1 National Lawyers Guild 2011 Voters Guide to Primary Election Judicial Candidates In the upcoming May 17, 2011 primary election, the ballot will include candidates for judges at several levels of the Pennsylvania judicial system, including Supreme Court, Superior Court, Commonwealth Court, Philadelphia Court of Common Pleas, Philadelphia Municipal Court, and Philadelphia Traffic Court. For empty seats, the Democratic and Republican parties have nominated candidates. (In some cases they have nominated competing candidates and in other cases they are the same.) Once again, voters are asked to make choices with almost no information about the candidates. As a progressive bar association dedicated to the need for basic and progressive change in the structure of our political and economic system, the Philadelphia Chapter of the National Lawyers Guild is concerned about this lack of information. To that end, a committee of the National Lawyers Guild Philadelphia Chapter has surveyed members of the progressive legal community in Philadelphia and other parts of Pennsylvania. Members of the progressive legal community were asked to respond to a short, anonymous questionnaire about the candidates. The respondents included attorneys for non-profit public interest organizations, criminal defense attorneys, prosecutors, private practitioners, and law professors. The vast majority had 11 or more years experience as lawyers or legal workers, and many had more than 25 years. Respondents were asked how they knew the candidates, and how they would rate the candidates for election. Respondents were then asked to give a detailed response in regards to their rating of a specific candidate. These comments are perhaps the most telling, and useful to other voters. We have made no substantive changes to the comments, and edited comments only for length and professional tone. Here are the results of the survey. We hope that you will find them useful in making your voting decision. Please be aware, however, that these ratings and comments reflect the opinions of the individual respondents only, and are not to be taken as opinions or endorsements by the National Lawyers Guild or the Guild s Philadelphia Chapter. In fact, as with any survey reflecting many points of view, there is significant disagreement among the respondents as to the merits of some of the candidates. Note that a response of no opinion likely reflects the fact that the legal professionals we surveyed did not have personal knowledge of the candidate. Favorable and unfavorable percentages reflect actual knowledge and remainder have no information. I found her to be thoughtful about legal issues. A moderate on the criminal bench. Highly efficient, not always to the benefit of criminal defendants. Impressed with her initiative to try to establish a "housing" court with supportive services to assist parents whose children would be removed from the home due to substandard housing (or not reunited due to substandard housing)--she was spear-heading an effort to have affordable housing units made available to these families, together with supportive services and court supervision Was a very fair judge in juvenile court. Her order to me put my job in jeopardy. David N. Wecht % strongly recommend, 97.3% no opinion He seemed very real in my brief conversation with him and I believe that he has a public interest background. Commonwealth Court Paul P. Panepinto 3 4.4% strongly oppose, 31.1% oppose, 8.9% recommend, 4.4% strongly recommend, 51.1% no opinion Motions court opinions are not thoughtful and are often inconsistent. Did not seem to pay attention to the law as much as the overall situation (in mortgage foreclosure, did my client have a job? Did she have a job prospect?). Several motion court decisions that were fair to people in foreclosed properties who were facing ejectment/eviction. Judge Panepinto was compassionate and seemed to want to achieve justice and do the right thing. He didn't seem bound by the law and, thus, there was no predictability to his decisions. Competent enough. Weak jurist. He is an OK Common Pleas judge but nothing about him particularly recommends him to higher office. The best that can be said is that unlike many Republicans, he is not mean-hearted and he shows a degree of empathy for the individuals before him, tries to be fair. He is not a particularly deep thinker. Although in my own experience he has seemed fair, he describes himself in his campaign website as a conservative Republican who believes in limited government and does not legislate from the bench and a Roman Catholic, pro-life, and loyal Republican. The only reason I'd vote for him for Commonwealth would be to get him off the Common Pleas bench. Works slowly, and with a very poor grasp of the law. He's

6 been in Motion Court for a couple years now, and I wince every time one of my cases gets assigned to him. Judge Panepinto does not strike me as having the judicial temperament, thoughtfulness or depth of legal analysis I would desire from an appellate court judge. Worked with Judge Panepinto on the Race/Ethnic Bias and Gender Fairness Task forces established by the Phila Bar Assoc. He participated fully and supported our efforts whole-heartedly. He is currently motions court judge. So far, not particularly impressive. Pleasant, only medium bright. "Republican", but not evil. Anne Covey 4 2.6% strongly oppose, 97.4% no opinion Management side lawyer. Kathryn Boockvar 102 7% recommend, 30.2% strongly recommend, 62.8% no opinion Excellent lawyer, smart, compassionate, community minded, civil rights background. Experience in the types of cases she would hear. Comes across as very progressive and energetic. Long time progressive. Strong voting rights and other community work. Has an excellent reputation as smart, progressive, someone with integrity. Would make an excellent judge. Supported by groups I trust including Equality Advocates Experienced civil rights, employee rights, voting rights champion; check out for all you need to know. Worked with her on voting rights campaign and found to be bright, energetic, committed and politically in tune. Barbara Behrend Ernsberger % strongly oppose, 2.6% oppose, 5.1% recommend, 89.7% no opinion She lost last time, more of a party connected person than Kathryn and I'd like to see Kathryn win. "Not recommended" by the Bar Association. Court of Common Pleas Jim DeVergilis % strongly oppose, 7.7% recommend, 82.1% no opinion Made a terrible impression at a candidate forum, made comments suggesting he was completely comfortable with the idea that cops will lie on the stand. He would make an awful judge. His campaign literature says he worked to get Corbett elected governor. Not recommended by the Philadelphia Bar Association. In 20+ years of public interest practice, Jim DeVergilis is by far, one of the most troubling (on many levels) attorneys I have ever encountered in a courtroom. He has made inappropriate comments and acted in ways that make me question his sense of professional responsibility. In one case, he continually referred to my client as "a pig" (a young African American female), he referred to me as "a little sneak" for legitimately obtaining documents that are available as a matter of public record and that he insisted did not exist. In terms of intellect, he made the startling argument that the U.S. Constitution was not applicable to the Philadelphia Municipal Court. Mr. DeVergilis also has claimed "he put the (particular) Judge on the bench," implying that thus, he controlled the outcome.

7 Jim DeVergilis is the "Donald Trump poster boy" for all that is wrong in our profession; and humanity, for that matter. If Jim DeVergilis can be elected to any judgeship, I would seriously have to consider whether I could remain in this profession. Very negative experience though a co-worker I trust. Weak on courtesy and ethics. Brags about being an insider who puts judges on the bench. Working class, a bit rough, no scholar, but basically good heart. Acceptable. Fran Shields 6 Ted J. Vigilante 7 2.7% oppose, 97.3% no opinion 5% strongly oppose, 7.5% oppose, 5% recommend, 82.5% no opinion Encountered him several years ago in Family Court cases. He did not impress me as someone who would make an excellent judge. Had him on arbitration panels and seen him in person. Seems capable of doing the job. This guy's campaign focuses on the idea it's good to be a vigilante. Not kidding. Voters should say no. Anne Marie B. Coyle 8 5.4% oppose, 5.4% recommend, 89.2% no opinion Lack of attention to details of case. A relatively humane prosecutor in her day. Not bad. Maria McLaughlin 9 5.3% oppose, 5.3% recommend, 2.6% strongly recommend, 86.8% no opinion Competent enough Kenneth J. Powell % strongly oppose, 2.7% oppose, 5.4% recommend, 5.4% strongly recommend, 83.8% no opinion I have often appeared before Judge Powell in Municipal Court. He is a fine judge; great judicial temperament; smart, humane. fair & knows the law. Doesn't suffer from "black robe" disease. Fair to low income litigants in Municipal Court, which is too often rare. Courtesy. Seems not to have forgotten what it's like to practice. Appeared before him a couple of times in Municipal Court. Perfectly decent judge. Decent in general, but too much of a cop lover. Actually thinks they're all telling the truth at the moment. Give him time. He'll be okay. Good heart. Sadye Ladov % strongly oppose, 10.9% oppose, 32.6% recommend, 19.6% strongly recommend, 30.4% no opinion It was a profound disappoint to me when she (as Chancellor of the Philadelphia Bar Association) had the opportunity but failed to stand up for an independent judiciary. Judge Craig Washington came under attack by the FOP for removing a photo of a recently slain Philadelphia police officer from his courtroom while preliminary hearings were being held. It was a unique opportunity to show leadership, courage and principle; unfortunately she followed the "politics". Nonetheless, I would still recommend her given the field of candidates. Clear and concise decision making and excellent understanding of law.

8 Former Bar Association Chancellor, private practitioner, whose practice was in personal injury.-----i believe. She worked as a prosecutor in NYC area decades ago and still offers quotes in local media based upon that. Very weak in her public statements about the situation when Municipal Court Judge Washington was attacked by the FOP (about two years ago) for trying to run his courtroom as an impartial courtroom even though it was located in a police district. She was quoted recently on the system of electing judges, as not defending the big money, but saying that if you don't play, you don't get a chance to "serve the people."----i guess it often boils down to what the rest of the field looks like. By that standard she probably looks good. Has served in varying capacities with the Philadelphia Bar Association; seems to be a fair minded and compassionate person. From my knowledge of her, I worry she might apply her gut first rather than the law. As a Bar Association leader, she seems reasonably bright and energetic, but I cannot say much more about her. As chancellor of the Philadelphia Bar Association, she formed the Civil Gideon Task Force. Hard working, skilled litigator. I do not know her well but she seems very committed to the profession and caring for the poor. From what I have observed, I am unsure that her judicial demeanor will be consistently appropriate. Has amazing presence. Seems like she would be fair, although I don't know her well. She is reasonable, intelligent, cares about the public. Have had odd encounters with her. Stay away. Charles Ehrlich % strongly oppose, 9.5% oppose, 14.3% recommend, 16.7% strongly recommend, 50% no opinion Seemingly honest, forthright person, highly regarded generally. Notorious as a prosecutor. Will be beloved by the District Attorney's Office. He is smart, fair and reasonable. Chief at the District Attorney's office for years. Opposed to free speech. Rigid in thought and action. Major supporter of Lynn Abraham. Just say no. Sean Kennedy 104 Diana Anhalt % oppose, 97.3% no opinion 2.6% strongly oppose, 7.9% recommend, 5.3% strongly recommend, 84.2% no opinion Decent District Attorney. Smart. Colleagues who have seen him in court (child dependency cases) describe him as a strong advocate for his clients. At a candidate forum, he spoke convincingly about the need for fairness on the bench. 9 A petition was circulated alleging that he made misrepresentations about his residence in order to qualify to be a committeeperson. The petition was circulated after he provided the crucial vote to elect a party-backed ward leader in the 2nd Ward. He has been endorsed by the Democratic City Committee. Robert W. Kline % oppose, 97.3% no opinion At a candidate forum, said little to explain why he wanted to be a judge. But did not seem a bad guy, is involved with his kids sports teams. Daine Grey Jr % oppose, 5.3% recommend, 10.5% strongly recommend, 81.6% no opinion Smart and on top of legal issues. Smart, caring defense attorney. Former Public Defender. At a candidate forum, he spoke movingly, with detailed examples, about his anguish having to represent clients before unfair judges, and vowed to be different. He got my vote right there. Christopher Miallos Jr % strongly oppose, 11.4% recommend, 25% strongly recommend, 56.8% no opinion Good prosecutor, concern for victims. A prosecutor through and through. Chris has been committed to ending sexual violence and domestic abuse throughout his career. He is also an openly gay man. I recommend him very highly. Good DA. Smart guy with lots of experience. Very smart, reasonable, great experience, Has a heart for people. Prosecutor most of his career. Predictably one-sided. Was wonderful as head of family violence and sexual assault unit of DA's office. Made a good impression at a candidate forum. Was a DA, has taught trial advocacy. Barbara A. McDermott % strongly oppose, 2.6% oppose, 2.6% recommend, 23.7% strongly recommend, 68.4% no opinion We were neighbors years ago; I liked her a lot; very honest, smart and hardworking. Smart and committed. Smart, caring defense attorney. Former DA. Not impressed with her as a lawyer. Would be trouble on the bench. Recommend no. Harry J. Lavant % strongly oppose, 2.6% oppose, 5.3% recommend, 2.6% strongly recommend, 86.8% no opinion Tom Ferrick reports he owes PA and NJ back taxes and Philly RE Taxes; he never responded to the reporter's inquiries/request for comments. Based upon personal experience, one respondent described candidate as very nice, but did not believe him to appropriate for the bench because of insufficient intellect and energy. Uses whatever he can, inappropriately, win his case. Good enough. He'll do. Drew Aldinger % oppose, 5.1% recommend, 5.1% strongly recommend, 84.6% no opinion Represents the purchaser of City real estate tax liens; nothing remarkable either way. Drew Aldinger works as a debt collector. We really don't need any more procreditor, anti-consumer judges in Common Pleas Court. I do not know him well, but he was very respectful while an adversary in one case. In civil litigation I believe he will be fair and even handed; no real opinion of his potential as a judge in criminal cases. Although his firm is a debt collection firm, a colleague who has had a lot of contact with him as opposing counsel says he is honest and fair and would be a good judge. He has taken cases without a charge for low income clients from the Volunteers for the Indigent Program. He made a good impression at a candidate forum. He is endorsed by Liberty City. Ted J. Vigilante 124 5% strongly oppose, 7.5% oppose, 5% recommend, 82.5% no opinion Encountered him several years ago in Family Court cases. African American and Latino, real asset. Extremely fair-minded, hard working, practical. At a candidate forum and in a discussion while campaigning, he seemed to be exactly what one looks for in a judge: thoughtful and fair. He has taken cases without a charge for low income clients from the Volunteers for the Indigent Program. Is endorsed by Liberty City. Leon A. King % strongly oppose, 7.3% oppose, 17.1% recommend, 2.4% strongly recommend, 65.9% no opinion He learned a lot as head of Philly prisons and now speaks for reducing incarceration and better re-entry programs. As head of Philadelphia prison system, he was a strong advocate for systemic change. He would be good as a Judge. My experience was that he was not as forthcoming as I would have liked. Say no Made a very poor impression at a candidate forum, seemed devoid of ideas. Sayde J. Ladov % strongly oppose, 10.9% oppose, 32.6% recommend, 19.6% strongly recommend, 30.4% no opinion It was a profound disappointment to me when she (as Chancellor of the Philadelphia Bar Association) had the opportunity but failed to stand up for an independent judiciary. Judge Craig Washington came under attack by the FOP for removing a photo of a recently slain Philadelphia police officer from his courtroom while preliminary hearings were being held. It was a unique opportunity to show leadership, courage and principle; unfortunately she followed the "politics". Nonetheless, I would still recommend her given the field of candidates. Clear and concise decision making and excellent understanding of law. Former Bar Association Chancellor, private practitioner, whose practice was in personal injury. I believe. She worked as a prosecutor in NYC area decades ago and still offers quotes in local media based upon that. Very weak in her public statements about the situation when Municipal Court Judge Washington was attacked by the FOP (about two years ago) for trying to run his courtroom as an impartial courtroom even though it was located in a police district. She was quoted recently on the system of electing judges, as not defending the big money, but saying that if you don't play, you don't get a chance to "serve the people." I guess it often boils down to what the rest of the field looks like. By that standard she probably looks good. Has served in varying capacities with the Philadelphia Bar Association; seems to be a fair minded and compassionate person. From my knowledge of her, I worry she might apply her gut first rather than the law. As a Bar Association leader, she seems reasonably bright and energetic, but I cannot say much more about her. As chancellor of the Philadelphia Bar Association, she formed the Civil Gideon Task Force. Hard working, skilled litigator. I do not know her well but she seems very committed to the profession and caring for the poor. From what I have observed, I am unsure that her judicial demeanor will be consistently appropriate. Has amazing presence. Seems like she would be fair, although I don't know her well. She is reasonable, intelligent, cares about the public. Have had odd encounters with her. Stay away.

The kind of District Attorney who didn't care what the defendant's personal story was, although he is now campaigning as though he has great compassion. NEVER showed it as a District Attorney and didn't much care about the defendant's side of anything. Young, but fundamentally decent. At a candidate forum, was quite impressive, described his rise from poverty, said he was the first in his family to graduate from high school. Not recommended by Bar Association. Municipal Court Marvin L. Williams % strongly oppose, 8.1% oppose, 2.7% recommend, 78.4% no opinion Tom Ferrick reports that he has failed to pay his Philly real estate taxes since 08, and has had numerous PGW liens. Yet, he's apparently raised the amounts necessary to give City Democratic Committee for its endorsement. Poor judicial manners and lack of understanding of law. Not very learned, nor competent in current position as Master. Same comments as for Common Pleas Court. He does not understand custody law very well and he is a custody master. He also has made inappropriate remarks regarding parties' immigration status. Derrick W. Coker % strongly oppose, 5.6% oppose, 2.8% recommend, 88.9% no opinion He impresses me as a terrible lawyer. Martin S. Coleman % strongly oppose, 2.9% oppose, 94.3% no opinion Right-wing. Is a soldier in the war on rights. Say no. Vincent L.
