1 BIRMINGHAM TOWNSHIP BOARD OF SUPERVISORS MINUTES JANUARY 5, 2015 The regular meeting of the Board of Supervisors followed the organizational meeting for the annual appointments. It was noted at the organizational meeting that Supervisor William Kirkpatrick was absent. Chairman Conklin moved to approve the December 8, 2014 minutes as written. Mr. Boorse seconded the motion and the minutes were approved. Mr. Boorse moved to approve the bills submitted for payment. General Fund bills totaled $61, Sewer Fund bills totaled $15, Chairman Conklin seconded the motion and the bills were approved. PUBLIC COMMENT The Commonwealth of PA Sunshine Law Act 93 (as amended in 1998) requires public comment to be held before official action is taken. There was no public comment. ORDINANCE HEARING TRUSTEES INSURANCE FUND HEALTH (DENTAL) AND UNEMPLOYMENT It was duly advertised on December 29, 2014 in the Daily Local News that the Board would be considering two ordinances. The first ordinance would authorize the participation of the Township in the Pennsylvania Townships Health Insurance Cooperative Trust pursuant to the Intergovernmental Cooperation Law and the second ordinance would authorize participation by the Township in the Pennsylvania State Association of Township Supervisors Unemployment Compensation Group Trust pursuant to the Pennsylvania Intergovernmental Cooperation Law. The following exhibits were presented. B-1: Proof of publication in the Daily Local News on December 29, B-2: Letters dated December 29, 2014 from Solicitor Kristin S. Camp to the Chester County Law Library providing the proposed amendments for publication. B-3: Letters dated December 29, 2014 from Kristin S. Camp to the Daily Local News providing the proposed amendments for public inspection. The ordinances are required to be adopted by the Township to participate in these benefits. With no questions from the Board, Chairman Conklin moved to adopt the ordinances as written. Health (Ordinance 15-01) Unemployment (Ordinance 15-02). Mr. Boorse seconded the motion to adopt the ordinances. ELECTRICAL CONTRACT WWTP AUTODIALER Sandi Morgan of URS Corporation, Township Sewer Engineer, has provided a design drawing for electrical work to install floats in the sludge tanks at the sewer plant. The work is required because the tanks overflowed and raw sewage flowed on the ground. Alarm floats need to be installed in the sludge tanks so if the tanks start to overflow again an alarm will call the operator so they can get to the plant and clear the clog before the tanks overflow. Rich Jensen, Building Inspector, had obtained three quotes for the work but they all exceeded the three bid telephone bidding limit of $19,100. for Supervisor Kirkpatrick had proposed that the auto dialer be removed from the bid solicitations and that it be purchased separately by the Township. The cost of the auto dialer is $3,900. Removing the auto dialer from the bids would also eliminate mark-
2 up on the auto dialer. Chairman Conklin suggested that Solicitor Camp confirm that there was no issue with the Township reworking the bid requests by removing the auto dialer. Solicitor Camp advised that removing the auto dialer would violate the bidding procedure regulations. However, as of January 1, 2015, the bidding limit for telephone bids was raised to $19,400. One of the bids received, with the auto dialer included, was for $19,350. so the work could be awarded without having to formally bid the project. The following bids were received (auto dialer included): Joseph A. DeAugustine Electrical Contracting, Chadds Ford, PA - $19, Four-D Electric, Havertown, PA - $37, Cook s Service Co., Inc., Avondale, PA - $23, MGK Industries, Inc., Pottstown, PA - $21, Chairman Conklin moved to award the contract for the electrical work at the sewer plant to Joseph A. DeAugustine Electrical Contacting of Chadds Ford, PA for $19, Mr. Boorse seconded the motion and it was approved. POLICE REPORT Chief Nelling reported for the month of December There were 1,078 incidents during the month including four criminal arrests (1 DUI). There was one residential burglary with no forced entry. There were 7,052 patrol miles logged on the vehicles during the month. The meeting was adjourned at 7:44 PM.
