2 Introduction 'The School Improvement Service (SIS) began working closely with the LA Human Resources (HR) department as soon as the pilot started as we realised that the employment of tutors was very much part of their remit. As a result of this close partnership working both the SIS and HR have been able to support schools by giving them consistent messages. Headteachers have really appreciated this.' (Calderdale LA) This toolkit offers practical employment and Human Resources advice to support senior leaders and tuition leads in the planning and delivery of effective one-to-one tuition. Qualification requirements for one-to-one tutors A tutor undertaking one to one tuition must: have qualified teacher status (QTS) (although they do not have to be currently employed as a teacher); or, be a non-qts in the summer before gaining QTS; or, be an overseas trained teacher qualified to teach in schools in England; or, be an Further Education (FE) or Higher Education (HE) trained teacher with appropriate subject qualifications. One-to-one tutor recruitment and placement arrangements Analysis of tutor availability at a strategic planning level should enable tuition leads to meet their volume and quality targets. One-to-one tutors need to be recruited through a variety of marketing strategies, for example: advertisements in local newspapers flyers to every school. You may wish to contact the Training and Development Agency (TDA), who are able to provide packs with marketing materials for local use. These packs can be ordered from onetoone@tda.gov.uk. Tuition may occur in a variety of locations such as: at school in the pupil s home within the local community. Tuition may also occur at a variety of times, for example, at either end of the school day, in the evening, at weekends, during the school holidays or during the school day. For some pupils delivering tuition in one hourly sessions over a 10 week period may be most effective, whereas other pupils may benefit from blocks of time allocated over a shorter period or even through a school holiday. The class teacher and the tutor should decide which model is right for each pupil. Tutors appointed might come from a variety of backgrounds including: full or part-time teachers currently working in schools teachers/lecturers working in Further Education and/or Higher Education institutions retired teachers teachers secured through supply agency providers teachers secured through private tuition agencies. A national marketing and recruitment campaign to increase the number of tutors has been launched by the TDA. The TDA has established a national database to encourage tutor registration. Local authorities will be notified of tutors who express an interest in working in their local authority. Key stakeholders will be kept informed of developments by the TDA. Page 2 of 6
3 Selecting one-to-one tutors In determining whether an applicant should be appointed as a one-to-one tutor, it is important that the applicant meets the qualification requirements and the expected competencies/skills standards. For example, you should consider whether: the applicant complies with pre-employment checks including enhanced CRB clearance the applicant meets the definition of a qualified tutor for the purposes of providing one-to-one tuition there is evidence that the applicant has a track record of effective teaching the applicant is willing to commit to one-to-one tuition per pupil for 10 sessions in a suggested minimum of one-hour blocks, plus two additional hours, which can be used for planning, teacher liaison time, or attendance at local training the applicant is willing to engage in relevant continuous professional development (CPD) the applicant is willing to feedback effectively to the class teacher and parents/carers on the progress of the pupil. Pre-employment vetting of one-to-one tutors It is essential that pre-employment checks are undertaken for successful candidates. All tutors must also hold the appropriate level of disclosure an Enhanced Criminal Record Bureau Check. The DCSF s guidance on Safeguarding Children and Safer Recruitment in Education (2006) provides guidance on a number of mandatory recruitment and vetting checks to be undertaken and the Single Central Record of Recruitment and Vetting, which must be maintained. Additional information is available at Professional Code Schools should inform tutors of the expected professional standards, which should be based on the school s written code of conduct. In addition, schools should clarify other key expectations, for example in respect of security photo-identification; procedures in relation to child protection; data protection; and arrangements for tutor absence. Pensions Employment as a tutor by a local authority or in a school maintained by the local authority falls within the scope of the Teachers Pension Scheme (TPS), unless the tutor has opted out of this scheme formally or is already in full-time pensionable employment with another TPS employer ( If a potential tutor has queries about this issue then they should contact Teachers' Pensions on for further advice on any effects on their benefits. They should remember that they would have a duty to inform Teachers' Pensions before taking up any employment (like one-to-one tuition) that is covered by the TPS. Within the above, teachers currently in receipt of ill health early retirement benefits should be aware that: where those benefits became payable on or after 1 April 1997 a return to employment covered by the TPS would lead to immediate loss of entitlement to and thus cessation of those benefits; or Page 3 of 6
4 where those benefits became payable before 1 April 1997 a return to, or taking up further, employment covered by the TPS could lead to a review of continued entitlement to those benefits, which may or may not lead to them being stopped. None of the above stops someone who is in receipt of ill health early retirement benefits returning to teaching via the one-to-one tuition programme, but s/he must satisfy their prospective employer that s/he has the health or physical capacity to carry out the proposed activities and the effect on those benefits has to be considered (as above). Overview of funding and pay arrangements for one-to-one tuition For information on the details of the funding framework to support one-to-one tuition and payments received from the Standards Fund grant (1.5), refer to Standards Fund circular at: In summary: where tutors are paid on an hourly rate, the highly recommended hourly rate of pay is set out in the Standards Fund guidance (updated January 2009) the Standards Fund guidance suggests a gross hourly rate of 33 in inner London, 32 in outer London and 29 for the rest of England. This has been calculated according to feedback from Making Good Progress pilot LAs. The guidance suggests an average deduction of 4 for employer on costs. the Standards Fund allocation allows a tutor to receive an additional payment equivalent to 2 hours per pupil, which is paid to the tutor for preparation, liaison time, and training the Standards Fund formula includes a per pupil allocation for schools for each pupil tutored which covers costs incurred by schools for administration time and teacher tutor liaison the Standards Fund also provides central funding to support the role of local authorities. 5 Current guidance for determining appropriate terms and conditions of service for one-to-one tutors Model 1 Teacher employed to undertake tuition as their sole activity Overarching terms and conditions for tutor School Teachers Pay and Conditions Document (STPCD) - general terms and Tutor pay rate Tutor is paid in accordance with the terms and conditions under STPCD. Model 2 Full or part-time teacher at the school, also works as a tutor out-of-school hours (i.e. outside the normal school day for that particular school) Model 3 Part-time teacher who accepts one-to-one tuition in school day in addition to existing arrangements Model 4 Tutor in or outside the school day where tutor engaged on local (tailored) terms and conditions determined by the employer (e.g. an Academy) School Teachers Pay and Conditions Document (STPCD) - general terms and School Teachers Pay and Conditions Document (STPCD) - general terms and Local (tailored) terms and Part 7 of the STPCD contains provisions for additional payments. Additional hours payment should be based on the approved Relevant Body s (e.g. Governing Body) hourly paid rate. Recommendation: hourly pay rate is based on the Standards Fund highly recommended out-of-school hours rate (approximately M6). Tutor is paid in accordance with the terms and conditions under STPCD. Recommendation: the hourly pay rate is based on the Standards Fund highly recommended rate (approximately M6) or, if during the school day, reflects the local arrangement in accordance with the teacher s terms and Model 5 Tutor engaged in or out of school hours by supply agency/private tuition agency Terms and conditions negotiated between tutor and supply agency/private tuition agency. Determined by supply agency/private tuition agency. Recommended that the hourly gross pay rate paid to the agency by the school/la does not exceed the Standards Fund highly recommended rate. * Advice should be sought from HR providers on providing written confirmation to one-to-one tutors.
