1 2015 OSU Emergency Procurement Guideline PROCUREMENT, CONTRACTS, AND MATERIAL MANAGEMENT (PCMM) HAS OUTLINED THE FOLLOWING GUIDELINE FOR PURCHASING IN THE EVENT OF A DISASTER An emergency, as defined below, creates an immediate and serious need for supplies and/or services which cannot be satisfied following the normal procurement method due to the element of time. Emergency circumstances are those that involve issues surrounding the safety of students, staff, the public, and/or require the protection of property from further immediate damage. When an emergency is declared, PCMM may issue a blanket emergency exemption for all purchases placed within a certain timeline to support the University needs. Notwithstanding the immediate nature of an emergency, all procurements conducted as emergencies should be made as competitive as possible and cover only the goods and services necessary to meet the requirements and duration of the emergency. Definition of Emergency: OSU Procurement Standard (17) defines an emergency as an unexpected, serious situation that creates a significant risk of loss, damage, interruption of service, or threat to the public health or safety that requires prompt action to remedy the condition. OSU Standards Governing Emergency Procurements: Personal or Professional Services and Goods and Services OSU Standard (4) Emergency Procurement. The Institution President,, or designee may declare an Emergency when such a declaration is deemed appropriate. The reasons for the declaration will be documented and will include justifications for the procedure used to select the Entity for a Contract within the scope of the Emergency declaration. After the Institution President,, or designee has declared an Emergency, the Institution may negotiate a Contract with any qualified Entity for services included in the scope of the Emergency. The Institution will maintain appropriate records of negotiations carried out as part of the contracting process. Capital Construction and Contracting OSU Standard (4) Emergency Procurement. The Institution President,, or designee may declare an Emergency when such a declaration is deemed appropriate. The reasons for the declaration will be documented and will include justifications for the procedure used to select the Contractor or Professional Consultant for a Contract or Public Improvement Contract within the scope of the Emergency declaration. After the Institution President,, or designee has declared an Emergency, the Institution may negotiate a Contract or Public Improvement Contract with any qualified Entity or Professional Consultant for services included in the scope of the Emergency declaration. The Institution will maintain appropriate records of negotiations carried out as part of the contracting process. Processes: In the event of an emergency or disaster, there may be no access to the Financial Information System of Banner, making creation of Banner Purchase Orders impossible. PCMM advises purchasing through use of the following mechanisms: Departments utilize their departmental procurement card where feasible Utilize Direct Pay vendors when applicable Maintain departmental Purchase Orders in hard-copy form and place orders using the hard copy Purchase Order and maintaining record of all purchases. PCMM has Purchase Order templates available as well as OSU Standard Terms and Conditions for both goods and services. OSU s Standard Terms and Conditions for Purchase Orders are available at Prepare a written determination for signature by the agency head or designee indicating the nature of the emergency, the reason for selection of the particular contractor and include such determination with the file. 1
