2 Gazette No.: 20/2004 Published on 14 May 2004 FIXED TELECOMMUNICATIONS NETWORK SERVICES LICENCE TELECOMMUNICATIONS ORDINANCE (Chapter 106) In accordance with General Condition 20 of Fixed Telecommunications Network Services Licence, Hong Kong Broadband Network Limited (referred to as HKBN ) hereby publishes the tariffs, terms and conditions under which it provides the following service plan with effect from and including 3rd May Charges of V-Phone Service Service Description Charges V-Phone Service One-time Installation Fee HK$850 Repair/Replacement of Equipment HK$1,000/set Monthly Fee HK$800 Special Terms and Conditions of V-Phone Service ( the Service ) 1. The Service which includes the supply of one set of Equipment shall only be available to corporate customers of HKBN. 2. The V-Phone Box and the accessory equipment thereof shall be collectively referred to as the Equipment. 3. Unless otherwise provided, Subscriber shall subscribe the Service for a minimum period of 12 months from the Service activation date ( Minimum Contract Period ) or as stipulated under the relevant order form and/or other relevant document as appropriate. If the Service is terminated for whatever reasons during the Minimum Contract Period, Subscriber shall pay the service fee for the remainder of the Minimum Contract Period. 4. Subject to clause 4 hereof, Subscriber may terminate the Service by giving at least thirty (30) days prior written notice to HKBN. Termination will take effect on the first day of the month immediately following the expiration of the 30 days notice period. No written confirmation will be given by HKBN upon such termination. 5. Upon the submission of the duly signed subscription form for the Service to HKBN but before the activation of the Service, HKBN reserves all rights to charge Subscriber a handling charge as shall be determined by HKBN from time to time, for each and every line the Subscriber requests to be withdrawn from the activation of Service. 6. Upon delivery of the Equipment to the Subscriber, HKBN shall not be responsible for any matters relating to the Equipment except for any post-sales service as expressly provided herein. 7. The Service and Equipment must only be used in Hong Kong and at the installation address stated in this form. In the event Subscriber uses the Service and Equipment out of the installation address, the location where the Equipment situate cannot be traced by HKBN. 8. The Equipment sold hereunder shall be entitled to a 12-month warranty and will be eligible for off-site maintenance service within the warranty period. 9. The warranty shall include inspection, repair and replacement of parts of the faulty Equipment subject to the terms hereunder. 10. The warranty shall not be assignable nor transferable to any third party.

The warranty is only valid in Hong Kong SAR and it shall be void and invalid if the Service is terminated for any reason and /or the seal, label or otherwise on the Equipment is damaged or destroyed. 12. The repair or replacement of any defective part of the Equipment is subject to HKBN s discretion. In the event HKBN replaces any part or component of the Equipment, the removed part or component shall become the property of HKBN. 13. It shall be Subscriber s responsibility to deliver the faulty Equipment to HKBN for repair and to collect the repaired or replaced Equipment thereafter. The Subscriber shall collect the repaired or replaced Equipment within 30 days from notification by HKBN for such collection, otherwise, HKBN shall reserve the right to dispose of the uncollected Equipment after the said 30-day period. 14. Subscriber shall use the Equipment properly and in accordance with the instructions provided by HKBN in order to be entitled to the maintenance service by HKBN. 15. Subscriber must not or allow any other person to open up or tamper with the Equipment in any manner including any repair, alteration, disassembling, removal of any part or component or serial number or any identification label on the Equipment or use it for anything HKBN does not authorize. 16. In the event of malfunctioning, breakdown or damage to and of the Equipment, HKBN shall not be liable to repair or replace the Equipment or any part or component if such arises from or occasion by fair wear and tear, any misuse, negligence, willful damage, or damage on the part of the Subscriber or its agents or employees, by breach of the terms herein, any accident beyond the control of HKBN, force majeure or any use of the Equipment outside Hong Kong SAR. 17. It shall not be HKBN s responsibility to repair or carry our any maintenance or replacement work if the Equipment or any part thereof is beyond repair. 18. At the request of HKBN, Subscriber must provide relevant information to prove date of subscription and activation of Service. 19. Upon the expiration of the warranty period of the Equipment, HKBN shall not be responsible to carry out any maintenance, repair work or otherwise for the Equipment in any manner whatsoever. 20. If the Equipment is lost or stolen during the term of the Service, Subscriber must inform HKBN immediately, HKBN may charge the Subscriber the cost of replacing such lost or stolen Equipment. 21. HKBN will not be liable to the Subscriber for: i. any fault in other equipment the Subscriber uses; ii. any fault in the Equipment whether or not caused by Subscriber tampering with it, Subscriber s negligence or failure to follow HKBN s instructions; iii. Subscriber s use of Equipment with any other equipment HKBN does not authorize; iv. Subscriber s use of Equipment away from the installation address in Hong Kong. 22. Subscriber shall at its own costs and expenses, make available broadband Internet connection with the following conditions for the use of the Service:- - Network that supports 10/100 Base TX interface - Broadband Internet connections with minimum 300kbps upload and download speed; - No firewall configured within the Local Area Network (LAN) environment; - Network that is NOT operating behind Network Address Translation (NAT); - Provision of a public IP address by DHCP or PPPoE or static assignment; - Network that does not require any kind of login except PPPoE; and - RJ45 plug

4 23. The Service is unavailable under a web log-in broadband technology. If Subscriber uses broadband service with the Service concurrently, it is the Subscriber s responsibility and at his own costs to have multiple logins for xdsl with PPPoE login broadband technology, and multiple IP addresses for cable modem broadband connection. 24. Before the existing number is ported to HKBN (if applicable), Subscriber may at its own costs arrange call forwarding service with their existing service provider to forward the existing number to the temporary number as may be allocated by HKBN. 25. HKBN does not warrant or guarantee the Service to be continuous or uninterrupted throughout the Term. Subscriber accepts the Service and the Equipment are provided on an as is and/or as available basis. Subscriber accepts that the provision of the Service is contingent upon the reliability of the Internet. 26. These Special Terms and Conditions shall be subject to the General Terms and Conditions of HKBN, Special Terms and Conditions for Business Line Service and Special Terms and Conditions of Number Porting (Number Switch Over) Service and all the terms and conditions stated therein as may be in force from time to time in order to use the Service. If there is any inconsistency between them, the Special Terms and Conditions herein shall prevail to the extent of such inconsistency. All matters related to the Service and Equipment shall be subject to the final decision of HKBN. 27. In case of any discrepancies between the English and Chinese versions of these terms and conditions, the English version shall prevail. Hong Kong Broadband Network Limited ( HKBN ) hereby publishes the revised tariffs of HKBN IDD 0030 International Call Forwarding Service (Gazette No.: 12/2003) pursuant to its Fixed Telecommunications Network Services License with effect from 3rd May The monthly Fee of the Service is revised from $68 to $500. Unless otherwise specified by HKBN, all other charges, Terms and Conditions filed shall remain unchanged. In accordance with General Condition 20 of Fixed Telecommunications Network Services Licence, Hong Kong Broadband Network Limited (referred to as HKBN ) hereby publishes the following supplementary Tariffs and Special Terms and Conditions of HKBN IDD 0030 International Call Forwarding Service (Gazette No.: 12/2003) under which it provides HKBN IDD 0030 International Call Forwarding Service Flexi Plan ( Flexi Plan ) with effect from and including 3rd May Charge HK$ 500 per day plus usage charge on International Forwarding Service, subject to IDD 0030 International Calling Service as gazette published on 1st February 2002 and 23rd August Supplementary Terms and Conditions of the Flexi Plan For Flexi Plan Subscriber(s), apart from clauses 1, 3, 4, 8, 9, 10, 11 of the Special Terms and Conditions for HKBN IDD 0030 International Call Forwarding Service, the following clauses are also applicable: 1. A service fee of HK$500 per day or any amount as stipulated under the relevant order form and/or other relevant document as appropriate will be charged for the Contract Period. The Service will be terminated automatically upon the expiration of the Contract Period unless otherwise requested by the Subscriber(s) to continue to use the Service.

5 2. The Calling Charges Rebate (or any part thereof) is only valid during the Contract Period. Any unused Calling Charges Rebate cannot be redeemed for cash nor transferred to others and shall be deemed forfeited after the Contract Period unless or otherwise specified under the relevant order form and/or other relevant document as appropriate. 3. The service fee for the Flexi Plan does not include any local call charge in Hong Kong, China and overseas, call forwarding usage charge (Except for the Calling Charges Rebate mentioned in Clause 2 above, if applicable) and other service charge for any other new or value-added service All payment made shall not be refundable nor transferable. 4. If Subscriber(s) shall for any reason register any service plan of the Service again with the same international call forwarding number during the Contract Period, any free Caller Number Display under such re-registered service plan, if applicable will automatically expire after the Contract Period. 5. The Caller Number Display service will be cancelled automatically upon the expiration of the Contract Period unless as requested otherwise by Subscriber(s) or otherwise specified under the relevant order form and/or other relevant document as appropriate. 6. All Calling Charges Rebate, if applicable shall be terminated upon the alteration of the Service Plan or termination of the Service or any breach of the terms and conditions contained herein or the General Terms and Conditions of Hong Kong Broadband Network Limited ( HKBN ) by Subscriber(s). All other charges and conditions shall remain unchanged. All of the above Services are provided subject to HKBN s General Terms and Conditions of Service as published from time to time.
