2 Charter School Responsibility: Protect Health and Safety of Students Objectives of this session: o To describe the student health requirements for N.C. Charter Schools. o To describe other student health recommendations for consideration. o To provide resources for assistance in addressing student health issues. C
3 Charter School Responsibility: Protect Health and Safety of Students N.C. Charter Schools are not LEs. When state statute says that all public schools shall those requirements are interpreted to include charter schools. When state statute says local boards of education, local administrative units, etc. shall those requirements are interpreted to NOT include charter schools. C
4 GS 115C Charter School Responsibility: Protect Health and Safety of Students Medical Care to Students by School Personnel o Law allows school staff to give medical care within areas described o llows staff to refuse o Provides limited protection from liability C
5 Providing Nursing Services NC State Board of Ed policy #16 NCC 6D.0402 Each LE shall make available a registered nurse for assessment, care planning, and on-going evaluation of students with special health care service needs in the school setting. Special health care services include procedures that are invasive, carry reasonable risk of harm if not performed correctly, may not have a predictable outcome, or may require additional action based on results of testing or monitoring.

8 Current Health Law and Charter Schools Students with Diabetes GS 115C-47, Senate Bill 911 Senate Bill 738 Ensure that guidelines adopted by the SBE are implemented in schools in which students with diabetes are enrolled. Report on compliance annually by June 1st.
9 Current Health Law and Charter Schools Required components for schools with diabetic students: o Generalized diabetic training for school staff o Two intensively trained school staff for specific students with diabetes o Written plan for diabetic student care
10 Current Health Law and Charter Schools Immunizations o LL North Carolina children must be compliant with immunization law. o Charter schools verify and report on that compliance by November 1 st of each year. o Principal/headmaster is required to exclude students not in compliance by the 30 th calendar day after start of school.
11 Current Health Law and Charter Schools Kindergarten Health ssessment o Required with enrollment in kindergarten. o Compliance reported with immunization compliance by November 1 st of each year. o Forms can be downloaded at alth.htm
12 Current Health Law and Charter Schools o Occupational Health and Safety ct (OSH) Requirements may be downloaded from o Garrett s Law Notifications Statute requires that you provide annual notification regarding vaccines for meningitis, flu and HPV. 13 Other Health Recommendations Medication administration Policy and procedure Treat all medications the same Discourage routine medications at school
