8 NEW JERSEY COMMERCIAL AUTOMOBILE INSURANCE PLAN PLAN OF OPERATION ARTICLE 1. PURPOSE AND SCOPE OF PLAN To provide an insurance market for persons who are neither eligible for the voluntary market nor qualify for NJPAIP. Good faith provisions Establishes a participation program to share premiums, losses, and expenses. ARTICLE 2. DEFINITIONS This rule provides all commonly used insurance terms and their definitions. ARTICLE 3. QUALIFICATION - Attempt, within 60 days prior to the date of application to secure coverage. New Jersey domiciled Licensed Person Private passenger auto cannot be only owned or leased by a natural person (except for public/livery auto). Utility type vehicles: pickup trucks, etc. Motorcycles, unless PAIP qualified Corporate owned vehicles, excluding farm family corporation or partnership. Leasing and sub-leasing issues Rates for vehicles garaged out of state- use the AlP rates for that state - Unqualified applicants If the principal or a regular operator fails to hold a drivers license valid in NJ. Exception - if the person is licensed out of state and can demonstrate they are employed by a named insured domiciled in NJ. If the applicant fails to meet all obligations to pay any Servicing carrier any auto insurance premium. If the applicant has already been cancelled by a Servicing Carrier as a result ofbeing declared UNQUALIFIED. If the reason for unqualificatioh has been satisfied, then the applicant may apply Rev. 10/22/07 4

9 - Hired Auto Coverage Hired Auto Coverage is a supplementary coverage only and should be written in the same policy that provides coverage for the insured's owned and or long term leased vehicles. If the insured's owned vehicles are insured in the voluntary market, Hired Auto is NOT AVAILABLE in the Plan. If the owned and or long term leased vehicles are insured in the Plan, Hired Auto IS AVAILABLE on the same policy. 10 ARTICLE 5A. PARTICIPATION PROVISIONS - Every insurer admitted to transact and transacting motor vehicle insurance in New Jersey shall participate in CAIP to the extent required by law, regulation, this Article, and the Plan of Operation. ARTICLE 58. GENERAL PROVISIONS ARTICLE 6. COST OF ADMINISTRATION This article discusses a minimum annual fee for CAIP subscribing companies. ARTICLE 7. EXTENT OF COVERAGE Bodily Injury LiabilitylProperty Damage LiabilitylUninsured Motorist and Underinsured Motorist Coverage - Hired Auto Coverage - When an ICC, PUC, or PSC filing, or any other similar state or federal regulated filing, or an MCS 90 endorsement is requested, the servicing carrier shall be required to include hired autos and nonowned auto liability coverage. The only split limits available in CAIP are for Snowmobiles and ATVs, both only able to obtain minimum 15/30/5 limits. Liability coverages are available in only Combined Single Limits, beginning at 35,000. Increased limits are available for 50, 100, 300, and 500 thousand. Federal, State or Municipal laws may require higher limits. These are available but may require evidence and will impose an effective date delay. (See Article 9) - Basic and additional PIP and medical payments coverages No fault coverages are available to only vehicles subject to the act. Unlimited and Limited Tort Threshold options - must complete both the application and the coverage selection form. Deductible medical expense options: $500, $1,000, $2,000 and $2,500 Additional PIP is not available for corporately owned vehicles. Motor bus passengers, except for New Jersey Transit - As required by law, medical expense coverage must be made available to motor bus passengers at a 250,000 limit per person. - Zero Tort Threshold option is not available for non-individuals Physical Damage Coverages ACV, subject to maximum loss payable amount of $60,000. Deductibles are limited to $500, $1,000, $1,500, and $2,000. Must have liability coverages (see out of state exception) Leinholder notice Rev. 10/22/07 6

11 Filings/certificates Hired autos Vehicle inspection requirements- requiredfor those CAlP risks that are eligible for physical damage coverage. Either CARCO or CGl Checkpoint may be used for inspections. Suspension of coverage- only allowable for risks without any financial responsibility filings, (DOT, PUC, SR) and then only for more than 30-day periods, and with the surrender oflicense plates. 12 ARTICLE 8. PREMIUM DEPOSIT REQUIREMENTS AND PAYMENT OPTIONS - Advanced Payment Option 40%-30%-30%: Fleets of5 or more, Vehicles State, or Federal requiringjilings. 6 pay- 30% deposit, and 5 monthly payments $4.00 servicefee with each payment. - Installment Option - NonclassifiedlRated Exposures - Guaranteed Funds Requirement At least 80% ofthe deposit must be a bank check, money order, or cashier's check. Ifany ofthe above modes ofpayment are made payable to the producer it can be endorsed to the CAIP. - Dishonored Checks Applicant's check - Servicing carrier reserves the right to require that future premium payments to the servicing carrier be made by certified check, bank check, money order, premium finance check, or producer's check when an applicant's/insured's payment has been justifiably dishonored by the financial institution. Producer's check - The Plan reserves the right to require that future premium payments to the servicing carrier be made by certified check, bank check, money order, premium finance check, or producer's check when an applicant's/insured's payment has been justifiably dishonored by the financial institution. - Deposit, installment, or Additional Premium Payments ARTICLE 9. APPLICATION FOR ASSIGNMENT, DESIGNATION OF SERVICING CARRIER, EVIDENCE OF INSURANCE, AND EFFECTIVE DATE OF COVERAGE - Application must be completed properly to avoid delays. - Added vehicles and physical damage coverages - 1 part ill card - original to the insured, photocopy to carrier, and photo copy for producer. - Ordering applications and temporary ill cards using the sample order form. - Temporary ID cards Original vehicles Added vehicles Replacement vehicles Renewal policies Other usage Rev

13 Physical damage coverage on additional or replacement vehicles General provisions - Application defects - Designation of Servicing Carrier - No producer shall bind a risk for CAIP or submit an application for insurance in CAIP if a known current valid voluntary market offer for coverage exists. 9.B.4. Private Passenger, Private Passenger Types, Trucks with a Gross Vehicle Weight (GVW) or Gross Combination Weight (GCW) of 20,000 Ibs. or less, Motorcycles, Recreational Trailers, Motor Homes, and Camper Bodies Only: (1) Applications must be mailed via certified mail, first class mail, or overnight delivery service within one calendar day of the insured's signature unless a later date is specified. (2) Immediate coverage, subject to specific conditions outlined under Article 9.A. (3) NOTE: BE SURE TO COMPLETE THE EVIDENCE OF INS1JRANCE AND EFFECTIVE DATE OF COVERAGE SECTION ON THE APPLICATION. SECTION 15 OF BLUE APPLICATION, SECTION 13 OF YEl,LOW APPLICATION. Added coverage - Prospective from date and time change request is completed providing the change request is sent within 1 working day, as confirmed by the postmark. Reduction or elimination of coverage - A request from the insured must be signed and dated. Deletion of vehicles - Proof of vehicle disposal should be submitted with the request for symbols B.5. Taxi, Limousine, Tow Truck, and Airport bus Applications and Caip Applications Requiring Filings orlimits in Excess of$500,000 Combined Single LimitCoverage: (1) Coverage becomes effective on the 17th day from the application completion date if mailed certified (return receipt) within 1 day, or later date of applicant's request or 15 days following the date assigned by the Plan if the 17 day provisions are not met. (2) Other provisions (3) Waiving the 17 day delay- - 9.B.6. For All Applicants Other than ThoseDefined in Article 9.B.4 and 5 (1) Applications must be mailed via certified mail or overnight delivery service. (2) Coverage becomes effective the day after the certified mail or day after the receipt of the application when mailed via overnight delivery. Added coverage - E,1fective date is the day after a certified mail, return receipt postmark, otherwise the day following the date received at the Plan. Ifthe request is to increase CSL above $500,000, a 17-day delay is imposed. Reduction or elimination of coverag;e - A request from the insured must be signed and dated. Rev

ARTICLE 10. ISSUA.~CE OF TEMPORARY IDENTIFICATION CARDS - Temporary Identification Cards (1) Original copy given to applicant (2) 2 nd copy submitted with application (3) 3 rd copy retained by the producer of record - Replacement cards - Issue cards for additional vehicles, replacement vehicles, renewal policies, and lost/stolen ARTICLE 12. RATES NOTE: Effective September 1, 2004, the reference to "Employers Nonownership" has been deleted and replaced by "Nonowned Auto coverage" - Private passenger autos use PAIP rates (Rule 30) - Out of State Garaged Vehicles registered in NJ Vehicles are subject to rates of state of principal garaging - AIP of the state of Principal garaging does not provide physical damage coverage? Such risk is subject to whichever of the following produce the higher dollar amolillt: Rates applicable to NJ territory determined by address on registration, and otherwise subject to all provision of the plan or Rules, rates, minimum premiums, classifications in force, rating plans, and territory where vehicle is principally garaged, and otherwise subject to all provisions of plan. - Surcharge for Extra Hazardous risks This is subject to AIPSO approval of the surcharge and amount, plus notice to the Insurance Department. ARTICLE 15. CANCELLATIONS Insured Request Cancellations The minimum earned premium is $100. Return premiums are calculated on a short rate basis, or at 90% of prorata amount, less any outstanding amount due. The following cancellation return premiums are calculated on a prorata basis: Reapplication occurs within 30 days, The auto is repossessed, Other vehicles remain in force, Rev /07 10

15 - Insurer Termination - Military service, - Stolen or constructive total loss with cancellation requested within 30 days after the loss, Evidence that coverage is replaced in the voluntary market. Non-payment of premium. Suspended/revoked license. Reasons that allow the servicing carrier to cancel within the first 120 days ofthe policy. (See Article. 15.B.2) Required appeal statement. (See Article. 16) Such cancellations are calculated on a prorate basis, at a minimum of $100 premium per policy, with required evidence of mailing. - Cancellation of coverage of NJ Standard Personal Automobile Insurance Plan policy is cancelled in accordance with New Jersey Personal Automobile Insurance Plan manual. ARTICLE 16. RIGHT OF APPEAL - Appeals subcommittee. - Criteria for submitting an appeal. - Requirements for a stay of cancellation. ARTICLE 17. RE-QUALIFICATION - Time and Compliance Requirements to resubmit application for coverage. The A/PSO edit system will reassign a CA/P applicant to her/his fonner servicing carrier which may deny the risk for eligibility characteristics to which the risk was previously denied. This may involve premium and audit data, safety consideration, etc. - Prior CAIP payment obligations - (owed money) - Prior CAIP non-compliance (underwriting) - Prior CAIP ineligible cancellation ARTICLE 18. PRODUCER COMPENSATION - 5% is paid for truckers operating beyond a 50-mile radius, and public autos other than school buses. 10% is paid for all other risks. - No commission is paid for ineligible risks, regardless of coverage provided. No commission is paid to a producer who is not certified. **Commission is fully earned when the policy is canceled for non-payment**. Rev /07 11

16 ARTICLE 19. INDEMNIFICATION This refers to Committee, Panel and Subcommittee representatives, and servicing carriers. ARTICLE 20. AMENDMENT OF THE PLAN OF OPER4TION ARTICLE 21. CHANGE OF OWNERSHIP/TRANSFER OF LOSS EXPERIENCE All exposures of commonly owned entities that are insured in CAIP shall be written on the same policy and combined for rating purposes. Ownership Combination of entities - Reapplication to the Plan Name and/or Ownership Change Form ARTICLE 22. FINANCIAL RESPONSIBILITY SERVICING CARRIERS - The Governing Committee may appoint financial responsibility servicing companies that will be authorized to make PUC filings on behalf of an insured who requires such filings and whose voluntary market insurer cannot make such filings in a given state. ARTICLE 23. DUTIES OF SERVICING CARRIERS, PRODUCERS & INSUREDS All parties must comply with regulations and statutes promulgated by the Department of Banking and Insurance and enacted by the State of New Jersey. - Any question may be presented to the CAIP office in Mount Laurel. The Plan telephone number for CAIP questions is , extension 5. ARTICLE 24. SPECIAL INVESTIGATIONS UNIT -All producers are obligated to cooperate with the Special Investigations Unit. ARTICLE 30. 17 ARTICLE 31. REVIEW OF PRODUCER PERFORMANCE - Article 32. of the PAlP and CAIP Plan of Operations sets forth the specific requirements that certified producers must follow. ARTICLE 31A. RECIPROCAL PROCEDURE FOR PRODUCER PERFORMANCE - In the event a producer's certification is revoked, suspended, or conditioned in the New Jersey Commercial Automobile Insurance Plan (NJCAIP), the producer's certification will automatically be revoked, suspended, or conditioned in the New Jersey Personal Automobile Insurance Plan (N1PAIP). ARTICLE 32. PERFORl\,IANCE STAl'JDARDS FOR PRODUCERS \VRITING NE\V JERSEY COMMERCIAL AUTOMOBILE INSURANCE PLAN RISKS - This Article lists the requirements to which CAIP producers must adhere. - Just as you have the right to complain about servicing carriers they have an equal duty to issue a complaint if you do not perform in accordance with these requirements. - You should review the producer performance complaint form and deficiencies in the handout. If you feel that any deficiency or complaint levied against you is invalid, you should immediately respond. Failure to respond will mean that it is considered a valid infraction. Reply to the Plan on the complaint form as required. For deficiency disputes, you can call the Plan's Customer Service and they will research the matter. - There are various steps in which poor producers progress after exceeding their normal allotted complaints, also referred to as Producer Complaint Norms. Each step is designed to assist the producer through corrective action. ARTICLE 40. PERFORMANCE STANDARDS FOR SERVICING CARRIERS This section lists both efficiency and quality requirements for servicing carriers. You should file a complaint if they fail to properly perform their obligations. A sample of the complaint form is provided in the handouts. Copies will be provided with each supply order. - If a servicing carrier does not provide a toll free number for your use, and they have violated Plan rules, you may call them collect. But you should be prepared to indicate the specific violation and manual section should such information be required when a collect call is accepted. - Motor carrier filings must be made within 3 days of receipt of the application, or by the coverage effective date for 15/17 day delayed applications. Renewals may be paid in full or via the installment option as billed, as communicated to the insured and producer by each servicing carrier. * Payment to the producer shall be payment to the company. Payment must he mailed the next working day. However, it is the producer's responsibility to maintain records to demonstrate when the payment was received and remitted to the servicing carrier the next working day*. MID-TERM PRODUCER CHANGE A substitute producer may be designated by the applicant or insured at any time and, upon designation, shall be the producer of record. All commissions will go to the original producer for the remainder of the policy period. Likewise, the original producer will be responsible for all return commission. The notice of agency acquisition/transfer/merger form shall be used to change the producer of record when an agency assumes control of another's book of business. This form shall be photocopied, properly completed, and submitted to the Plan and all assigned carriers to which an insured affected by this change of producer has been assigned. Rev. 01/01/1] 14

INCREASED LIMITS Optional Limits vs. Limits Required by Law Various limits available NOTE: The New Jersey department of Banking and Insurance approved factors for $250,000 combined single limit liability coverage required by law in order to comply with regulations set forth by the New Jersey Motor Vehicle Commission; effective May 1, 2006 for new business and June 15,2006 for renewal policies. 22 RULE 18. EXPERIENCE RATING PLAN Experience rating is mandatory for all risks meeting the qualifications set forth in this Rule, provided the experience, as defined in the Rule, is available. The experience period is three years ending at least six months prior to effective date. Surcharges are not assessed under Article12 but rather a factor based on a percentage of paid premiurnllosses. Effective September 1, 2004, the reference to "Employers Nonownership liability" has been changed to "Non-owned auto liability". Experience to be used by a Servicing Carrier. RULE 19.
