Purpose of this policy It is vital that in every school there is clarity and consistency about the school s role in relation to all drug matters. All schools should have a drugs policy. The purpose of developing a school drugs policy is to: clarify the legal requirements and responsibilities of the school reinforce and safeguard the health and safety of pupils and others who use the school clarify the school s approach to drugs for all staff, pupils, governors, parents/carers, external agencies and the wider community give guidance on developing, implementing and monitoring the drug education programme enable staff to manage drugs on school premises, and any related incidents that occur, with confidence and consistency, and in the best interests of those involved ensure that the response to incidents involving drugs complements the overall approach to drug education and the values and ethos of the school provide a basis for evaluating the effectiveness of the school drug education programme and the management of incidents involving illegal and other unauthorised drugs reinforce the role of the school in contributing to local and national strategies. ((DfES 2004: Drugs Guidance for Schools ) 2. Preface The principal reason for this policy is the well being and welfare of our pupils and the school community. We formed this policy involving staff, pupils, and parents so that each person understands their role and responsibilities with regard to drugs education at MEADOWBROOK COLLEGE. This document outlines our approach drugs education (see appendix 1). Within this document, the title Head Teacher refers to the Head Teacher or his nominated representative(s).

2 This policy reflects the shared values and aims of Our School, providing guidance to MEADOWBROOK COLLEGE staff; parents; and pupils. This policy links to and is informed by other MEADOWBROOK COLLEGE guidance and policies covering areas such as personal, social and health education; science; behaviour; assessment; child protection; equal opportunities; special educational needs; confidentiality; medicines; exclusion; health and safety and smoking. Our response to any drug-related incident is detailed in the MEADOWBROOK COLLEGE Managing Drugs Incidents Guidance (see appendix 2) 3 Rationale This policy assists our aim to further the well being of pupils at MEADOWBROOK COLLEGE. As drugs, including alcohol and tobacco are part of young people s lives we believe that it is right & proper to ensure the curriculum covers as much PSHE as possible. We are aware that: average first drug contact age is 12-13; drinkers outnumber non-drinkers by 13, and by 15 nearly all have tried alcohol; approximately 920,000 pupil live with excessive drinkers and 23% of child neglect cases via help line calls relate to alcohol abuse. (Note: Include most recent figures and key findings form our student drug use survey) 4 Our agreed definition of drugs A definition of a drug given by the United Nations Office on Drugs and Crimes is: A substance people take to change the way they feel, think or behave. The term drugs and drug education, unless otherwise stated, is used throughout this policy to refer to all drugs: All illegal drugs (those controlled by the Misuse of Drugs Act 1971). All legal drugs including alcohol, tobacco, volatile substances (those giving off a gas or vapour which can be inhaled) ketamine, khat and alkyl nitrites (known as poppers). All over the counter and prescription medicines. For more information about drugs, definitions and the law see appendix 3 4 Aims of this policy Whilst we acknowledge that the number of young people who use and misuse substances is rising, we recognise that a larger number of young people are choosing not to use or misuse substances. We aim to provide all MEADOWBROOK COLLEGE students with appropriate drugs education through a planned drug education curriculum as we seek to inform and educate students about the consequences of drug

3 use and misuse (see appendix 4). This document acknowledges and clarifies MEADOWBROOK COLLEGE s role in drug prevention and drug education and helps ensure a holistic approach appropriate to our students' needs. MEADOWBROOK COLLEGE provision incorporates knowledge and understanding, attitudes and personal and social skills that help students to lead fulfilled lives without the misuse of drugs. MEADOWBROOK COLLEGE drugs education provides accurate information about substances relevant to a pupil s age and maturity, is responsive to pupil needs and will develop a holistic awareness of drugs. This involves pupils developing; self-esteem, citizenship, decisionmaking skills, responsibility as well as drug & alcohol knowledge. We value drugs education as part of our holistic view to health education and it is thus a vital part of our whole approach and commitment to being a healthy PRU. At MEADOWBROOK COLLEGE substance education will therefore: enable students to make healthy, informed choices by increasing knowledge, exploring their own and other people's attitudes and developing and practising skills promote positive attitudes towards healthy lifestyles provide accurate information about drugs increase understanding about the implications and possible consequences of use and misuse encourage an understanding for those experiencing or likely to experience drugs use widen understanding about related health and social issues These aims are achieved through aspects of the pupil's experiences in the taught curriculum, the informal curriculum and through opportunities for extra-curricular activities. Whilst we deliver the taught curriculum mainly through PSHE, other opportunities to reinforce learning will occur in other parts of the teaching programme. An overview of MEADOWBROOK COLLEGE s drugs education coverage for each MEADOWBROOK COLLEGE Programme can be found in Appendix 4. MEADOWBROOK COLLEGE staff will be responsible for delivery of drug s education, but where appropriate, outside visitors may contribute to our drugs education. Outside contributors will be aware of the school s substance policy and any other policies relevant to it. 5 The National Perspective Our aim and approach (to help young people resist drug misuse in order to achieve their full potential) is in line with recent advice from the Department for Education & Skills including Drugs: Guidance for Schools (Feb 2004), Oxfordshire Healthy Schools Initiative and the advice of LEA/OCC Drugs Action Team.

4 6 Our Commitment to Health & Safety MEADOWBROOK COLLEGE is committed to health and safety and will take appropriate steps to safeguard the well being of students and staff against drugs misuse. We acknowledge the importance of our pastoral role in the welfare of our young people, and through our general ethos, will seek to educate all students and will facilitate support for those who need it. MEADOWBROOK COLLEGE sites will be checked to clear drug paraphernalia away if it is present, solvents and aerosols will be stored safely and pupil s use of solvents in lessons will be supervised. 7 MEADOWBROOK COLLEGE, Parents and Carers As a PRU we share responsibility for the education of our young people with parents and carers. Staff, parents and carers inform and involve each other through open and regular communication and co-operation to achieve the successful implementation of this policy. 8 Training for MEADOWBROOK COLLEGE Staff All staff have access to on-going support and training as part of their own professional development. Programme Mangers will ensure that appropriate training and support is available to new staff (including access to this policy) and that members of their team have access to drugs awareness training. Each Programme will have a minimum of one drugs awareness training session every year 9 LEA, The Police, School Nurse and other support MEADOWBROOK COLLEGE actively co-operates with other agencies such as the Police (Youth Affairs Officer), School Nurse, Health and Social Care, the Local Education Authority (LEA) and health and drug agencies, to deliver its commitment to drugs education. 10 Lead responsibilities Whilst the Head Teacher takes overall responsibility for this policy each Programme Manager will be responsible for its implementation within their Programme and the monitoring of its impact on students progress. 11 Drugs found or used on MEADOWBROOK COLLEGE sites, trips and off-site activities MEADOWBROOK COLLEGE believes that the possession and/or misuse of any drugs on any of our sites, trips or off-site activities is totally inappropriate and, in some cases, illegal. In all cases students will be asked to immediately give the substance to a member of staff (initially for safe keeping). Staff will deal with these drugs in line with the guidance contained in MEADOWBROOK COLLEGE Managing Drugs Incidents Guidance (see appendix 2).

5 Any failure to comply will be interpreted by staff as a serious breach of MEADOWBROOK COLLEGE s Behaviour Exceptions and dealt with accordingly (see MEADOWBROOK COLLEGE Behaviour and Exclusions Policies) In cases involving illegal or unauthorised drugs parents will be contacted and the police may be involved. A drugs incident monitoring form will be completed. Individual exceptions may be made for pupils who need to take prescribed medicines where appropriate, this is detailed in the school medicines policy. Where pupils need to take prescribed medicines this will be dealt with under the School Medicines Policy. 12 An overview of MEADOWBROOK COLLEGE s responses to incidents involving drugs If there are instances involving drugs use or supply on MEADOWBROOK COLLEGE sites, trips or off-site activities staff will follow the MEADOWBROOK COLLEGE Managing Drugs Incidents Guidance. As part of these, and following discussion between staff members who know pupils well, the Head Teacher (Programme Manager) will inform parents/carers at the earliest opportunity. We (staff and parents/carers) can then work together to support the young person involved. MEADOWBROOK COLLEGE will consider each drugs incident individually and recognises that a variety of responses may be necessary to deal with incidents. MEADOWBROOK COLLEGE will consider very carefully the implications of any action it may take. It seeks to balance the interests of the pupil involved, other students and the local community. Fixed term exclusion may be warranted and, when all other reasonable steps have been taken, it may be necessary to review the appropriateness of the student s current educational programme. This may result in the student receiving individual provision off-site. MEADOWBROOK COLLEGE Managing Drugs Incidents Guidance gives a detailed account of our responses and responsibilities (see appendix 2).. 14 Staff Welfare MEADOWBROOK COLLEGE will follow the OCC policy on drug and alcohol misuse for staff as part of its health and safety policy. This can be found in the alcohol section of the document XXXXXXXX. The OCC policy is designed to reduce to a minimum the possible effects of substance misuse on the user, other employees and the environment. TO BE CHECKED 15 Monitoring, Evaluation and Review Monitoring and evaluation of this policy & drugs education will be carried out in line with the school Assessment Policy. Evidence collected will include pupils Draw & Write examples & assessments made before blocks of work are began and those made following a block of

6 work. The review of this document will take place as identified at the top of the policy unless the School Development/Improvement Plan, school management or DfES (HMI or OFSTED) dictate otherwise. The Governors will review this policy every two years, assess its implementation and effectiveness and ensure the policy is promoted and implemented throughout the school. 16 Healthy Schools Standard What is the National Healthy School Standard? The National Healthy School Standard (formerly known as the National Healthy Schools Scheme) was proposed in the Green Paper 'Our Healthier Nation' in In this paper, the government identified the school as a setting to improve the health of pupil. In the government's view, a healthy school is in a key position to improve pupil's health and educational achievement, with the support of other agencies. We use the Healthy Schools Drugs component as a tool to audit our progress towards an ever-healthier MEADOWBROOK COLLEGE. 17 Pupil and Parent/Carer Support We aim to support students and parents/carers through high quality pastoral support centred around effective keyworker relationships. This support will be crucial in situations with drugs dimensions. Staff will make available information and details of local support agencies, telephone helplines and website addresses. Where appropriate specialist support from recognised agencies may also be offered to students and/or parents/carers., 18 Awareness of this policy MEADOWBROOK COLLEGE staff, parents/carers, and pupils will be made aware of the contents of this policy and how it affects the education we offer and the welfare of our community. New members of the MEADOWBROOK COLLEGE community will be made aware of the policy through the welcome pack/prospectus or a member of staff responsible for induction or co-ordination. Outside contributors will be aware of the school s substance policy and any other policies relevant to it. MEADOWBROOK COLLEGE Drugs Working Group

7 January 2014 MEADOWBROOK COLLEGE Drugs Policy: Appendix 2 Managing Drugs Incidents (For tobacco related incidents please see MEADOWBROOK COLLEGE guidance on dealing with smoking incidents) 1. Dealing with suspicions Student suspected of possessing illegal \unauthorised drugs and or alcohol and Student suspected of supplying illegal\unauthorised drugs (not for reward/gain) Students suspected of using illegal\unauthorised drugs Senior staff can search students or their possessions and can ask students to show that they do not have anything in their possession or on their person Can search MEADOWBROOK COLLEGE property but should ask student first Any discussion of suspicion with student should happen in an appropriate setting with two staff present. If more than one student is involved students should be interviewed separately Any outcome/action by staff should reflect the need to use discretion and judgement as they are dealing with suspicions not facts. If staff view is that it is probable a drugs /alcohol incident has occurred their actions should be guided by consideration of the severity and context of the incident. Action could include: - discussion and verbal warning (if student accepts responsibility and/or it is a first offence) - informing parent/carer - restriction of freedom at breaks etc. (on grounds of reducing risk of actual incident occurring) - 1 day fixed term exclusion/ rest of day educated at home (more serious incidents and/or repeat incidents) - Use Drugs Assessment Tool (attached) to assess need to refer on to specialist drugs worker/agency (suspected incidents involving class a or b drugs, or ongoing drugs issue for the student) - Consult with police (class a or b drugs, or ongoing drugs issue for student) - Review suspicions from Child Protection perspective (follow CP procedures if appropriate) Staff should use their own judgement to decide if incident warrants recording on a drugs incident monitoring form. If student accept In all cases students should be reminded that illegal drugs are illegal and are not ever acceptable on MEADOWBROOK COLLEGE sites or off-site activities. Guidance as for Student suspected of possessing illegal\unauthorised drugs above. Need to consider students health and safety requirements (intoxication). In incidents involving suspicion where behaviour is both uncharacteristic and judged to be unacceptable (for teaching)

8 refer to Students caught using and/or under the influence of illegal\unauthorised drugs below: 2. Dealing with incidents where students have been caught in the act Student caught in possession of illegal\unauthorised drugs Discussion of incident with student should happen in an appropriate setting with two staff present. In incidents involving suspicion where behaviour is both uncharacteristic and judged to be unacceptable (for teaching) refer to Students caught using and/or under the influence of illegal\unauthorised drugs below Class C drug, or any other unauthorised drug (except tobacco) first or isolated incident o 1 day fixed term exclusion (KS4 ) or rest of day educated at home (KS3) o Parent informed (FEx letter), invited to reintegration meeting and asked for commitment to enforcing MEADOWBROOK COLLEGE expectations regarding students brining or using illegal\unauthorised drugs at school. o Any small quantities of confiscated illegal drug to be disposed of (2 staff, flushing down toilet) Any confiscated unauthorised drugs to be returned to parents o Staff to complete an Incident Report Form, completing the type of behaviour as Drug Related. Class A and B drugs (or persistent Class C/unauthorised drug incidents) o Serious consideration of 5 day fixed term exclusion (KS4) or 5 day educated at home (KS3) Minimum 1 day fixed term exclusion (KS4) or rest of day educated at home (KS3) Nb any such exclusions to be handled as any other 5day FEx (see MEADOWBROOK COLLEGE Exclusion Policy). o Parent informed (FEx letter), invited to reintegration meeting and asked for commitment to enforcing MEADOWBROOK COLLEGE expectations regarding students brining or using illegal\unauthorised drugs at school. o Use Drugs Assessment Tool (attached) used to assess need to refer on to specialist drugs worker/agency

9 o Consult with police with a view to possible proceedings o Review incident from Child Protection perspective (follow CP procedures if appropriate) o Confiscated drugs to be placed in a sealed envelope and securely stored on site (Admin Manager) whist collection is arranged with Police o Staff to complet Incident Report Form, completing the type of behaviour as Drug Related.

Dealing with incidents where students have been caught in the act (continued) Student caught using, and/or under the influence of, Absolute priority is staff duty of care to secure student s health and safety (see attached guidance regarding medical emergencies) illegal\unauthorised drugs and Use MEADOWBROOK COLLEGE progressive intervention strategy to manage any or alcohol unacceptable/challenging behaviour (see Behaviour Policy) Parents should be asked to collect any student who is judged to be intoxicated on the basis of them being unfit for education. If parents are unable to collect student Staff could arrange to transport student home but only following satisfactory completion of a written risk assessment by the member of staff and a PM/APM. A second member of staff should accompany the student as an escort. The parent must be able to receive the student on arrival at home and staff should make every effort to ensure parent will be able to manage their child whist under the influence. Follow guidance for Student caught in possession of illegal\unauthorised drugs above Staff to complete a drugs incident monitoring form 3. 11 DRUGS SITUATIONS - MEDICAL EMERGENCIES The procedures for an emergency apply when a child or young person or others are at immediate risk of harm. A person who is unconscious, having trouble breathing, seriously confused or disorientated or who has taken a harmful toxic substance, should be responded to as an emergency. Your main responsibility is for any student at immediate risk, but you also need to ensure the well-being and safety of others. Put into practice your MEADOWBROOK COLLEGE's first aid procedures. IF IN ANY DOUBT, CALL MEDICAL HELP. ALWAYS: assess the situation if it is a medical emergency, send for medical help and an ambulance BEFORE ASSISTANCE ARRIVES: If the person is conscious: ask the person what has happened and to identify any drug used collect any drug sample and any vomit for medical analysis do not induce vomiting keep the person under observation, warm and quiet If the person is unconscious: ensure that the person can breathe and place in recovery position do not move the person if they have fallen, as a fall may have led to spinal or other serious injury which may not be obvious do not give anything by mouth do not attempt to make the person sit or stand do not leave the person unattended or in the charge of another student. WHEN MEDICAL HELP ARRIVES: pass on any available information and any vomit and drug samples. These other substances may raise common issues. 2.0 The Law on Drugs 2.1 It is an offence under the Misuse of Drugs Act 1971: To supply or offer to supply a controlled drug to another in contravention of the Act; To be in possession of, or to possess with the intent to supply another, a controlled drug in contravention of the Act; it is a defence to the offence of possession that, knowing or suspecting it to be a controlled drug, the accused took possession of it for the purpose of preventing another from committing or continuing to commit an offence and that as soon as possible after taking possession of it he/she took all such steps as were reasonably open to him/her to destroy the drug or to deliver it into the custody of a person lawfully entitled to take custody of it; For the occupier or someone concerned in the management of any premises knowingly to permit or suffer on those premises: the smoking of cannabis, or the production, attempted production, supply, attempted supply, or offering to supply any controlled drug. 13 MbC Drug and Alcohol Policy Jan 2013
