We ve been doing it since With nine attorneys and three offices, we re New Mexico s largest personal injury law firm. So, I guess we re doing something right. what s with the cover photo? We were looking for something different. We saw that B-29 Superfortress and the guided missile battery at the National Museum of Nuclear Science & History in Albuquerque and said hmmm. what s your Firm s philosophy? First, we know the jury system is America s great equalizer. It gives the little guy at least a chance at a fair fight. Second, we believe that when corporate power co-opts the other two branches of government, the courts truly are American freedom s last bastion. Corny, but true. that sounds like something the Aclu would say. Many of the cases that shape law in our country are, in fact, personal injury cases: workplace safety, bad drugs and products, insurance bad faith, police misconduct. We take those types of cases on behalf of regular folks who have been screwed over by a corporation s malfeasance or a government agency run amok. would you explain insurance bad FAith? Under New Mexico law, insurance companies are required to deal with their clients in good faith. Refusing to pay a valid claim, refusing to investigate a claim, delaying a valid claim all are acts of bad faith that open the company to further damages. We handle larger bad-faith claims. in general, what should people KnOw AbOut personal injury claims? First, an injured party has only a limited period to make a claim, possibly only two years. Second, they should document an incident via photos and witness names. Third, they should talk with an attorney as soon as possible, especially before they talk to the other side. And most importantly, they should know that consulting a personal injury lawyer costs nothing. Most of the cases we take are contingency cases meaning there s no cost to the client if there s no recovery. don t most cases settle Out OF court? Most do, but the carriers know our attorneys are ready to take every case to trial, if necessary. They know our firm can afford the up-front cost of gathering evidence, locating witnesses, reconstructing accidents and retaining experts, which can be quite expensive. A quick response can make the difference in the outcome of a possible lawsuit. You may save money you don t have to spend defending lawsuits when your business documents are well-drafted and planned. Work with your lawyer to spot possible risks, and steer clear of them. An ongoing relationship with your lawyer or a law firm puts you in control if your business faces a lawsuit. Your legal team knows something about your business and can quickly respond to trouble. 5 legal trends New Mexico law 2013 Driver s licenses for undocumented immigrants and a controversial law permitting horse slaughter are making news in New Mexico. As immigration law continues to raise controversy nationwide, in the border state of New Mexico, Gov. Susana Martinez is carrying out a new push to repeal the state law allowing undocumented immigrants to obtain driver s licenses. Martinez, who has tried to get the law repealed twice before, described it as dangerous in a post on her official Facebook page. I am once again asking the legislature to repeal the law that gives driver s licenses to illegal immigrants, said Martinez, a Republican. I am always willing to discuss this issue with legislators from both parties and explore ways to find common ground, but I believe the most effective solution is to simply repeal this dangerous law. Still, according to a CNN report, some immigration activists were hopeful that the nod toward compromise was a sign that her approach may have changed from past attempts to repeal the measure. We are encouraged that a compromise can be worked out by the legislators and the governor, said Allen Sanchez, executive director of the New Mexico Conference of Catholic Bishops, a group that has fought the governor s attempts to repeal the law. Martinez, the first Latina governor in the United States, has supported the repeal of the 2003 law since her campaign for governor. In 2011, she said the law had turned New Mexico into a magnet for people from other states seeking a license. We have created an industry of human trafficking, Martinez said in People are getting paid to bring other people from all over the country to New Mexico for the whole purpose of defrauding our state. New Mexico and Washington are the only two states that grant unrestricted driver s licenses to undocumented immigrants. Utah issues driving privilege cards to undocumented immigrants who have lived in the state for more than six months. Illinois lawmakers approved a measure earlier this month to allow undocumented immigrants to get temporary licenses. Several New Mexico lawmakers have said that they were considering a measure that would be a compromise more in line with the approach Utah and Illinois have taken, CNN affiliate KRQE reported. It doesn t benefit the citizens of the state of New Mexico for us to be at a stalemate, Democratic state Sen. Pete Campos told KRQE. It is important for us to move forward. Horse-slaughter controversy Actor and activist Robert Redford and former New Mexico Gov. Bill Richardson recently joined the divisive debate against a return to domestic horse slaughter, announcing the formation of an animal protection foundation to fight the opening of plants in New Mexico and Iowa. The Foundation to Protect New Mexico Wildlife s first act was to join a federal lawsuit filed by the Humane Society and other groups to block the planned opening of the first horse slaughterhouses in the U.S. to operate in more than six years. Meat from the slaughterhouses would be shipped to some countries for human consumption and for use as zoo and other animal food. New Mexico Attorney General Gary King also filed a motion to intervene on behalf of horse slaughter opponents. Horse slaughter has no place in our culture, Redford said in a statement. It is cruel, inhumane, and perpetuates abuse and neglect of these beloved animals. A lifelong horse lover, Richardson said he is committed to do whatever it takes to stop the return of horse slaughterhouses in this country and, in particular, my own state. Congress was right to ban the inhumane practice years ago, and it is unfathomable that the federal government is now poised to let it resume, he said. 6 new mexico s top rated lawyers in 2013 continued from pg 5 of Roswell, N.M., the Department of Agriculture in June gave Valley Meat the go-ahead to begin slaughtering horses. Officials said it was legally obligated to issue the permits, even though the Obama administration opposes horse slaughter and is seeking to reinstate a congressional ban that was lifted in Another permit was approved a few days later for Responsible Transportation in Sigourney, Iowa. The move has divided horse rescue and animal welfare groups, ranchers, politicians and Indian tribes about what is the most humane way to deal with the country s horse overpopulation and what rescue groups have said are a rising number of neglected and starving horses as the West deals with persistent drought. In addition to its opposition to horse slaughter, Redford and Richardson say, the Foundation to Protect New Mexico Wildlife will focus on the preservation and protection of the state s wild mustang and burro population. Other efforts will focus on the Mexican grey wolf, bison and the reintroduction of native fish and mammal species. The foundation will also work to support New Mexico s animal shelters and to prevent animal cruelty. Same-sex marriage In August, New Mexico Attorney General Gary King told the state s highest court that a prohibition on same-sex marriage is unconstitutional. In written arguments filed with the court, according to a report on CBSlocal.com, King said the justices should invalidate the state s ban on gay marriage if they agree to resolve the issue in a lawsuit filed by two Santa Fe men who were denied a marriage license. King, a Democrat who plans to run for governor next year against Republican Gov. Susana Martinez, said New Mexico law effectively doesn t allow gay marriages although there s no statutory provision that specifically prohibits, or authorizes, gay couples to be married. New Mexico s guarantee of equal protection to its citizens demands that same-sex couples be permitted to enjoy the benefits of marriage in the same way and to the same extent as other New Mexico citizens, King said in the filing. The lawsuit was filed directly with the justices to try to get a speedy decision. However, the court could decide that the case should be handled differently and has to work its way through the legal system as an appeal from a lower court ruling. The lawsuit asks the court to order Santa Fe County Clerk Geraldine Salazar to issue the two men Alexander Hanna and Von Hudson a marriage license. Despite urging the justices to strike down a gay marriage prohibition, King also said in his filing that the lawsuit wasn t properly held before the high court and, therefore, the justices should deny the men s request to order the Santa Fe County clerk to issue them a marriage license. King and a lawyer for the county clerk argued that the Supreme Court doesn t have the power to issue such an order involving a county official only state officers, boards and commissions. King said if the court granted the request by the Santa Fe couple it would set a precedent that could overload the justices with requests for similar orders concerning any dispute a party has with any local or county official, such as county tax assessment protests and local zoning disputes. The lawsuit contends that denying marriage licenses to same-sex couples violates the New Mexico Constitution, including its Equal Rights Amendment prohibiting gender-based discrimination and provisions that guarantee due process and equal protection under the law. Rep. Brian Egolf, a Santa Fe Democrat and one of the lawyers who brought the lawsuit, said his clients agree with the attorney general that the same-sex marriage prohibition should be struck down. They believe that this is the ultimate issue in the case and hope that the Supreme Court will not allow an unconstitutional statute to stay on the books, said Egolf, who unsuccessfully pushed a proposed constitutional amendment in this year s Legislature to legalize gay marriage. Brian Egolf He said the Supreme Court has the power to decide this issue once and for all, and that doing so will resolve a matter of great public importance. After the Santa Fe men brought their case, the American Civil Liberties Union and others filed a similar lawsuit with the Supreme Court on behalf of six same-sex couples. That case also asks the justices to decide whether New Mexico recognizes same-sex marriages from other states. New health care laws Nearly 192,000 New Mexicans will be eligible for subsidies to help pay for health insurance next year, according to a report from Families USA, a Washington-based consumer health organization. Federal tax credits that take effect January 1 will make health insurance affordable for many working families and young people. The tax credit subsidies are a game-changer, Ron Pollack, executive director of Families USA, said in an Associated Press report. They will make health coverage affordable to huge numbers of families that would otherwise be priced out of the health coverage and care they need. Barbara Webber, executive director of Health Action New Mexico, said New Mexico is one of the states with the most to gain from the new healthcare laws because of its high numbers of uninsured and underinsured residents. Many of our families have gone for generations without health care coverage, she said. The subsidized rates will be available to New Mexicans who purchase health insurance through a new state exchange being implemented as part of the national health care overhaul. In addition to creating the exchange, Gov. Susana Martinez has signed legislation expanding Medicaid programs to cover people earning up to 138 percent of the poverty level. Beginning October 1, people who are uninsured can begin signing up for the subsidies, which will be granted on a sliding scale, with the poorest people getting the largest credits. But representation of tribes and Native people covers a lot more than that. It involves many of the same challenges faced by most other large clients, including contracts, personal injury, workers compensation and a host of similar legal issues. At the root of most Indian law issues lies a jurisdictional maze of an evolving body of law. Disputes are exacerbated by issues centering on which rule of law to apply, whether applicable in other jurisdictions, and in what judicial forums to resolve these matters. Over the course of centuries, the sovereign rights of Indian Nations have undergone substantial modification. The Pueblo Indians of New Mexico are no different in holding a unique status among the Native people of America. In 1877, the U.S. Supreme Court, in U.S. v. Joseph, ruled that the Pueblo Indians of New Mexico were not an Indian tribe. Rather, it determined that Pueblo Indians held their lands with a right superior to that of the United States because their title originally fell under the laws of Spain and Mexico. When the United States took possession of present-day New Mexico, through the Treaty of Guadalupe Hidalgo, with time it honored the vested communal fee-simple property rights of the Pueblo Indians. 20tH CEntury DEvElOPMEnt OF tribal sovereignty Several decades later, coupled with the passing of an Enabling Act in 1910 and the statehood of New Mexico in 1912, the Supreme Court reversed their previous decision with U.S. v. Sandoval, holding that the Pueblo Indians fell under federal superintendence, like other Indian tribes. Accordingly, the Pueblo Indians could not freely alienate their lands without federal approval. From that moment on, the Pueblo Indians joined the oscillating jurisprudence governing the rights of tribal governments, which continues to exemplify the contours of present-day Indian law. These might include a faulty pacemaker, heart valve, prosthetic knee, trans-vaginal mesh, or any other device. 10 new mexico s top rated in 2013 lawyers A BRIEf INTRODUcTION TO Class action lawsuits need to Know a personal injury class allows you you to participate in a group lawsuit to recover damages for an injury that you may not have pursued on your own. The cost of litigation is shared by the entire group, so it becomes reasonable for an attorney to take the case. Class action lawsuits are particularly effective in forcing large companies to change the way they do business. Rule 23 of the Federal Rules of Civil Procedure controls the creation of class actions filed in federal court. Every state has its own procedural rules that control class actions filed in state courts. The Class Action Fairness Act of 2005 allows an attorney to use federal class action rules in state court if any of the plaintiffs live in a different state from where the action is filed. PERSONAL INJURY CLASS ACTIONS MUST BE CERTIFIED The court must allow appropriate lawsuits to be turned into a class action. A judge determines if a class action is a fair and efficient way to handle a large number of potential cases. The plaintiff s lawyer must show that the case and the plaintiff are good representations for the injured group. If a judge agrees, he certifies the class and allows the class action to proceed. POTENTIAL PLAINTIFFS CAN OPT OUT If you are part of the group that has been injured, you must opt out of the class action if you want to sue on your own. Opting out tells the court that you do not want the results of the lawsuit to apply to you. If you fail to opt out of the class action, you lose the right to sue on your own behalf. MASS INJURY CASES Mass injury class actions are a more complex type of personal injury group litigation. Mass injuries are typically cases where large groups of people have been injured by a defective drug or product, such as defective breast implants. It can be hard to use a class action to resolve mass torts because individual personal injuries will differ. It can be impossible to determine the size of the settlement needed to compensate plaintiffs who may develop injury symptoms in the future. Once started, the case could take more or less time to resolve than an individual lawsuit. Much depends on the defendant and how hard it fights the class claims. A case may go on for years. A judge or jury may decide who wins, but quite often class actions end with a settlement.
