Blankenship has led Massey Energy as Chairman and CEO since 000, and he s been with the company since. Baxter F. Phillips Jr., President of Massey Energy, will succeed Mr. Blankenship as Chief Executive Officer, according to the release. Phillips has been with Massey Energy since. Admiral Bobby Inman, Lead Independent Director on the Massey Board, will succeed Blankenship as Non-Executive Chairman. He has been a director since. After almost three decades at Massey it is time for me to move on, Blankenship said in a prepared statement. Baxter and I have worked together for years and he will provide the company great executive leadership. Most of all, I want to thank the Members of Massey Energy whose hard work supports not only their own families, but also contributes greatly to the entire community of Central Appalachia. I want to thank Don for all he has done to build Massey Energy, Phillips said. I also want to thank the board for giving me the opportunity to succeed him as CEO. This is a strong and successful coal company, and I will work hard to match and surpass its record of success. On Oct. th, Boone County Sheriff s Department deputies arrested Daniel Alvin Toler,, on charges that while under the influence of alcohol, the man - Dorlen Hill of Rock Creek; and rd place - Creamy Coconut Delight - Radeana & Bryer Dotson of Danville. The Hacienda Restaurant on Main Street in downtown Madison provided free refreshments during the celebration. The celebration also included music at the Boone Heritage & Arts Center, story telling at the Madison Library and free face painting at D&B, which was sponsored by Ferrell & Hill. Initially, Toler was charged with two counts of DUI causing injury, driving with a suspended license and driving without insurance. Last week, further scrutiny of Toler s criminal history by Boone County Chief Assistant Prosecutor Jennifer Anderson revealed that the man had two previous DUI convictions, which he had received while driving drunk in the state of Tennessee. Under West Virginia State Criminal Code, a rd offense DUI charge is considered a felony. Toler faces at least a year in jail if convicted on that charge alone. Toler was arrested and released again on bone last week. It is likely his case will be presented to a Boone County grand jury in January. The West Virginia Attorney General s Office of Consumer Protection has closed an investigation into alleged conduct by a former Boone County funeral home operator who suddenly closed down earlier this year. The agency alleged that Thomas R. Stevens, Jr., who owned and operated Stevens Funeral Home, on Riverside Drive, had violated the West Virginia Pre-need act since as far back as 000. Funeral directors can be licensed to open up pre-need accounts, which allow customers to invest money ahead of time, which would ensure that the consumer had their funeral services provided for. The customers would purchase an insurance policy to finance this. When Stevens shut their doors in March 00, customers began to call state officials to enquire as to the status of their accounts. When auditors visited the Boone County bank to check the status of these accounts, they discovered that at least 0 customers who had contracts with the funeral home were not listed at the bank, where they should have been. It soon became clear that a large number of consumers had paid in advance for preneed services, but their funds were nowhere to be found, a court document filed by the attorney general s office stated. Former firefighters sentenced in arson case FROM STAFF REPORTS MADISON Three - year-old former members of the Madison Volunteer Fire Department have been sentenced in the May 00 arson of an apartment / office building near the Boone County Courthouse. Dustin Vance,, of Foster, Gerald Waters III,, of Madison, and Larry Nunnery III,, of Danville, all pleaded guilty to first degree arson in the By LAWRENCE KEENEY STAFF WRITER MADISON A Madison-area woman convicted three times in the past four years is now a convicted felon in the State of West Virginia after being charged with stealing tiny, low cost items. Earlier this month, Shandi Camille Dillon,, of the Madison area entered into a felony plea agreement on third offense shoplifting. Dillon was arrested on July st, 00, by Madison matter. They were sentenced to five years in jail, but that sentence was suspended pending a two-year probationary period. An investigator from the West Virginia State Fire Marshal s Office stated his belief that the men were bored, and decided to set a building adjacent to the Madison Fire Station on fire, then rushed across to the station, where they then reported the fire to the Police after being approached in the Madison Foodland. Police suspected she had stolen items from the grocery store, but soon discovered that while she had not stolen items from there, she had in fact taken items from another establishment across town. A complaint filed on the day of arrest by Lt. John Adams said Dillon volunteered that she had stolen a tube of lip balm from the Madison Go. Mart store, valued at less that $.00. After discovering that Dillon had two previous Boone Center. Madison businessman Larry V. Lyon owns the building, and at the time of the fire, relatives of Boone County celebrity Jesco White inhabited an apartment that caught fire. No one was injured in the incident. Soon after the fire, investigators realized the fire was likely arson. Within hours, the three young men were removed from the rolls of the Madison Volunteer Fire Department. In West Virginia first and second offense convictions for shoplifting are considered misdemeanors, while third offense is treated as a felony. She was convicted of shoplifting previously on August, 00 and January, 00. When Dillon returns to court in the near future the woman faces a theoretical prison sentence of -0 years, but is likely to be placed on probation. Last year Amy Michelle Wilson, 0, was indicted on charges of taking the identity of another person. Last year she was indicted on charges stating that Wilson applied over the Internet for a credit card from U.S. Bank in the name of her sister. After receiving the card, authorities were able to document charges of $,.. A complaint filed against Wilson by Trooper S.M. Boyles, of the West Virginia State Police said Wilson had the credit card bills sent to her personal address and made multiple purchases, paid bills and used the card for personal financial gain. The crimes took place between November rd, 00 and November th, 00. Last week, in front of Coal Valley News Boone County Circuit Judge Will Thompson, Wilson formally entered into a guilty plea in the case. Theoretically, Wilson could receive a prison sentence of up to years in state prison and up to a $,000 fine. The judge agreed to a plea, which would allow her to receive a suspended -month probationary sentence. 4 WEDNESDAY, DECEMBER, 00 PAGE A Opinion Under the Dome An important decision for the 0 West Virginia Legislature is going to be made next week during a private caucus of all Democrat members of the State Senate in Charleston. This assumes Gov. Earl Ray Tomblin--still officially Senate president and one of the members of the majority party-- attends this closed-door meeting. Reports have surfaced that senators may decide to elect a new "acting" Senate president when the TOM D. MILLER 0 regular legislative session begins at noon on Wednesday, Jan.. If that happens, the real vote to decide this issue will come at that caucus and then be "rubberstamped" officially on the opening day of the legislative session. Sen. Jeff Kessler, D-Marshall, the first announced candidate for governor in 0, claims he has the votes to become the new Senate leader. So last week Senate Majority Leader Truman Chafin, D-Mingo, pleaded with his colleagues to refrain from talking publicly about these potential changes. Tomblin wants to concentrate on his new role as the state's chief executive and wants to let the Senate run its own show. He wants Sen. Joe Minard, D-Harrison to preside over the Senate in his role as President Pro Tem. Minard was appointed to that largely ceremonial position by Tomblin under Senate rules that don't require members to elect him. Gov. Tomblin's influence over Senate members will be tested at this caucus. He appointed Chafin as majority leader along with all the committee chairmen. So Chafin is one of several members who might end up on the back row, if Kessler's planned political coup becomes a reality. Sen. Herb Snyder, D-Jefferson, has already gone public with the suggestion that a majority of the Senate Democrats would come up with a new leadership team. That could lead to changes in the chairmanship of some powerful committees like the Senate Finance Committee where Sen. Walt Helmick, D-Pocahontas, currently holds that post. Kessler might have to relinquish his current post as chairman of the Senate Judiciary Committee--generally considered second only to the Finance Chairman's job in terms of power and importance--if he does take on the job of presiding officer during floor sessions. Former Sen. Mike Oliverio, D-Monongalia, was vice-chairman of that committee for the past two years and he won't be coming back after making an unsuccessful bid for a seat in the U. S. Congress. Sen. Brooks McCabe, D-Kanawha, currently vice chairman of the finance committee could cast his lot with Kessler at the caucus and perhaps become chairman if Helmick ends up on the wrong side in the caucus vote. Both Chafin and Helmick, though, have displayed an amazing ability for political survival in such showdowns. And the final results may not be certain until the opening day of the legislative session when any changes will be formally approved... MEANWHILE, the success of state-licensed gambling in the eastern panhandle continues to exceed all expectations. Charles Town's relatively new Hollywood Casino grossed $0. million in October which is more than three-fourths of all the table games revenue for all the state's casinos combined. That's a far better yield than the initial predictions from state lottery officials who predicted when Jefferson County voters approved table games at the Charles Town racetrack a year ago that the yield there would be more than half the state's total take. As evidence of the wide gap between the revenues generated there, the new Mardi Gras casino at Tri-State Greyhound Racetrack in Kanawha County is second in table games revenue with $. million in October. Tri- State did jump ahead of Mountaineer Racetrack and Casino in Chester, though, which reported revenues of $. million. The fourth racetrack operation on Wheeling Island produced $. million. Admittedly the new hotel that opened earlier this year is helping the Kanawha County casino. And Charles Town's initial results may drop after the newness of the table games wears off there. 6 WEDNESDAY, DECEMBER, 00 PAGE A Education Tobacco and Drug Free Programs Scott High School has been very busy with its drug and tobacco free programs. The RAZE crew went to the Regional RAZE kick-off at the University of Charleston. They met with other teens in the fight against big tobacco with a day of fun, learning, and ideas. We have also held a N-O- T on tobacco class. It had four students but was successful. N-O-T is a ten week class on ways to stop smoking and the effects of tobacco. Each year the N-O-T program gives an award for the school who has the most students reduce or quit smoking for the year. Scott High School has won this award for the last four years. The students are a great resource in helping other students to stop smoking and become drug free. For Red Ribbon week, the students handed out red ribbons and put up signs around the school promoting tobacco and drug awareness. Also, students signed a pledge to become drug free. Also, Scott High School joined with the rest of the country on Nation Smoke Out day to pledge to stop smoking. The students have been very busy with tobacco and drug free activities. A check in the amount of $000 was received from Erie Insurance to form a Looking Out Club. The money will be used for activities to stop teens from dangerous driving habits such as drinking and driving and texting and driving. Brookview s trip to the State Capitol & Museum The th grade students at Brookview Elementary toured the State Capitol and visited the WV State Museum on October, 00. This trip was a great opportunity for the students to learn about artifacts, culture, and history. All students had the opportunity to use flip cameras to document their experiences. Their videos were saved on flash drives provided by the WV State Museum. Some of the students, who are participating in the WV GeoCache Challenge, followed clues to find a GeoCaching treasure. 8 WEDNESDAY, DECEMBER, 00 PAGE A Faith The season for the reason In the midst of all that is associated with the Christmas Season, we often hear Jesus is the reason for the season. I accept that without any hesitancy at all. He is the reason. Without Him there would be no such thing as Christmas. The very word tells us it is the Christ mass-- the celebration of the birth of Jesus Christ. Without question, Christ is the reason. BILL ELLIS The month of December is the season we, and millions throughout the world, celebrate the reason. It is a time for Him. He is center stage. Those of us who embrace Him know that without Him there would be no reason or season called Christmas. It is all about Him. John, the beloved disciple and follower of Jesus, sets the record straight with these words in his introduction to the birth and life of Christ. In the beginning was the Word, and the Word was with God, and the Word was God. He was in the beginning with God. All things were made through Him, and without Him nothing was made that was made (John :-). It is important that we understand that Jesus existed before the world was created. The Living Bible, a paraphrase of the Holy Scripture, renders verse three and Jesus part in creation this way: He created everything there is nothing exists that he didn t make (John :). William Barclay, the great New Testament expositor of Scotland, renders this verse, He was the agent through whom all things were made; and there is not a single thing which exists in this world which came into being without Him. He is the season. He is the reason. We moderns have tacked so much nonsense onto the Christmas story that the meaning of the day and the season has all but been buried under the debris of time. What can be done that might clarify the meaning of Christmas? I suggest a few simple things that might help bring some additional degree of meaning to his magnificent event.. Join with me in adopting the greeting Merry Christmas rather than the Happy Holidays. The real meaning is high above a mere holiday. It is Merry Christmas, Happy Christmas, Blessed Christmas or some other version, but without Christ in it, the meaning is lost.. All Christmas cards, letters, signs, billboards and whatever, without Christ as the prominent one misses the point. Spread the name of Jesus Christ in every communication.. Decorations may be colorful and bright, but they too should be about Christ. We do not have an actual photograph of Jesus. Warner Sallman, whom Kitty and I met in Anderson, IN., in 0, did the most famous artistic portrayal of Jesus. In recent years, we talked with his son in Naples, FL.. I enjoy the songs about Christmas, especially the standard classics, but I like best the great hymns and gospel songs that have stood the tests of time.. When we give gifts to family and friends, we do so in following the example of the Wise Men who brought gifts to the Christ child. Such organizations as Samaritan s Purse, World Vision, Prison Fellowship and other Christian service organizations have gift catalogs through which you may give to the neediest in the world. The Union Mission, City Mission and The Salvation Army distribute our gifts -- money and material to those in need. The reason for the season is to exalt Jesus Christ and all that is done in His name. Reach out to others in every way you can and bless their lives through Christ and the gift of eternal life. This tells us that our lives are no mistake. Our parents may not had planned us, but God did, He was not surprised by our birth. I was born two months early. Before I was conceived by my parents, I was already conceived in God s mind. It was not a change or fate. We are alive because God wanted to create you and me; Look what the Bible has to say here, The LORD will perfect that which concerned me: thy mercy, O LORD, endureth for ever; forsake not the works of thine own hands (Psalm :). He will complete what he has begun. He will complete what he has begun. He will not begin to interpose in my behalf, and then abandon me. He will not encourage me, and then cast me off. God chose our race, the color of our skin, hair, and every other feature. My substance was not hid from thee, when I was made in secret, and curiously wrought in the lowest parts if the earth (Psalm :). What God is saying is that knew me inside and out, He knows every bone in our bodies. Do you know who God made you? God also decided when you would be born and how you would live. When I was born I was two months early. But in God s plans that was the day I was to be born. Thine eyes did see my subject God plans and I was did see my substance, yet being imperfect; and in thy books all my members were written, which in continuance were fashioned, when as yet there was none of them (Psalm :). God also planned where we would be born and where we would live for his purpose your race and nationality are no accident. I could had been born in England or I could have be born on the Queen Mary. A man without a country, but I was born in the good old West Virginia. My Aunt Margaret said I was born under a Cabbage leaf on the farm. God planned it all for a purpose. The Mountaineers claimed a portion of Big East title for the first time since 00 with Saturday's - victory against Rutgers, but saw the league's Bowl Championship Series invitation go to UConn after its victory against South Florida Saturday night. WVU accepted an invitation to the Champs Sports Bowl on Sunday, according to multiple sources. An announcement was to be made by Florida Citrus Sports, the organizing body in charge of the Champs Sports Bowl, later in the night. Now No. in the coaches' poll and No. in the Associates press poll, WVU is expected to play North Carolina State at :0 p.m. Dec. at the Citrus Bowl in Orlando, Fla. The Wolfpack (-) would have been in Saturday's Atlantic Coast Conference title game if not for a loss to Maryland a week earlier. After a - start in conference play, the Mountaineers won their final four games. "It's been a fabulous four weeks, the ride of my life, and I'm so grateful we've come out the way we have," said WVU Coach Bill Stewart.
