In addition, a large construction project will involve many different contracts - at least a few of which will be disputed over the course of construction. To deal with these issues, you ll need the help of an experienced commercial real estate lawyer. zoning and land use are Key Before you purchase commercial property, you must know whether state and local zoning and land use laws will restrict the type of structures you can build. These laws can ultimately make or break your investment. Don t wait for ground-breaking to discover the land is not zoned for commercial purposes. environmental laws affect construction A number of federal laws, such as the Clean Water Act, are intended to prevent pollution to the environment. Because of the environmental risks in commercial construction, you may find limitations and other requirements on your construction activities. Failure to comply can subject you to expensive penalties and fines, regardless of your awareness of the law. get everything in writing Different contractors that you hire will be responsible for different parts of the construction project. You need to protect your interests by creating written agreements with each contractor that states very clearly state your expectations. Agreements should also list dates for completion. indemnity clauses Protect you Disagreements and costly mistakes are fairly common in the construction industry. Sometimes you may be liable to pay damages just because you own the property. Because of this, it is important that all contacts include indemnity clauses. If a business owner keeps rusting, inoperable vehicles on the property or stores abandoned furniture there, most municipalities would consider this a nuisance. Lumber or construction equipment that s in such bad condition that it s no longer useful could also be a nuisance. Hazards that risk the health of the public are nuisances in most municipalities. For example, stagnant water, animal manure, and septic waste can all pose a health risk to anyone who comes in contact with them. Any odors they produce would make the area unpleasant for anyone visiting. nuisances can earn Penalties and Fines When a complaint is made against a business, a city or county official will inspect the commercial property to see if any laws are being broken. This might result in a warning to the property owner. If the owner doesn t address the problem, the government will levy a fine - and keep charging fines until the situation is fixed. Nursing facilities try to accommodate residents food preferences and give feeding assistance to those residents who suffer from nutrition, dietary or eating difficulties. serving regular nutritious Meals Residential care, assisted living or nursing facilities must serve residents a minimum of three meals each day at regular mealtimes and snacks before bedtime. When preparing and serving meals to residents, nursing facilities must try to provide: Attractive and delicious meals, including ethnic foods Alternative food choices that are consistent with the usual and ordinary food items provided by the facility Meals at the times preferred by residents so long as the times requested are reasonable Meals in a quiet enjoyable social setting rather than noisy dining areas or residents eating alone in their room Sometimes, there are indications that a resident is having difficulty in the use of normal eating methods or techniques. Facility staff must be trained to observe when residents are not eating enough foods and must work with residents to maintain their ability to eat. The specific steps that a facility can take include: Prompting the resident to eat Providing residents with specialized utensils or other helpful devices and training with their use Providing therapy to improve swallowing skills Hand feeding the resident There are, of course, several other considerations including monitoring nutrition status and the possibility of intravenous feeding. 9 selecting A WorkErs compensation lawyer If you ve been injured at work and need to find a workers compensation law attorney, learn some basics about the practice area. Visit your state s web site for its industrial commission, which should have claimant information specific to state laws. If you have a lawyer who you ve worked with on other legal matters, such as for your taxes, estate planning or real estate needs, ask if they can suggest a workers comp attorney who works with similar claimants. When you have a short list of two or three lawyers, contact them and set up consultations. Typically, workers comp lawyers won t charge a fee for the initial meeting. During your meeting, the lawyer assesses your case, and you can decide if you d like to have the lawyer represent you. If your meeting can t be scheduled promptly, it can mean the lawyer s caseload is heavy, and he or she may lack resources to take on your case. Pregnant Man Finally Granted Arizona Divorce In August, the Arizona Court of Appeals ruled on a divorce case that may have wide-ranging implications for transgender persons in the state. The case made headlines because it involved the so-called pregnant man, a transgender man who gave birth to three children and told his tale on numerous talk show programs. Thomas Beatie was born female, but began transitioning to his psychological gender in In 2002, while living in Hawaii, he underwent gender-reassignment surgery. Under Hawaiian law, Beatie was able to have his birth certificate amended and be legally recognized as male. Beatie later married, but his wife was unable to conceive due to a hysterectomy. Because Beatie still had female reproductive organs, he was able to get pregnant via artificial insemination. By 2011, the couple had three children and had made numerous appearances on television. Beatie and his wife later moved to Arizona, where their marriage faltered. When they petitioned for an uncontested divorce in the state, they ran into trouble. In 2013, Maricopa County Superior Court Judge Douglas Gerlach ruled that Beatie was female because he had given birth. The marriage, then, was between two women. And given that Arizona did not recognize same-sex marriage, its courts could not grant the couple a divorce. A three-member panel of the Arizona Court of Appeals overturned the lower court s ruling in August The question before this Court is not whether the State of Arizona allows same-sex marriage or divorce, but whether the laws of the State of Arizona allow a marriage, lawfully entered into in another state, between two persons the foreign state formally recognized at the time of the marriage as male and female, to be dissolved, the appellate court wrote in its opinion. The court also noted that Arizona permits people who have undergone a sex change operation to obtain an amended birth certificate reflecting the appropriate gender. In a statement issued by his attorney, David Michael Cantor, after the ruling, Beatie expressed his gratitude to the court: I feel I have finally been recognized in Arizona as not just a man, but a human being, he wrote. People are going to have to get used to the fact that transgender people exist and they deserve the same rights and responsibilities that everyone else have, Cantor said, according to Reuters. That includes the right to get married and the right to be divorced and the responsibilities that go along with all that. The ruling means that transgender persons with legally amended birth certificates now have the same right to get driver s and marriage licenses as other Arizona residents. Court Orders State to Pay $317 Million to Schools Immediately Shortly before the school year began, Maricopa County Superior Court Judge Katherine Cooper ruled that Arizona must immediately pay $317 million in back payments to public schools. That s just the tip of the iceberg; back payments the state owes the school system amount to $1.6 billion, due over the course of five years, according to Cooper s ruling. The ruling was the result of a longstanding lawsuit that challenged the state s funding of public education. The suit claimed that the state owed the school system money because it had not fully covered inflation costs as required under a voter-approved law. They need to start giving the schools the money now. There is now a court order in effect that requires the state to comply. Experts expected the state to appeal the ruling and to seek a stay delaying the payments until the appeal is resolved. That would likely push the issue into 2015, when Arizona will have a new governor and a new legislative session. The state is currently predicting a $49 million budgetary shortfall for the current fiscal year; with the first payment to the schools factored in, the shortfall would amount to $366 million. In fiscal year 2014, Arizona allocated $3,327 per student. With the $317 million in additional funding, per-pupil spending would increase to $3,560. That figure still ranks the state in the bottom 10 nationally for spending per student. The state is also on the line in a similar case to determine whether it owes the schools an additional $1.3 billion for retroactive inflation costs. Judge Cooper will hear that case later in the fall. Penalty Phase Delayed in Jodi Arias Case The trial of Jodi Arias, the former waitress convicted of murdering her ex-boyfriend, Travis Alexander, dominated cable news for much of Now, with another delay in the proceedings, it looks like the case will stretch on even longer. Arias now represents herself. She requested a delay in the opening of her penalty retrial, slated to begin on September 8, 2014; in late August, Maricopa County Judge Sherry Stephens granted the request. On May 8, 2013, Arias was convicted of first-degree premeditated murder in the 2008 killing of Alexander. One week later, a jury decided that the murder was cruel, heinous, or depraved, and therefore Arias was eligible for the death penalty. However, the subsequent penalty phase was less conclusive: Jurors were not able to reach a consensus on a verdict. According to CNN, the jury was split 8-4 in favor of the death penalty. Under Arizona law, prosecutors were allowed to request a second penalty phase with an entirely new jury. If the new jury also fails to reach a consensus, the death penalty would be removed as an option. In that case, Arias would either be sentenced to life in prison, or she would be eligible for release after 25 years. Arias requested to serve as her own attorney after disagreeing with her court-appointed lawyers on courtroom strategy. As of press time, the penalty retrial phase is now scheduled to begin on Sept. 29, Killing of Shooting Instructor By 9-Year-Old with Uzi Raises Questions About Gun Laws In late August, a 9-year-old girl fatally and accidentally shot her shooting instructor with an Uzi at a shooting range in Arizona s Mojave Desert. The incident made headlines nationwide and spurred questions of Arizona s laws governing firearms and minors. Federal law prohibits those younger than 18 from owning a firearm. But it does not restrict firearm use by children. Under Arizona law, minors as young as 14 are permitted to shoot at ranges without the supervision of a parent or guardian. There is no law restricting children accompanied by parents or guardians from shooting firearms. Instead, age restrictions are left up to individual ranges to determine. Bullets and Burgers, the range where the shooting occurred, permits children eight and older to shoot, as long as they re accompanied by a parent or legal guardian. Her parents accompanied the girl in question to the range. According to the Mohave County Sheriff s Department, instructor Charles Vacca was standing next to the girl, teaching her how to use the automatic weapon. When the girl pulled the trigger, the recoil sent the gun over her head, killing Vacca. Youth shooting sports are generally extremely safe activities, enjoyed by millions of Americans, Michael Bazinet, a spokesperson for the National Shooting Sports Foundation, told Time magazine. However, others reacted to the incident by calling for reforms of current gun laws. Connecticut passed a law prohibiting children under 16 from handling automatic weapons at ranges; the move followed the death of an eight-year-old who lost control of an Uzi he was firing at a gun expo in Currently 28 states and the District of Columbia have laws that govern minors access to firearms. When things like this happen, we do draw our attention to the law, Lindsey Zwicker, staff attorney with the Law Center to Prevent Gun Violence, told the Los Angeles Times.
