Among such inconceivable victories was the recent one involving a woman seeking divorce in a long-term marriage, following six years of separation. She sold a medical testing company formed early in marriage, for tens of millions of dollars. Her estranged husband believed he was more than entitled to share in her good fortune. Mr. Lewis and team thought a more equitable outcome was deserved and looked to make it happen. Through trademark digging and use of discovery, they developed a solid but unprecedented legal argument. As ever, the firm relentlessly worked to try and avoid their client becoming yet another individual unfairly losing fruits of hard work to an undeserving spouse. With little prior law on point, they went about finding a basis to create precedent, developing their case based on laws rarely invoked and less frequently sustained in court. First turning all stones and then weaving law and fact together, Lewis and colleague Donta e Bugg presented an undeniably powerful case before a highly respected jurist. The court granted their novel pre-trial motion, finding that the law authorized and equity compelled his decision to rewind the company s value back to the time of separation. No question, legally and equitably, this was the right ruling, Lewis comments. Still, we are always grateful when a court shows fortitude and takes time to carefully consider such a pre-trial motion. Lewis mostly hoped such ruling might impel settlement, thereby sparing his client the time and emotion of a trial. Fortunately, Lewis opponent also grasped the wisdom and power of the court s decision. Having once demanded many millions of dollars, the client s husband settled just before the trial began, walking away with a small fraction of what he was asking and, smiles Mr. Lewis, exactly what he deserved. Their client has not stopped thanking Lewis, Bugg and team. She wears an increasingly confident smile borne of personal vindication. Beyond preserving a fortune for her own benefit, she has done so for her children, grandchildren, charities and beyond. Moreover, she achieved something else, once seemingly unattainable. The process permitted her to reclaim the dignity stolen by her abusive husband. While repelling this long-term tormenter, she restored her personal narrative, re-establishing true validity in every sense: as a person, spouse, parent, remarkable entrepreneur and successful businesswoman. Even after separation, her husband had stalked her from afar, persistently working to bring her down and undermine her success. Her pain is ended; with this success, thwarting this last effort to score at her expense, she has gained a palpable, growing sense of peace and worth. METHODOLOGY This list is excerpted from the 2010 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published for more than a quarter of a century, Best Lawyers lists attorneys in 79 specialties, representing all 50 states and the District of Columbia, who have been chosen through an exhaustive survey in which thousands of the nation s top lawyers confidentially evaluate their professional peers. The 2010 edition of Best Lawyers, which was published in November 2009, is based on more than 2.8 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 26 years ago. Lawyers are chosen for inclusion based solely on a vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2010 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Voting lawyers were provided this general guideline for determining if a nominee should be listed: If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them? All votes and comments were solicited with a guarantee of confidentiality a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer s inclusion is based on the subjective judgments of his or her fellow attorneys. 7 2010 Survey Results COVER SPOTLIGHT Washington DC City Bus Accidents Compel Better Safety Procedures Patrick Regan s Battle to Help Injured Families O n Valentine s Day 2007, two close friends who worked together at the Federal Trade Commission in DC had just finished their workday and were crossing Pennsylvania Avenue when they were hit and killed by a Metrobus as it turned the corner and struck them in the crosswalk. The horrific accident was caught on a security video atop the National Archives Building. The families of the two women filed multi-million-dollar lawsuits, alleging that the driver was negligent when he turned the bus without keeping lookout. The cases, which shone a spotlight on bus driver safety, were resolved last year with a $2.9 million settlement to the family of Sally D. McGhee, and $2.3 million to the family of Martha Schoenborn. More importantly, the tragedies compelled the bus company to institute a series of procedures and policies to improve driver safety, notes Patrick M. Regan of DC s Regan Zambri & Long, who represented the McGhee family. As a result of the accident, the company issued a safety bulletin to bus drivers urging them to employ more caution with pedestrians. Company managers also met one-on-one and in small groups with each of its 2,400 bus drivers to discuss pedestrian safety. In addition, it announced that it would institute a safe driving refresher course for all of its 2,400 drivers, modeled on a similar program in California. But, in Regan s opinion, the company has more work to do in the area of driver safety. He was recently retained in connection to an accident in which a pedestrian was hit and critically injured by another Metro bus driver, who was subsequently fired by the company for failing to follow standard operating procedure, according to a Metro statement. The driver had a past history that included two other on-the-job accidents in seven years, as well as five traffic tickets in one month last year, according to court records described in a report by The Washington Post. In the McGhee case, Regan, represented McGhee s adult brother and sister, co-executors of her estate. Their lawsuit alleged that the bus driver drove I n Regan s opinion, the company h a s m o r e w o r k to d o in t h e a r e a o f d r i v e r safety. recklessly and without appropriate caution when he struck the two women, who were properly obeying traffic signals. (A third lawsuit against Metro was filed around the same time for another fatal accident by a bus against a pedestrian.) In 2007, when the suits were filed, Metro spokesperson Lisa Farbstein told The Washington Times, They were very tragic accidents and our hearts go out to the surviving families. She also noted that the drivers had been dismissed from the company. The driver who struck the two women, pleaded guilty to two counts of negligent homicide and was sentenced in DC Superior Court to a year in jail. According to federal prosecutors at his sentencing, the accident resulted from his failure to watch where he was headed before turning onto Pennsylvania Avenue and striking the two women in the crosswalk. Although the McGhee case was one of several filed around the same time against Metro drivers, it would be no slam-dunk in a trial, according to Regan. It was essential to prove, should the case go to a jury, that the two women had not been careless in crossing the street. From the liability side, the most difficult part of the case was locating the security video that proved to be a critical piece of evidence, Regan says. Although the police had obtained one video from a nearby building, it did not provide a clear-enough view of the accident and was of limited value. Regan s private investigator worked hard to find an alternative video that made all the difference in moving the case to settlement, by clearly showing the women did not contribute to the accident. The case faced another hurdle. The statute related to wrongful death in DC is one of the most conservative in the country, stringently limiting the amounts that can be recovered. The bus company argued that McGhee died immediately, and thus she suffered no significant pain and suffering, which in turn would mean little or no monetary damages. But Regan s investigative team located a witness who was the first person to arrive on the scene. He said that McGhee was in serious pain and suffered significantly in the five minutes following the accident, and then died. Regan is currently part of the legal team which is representing, pro bono, the estate of murdered DC lawyer Robert Wone in a $20 million wrongful death lawsuit against three men they say killed Wone. 8 Baltimore & Washington DC s Best Lawyers For more info go to

12 Baltimore & Washington DC s Best L a w y e r s I exceptional case The King of DC Medical Malpractice Tells All Jack Olender on How Medical Malpractice Suits Help Spur Changes In Medical Procedures n the popular eye, medical malpractice lawsuits are often viewed as a scourge on society, driving up health care costs and forcing doctors to practice defensive medicine. But, in fact, many of the most significant improvements in health care and hospital procedures are the result of medical malpractice lawsuits. For that reason, there is a silver lining to medical malpractice litigation for the defendants, says Jack Olender, who has numerous examples from his own career spanning half a century as a medical malpractice attorney in DC. Many hospitals and HMOs have instituted changes in policies and procedures brought to light by lawsuits, thus preventing future injuries and deaths, Olender notes. Since the vast majority of healthcare workers are very devoted to best practices and genuinely seek to provide top-notch care, he finds that many hospitals, physicians, and other health care workers and institutions are eager to find ways to improve patient care and avoid mistakes. Take, for example, one of Olender s latest cases, which has resulted in a hospital changing its paging procedures for responding to emergencies. A woman in the care of the hospital had stopped breathing and needed immediate resuscitation. Although an emergency code was broadcast through the hospital, it did not designate what kind of physician was needed and the woman suffered brain damage as a result. Olender sued, and the hospital settled the case for a confidential amount, ensuring that the woman who is now in a persistent vegetative state will receive the around-the-clock medical care she needs. Equally important, however, is that the hospital evaluated and changed its procedures for responding to emergencies, so that the appropriate medical specialty is directed toward the patient s particular needs, says Olender. The hospital has also implemented a simulation laboratory where doctors can practice responding to emergencies and using the best procedures. The hospital credits our case as causing this procedure to be followed, which should prevent other tragedies in the future, says Olender of Jack H. Ja c k Olender In a similar case handled by Olender a few years ago, a young woman undergoing a routine gynecological procedure at a medical clinic went into cardiac arrest. The clinic was not prepared to respond to life-threatening emergencies, and the woman died. The case settled during mediation. But the clinic also instituted changes to its procedures for advanced life support to ensure that in the future, they d be prepared to appropriately respond to similar emergencies. Another case involved a child who was badly brain damaged as a result of a medical device that malfunctioned in a hospital and was not being used properly by the staff. The case settled shortly before trial. At the request of the parents, whom Olender represented, one of the conditions of settlement was that a sum of money be set aside at hospital to present an annual seminar to the staff on proper use of the device so this kind of incident wouldn t happen again. Olender says that it s quite frequent that defendants will openly acknowledge the value of medical malpractice suits in improving health care. For instance, after a major trial in which Olender landed a significant jury verdict, a hospital administrator mentioned to a friend of Olender s that the lawsuit was a positive experience because it gave the hospital the impetus to re-examine some of its procedures and determine how to improve them. This type of response to lawsuits is quite common, says Olender, who holds an LLM in forensic medicine in addition to his JD. We constantly run into this situation, where the system is in error and is not set up to give proper care, and when cases are carefully presented and it s demonstrated what needs to be done, many institutions will make the corrections to protect people in the future, he says. In these cases, they ll say, Yes, we made an error and we will correct it. We see this repeatedly. Olender has historical perspective on the issue: He landed the first multi-milliondollar obstetrical verdict in the country, and his firm has had more than 200 med-mal verdicts and settlements of more than $1 million. While ensuring that his clients are appropriately compensated for their injuries, Olender finds it rewarding to also provide a societal benefit by improving medical care. We have a primary duty to our client to get the best result possible but we also have some ancillary duty to the public to make things safer, says Olender. That result happens time and again, he adds. There are all kinds of opportunities to enhance the quality of medical care that flows from malpractice suits, says Olender.
