The applicant agrees that this application is a contract on providing the telephone and/or broadband Internet services immediately upon the Service Provider agrees to provide the service to it. 10. Contract to provide telephone and/or broadband Internet services 1) Service Provider means TOT PCL 2) Service User means the applicant for the telephone service, which is approved by the Service Provider. 3) The Service User shall comply with the laws, regulations, rules, orders, notices and any conditions of the Service Provider involving the telephone service and/or broadband Internet service that are enforced now and in the future. 4) The Service User shall supply and maintain the telephone and the terminating equipment. 5) The Service User must pay for service charges and/or fees within 15 days following the date of receiving the bill on the service. 6) In the event the Service User owes a debt in clause 5, the Service Provider is entitled to suspend the service on an unpaid number, which the Service Provider shall notify in writing in advance or by other means that notify the Service User no less than 15 days in advance. 7) This service contract is an exclusive right, in which a change on the Service User shall require prior consent in writing from the Service Provider. Moreover, the Service User agrees not to provide the right of using the service to any other individuals and legal entities. 8) The service rates may be adjusted up or down as specified by the National Telecom Commission. 9) The Service Provider reserves the right to change the phone number, system and method of service, which it shall notify the Service User no less than 30 days in advance. The Service User agrees to allow the Service Provider to provide the service normally according to the network system, e.g. showing the originating number, etc.

5 5 10) The Service User agrees to allow the Service Provider to use such information for operation of the Service Provider in all respects including reveal certain or whole information to other Telecommunication Providers or any person who needs to make a customer list and use in some purposes such as sales, marketing, CRM and so forth without any notification to the Service User in advance. 11) When there is a service interruption on the telephone the Service User must notify the Service Provider, who shall repair the Service Provider s part up to the linking point until good condition within a reasonable time free of charge, except that such interruption is caused by the Service User or its subordinates. In the event the Service User is damaged by an interruption on the telephone or broadband Internet due to a modem or router connection, the Service User agrees not to claim whatever damages from the Service Provider, and it agrees to pay for the service charges as the Service Provider shall collect. 12) The Service User agrees to use the service corresponds to the objects stated in the contract that is not against the laws or peace and good moral of the people. 13) All the correspondences, letters and notices of the Service Provider sent to the Service User at its billing address shall be regarded as duly received by the Service User already. 14) If the Service User breaches a contractual clause, the Service Provider is entitled to suspend the service and/or terminate the contract. However, the Service Provider shall notify the cause of termination to the Service Provider no less than 15 days in advance. In the event the Service User does not desire to use the service, it must notify the Service Provider on the termination in writing no less than 30 days in advance. 6 6 11. Criteria on the broadband Internet 1. The broadband Internet service is provided without a guarantee on the interface speed, due to the speed of sending data between the computer and the network of TOT not the speed in receiving or sending the data. The real speed may be below the top speed in the applied interface, as the high-speed Internet is a shared bandwidth, which is a shared circuit at the proportional rate. 2. Interface speed of the network may be affected by several factors, e.g. condition and distance of the internal telephone cable of the Service User, the condition of the computer, the speed of interface and the crowded condition of the Internet network, including the server and router of the Web site it visits and several other factors. 3. TOT shall not be responsible for damage resulted from the quality of receiving and sending data or delay or mistake of the data and news, including not liable for a leak of the confidential data stored in the system or sent via the Internet network. 12. In the event you desire to pay the telephone service charges by deducting from a bank account (Please fill out the application to pay for the telephone service by deducting from a bank account.) 13.
