1 JEM Establishing identity during a disaster: The Emergency Management Assistance Compact and the First Responder Authentication Credential Jillian A. Williams, JD Aileen B. Xenakis, JD ABSTRACT As emergencies consistently overwhelm the resources of the jurisdictions they affect, the emergency management community responds with legislation enacting programs to send aid more efficiently, including the Emergency Management Assistance Compact (EMAC). Correspondingly, emergency management technology develops to meet the field s evolving needs. The Office of the National Capital Region Coordination (ONCRC) finds that the technology behind First Responder Authentication Credentials, or FRAC cards, will supplement the EMAC program by providing the trust framework that will enable identity and typing to be electronically verified to one individual issued from an authoritative source. It puts into practice trust but verify with verification being enabled electronically and provides a trust framework that assures the incident scene commander that a visiting first responder is who he says he is and is certified to perform the tasks that he has been assigned. In the chaos that accompanies such disasters, there is a latent threat of doing more harm by admitting unauthenticated people to an already vulnerable asset or scene; in an effort to protect against further harm, capable and available assisting responders are often prevented from actually helping. The FRAC program is the next stage in the emergency management field s development of more efficient response mechanisms. In essence, FRAC picks up where EMAC left off: it provides a credential with photo and biometric identification that accesses computer data confirming the visiting first responder s attributes and skill sets. It allows on-scene security to confirm a visiting first responder s identity and credentials. Necessity is the mother of invention, and the FRAC program meets the current need for electronic verification of identity and skills, while simultaneously allowing for greater accountability on the scene of a disaster. The FRAC technology will be a critical element in reaching the next level of success in emergency response. It should fit seamlessly into the programs that have already yielded positive results and should help first responders to be more effective and efficient. Key words: technology, FRAC, authentication, credential, security INTRODUCTION Recent emergencies have overwhelmed the resources of the jurisdictions they affect, and as they present an increasing need for external assistance, the emergency management community has responded by developing more efficient and more effective ways to address these calls for help. For first responders and volunteers from the local area as well as jurisdictions across the country to assist a jurisdiction affected by disaster, they must be authorized to gain access to, and move within, the emergency scene. That authorization should be based on authentication criteria consistent with federal E-Authentication standards, which will provide very high confidence of an asserted identity and its typing category. This provides the trust framework that will enable identity and typing to be electronically verified to one individual issued from an authoritative source. It puts into practice trust but verify with verification being enabled electronically and provides a trust framework that assures the incident scene commander that a visiting first responder is who he says he is, and is certified to perform the tasks which he has been assigned. 11

The Emergency Management Assistance Compact (EMAC) made great strides toward addressing the need for organization and validation when unaffected states send help to disaster areas. EMAC allows a state affected by a Governor-declared emergency to place specific requests for aid, so that unaffected jurisdictions know exactly what is needed, what to send, and how to help. As the Office of National Capital Region Coordination (NCRC) finds, the First Responder Authentication Credential (FRAC) program is the next stage in the Emergency Management field s development of more efficient response mechanisms. In essence, FRAC picks up where EMAC left off: it provides a credential with photo and biometric identification that accesses computer data confirming the visiting first responder s attributes and skill sets. It allows on-scene security to confirm a visiting first responder s identity and credentials. EMERGENCY MANAGEMENT ASSISTANCE COMPACT The current structure for disaster-affected jurisdictions to receive assistance from other states is governed by the EMAC, Public Law Established in 1996, EMAC provides a framework for states and the Federal government to send and receive aid during Governor-declared emergencies; essentially, when an affected jurisdiction s resources are overwhelmed, EMAC allows its members to share resources more efficiently, access other States equipment and personnel more readily, and respond more effectively with these bolstered resources (both human and otherwise). EMAC is a predetermined program that outlines liability, responsibility, and financial guidelines so that these complex issues do not need to be addressed in the throes of an event. All 50 States and several territories have joined EMAC. 1 When members experience an event natural or man-made that meets the conditions set by EMAC, the compact itself becomes a binding contract. To meet the EMAC conditions, an emergency has to prompt the Governor to declare a State of Emergency. 2 Once that happens, the affected State s authorized EMAC representative has the power to notify the EMAC National Coordinating Group (NCG) and make an official request for A-Team deployment. 2 The A Team assists the State in crisis by identifying what resources are needed or depleted, identifying the costs and availability of such resources, and issuing an EMAC broadcast to communicate the affected State s needs. 2 Once the States (the affected State and the State rendering aid) agree on the costs, resources are sent; after the disaster has been been abated, the aid-rendering State may submit invoices for reimbursement. 2 Because EMAC provides an established agreement that the State requesting aid will shoulder the financial responsibility of reimbursing the assisting States, aid-rendering States can respond more quickly. This alleviates those responding States of financial burdens they would otherwise incur by deploying their employees in a disaster. When States have a written guarantee of reimbursement before any disaster occurs, it means they can more willingly and more quickly respond, without having to research conflicting State fiscal policies. Additionally, EMAC procedures are clear and finite, which saves even more time the alternative is researching and navigating bureaucratic requirements, wasting critical time that could be spent assisting in an emergency. OFFICE OF NATIONAL CAPITAL REGION COORDINATION FIRST RESPONDER AUTHENTICATION CREDENTIAL On August 27, 2004, President Bush released the Homeland Security Presidential Directive 12 (HSPD-12) requiring that each Federal agency develop a policy for a common identification standard for federal employees and contractors. 3 This standard was to include secure forms of electronic identification that would provide a safe way to identify federal workers as well as be interoperable between all federal agencies. As defined by HSPD-12, a secure and reliable form of identification is one that (a) is issued based on sound criteria for verifying an individual employee s identity; (b) is strongly resistant to identity fraud, 12

3 tampering, counterfeiting, and terrorist exploitation; (c) can be rapidly authenticated electronically; and (d) is issued only by providers whose reliability has been 3(para 3) established by an official accreditation process. After HSPD-12 was issued, the National Institute of Standards and Technology (NIST) released Federal Information Processing Standards Publication (FIPS) 201, Personal Identity Verification (PIV) of Federal Employees and Contractors. 4 This document served to establish administrative and security guidelines for the issuance of PIV credentials. The document outlined the minimum requirements for a Federal PIV system that would meet the requirements set out by HSPD-12, as well as outlining the specifications that would support interoperable systems between Federal departments and agencies. To bolster protections against terrorism and further interoperability between State and Federal disaster response, the Federal Emergency Management Agency (FEMA) NCRC leveraged the technical standards developed for the Federal PIV standards to develop the FRAC Initiative. The NCRC used the Federal PIV standards to develop a smart identity credential system that could be used for Federal, State, and local emergency responders. The FRAC is an identification credential with a digital chip that allows for fast, secure electronic validation even during times where there is a lack or destruction of power and communication capability. All Federal agencies of the Executive Branch of the Federal Government are in the process of issuing PIV credentials to all employees and contractors for eventual routine use as the authentication token to be granted authorization to Federal facilities and networks. This implementation has been leveraged so that the identity token used by the Federal force for routine everyday use is the same identity token that is used on the day for emergency access use for the Federal/Emergency Response Officials nation-wide. Those outside the Federal government can now be interoperable with and trusted by their Federal partners by collaborating on the use of the same standards for their emergency response officials. Because all issuers adhere to a standard set of security requirements for the electronic validation and acceptance of the FRAC (which is termed PIV interoperable), the credential can establish a common chain of trust among jurisdictions, command personnel, and responders. 5 These smart credentials would provide the necessary security at an incident scene while at the same time allowing for multijurisdictional response. The FRAC would enable first responders to carry an electronically verifiable credential that would allow emergency officials to electronically validate that they (1) are who they say they are and (2) have the typing skills and attributes they claim to have. This information adds a necessary level of security to incident scenes; it also allows officials to deploy first responders to different parts of the response scene based on where their skills would be most effective and efficient. The ability to align the first responder more closely with the actual need allows for a more streamlined approach to incident management. In addition, the credential will allow for digital irrefutable evidence of those who responded to the scene, both for postevent reconstruction and for improving response in future disaster events. The NCRC established this initiative as a remedy to access problems, such as those encountered by state and local emergency officials responding to the 9/11 attack on the Pentagon. 6 It was reported that during the response to 9/11, multiple attempts to enter the scene were made by people posing as firefighters or police officers. The Arlington County 9/11 After Action Report stated, Some firefighters said they had never seen so many volunteers, and wondered aloud if a volunteer firefighter tee shirt was the only required identification. 7 This problem is not unique to 9/11. As stated by Marko Bourne, Director of Policy and Program Analysis for FEMA, Examples of people posing as firefighters, police officers, doctors or rescue specialists are well documented in every major disaster, and underscore the need for further measures to provide the Incident Commander with greater assurance that those who respond, whether asked or not, can be verified, validated and utilized. 8 In fact, during the response to 9/11, the problem of incident scene management was not only one of keeping unwanted people out of the scene, but it was also a question of getting necessary people through the different jurisdictional boundaries. Lamar Jones, 13

4 Director of Antiterrorism for the Pentagon Force Protection Agency (PFPA), was prevented from entering several road blocks set up by different State and local jurisdictions even though he was holding a Pentagon identification badge. He was forced to go through as many as 13 different jurisdictions before he was finally able to gain access to the Pentagon. 9 This example demonstrates the necessity for a credentialing system that can be used effectively by Federal, state, and local first responders, both to identify the credential holder as well as to detail the individual s skills. As Bourne acknowledged, The implementation of a credentialing and typing system using common, non-proprietary standards will support and facilitate intrastate and interstate initiatives, and have the further benefit of addressing issues of selfdispatching personnel and scene control. 8(p6) In addition to the improved approach to incident management, the credential also fills a need observed in the response to 9/11 in that it allows for tracking capabilities not currently available for first responders. The credentialing technology provides a real-time roster allowing for accountability, traceability and liability. If this technology had been in place during the 9/11 response, it would have been possible to track better which first responders were on the scene, when they arrived, when they left and even the section of the scene where they were. As stated by the Smart Card Alliance white paper, Emergency Response Official Credentials: An Approach to Attaining Trust in Credentials across Multiple Jurisdictions for Disaster Response and Recovery, a key benefit of having an emergency response official credential is the provision of records for personnel who respond to an incident for post-event reconstruction and liability issue assessment. 5(p8) USE OF FRAC CREDENTIALS BY VOLUNTEERS RESPONDING TO AN EMAC REQUEST Increased issuance of FRACs can address an often overlooked issue: the need for volunteers responding to an EMAC request to be treated as agents of the requesting state for liability purposes. As mentioned earlier, while EMAC allows agents of a state responding to an EMAC request to be treated as an agent of the requesting state for tort liability protection and immunity, this advantage is not extended to volunteers. Under EMAC, no party state or its officers or employees rendering aid in another state pursuant to this compact shall be liable on account of any act or omission in good faith. 10 Although this act makes it clear that only state parties may receive liability protection, it may be hypothesized that one reason for this clause is the inability to adequately authenticate a volunteers capabilities and qualifications. This problem can be addressed by the FRAC s ability to electronically list the attributes and skills of a volunteer at the scene ensuring that the volunteer is who he or she claims to be and has the qualifications he or she claims to have. One of the building blocks recently implemented by the FRAC program is the standardization of the definitions of medical first responders. After working with the Department of Health and Human Services (HHS), definitions of the most common and most important medical first responders were developed. These definitions established a minimum set of requirements that the first responder must have to be categorized under a certain category. Although the responder may have qualifications exceeding the minimum requirements, the definition allows for trust across multiple jurisdictions. This standardization gives an incident scene commander in Georgia the knowledge that the Georgian pediatric nurse has the same minimum qualifications and licenses as the pediatric nurse from Florida who is responding to an EMAC request. This element of the FRAC initiative provides another layer of trust for incident scene commanders in an emergency. With this trust model in place, the state requesting EMAC resources can provide a broader net of liability protection with the knowledge that the responding volunteers do have the necessary skills and knowledge to help the affected population responsibly. Another factor that states can consider when deciding to lend liability protection to credentialed volunteers responding to an EMAC request is the security protocol in place. The current security model in place for FRAC issuance requires a volunteer requesting a FRAC credential to be nominated by a valid agency or organization. After running a basic background check on the volunteer, or verification that the nominating agency has conducted the check, the issuer would then require proof of licensure and identity. Once 14

5 a volunteer has gone through this process and received a FRAC, a requesting state can validate the credential and know that the volunteer is who s/he claims to be, and has the qualifications s/he claims to have. Currently, one way of tracking responding volunteers is the state-based Emergency System for the Advance Registration of Volunteer Health Professionals (ESAR-VHP). This national program was developed after problems occurred in several mass casualty events where hospital administrators were unable to use health professionals because they could not verify their medical or other credentials. Administrators were unable to confirm volunteer physicians identities or basic licensing or credentialing information, including training, skills, competencies, and employment. 11 A state-based registry was developed where medical volunteers enroll, have their credentials (qualifications) verified, and are assigned to a volunteering mobilization area in time of a disaster. While this system is a strong step toward ensuring that medical volunteers can help effectively, the Los Angeles County ESAR-VHP reports that although a volunteer has been pre-credentialed prior to an assignment, it is up to the hospital, clinic, or the site where you are being assigned to privilege you and decide exactly what you will be doing, where you will be assigned, and [to whom] you will report. 12 Using the FRAC in this type of situation will make the process much easier as well as add a level of security and tracking capability not currently present. With the ability to view a volunteer s attributes, incident scene commanders will be able to validate electronically that the volunteer is, for example, properly licensed as a pediatric nurse, and it would allow incident commanders to channel that person into an area of the scene where a pediatric nurse could do the most good. Emergency officials would also be able to track when that nurse was given access to the scene, in which area of the scene s/he is stationed, the number of pediatric nurses currently in that area of the scene, and the time that specific pediatric nurse leaves the scene. CONCLUSIONS By meeting the current needs for electronic verification of identity and attributes/skill sets, and by allowing for greater accountability on the scene of a disaster, FRAC fills several remaining gaps where EMAC does not quite reach far enough. As emergency management develops and lessons learned are shared, technology will play an increasingly important role in creating new best practices. The FRAC technology will be a critical element in reaching the next level of success in emergency response. It should fit seamlessly into the programs that have already yielded positive results, and should help first responders to be more effective and efficient. Jillian A.
