1 CERES REDEVELOPMENT AGENCY COMMERCIAL REHABILITATION LOAN PROGRAM The applicant,, has read the guidelines for the and agrees to carry out the work in accordance with these guidelines. The applicant further agrees to comply with Agency design guidelines and the specific design shown in applicant-submitted improvements and Agency staff recommendations. Any changes in the approved plans or specifications must be presented to the Agency for approval. In addition, the applicant agrees to provide a photograph of the façade of the storefront(s) and all areas to be improved before the improvements have been performed. It is further understood that applicant must submit detailed cost documentation, including canceled checks, bills, copies of building permits, all contractor s waivers of lien, and a photograph of the storefront(s) upon completion of Commercial Rehab Loan Program improvements. Finally, applicant understands that work cannot begin on the improvements until application has been approved by the Agency and copies of all necessary permits (i.e. building, sign, awning, etc.) have been submitted to the Agency. Applicant realizes that the cost of work performed prior to approval will not be reimbursed by the Agency. 2 CERES REDEVELOPMENT AGENCY COMMERCIAL REHABILITATION LOAN PROGRAM I. INTRODUCTION The (Program) is designed to stimulate building improvements and upgrade the appearance of commercial properties in commercial redevelopment areas. The Program is provided in recognition of the extremely valuable impact these investments have on the effort to maintain the vitality of commercial areas. The objective of this Program is to promote joint public/private action and investment for these areas. All improvements must be consistent with the design guidelines, if any, established for the redevelopment area. The administration of this Program will be the responsibility of the Ceres Redevelopment Agency (CRA). The Program will initially be funded with loans from the CRA, provided by an Economic Development Bank loan, and subsequently by other funds when available. These guidelines have been developed to present the basic elements of the Program with specific emphasis on the eligibility criteria for selection of applicant/area, types of improvements and expenditures. Details of the necessary documentation for processing loans under this Program are outlined in the procedural steps. II. DEFINITIONS For the purposes of this program, the following definitions will apply: 1. Awning Canopy a temporary shelter, sometimes retractable, that is supported entirely from the exterior of a building. 2. Codes the Building Code and Zoning Code of the City of Ceres, latest editions. 3. Design Guidelines architectural design guidelines developed, if any, for rehabilitation in the commercial revitalization area (redevelopment area). 4. Design Review CRA staff will be responsible for plan review of exterior improvements for consistency with any established design guidelines. 5. Exterior Lighting lighting fixtures and the installation of same, attached or connected to building undergoing renovation. Exterior lighting can include freestanding lighting in the public way.

3 Ceres Redevelopment Agency Page 2 6. Façade the entire exterior front surface of a building from grade to the roofline. Where a building abuts two streets and /or an alley, empty lot, parking area or open space, such building may have other faces considered facades at the discretion of the CRA. 7. Final Design detailed drawings showing the refined preliminary design and revised cost estimates. 8. Landscaping trees, bushes, trellis, planter boxes and similar items. Adequate irrigation must be provided. 9. Passive Energy Conservation Equipment equipment and/or material which, by their very nature and method of use and installation, improve the energy efficiency of the building. Such equipment must be part of the building and may include canopies, awnings, shutters or other shading devices and special glazing. 10. Preliminary Design initial conceptual sketches of improvements based on the objectives of the owner(s). 11. Professional Fees those expenses not spent on physical improvements, materials, equipment or labor directly related to their installation. These costs include, but are not limited to, engineering fees and architectural services. 12. Shutter moveable cover or screen for a door or window to provide protection from the elements. 13. Sign any commercial sign attached to the building which is consistent with the City Sign Ordinance and any applicable Specific Plan. 14. Working Drawings and Specifications the drawings which show detailed methods of installation materials and the specifications to be followed in constructing the improvements. III. ELIGIBLE APPLICANTS AND AREA 1. Applicants Owners of commercial property are eligible to apply for assistance. 2. Area Areas which are located within the designated redevelopment project area are eligible for assistance under this Program. See Attachment A for a map of eligible areas.

4 Ceres Redevelopment Agency Page 3 IV. ELIGIBLE IMPROVEMENTS Eligible types of improvements may include: 1. Façade renovation 2. Signs 3. Doors 4. Windows 5. Awnings 6. Graphics 7. Exterior lighting improvements 8. Landscaping 9. Decorative fencing and landscaping of vacant parcels in connection with a façade treatment 10. Capital improvements such as surface parking lot installation and improvements, sidewalks, entryway treatments, special features, lighting, curb and gutter in conjunction with façade work 11. Certain types of passive energy conservation improvements. All improvements must conform to City building codes and any design guidelines adopted for the area. Participant s proposals will be subject to design review by CRA staff. V. ELIGIBLE EXPENDITURES An approved property owner is eligible for a loan of up to 50% of the project cost or $25,000, whichever is less. Interest will be charged at 3.5%. Improvements above the storefront level are only eligible when performed in conjunction with storefront improvements. Rehabilitation of second story facades is also eligible if first floor improvements are approved and/or performed. Professional fees may be included in the total storefront improvement cost. Loans will only be made for improvements started and completed after CRA acceptance of the final plans and specifications. VI. APPEAL PROCESS The applicant has the right to appeal the CRA staff architectural review decision to the CRA Board.

This step will occur with CRA staff. The initial contact would determine whether the project is located within a redevelopment area and if the proposed activities are within the program guidelines. The program guidelines will be reviewed and a copy, including the application form, will be provided to the potential applicant. Property owner fills out application form and sends application to the CRA with photographs of the site and storefront. Application is reviewed by CRA staff to determine whether the activities are within the program guidelines. Preliminary plans (two copies), color samples, awning designs (if included) and preliminary budget should be submitted for review and approval by CRA staff. NOTE: All information should be submitted together. An environmental review of the project will occur at this stage. Decisions of CRA staff can be appealed to the CRA Board, which shall be the final arbitrator of this program. Upon approval of the preliminary plans the applicant should prepare and submit final plans, specifications and detailed cost estimates to the CRA. If the final plans are consistent with the approved preliminary plans, the CRA will review and approve the final plans. The loan amount will be contingent upon the actual costs associated with the final plans. If improvements require building permits, applicants must submit final plans to the Community Development Department. The building permit is submitted to the CRA. If revised cost estimates are necessary, these should be submitted along with the building permit to the CRA. Upon submission and approval of these documents, an approval letter indicating the loan amount is sent to the applicant. This letter requires the applicant to complete improvements within 180 days from the date of the letter and states that partial completion of the project will void all agreements. If the improvements are part of an overall larger rehabilitation, the maximum time requirement will be established accordingly and documented in this letter. Repayment terms will also be detailed in the letter of commitment. NOTE: All change orders must be approved by the CRA. After completion of the work, the applicant s canceled checks and bills, copies of the building permits, all contractor s waivers or liens, and a photograph of the storefront improvements shall be sent to the CRA. NOTE: All information should be submitted together. CRA staff examines the finished work for compliance with the general design recommendations and approved change orders.
