10 The Investor-User-Dilemma The present situation is an obstacle for contracting in existing rental housing: The landlord may (unlike situations in which the owner s own system produce the heat) charge the tenants for costs of commercial heat delivery (i.e. for heating and domestic hot water) only if: only if only if The rental agreement specifically stipulates such charging (i.e. identical arrangements in all rental agreements of ones property), or All individual tenants agree to a modification of the rental agreement 09. 11 The Investor-User-Dilemma Consequence: One single tenant can prevent energy modernisation of rental real estate comprings 10 or more tenants. Energy efficiency investments are therefore unfeasible: They would burden the tenants with excessive energy costs. The real estate of the landlord loses attractiveness. Solution: Adaptation of the German Civil Code (BGB): The transition to commercial heat delivery by contracting must be uniformely enabled. ESCO Forum s proposal: New fixed heat-supply costs may not exceed previous heat costs by no more than 10 % 09. November Folie 10
