2 Public Procurement The organisation and management of contract award procedures to the highest standards and in accordance with best practice is an essential precondition to the proper management of every public body. In recent years there has been an exponential increase in the size and complexity of public contracts awarded by public sector and utility organisations across the various sectors. Public procurement expenditure in Ireland is around 15 billion annually and incorporates the entire range of public supplies, works and services contracts and the more complex areas such as combined contracts, public private partnerships and public works and services concessions. Compliance with European and national procurement directives and regulations by practitioners is an essential attribute of modern procurement management as is the compelling need to achieve best value for taxpayers money. Over the past few years the procedures, controls and rules that must be adhered to in relation to public procurement have grown nationally and resulting from our membership of the European Union. The burden on the procurement function has never been greater and thus the support required in the form of knowledge, education and training must reflect this new environment of responsibility. The new emphasis on procurement now means that senior management and procurement professionals recognise the contribution to be made by a professional procurement function, particularly when it adopts a strategic focus and operates from a value added perspective. This new role of procurement is gradually being acknowledged and resourced, leading to a more professional approach. It now requires qualified staff to implement and monitor strategic initiatives and ensure that procurement contributes to the corporate goals of organisations by providing quality supplies and services at the right time and at the best market price. The National Public Procurement Policy Framework, issued by the Department of Finance in 2005, highlighted the need for the public sector to move procurement policy and practice to a more strategic level. It also stressed the need for training and education to develop procurement capabilities and competencies among employees in order to sustain measurable improvements in procurement reform. The Certificate in Public Procurement and Diploma in Public Procurement In response to the growing need for high quality training in public procurement the Institute of Public Administration in association with Achilles Procurement Services, specialists in public procurement, offer two distinct courses - a Certificate in Public Procurement and a Diploma in Public Procurement. Both qualifications are awarded by University College Dublin (UCD). The Certificate consists of five two day modules. As a follow up to the Certificate, successful participants may apply to attend the Diploma course which, like the Certificate consists of five two-day modules. Participants must complete all modules on either the Certificate or Diploma to be awarded the qualification. Teaching/Learning Methodologies The teaching methodologies utilised throughout the Certificate and Diploma include tutor delivery, directed home study, assignments, work-based projects and on the Diploma a participant presentation. 3 Certificate in Public Procurement The Certificate is a comprehensive introduction to public procurement and focuses on best practice procurement in the public sector and the achievement of value for money within the context of Irish and European Union legislation. The course provides comprehensive detail on all aspects of the procurement process to professionals seeking to enhance their skill base in this important field. Objectives of the Programme The aim of the Certificate is to provide participants with the basic knowledge, skills and tools necessary to ensure an effective and efficient procurement service, which will deliver value for money, manage procurement risks and ensure compliance with all national and EU procurement regulations. Learning Outcomes Upon completion of the programme, participants will: g have a comprehensive understanding of Irish and EU procurement rules and regulations g fully understand the principles of best practice procurement g be proficient in areas such as value for money, procurement planning, tendering strategy, bonds, guarantees and conditions of contract g be able to prepare and assess tender documentation and conduct and manage a complete tender process g be competent to establish award criteria and evaluate tenders g have the ability to prepare and justify contract award recommendations g be able to assess and manage potential contractual risks g be competent in areas such as delivery and payment terms, debriefing tenderers, business ethics and e-procurement g fully understand all elements of international logistics management Programme Content Module One Foundation Principles and Rules g Principles and Regulations g Defining contract types g Procedures g Different types of Notices This module will set out, in detail the rules governing public procurement and the requirements for conducting an appropriate competitive tender process in accordance with EU and national rules. It will detail the various options available in terms of procedures and advertising requirements. It will also detail the key jurisprudence.

4 Module Two Assessment Processes g Selection Criteria g Award Criteria g Framework Agreements / Panels / Lists g Remedies Legislation This module will cover the key drivers in selecting tenderers and winners for contracts and go into detail on the pitfalls of the selection and award processes. It will also explain the use of framework agreements, qualification systems and panels as well as detailing the requirements of the Remedies legislation and the relevant jurisprudence to be taken into account. Module Three Value for Money, Planning and Procurement Strategy g Principles of Good Procurement g Value for Money g Procurement Planning g Procurement Strategy This module will address the various factors that characterise best practice procurement. It will examine how value for money can best be delivered and will provide a step-by-step guide to preparation of annual procurement plans. It will also look at the various tendering strategies that can be adopted for the many types of contracts and market conditions encountered. Module Four Tender Documentation and Tendering Process g Tender Documentation g Request for Tenders g Tender Receipt, Opening and Evaluation This module will cover the tender documentation required and the process involved in issuing a request for tender. It will also examine best practice in relation to receiving, opening and evaluating tenders, including scoring methods for evaluation. Module Five Debriefing, Risk Management, Ethics and Corporate Governance g Risk assessment and Management g Business Ethics & Corporate Governance g Debriefing g Contact Terms and Conditions This module will focus mainly on contractual risk management and associated issues such as bonds and guarantees, insurance, liquidated damages and other contractual remedies. It will also address areas such as business ethics, corporate governance and supplier debriefing.

5 Diploma in Public Procurement The Diploma in Public Procurement is a more advanced programme which caters for the needs of decision makers by equipping them with the skills to design and implement strategic initiatives ensuring they position and resource their procurement activity appropriately. Objectives of the Programme The Diploma focuses on the strategic aspects of procurement within the context of international best practice. This advanced programme provides participants with a comprehensive understanding of key aspects such as capability development, procurement planning, cost reduction initiatives, strategy development, change management and supply market structures and analysis. Learning Outcomes Upon completion of the programme, participants will have the ability to: g develop procurement strategy to meet the business needs of their organisation g implement a strategic procurement enhancement programme within their organisations using diagnostic and opportunity analysis techniques g prepare annual Corporate Procurement Plans g prepare a comprehensive set of Purchasing Procedures tailored to their organisation s requirements g analyse the supply market g understand the market forces that determine the relationship between public sector organisations and suppliers and will have the ability to assess opportunities for added value g introduce category and supplier performance management tools and systems that will ensure a high standard of service to the end user at competitive costs g establish a contract management process which will ensure business objectives are met and value for money is achieved g implement innovative procurement solutions to deliver cost reductions and to meet other business objectives g measure the performance of the procurement function g measure the performance of suppliers Programme Content Module One - Foundation g Basics of strategic procurement g Opportunity analysis g Business requirement analysis g Internal and external influences and barriers g Procurement structures g Introduction to course assignment This module will explain the application and key characteristics of strategic procurement. It will define important terms and concepts and will set the key factors involved in correctly scoping the procurement needs of an organisation, in a systematic way. It will demonstrate tools and techniques for reviewing current expenditure with a view to seeking cost reductions. It will also explain the various types of procurement structures that can be employed in best practice organisations.

6 Module Two Corporate Planning & Strategy Development g Procurement planning corporate plans g Capability development and commercial awareness g Supply positioning and Supplier Preferencing Matrices g Procurement strategies and Innovation g Porters five forces g Framework Agreements This module will set out how to develop a corporate procurement plan and will demonstrate the important tools used to identify and review current procurement profile and practices, to determine future resource needs and to link procurement to an organisation s strategic objectives. It will also address associated areas such as capability development, commercial awareness, innovation and the importance of framework agreements in the planning process. Module Three Market Research, Procurement Processes and Procedures g Market research and structure g Market analysis g Price cost relationship g Developing purchasing processes and procedures g Category Management g Role of ICT systems in procurement g eprocurement tools g Sustainable (green) procurement This module will explain how analysis of market conditions is used to determine the procurement environment and to identify opportunities and threats that impact on value for money and security of supply. It will also deal with the merits of having comprehensive procurement processes and procedures and will set out how they should be structured. It will also cover recent trends and changes in best practice procurement, such as category management, improved systems and environmental concerns, all of which are of critical importance to public sector organisations. Module Four Change Management and Negotiation Skills g Drivers for change g Planning for change g Interpersonal and communication skills g Negotiation strategies g Negotiation skills This module explains the principles of change management and the necessity to understand and make provision for how people react to and deal with change, in order to successfully introduce best practice procurement processes and procedures. It will also explain how the ability to negotiate is a key competence for procurement specialists and will cover the various stages of a negotiation process, the strategies used and the skills required. Module Five Performance Management g Procurement performance management g Contract & supplier performance management g Project management g Effective communication This final module will examine the key performance measures within a modern procurement function and will explain how to develop a monitoring and measurement system for both the procurement function and for suppliers. It will also cover the essential elements of project management, the importance of setting realistic expectations, fostering agreement among all parties and the value of effective communication when introducing changes.

7 Assessment Admission Requirements Participants are assessed by both compulsory requirements (assignments, a work-based project) and a written examination. Participants must complete all the assignments/case studies and pass the written examination to obtain an award. The Certificate and Diploma will be awarded by University College Dublin (UCD). Certificate in Public Procurement Assessment is based on a combination of three assignments, a work-based project and a three hour, closed book examination. The three assignments are a minimum of 1,000 words and the work-based project is a minimum of 4,000 words. The examination accounts for 70% of the marks and the assignments/work-based project for 30%. Participants are expected to engage in classroom discussion and workshops. Diploma in Public Procurement Assessment is based on a combination of three assignments, a work-based project, a presentation and a three hour, closed book examination. The three assignments are a minimum of 1,000 words and the work-based project is a minimum of 5,000 words. The examination accounts for 60% of the marks and the assignment for 40%. The weighting of marks is different from the Certificate as all students undertake a major work-based project involving an actual strategic initiative within their own organisation. The work-based project will last for the duration of the programme. Course presenters will provide ongoing assistance during the project. On completion of the project each participant will be required to make a formal presentation to an expert panel on the deliverables achieved by the project and marks will be awarded using assessment criteria. Applications should satisfy the following requirements: (a) A Leaving Certificate with a minimum of grade C in two higher level papers and grade D in four other subjects. The papers passed must include Irish, English and a third language. (b) A participant of mature years, that is a participant who is 21 years of age on the 1st January of the calendar year of entry, may, on the recommendation of the IPA Faculty Committee, be matriculated by the IPA for the purpose of entering the programmes. Certificate in Public Procurement The course is specifically designed for public sector officials and service providers engaged in the procurement of supplies, works and services. Some previous experience of procurement is necessary. Diploma in Public Procurement The programme is specifically designed for key decision makers in the procurement, project management and budget holding functions in the public sector. Participants may gain admission to the programme through the following avenues: hold the NUI Certificate in Public Procurement, or hold the IPA/Achilles Certificate in Public Procurement, or hold an equivalent non-ipa/achilles award in public procurement validated at certificate level, or demonstrate three years relevant public procurement experience. Venue The lectures will take place at the Institute of Public Administration s Training and Education Centre, Lansdowne Road, Dublin 4. Parking is available but limited.
