The blood drive and the wills clinic were both successful and our Law Week luncheon, featuring Judge McDonald s presentation about the Honorable J. Waties Waring, was enjoyed by everyone. Our reception for the circuit judges at the Hyatt was marvelous and the golf event likewise received high praises. No sooner was Law Week ended than we hosted our annual Family Night at the Zoo, on May 21, which was again a big success, enjoyed by approximately 100 families and a couple of weeks ago the Young Lawyers hosted a great event. On other fronts, there seems to have been an adequate response to Tom Bruce s previous appeal for volunteers for his Project Help endeavor. Tom has again graciously provided us with an article this month giving an update on how that is coming along. For that matter, also in this issue, Wendy Griffith has provided some comments about the Young Lawyers event, Stuart Sarratt has written about the efforts of the website committee to upgrade and enhance our website, and Hunter Freeman has written an interesting article about the accelerated docket program. I hope you ll enjoy reading all of them. We have made a concerted effort to get pictures from most of the events, and hope that you ll enjoy some of them which are included in this newsletter. There will in fact be many more accessible on our website, beginning, I understand, next week. It is a work in progress, and if you d like to see them start checking the website in the next week or so. Going forward, our summer luncheon, scheduled for July 16 at the Poinsett Club, features the Honorable Michelle Childs as our guest speaker. We hope to see you there and you may notice a table set up to recruit mentors for the S.C. Commission on CLE s mentoring program. Justice Kittredge s article in our March newsletter was about the mentoring program, and if, for whatever reason you didn t get to read it then, it is accessible on our website. If you are not already mentoring someone this may be a good time to start. This is probably as good a time as any to make a pitch regarding membership in the GCBA. While we have a healthy membership, we have noticed that a number of lawyers in our community are not members. For a lot of them this is inadvertent. Somehow when it comes time to make the dues check-off on the state bar form, it gets missed. For some, though it is intentional. Why anyone would not want to be a member is beyond me though I am certainly biased. Aside from interesting events with great speakers, the return on investment from a membership with the Greenville Bar just makes sense. Consider, for example, our CLE event--breakfast, lunch and a days worth of outstanding CLE at a prime location for $ unless you re getting your CLE free somewhere that s about as good as it gets. Moreover, the money that we make from the CLE and we do net a profit gets plowed back into our other events so that we are able to subsidize most events for our members, and price them substantially below cost. The cost of membership in the GCBA works out to $6.25 a month less than the cost of a meat and three for lunch at one of our local restaurants. Membership in the GCBA is one of the nicer things we do for ourselves--and for that matter for our clients as well--since, I would submit, developing and maintaining a sense of camaraderie, professionalism and fellowship among ourselves ultimately pays dividends for our clients and our judicial system in ways that cannot be adequately measured. 5 256th edition Page 5 GCBA YOUNG LAWYERS On June 4 th, approximately 50 of the Greenville Bar s young lawyers gathered to socialize and network at the Greenville Bar Young Lawyer s first happy hour. The event was held at Roost, located downtown. Of those who signed in, no less than 26 law firms and county offices were represented at the event. The successful turnout is directly attributable to a resolution passed earlier this year by the Greenville Bar s Executive Committee establishing its own Young Lawyer Committee. Young lawyer events mark a time when the younger generation of lawyers can get together and make new connections with others from a variety of practice areas and backgrounds. Katie Lyall, an attorney with McAngus, Goudelock & Courie, stated I love having the opportunity to get together with fellow young lawyers and socialize. Greenville Young Lawyers is comprised of young lawyers at various stages of their careers so it provides an atmosphere that is unmatched for networking, socializing and good times. TECHNOLOGY COMMITTEE UPDATE The Greenville County Bar Association website is getting a much needed makeover. The current site was developed in 2003 and has remained relatively unchanged since then. In the past decade the technology behind the Web and the way in which we use it has changed dramatically. We hope the new site will reflect these changes and better serve both the Bar and the community. The most prominent change is a total redesign of the website's layout. Featured in this redesign is a new Bar Association logo. Functionally, we are adding multimedia galleries of Bar events and a lawyer directory with contact information and picture profiles. The new site is currently under development, and we look forward to launching it soon. 9 256th edition Page 9 Homeless persons and near-homeless persons may seem invisible yet we see people sleeping in the public library and we see adults walking on Main Street with loaded back packs. From the Swamp Rabbit Trail, people can be seen camping and doing laundry along the Reedy River. These are people who need access to legal services but providers such as South Carolina Legal Services find it a challenge to include their needs when delivering services that are already stretched due to revenue and staff shortages. The Greenville Bar rallied with enthusiasm when plans for Project Host were described in this newsletter just before Law Week. We have been pleased with the response and can now go forward with the plans that were still forming at that early point. We have started weekly intake at Triune Mercy Center and, after meeting with their leadership, we have developed a schedule for preventive educational seminars at locations such as the Rescue Mission, Shepherd s Gate and others. However, there is still a need for additional volunteers. Availability of committed volunteers can be a turning point for someone who is struggling to improve their life. With this in mind, we will ask each potential volunteer to specify an area of interest. Housing Family Court Worker s Comp Social Security disability Other Public Benefits Employment Debt collections Foreclosure Defense Bankruptcy Immigration Preventive Education programs to groups Other: [please specify] Update on Project Help By Tom Bruce Here is our proposed sequence for the referrals: Referrals will only be made only after advance permission from the volunteer We will cater to areas of concentration when requested by the volunteer; for example, bankruptcy, immigration, foreclosure defense, etc. Initial referrals will be for advice only. referrals will be made with a pairing to a member of the SC Legal Services legal staff who will be available for consultation by the volunteer the volunteer attorney may recommend a service that is more extensive than advice; if so, the volunteer will have the discretion to commit to do more than advice if the volunteer attorney cannot provide the extensive service he/she can return the case to SCLS and it will be considered for acceptance at SCLS. Volunteers should take care not to promise any specific action by SCLS as cases can be accepted only after screening for conflicts, merit and staff capacity. Clients should be told that acceptance of their case by SCLS is not guaranteed. The SCLS internal staff will continue to conduct new client intake so that new cases are already in digest form prior to referral. This should create ease and simplicity. In fact, while I am on the subject, ease and simplicity for volunteers will be a permanent goal for those of us on the design team. 10 256th edition Page 10 FAST TRACK JURY TRIALS In an administrative order dated March 7, 2013, the Supreme Court of South Carolina established a fast track jury trial process, which allows litigants to have their day in court earlier than would normally be possible. The fast track jury trial is a voluntary, binding jury trial before a 6 person jury panel and a mutually selected Special Hearing Officer. The Special Hearing Officer will act as the judge and may be an attorney in good standing with the South Carolina Bar and who has satisfied the Rule 403 requirements or may be a Circuit Court Judge who is available and willing to hear the case. Both parties must consent to a fast track jury trial and once consent is granted it is irrevocable. Ordinarily, a fast track jury trial should last no more than 1 day and should be limited to 3 witnesses per side. However, a motion to extend the length of the trial and/or the number of witnesses may be made by either party. Fast track jury trials are exempt from mandatory mediation and/or arbitration. These trials are also removed from the court s docket and the trial date is mutually set by the parties, subject to the court s resources and schedule. These trials will not be given any priority over regularly scheduled cases and will be scheduled in accordance with the court s resources. To simplify and expedite the trials, the parties are encouraged to stipulate to modes and methods of the presentation of evidence. In lieu of discovery, each party must serve copies of all documentary evidence not less than 30 days before the scheduled trial date. The parties must also attend a pretrial conference not less than 10 days before trial, where objections to any documentary evidence must be made. If no objections are made at the pretrial conference, the evidence will be deemed admissible. Live witnesses must also be disclosed with sufficient notice to allow a deposition to be taken of each live witness. Unless requested and paid for by the parties, the fast track jury will not be recorded by a court reporter. The parties may also agree to waive any motions for directed verdict, motions to set aside the verdict, motions for additur or remittur or any judgment rendered by the jury. While the verdict will go in the file for the case, it will not be entered unless a motion is filed with the Clerk of Court and the judge rules that the verdict will be enrolled as a Judgment. If, however, the trial is not going according to plan, the parties may, by a previous stipulation, elect to have the ability to accept the last settlement proposal of the opponent at any time before the verdict is announced by the jury. So if you have a relatively simple case that you know is not going to settle, you may want to consider requesting a fast track jury trial. This could provide you and your client with a simplified and expedited method of adjudicating your client s case. Be careful though, by agreeing to a fast track jury trial, your client is waiving its right to appeal the verdict or receive its costs to which it might otherwise be entitled.
