1 HB Litigation Conferences Presents Orthopedic Litigation Conference DePuy and Zimmer Implant Updates Plaintiffs Only January 19, 2011 Conference Chairs Robert Brown joined Baron & Budd as a shareholder from Florida-based Alters, Boldt, Brown, Rash & Culmo, where he was a founding equity partner. Bob works in litigation of significance to Florida and the Gulf Coast, such as the Gulf of Mexico oil spill and Chinese drywall litigation. A member of the Florida Bar since 1986, Bob s decades of experience in mass tort litigation, product liability and commercial litigation make him a valuable addition to Baron & Budd s diverse practice. He has tried more than 50 cases to verdict, and he is admitted to the United States Court of Appeals for the Eleventh District and all federal district courts in Florida. He is AV rated by Martindale-Hubbell. One of the cases that inspired Bob as an advocate involved a loving, married couple who had fostered over 250 children with mental and/or physical disabilities. The husband was in a fatal car accident. Bob settled a lawsuit against the insurer of the other driver involved in the accident for 100 times the policy limits because of the insurer s bad faith. Although no amount will bring back the huge loss this family has had, Mr. Brown certainly helped his surviving wife and children to live a normal life. Making this kind of difference in the lives of everyday people motivates Bob as an attorney. In addition to his participation in the American Association for Justice s Leaders Forum and National Finance Committee, Mr. Brown serves on the Board of Directors of the Miami-Dade Justice Association and is President elect of the American Board of Trial Advocates Miami Chapter. Ben Gordon works in an Of Counsel capacity to the Levin Papantonio law firm in its Mass Tort Department. Mr. Gordon joined the Levin Papantonio law firm in its Mass Tort Department in 1993, and tried a number of mass tort cases with Mike Papantonio. Mr. Gordon became a partner in While continuing to consult with Levin Papantonio, Ben opened his own law firm in 1999, and has continued to limit his practice to the representation of plaintiffs, primarily those injured by defective devices or drugs. Mr. Gordon is the author of several published articles concerning medical and legal aspects of failed products such as Silicone Gel Breast Implants and dangerous drugs like fen-phen. He has worked on a variety of other mass tort projects including Rezulin, Ephedra, Sulzer Implants, Renu Contact Lens, and Avandia litigation. Mr. Gordon received his undergraduate degree, magna cum laude, from the University of West Florida in 1988, and his law degree from Cumberland School of Law, with honors, in As an Associate Editor of the Law Review, Ben authored a case note that was published by the Cumberland Law Review. As a member of Cumberland's Trial Advocacy Board, he was appointed as Director of the Senior Trial Competition for Cumberland. He served as a student class representative as a 1L and 2L, and was awarded a Cordell Hull Teaching Fellowship as a 2L and a 3L to train new law students in Legal Research and Writing. Mr. Gordon is licensed to practice law before all state and federal courts in Alabama and Florida, and also the United States Court of Military Appeals and the United States Court of Appeals for the Eleventh Circuit. He served as Staff Attorney for the Eleventh Circuit where he was appointed to the Honorable Judge Joel F. Dubina. He has also worked as an Adjunct Professor of Law at the John Marshall Law School in Atlanta, Georgia, and was appointed as a First Lieutenant in the Army JAGS CORPS (Reserves) after completing law school.

Katz joined Burg Simpson in September 2005 after six years with the New York law firm of Seeger Weiss LLP, in which he was a partner. Mr. Katz focuses his practice primarily in the areas of complex, pharmaceutical mass tort, and class action litigation including consumer protection, securities fraud, products liability and commercial litigation. In addition to his varied professional experience, Mr. Katz is a frequent speaker on electronic discovery and pharmaceutical litigation. Additionally, Mr. Katz has spoken on New York state franchise law and class action litigation at the invitation of the Greater New York Automobile Dealers Association. Mr. Katz's current practice involves primarily complex and class action litigation on behalf of aggrieved consumers, corporate shareholders, and property owners, and pharmaceutical mass tort litigation on behalf of those injured as a result of their ingestion of prescription medications and the implantation of medical devices. Mr. Katz was one of the lead attorneys who prosecuted the In re Zyprexa Products Liability Litigation (MDL No. 1956) that resulted in a $700 million settlement, where he not only held a leadership role in conducting discovery but he also served as chair of the law and briefing committee. Mr. Katz is currently one of the co-chairs of the Discovery Committee in the YAZ/Yasmin (Drospirenone) Marketing, Sales Practices, and Products Liability Litigation (MDL 2100) pending in the Southern District of Illinois, before the Honorable David R. Herndon. Mr. Katz is also serving as on of the co-chairs of the Discovery Committee in the In re: Gadolinium Based Contrast Agent MDL (MDL 1909), pending in the Northern District of Ohio. Mr. Katz was appointed to the Plaintiffs' Steering Committee by Justice Helen Freedman for the ReNu with MoistureLoc litigation pending in New York State Supreme Court. Mr. Katz was also one of the lead attorneys prosecuting the In re Ortho Evra Products Liability Litigation (MDL 1742) on behalf of women who suffered serious adverse events as a result of the use of the Patch, where he held a leadership role in conducting discovery. At the 2006 AAJ Annual Convention in Seattle, Mr. Katz was elected as Co-Chair of the Ortho Evra AAJ Litigation Group. While Mr. Katz was at Seeger Weiss, he served as co-chair of the law and briefing committee in the In re Neurontin Marketing and Sales Practices Litigation (MDL No. 1629), pending before the Hon. Patti Saris, in the District of Massachusetts. Mr. Katz represents or has represented those injured by the DePuy ASR artificial hip, Gadolinium Based Contrast Agents, YAZ/Yasmin/Ocella birth control pill, Zimmer Durom Cup artificial hip, Vioxx, Zyprexa, the Ortho Evra birth control patch, Bausch & Lomb's ReNu with MoistureLoc contact lens solution, AMO's Complete Multi-Purpose contact lens solution, Zicam nasal gel, Bextra, Celebrex, Propulsid, Rezulin, Baycol, PPA, Ephedra, Trileptal and Guidant and Medtronic defibrillators as well as other drugs and devices. Mr. Katz was born in New York, New York. He obtained a Bachelor of Arts, with distinction, from the University of Michigan in 1990 and earned his law degree, cum laude, from Boston University School of Law in Peter J. ( Pete ) Flowers is Managing Partner of the firm Foote, Meyers, Mielke & Flowers of Chicago, Illinois. Mr. Flowers concentrates his practice to medical device and medical malpractice litigation, and throughout his career he has been a formidable advocate for victims of faulty medical devices and of medical negligence. On their behalf, he has won favorable verdicts and recovered multi-million dollar settlements. For much of the last five years, Mr. Flowers has been involved in litigation against Johnson and Johnson subsidiary, DePuy Spine concerning their defective Charite Artificial Disc. He represents over four hundred plaintiffs, many of whom have suffered serious complications and require corrective surgery. In this litigation, Mr. Flowers has deposed close to one hundred high and mid-level DePuy and Johnson and Johnson employees, distributors, and consultants. Mr. Flowers was the President of the Illinois Trial Lawyers Association from 2009 to 2010, and is currently active on the organization s Executive Committee. He has been named an Illinois Super Lawyer in the area of medical malpractice, and recognized as a Leading Lawyer in Illinois by his peers, a distinction earned by only 5% of the state s lawyers. He is a member of both the Million Dollar Advocate Forum for resolving many cases in excess of $1 million, and the elite Verdict Club society which includes top attorneys from around the United States.

3 9:45 Analysis of the DePuy Hip Implant Update on Causation and Design Defect Daniel Nigh handles primarily ATV and Depuy cases in the Mass Torts Litigation Department at Levin, Papantonio, Thomas, Mitchell, Rafferty & Proctor, PA. He has spoken at several conferences and coauthored a journal article regarding the Depuy ASR recall, the science behind the defect, and injuries/damages resulting from the defect. After graduating law school, Mr. Nigh devoted his work experience into gaining trial experience. He worked as an Assistant Public Defender for over a year and tried 10 jury trials, in addition, to numerous motion and VOP hearings. He followed up with working at GEICO as an attorney, handling primarily personal injury defense cases. He tried 5 jury trials during his 3 year tenure at GEICO. Mr. Nigh graduated from Stetson Law School cum laude in 2006, earning a Juris Doctorate Degree. While attending law school, he clerked at Brasfield, Fuller, Freeman & O Hern, a civil defense firm in Saint Petersburg, FL. Mr. Nigh graduated from Florida Southern College magna cum laude in 2003, earning a Bachelor of Science degree in Psychology, a minor in Business Administration and a minor equivalency in mathematics. While attending college, he worked as a claims examiner at Auto Owners Insurance and later as a summer management intern and sales/underwriting associate at GEICO. He received the Academic Merit Full Tuition and Board Scholarship to attend Florida Southern College. Herbert O. Phillips IV, MD, JD, was an orthopaedic surgeon for 13 years before entering the legal profession. Dr. Phillips focuses his law practice on complex medico-legal issues, medical malpractice, and medical device product liability. Dr. Phillips has served in a number of administrative and leadership roles in the medical and legal communities. As a physician, he served as Chief of Surgery (1995) at St. Joseph s Hospital in Asheville, Chairman of the Orthopaedic division ( ), St. Joseph s Hospital, and was Chief of Staff Elect (1992) at CJ Harris Hospital in Sylva, NC. Daniel K. Bryson A founding partner with the law firm of Lewis & Roberts, PLLC, Mr. Bryson is one of the nation's most respected and experienced attorneys in the areas of mass torts and class actions. 4 11:00 Client Injuries Pre and Post Implant Revision John Restaino, Jr., D.P.M., J.D., MPH (Epi), of the Restaino Law Firm, Denver, Colorado, practiced surgery of the foot and ankle from 1980 to 1990 and law since Dr. Restaino also has a MPH in Epidemiology form the Johns Hopkins School of Public Health. Mr. Goetz has prior experience defending medical device claims in the Orthopedic Bone Screw litigation (MDL No. 1014), as well as significant experience representing hundreds of heart device claimants in Guidant (MDL No. 1708), Medtronic I (MDL No. 1726), and Medtronic- Sprint Fidelis (MDL No. 1905).
