R. BANKR. P COMES NOW, ROY KRONK ( Roy ), a creditor and party-in-interest, by and through his undersigned counsel, and hereby moves pursuant to Fed. R. Bankr. P for an order directing the examination of the Debtor, Casey Marie Anthony (the Debtor ), and states in support thereof the following: Petition ). 1. On January 25, 2013, the Debtor filed a Chapter 7 Voluntary Petition (the 2. At the time of the filing of the Petition, Roy had an action pending in state court against Casey Marie Anthony; Roy Kronk v. Casey Anthony, Orange County Circuit Court, Case No CA O. 3. The Debtor listed Roy as an unsecured creditor on her schedules filed herein (Dkt. 1), and listed the claim as a defamation claim that is contingent, unliquidated and disputed. 4. Roy believes that his claim against the Debtor is an exception to discharge pursuant to 11 U.S.C. 523(a)(6). 5. Furthermore, upon information and belief, it appears that there may be misstatements on the Debtor s schedules regarding her income, living expenses, and assets v2

P to examine the Debtor regarding her schedules and statements filed herein, including but not limited to her assets, income and expenses, and his scheduled claim, with such examination to take place at a mutually convenient date, time and location. 7. Fed. R. Bankr. P. 2004(b) states that the examination of the Debtor may relate only to acts, conduct, or property or to the liabilities and financial condition of the debtor, or to any matter which may affect the administration of the debtor s estate, or to the debtor s right to a discharge. WHEREFORE, Roy Kronk respectfully requests that this Court enter an Order (a) directing the examination by Movant of the Debtor, Casey Marie Anthony, pursuant to Fed. R. Bankr. P. 2004, at a date, time and location that is mutually convenient for the parties; and (b) for such other and further relief as this Court deems just and appropriate.
