1 FOI request ref 449/2010 I seek disclosure of the following information. In all cases I would like the most recent figures available. 1 The number of people employed in total by the force, both as an individual head count and as full time equivalents. 2 The total labour bill for the force, broken down into salaries, NI contributions and pension contributions etc. 3 A breakdown by department of the number of non-policing roles (human resources etc), together with their cost (reflecting the categories in Q2). 4 The number and cost (reflecting the categories in Q2) of ex-police officers employed as civilian employees of the force, together with the number of those receiving a police pension.

2 Response Information relevant to your request has been sought and provided by the Dyfed Powys Police Human Department and the Dyfed Powys Police Finance Department. In respect to question 3 of your request the cost of providing you with the information requested to provide a complete response is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the appropriate level as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations It is estimated that it would exceed 18 hours (i.e. minimum of 50 hours) to fully comply with this part of your request. The regulations can be Partial information has been collated to respond to question 3 and is included below, however to provide a complete response will require further research. To establish whether there is any further information concerning non-policing roles will involve research of 605 pieces of data it has been estimated that this task will exceed the appropriate limit as detailed above. In accordance with the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this part of the request under Section 17(5) A public authority which, in relation to any request for information, is relying on a claim that section 12 or section 14 applies must, within the time for complying with section 1(1), give the applicant a notice stating that fact. Although excess cost removes the Force s obligations under the Freedom of Information Act, as a gesture of goodwill, I have supplied the below information, relative to your request, retrieved or available before it was realised that the fees limit would be exceeded. I trust this is helpful, but it does not affect our legal right to rely on the fees regulations for the remainder of your request as detailed above.

Where figures have been exempted, the figures have been removed from the total staffing costs, as a result of the application of the s40 (2) exemption. Please also see additional information in response to question 3 at the end of the document. Information Subject to Freedom of Information Act 2000 exemptions A Section 40(2) exemption has been applied in part to the information contained with the above table. Where exemptions are relied upon Section 17 of the Freedom of Information Act 2000 requires Dyfed Powys Police, when refusing to provide such information (because the information is exempt) to provide you the applicant with a notice which: (a) states that fact, (b) specifies the exemption in question and (c) states (if that would not otherwise be apparent) why the exemption applies. Section 40 (2) (Personal Information) S40 (2) applies to third party personal data. This would not be released under the Freedom of Information Act 2000 unless there is a strong public interest. This is because any release would breach the Data Protection principles contained within the Data

6 Protection Act (1998). Principle 1 states that personal information must be processed fairly and lawfully. One of the main differences between the Freedom of Information Act (2000) and the Data Protection Act (1998) is that any information released under the Freedom of Information Act 2000 is released into the public domain, not just the individual requesting the information. As such, any release that identifies a living individual through releasing their personal data, even third party personal data is exempt. Personal data is defined under Section 1 (1) (e) of the Data Protection Act (1998) as: data which relate to a living individual who can be identified- (a) from those data, or (b) from those data and other information which is in the possession of, or is likely to come into the possession of, the data controller, and includes any expression of opinion about the individual and any indication of the intentions of the data controller or any other person in respect of the individual. Personal data is defined under the Data Protection Act (1998) as data that is biographical in nature, has the applicant as its focus and/or affects the data subject s privacy in his or her personal, professional or business life. All members of the public have an intrinsic right to privacy, in addition members of staff of Dyfed Powys Police have a right to privacy where their personal information is concerned and these rights are protected by virtue of the Human Rights Act and the Data Protection Act, and a public authority must not interfere with that right. Any release of the information subject to the exemption is likely to compromise those rights. Principle One: Personal data shall be processed fairly and lawfully and in particular shall not be processed unless (a) at least one of the conditions in Schedule 2 is met, and (b) in the case of sensitive personal data at least one of the conditions in Schedule 3 is also met. The exemption has been applied in this case due to the small number of staff subject to the information in question as a result it is possible to establish the identity of the member of staff that the information refers. The section 40 exemption is a class-based exemption. This means that the legislators when writing the legislation considered that the release of such information under the Freedom of Information Act 2000 would cause harm to the public authority or individual

7 concerned. There is therefore no requirement to carry out a HARM Test in respect of such information. The section 40 exemption is in part qualified and in part absolute, in the present case it would be absolute as to release the information would breach principle 1 of the Data Protection Principles which is the fair and lawful processing of data, and therefore there is no requirement to carry out a public interest test. Payments were made to 62 individuals all of which were in receipt of a police pension.
