r Principal t infrm him r her f issues, especially nging enquiries under sectin 47 f the Children Act 1989 and plice investigatins Act as a surce f supprt, advice and expertise t staff n matters f safety and safeguarding and when deciding whether t make a referral by liaising with relevant agencies Training The DSL, and cver fficers, will receive apprpriate training carried ut every tw years in rder t: Understand the assessment prcess fr prviding early help and interventin, fr example thrugh lcally agreed cmmn and shared assessment prcesses such as early help assessments Have a wrking knwledge f hw lcal authrities cnduct a child prtectin case cnference and a child prtectin review cnference and be able t attend and cntribute t these effectively when required t d s Ensure each member f staff has access t and understands the schl s r cllege s child prtectin plicy and prcedures, especially new and part time staff Be alert t the specific needs f children in need, thse with special educatinal needs and yung carers 7 Be able t keep detailed, accurate, secure written recrds f cncerns and referrals 4 DfE Keeping Children Safe in Educatin March DfE Keeping Children Safe in Educatin March 2015, Annex B 6 It is recgnised that whilst the Designated Lead is respnsible fr liaisn with agencies, DfE Keeping Children Safe in Educatin March 2015 states that if at any pint, there is a risk f immediate serius harm t a child a referral shuld be made t children s scial care immediately. Anybdy can make a referral 7 Sectin 17(10) Children Act 1989: thse unlikely t achieve a reasnable standard f health and develpment withut lcal authrity services, thse whse health and develpment is likely t be significantly impaired withut the prvisin f such services, r disabled children 5
6 Raising Awareness Obtain access t resurces and attend any relevant r refresher training curses Encurage a culture f listening t children and taking accunt f their wishes and feelings, amng all staff, in any measures the schl r cllege may put in place t prtect them The designated safeguarding lead will ensure the schl r cllege s plicies are knwn and used apprpriately: Ensure the schl r cllege s child prtectin plicy is reviewed annually and the prcedures and implementatin are updated and reviewed regularly, and wrk with gverning bdies r prprietrs regarding this Ensure the child prtectin plicy is available publicly and parents are aware f the fact that referrals abut suspected abuse r neglect may be made and the rle f the schl r cllege in this Link with the Lcal Safeguarding Children Bard (LSCB) t make sure staff are aware f training pprtunities and the latest lcal plicies n safeguarding Where children leave the schl r cllege, ensure their child prtectin file is transferred t the new schl r cllege as sn as pssible. This shuld be transferred separately frm the main pupil file, ensuring secure transit and cnfirmatin f receipt shuld be btained. Other Respnsibilities Referrals t the Multi Agency Referral Unit 8 cntacting, by telephne, the Multi Agency Referral Unit (MARU) as a matter f urgency, in rder t discuss the child prtectin cncerns f pssible abuse r neglect that the designated persn has in cnnectin with the child, being prepared t prvide the child s details and fllw advice and guidance prvided by the persn handling the call and as in the guidance referred t abve; prviding a written recrd f any frmal referral by fax/pst/ t the MARU using the multi-agency referral frm within 1 day; ensuring that, where a frmal referral has nt been agreed ther surces f supprt fr the child will be cnsidered. 7 ensuring that written recrds f cncerns abut a child are kept even if there is n need t make an immediate referral; ensuring that all such recrds are kept cnfidentially and securely and are separate frm pupil recrds, with a frnt sheet listing dates and brief entries t prvide a chrnlgy ensuring that Crnwall Cuncil s Directrate fr Educatin, Health and Scial Care is ntified immediately when any pupil subject f a Child Prtectin Plan is absent withut explanatin; cmpleting, with the Headteacher/Principal, an annual safeguarding audit t the Gverning Bdy which details any changes t the plicy and prcedures; training undertaken by the DSL and by all staff and gvernrs; relevant curricular issues, number and type f incidents/cases, and the number f children referred t Crnwall Cuncil s Directrate fr Educatin, Health and Scial Care and subject f a Child Prtectin Plan (annymised). If this self-assessment highlights any areas fr imprvement, this will be detailed in an actin plan which will be signed ff and mnitred by the Named Gvernr fr Safeguarding/Gverning Bdy/Prprietr t ensure these imprvements are implemented. cmpleting, with the Headteacher/Principal, a return t the Lcal Authrity, and the CISSCB wh have an auditing rle, in ensuring the schl is meeting its safeguarding requirements under Sectin175/157 f the Educatin Act 2002 supprting the Headteacher/Principal in implementing all recmmendatins applicable t schls and educatin services arising frm Serius Case Reviews prviding advice and guidance t clleagues, attending inter-agency meetings (r supprting ther staff t d s) and cntributing t assessments. Whle schl and staff respnsibilities Our schl recgnises that Safeguarding is nt just abut prtecting children frm deliberate harm. It relates t aspects f schl life including: pupils health and safety; the use f reasnable frce; meeting the needs f pupils with medical cnditins; prviding first aid; educatinal visits; intimate care; internet r e-safety; apprpriate arrangements t ensure schl security, taking int accunt the lcal cntext. Additinally, we recgnise that Safeguarding can invlve a range f ptential issues such as: bullying, including cyberbullying (by text message, n scial netwrking sites, and s n), peer n peer and prejudice-based bullying; racist and hmphbic r transphbic abuse; extremist behaviur; child sexual explitatin; sexting; substance misuse; issues which may be specific t a lcal area r ppulatin, fr example gang activity and yuth vilence and 7
8 ther particular issues affecting children including dmestic vilence, sexual explitatin, female genital mutilatin, radicalisatin and frced marriage. 9 All ur staff maintain an attitude f it can happen here and are aware f the signs and indicatrs f abuse. All members f staff have a respnsibility t prvide a safe envirnment in which children can learn. Our staff inductin prcess includes infrmatin n ur arrangements and systems fr child prtectin, the staff behaviur plicy, cde f cnduct and details f the Designated Safeguarding Lead (DSL). All members f staff are prvided with pprtunities t receive apprpriate training which is regularly updated, in rder t develp their understanding f the signs and indicatrs f abuse and f the schl s child prtectin prcedures. In cnjunctin with this plicy, all members f staff are prvided with, and are required t read, Department fr Educatin statutry guidance as utlined in Part 1 f Keeping Children Safe in Educatin All members f staff, vlunteers and gvernrs knw hw t respnd t a student wh disclses abuse, and the prcedure t be fllwed in apprpriately sharing a cncern f pssible abuse r a disclsure f abuse. All parents/carers are made aware f the schl s respnsibilities in regard t child prtectin prcedures thrugh publicatin f the schl s Child Prtectin and Safeguarding Plicy. When services are delivered by a third party r agency, educatin r therwise, n the schl site, we will btain written ntificatin frm any agency, r third-party rganisatin we use that the rganisatin has carried ut required checks n an individual wh will be wrking at the schl r cllege. This will include, as necessary, a barred list check, prir t the rganisatin having appinted that individual. We will check that the persn presenting themselves fr wrk is the same persn n whm the checks have been made 10. Our lettings and visitrs plicies will seek t ensure the suitability f adults wrking with and in the presence f children at any time. Cmmunity users rganising activities fr children are aware f and understand the need fr cmpliance with the schl s child prtectin guidelines and prcedures. Our schl perates safer recruitment prcedures including making sure that: statutry duties t undertake required checks n staff wh wrk with children are cmplied with in line with the Disclsure and Barring Service requirements in relatin t Regulated Activity; teachers 9 Ofsted Briefing fr Sectin 5 Inspectrs n Safeguarding Children, Ofsted March DfE Keeping Children Safe in Educatin
9 Prhibitin Orders and the Child Care Act 2006 and Childcare (Disqualificatin) Regulatins 2009 statutry guidance relating t vlunteers is fllwed recruitment panel members are prperly trained 11. We hld a Single Central Recrd (SCR) which demnstrates we have carried ut the range f checks required by law n ur staff 12, 13, 14, 15 Our schl cmplies with the requirements f Keeping Children Safe in Educatin Our schl cmplies with the requirements f the Childcare Act 2006 and the Childcare (Disqualificatin) Regulatins Shuld we dismiss r remve a member f staff r a vlunteer because they have harmed a child, r pses a risk f harm t a child r wuld have dne s if they had nt left, we will reprt this t the Disclsure and Barring Service (DBS). Our safeguarding plicies and prcedures will be reviewed and updated annually. If a child makes an allegatin r disclsure f abuse against an adult r ther child r yung persn, staff will: stay calm and listen carefully; reassure the child that s/he has dne the right thing in telling yu; nt investigate r ask leading questins; let the child knw that s/he will need t tell the DSL; nt prmise t keep what they have been tld a secret; infrm the DSL as sn as pssible; and make a written recrd f the allegatin, disclsure r incident which will be signed, and dated using the schl s safeguarding recrd prcedure Cnfidentiality and Infrmatin Sharing Infrmatin sharing is vital t safeguarding and prmting the welfare f children and yung peple. A key factr identified in many serius case reviews (SCRs) has been a failure by practitiners t recrd infrmatin, t share it t understand its significance and then take apprpriate actin 16. we recgnise that all matters relating t child prtectin are cnfidential; 11 DfE Keeping Children Safe in Educatin As required by: Schl Staffing (England) Regulatins (2009); Educatin (Independent Schl Standards) (England) Regulatins 2010; DfE Keeping Children Safe in Educatin 2015; 13 DfE Keeping Children Safe in Educatin 2015 schls must use the Emplyer Access Online service t check that a candidate t be emplyed as a teacher is nt subject f a prhibitin rder. 14 Teacher Prhibitin Order requirements Keeping Children Safe in Educatin Childcare Act 2006 and Childcare (Disqualificatin) Regulatins HM Gv- Infrmatin Sharing Advice fr Practitiners, March
10 the Headteacher/Principal r DSL will disclse persnal infrmatin abut a pupil t ther members f staff n a need t knw basis nly; all staff are aware that they have a prfessinal respnsibility t share infrmatin with ther agencies in rder t safeguard children; all staff are aware that they cannt prmise a child t keep secrets which might cmprmise the child s safety r well-being, r that f anther; and we will always undertake t share ur intentin t refer a child t Crnwall Cuncil s Directrate fr Educatin, Health and Scial Care with their parents/carers, unless t d s culd put the child at greater risk f harm, r impede a criminal investigatin. If in dubt, we will cnsult with the Multi-Agency Referral Unit (MARU). Managing Allegatins against staff We are aware f the pssibility f allegatins being made against members f staff r vlunteers that are wrking with r may cme int cntact with children and yung peple whilst in ur schl. Such allegatins are usually that sme kind f abuse has taken place. They can be made by children and yung peple r ther cncerned adults. 1. If an allegatin is made, the member f staff receiving the allegatin will immediately infrm the Headteacher/Principal r the mst senir teacher if the Headteacher/Principal is nt present; 2. The Headteacher/Principal r senir teacher n all such ccasins will fllw the prcedures in the Suth West Child Prtectin Prcedures, ( and will infrm the Lcal Authrity Designated Officer (LADO) ; 3. If the allegatin made cncerns the Headteacher/Principal, the persn receiving the allegatin will immediately infrm the mst senir teacher available wh will infrm the Chair f Gvernrs wh will cnsult the LADO as abve, withut ntifying the Headteacher/Principal first; 4. Whsever cntacts the LADO (at 2 r 3 abve) will discuss the nature f the allegatins in rder fr apprpriate actin t be taken. This may cnstitute an initial evaluatin meeting r strategy discussin depending n the allegatin being made. Headteachers/Principals will als: Cnsider the safeguarding arrangements f the child r yung persn t ensure they are nt in cntact with the alleged abuser; cntact the parents r carers f the child/yung persn if advised t d s by the LADO; cnsider the rights f the staff member fr a fair and equal prcess f investigatin; ensure that the apprpriate disciplinary prcedure is fllwed, including whether suspending a member f staff frm wrk until the utcme f any investigatin is deemed necessary; act n any decisin made in any strategy meeting; and advise the Disclsure and Barring Service (DBS) where a member f staff has been disciplined r dismissed as a result f the allegatins funded, r wuld have been if they have resigned. 10
11 Whistleblwing We recgnise that children cannt be expected t raise cncerns in an envirnment where staff fail t d s. We advise ur staff f ur Whistleblwing Plicy and f hw it can be implemented. Staff are aware f their duty t raise cncerns abut the attitude and actins f clleagues where these are inapprpriate r unsuitable. If necessary the member f staff, will speak t the delegated Whistleblwing Gvernr wh is KAREN SINGLETON. Supprting Staff Our staff will be advised n the bundaries f apprpriate behaviur such matters frm part f ur staff inductin and staff have access t supprt and guidance when required r requested We recgnise that staff wrking in the schl, wh have becme invlved in the case f a child wh has suffered harm, r appears likely t suffer harm, may find the situatin stressful and upsetting. We supprt such staff by prviding an pprtunity t discuss their anxieties with the DSL, r anther teacher and/r a trade unin representative as apprpriate. Our designated fficers have access t supprt and apprpriate wrkshps, curses r meetings as rganised r recmmended by the Crnwall and Isles f Scilly Safeguarding Children Bard (CISSCB), Safeguarding Standards Unit (SSU) r Lcal Authrity (LA). Physical Restraint Our plicy n physical restraint is cmpliant with the LA s Physical Restraint in Schls Guidance( alng with guidance frm the Department fr Educatin (DfE). We have a prcedure in place fr recrding each significant incident in which a member f staff uses frce n a pupil, and fr the reprting f these incidents t the pupil s parents as sn as practicable after the incident. A member f staff wh has used apprpriate physical restraint will have a reasnable defence t any legal actin against them, if: The purpse f the physical interventin was t avert an immediate danger f injury t any persn; r an immediate danger t the prperty f any persn ( persn includes the pupil); r t prevent the cmmitting f a criminal ffence; r where a yung persn s cnduct leads t behaviur that prejudices gd rder and discipline; and n mre frce was used than was reasnably necessary in the circumstances Wherever pssible such events are recrded and signed by a witness. Staff that are likely t need t use physical interventin are apprpriately trained. We understand that physical interventin f a nature that causes injury r distress t a child may be cnsidered under child prtectin r disciplinary prcedures. 11
12 Preventin We recgnise that the schl plays a significant part in the preventin f harm t ur pupils by prviding them with effective lines f cmmunicatin with trusted adults, supprtive friends and an eths f prtectin. Our schl will supprt all pupils by: Establishing and maintaining an eths, understd by all staff, which enables children t feel secure and encurages them t talk, knwing that they will be listened t. Prmting a caring, safe and psitive envirnment within the schl and ensuring that all children knw that there is an adult in the schl whm they can apprach if they are wrried r in difficulty. Prviding acrss the curriculum, including within PSHE, pprtunities which equip children with the skills they need t stay safe frm harm and t knw t whm they shuld turn fr help. Encuraging the develpment f self-esteem and resilience in every aspect f schl life including thrugh the curriculum. Liaising and wrking tgether with all ther supprt services and thse agencies invlved in the safeguarding f children. Ensuring that a named teacher is designated fr Children in Care, (CIC) and that a list f CIC is regularly reviewed and updated. The Educatin Welfare Officer (EWO) fr the schl is made aware f all CIC in the schl. Prviding cntinuing supprt t a pupil wh leaves the schl and abut whm there have been child prtectin cncerns, by ensuring that such cncerns and schl recrds are frwarded under cnfidential cver t the Headteacher/Principal at the pupil s new schl as a matter f urgency. Recgnising that children cme frm a variety f different cultural backgrunds, the schl has develped plicies t ensure that we embrace diversity in religin and faith, race, ethnicity, gender and sexual rientatin. We will include ur Child Prtectin and Safeguarding Plicy in ur schl prspectus/website and will pst cpies f ur plicy thrughut the schl. We are als able t arrange fr ur plicy t be made available t parents whse first language is nt English, n request. Training All members f staff and vlunteers will have access t apprpriate whle schl safeguarding training which is regularly updated. We will als, as part f ur inductin, issue infrmatin in relatin t ur Child Prtectin and Safeguarding Plicy and any ther plicy and infrmatin related t safeguarding and prmting ur children/yung peple s welfare t all newly appinted staff and vlunteers. Our DSL and DSL Cver fficers will undertake further safeguarding training in additin t the whle schl training. This will be undertaken at least every tw years and will update their awareness and understanding f the impact f the wide agenda f safeguarding 12

It will supprt bth the DSL and DSL Cver fficers t be able t better undertake their rle and supprt the schl in ensuring ur safeguarding arrangements are rbust and achieving better utcmes fr the pupils in ur schl. This includes taking part in multi-agency training. Our Gverning Bdy will have access t safeguarding training. Our named Gvernr fr Safeguarding will have access t additinal training at least every tw years t supprt the Headteacher/Principal in managing allegatins against staff and vlunteers wh wrk with children and yung peple and t supprt the annual review f this plicy, in rder t keep it updated in line with lcal and natinal guidance/legislatin. At least ne member f a recruitment panel will have undertaken safer recruitment training 17, 18. Missing Children We will mnitr unauthrised absence, particularly where children g missing n repeated ccasins. We will reprt such absences withut delay t the apprpriate agencies. Helping children t keep themselves safe Our children are taught t understand and manage risk thrugh ur persnal, scial, health and ecnmic (PSHE) lessns and thrugh all aspects f schl life. Children are taught hw t cnduct themselves and hw t behave in a respnsible manner. Children are reminded regularly abut e-safety and tackling bullying prcedures. Our schl cntinually prmtes an eths f respect fr thers and pupi9ls are encuraged t speak t a member f staff in cnfidence abut any wrries they may have. Plicy Review The Gverning Bdy f ur schl is respnsible fr ensuring the annual review f this plicy and fr additinal plicies 19 that are relevant t safeguarding and child prtectin.
