3 Cyclist wins 100% of claim three years after life changing accident Network Rail pleeds guilty We represent James How, a 10 year old boy who was a passenger in a pick-up truck that was hit by a train on an unmanned level crossing near Beccles in Network Rail pleaded guilty at Ipswich Crown Court to breaching Health & Safety law and have been fined 500,000. The vehicle was being driven by his grandfather, Richard Wright, on a private farm road in July James suffered a serious head injury. Quantum is yet to be clarified. Whilst James is back at school, there are evident cognitive issues and careful consideration will need to be given as to the lifelong impact. Cyclist Veronika Pete, a 31 year old marketing professional from central London, was left with life changing injuries after she was run over by a lorry crossing lanes to turn left on the Marble Arch gyratory on 7th December Acting on behalf of the defendant, insurance company RSA alleged that Veronika was partially responsible for the accident despite the driver being found guilty of careless driving as well as the vehicle not being fitted with adequate mirrors or safety equipment. Having initially suggested 20% liability to be accepted by Veronika, RSA gave in and acknowledged full liability just weeks before trial. Veronika was cycling along her regular route to work, travelling around the Marble Arch gyratory and heading towards Oxford Street past the exit to Edgware Road. The driver of the heavy bullion vehicle, Mr John Taylor, stated that he had seen the cyclist but then lost sight of her. He assumed she had turned left, taking the exit to Edgware Road. In fact Veronika was at the front of the bullion vehicle below the cab s line of sight. The vehicle was not fitted with mirrors designed to increase visibility that are now recommended for all new HGVs. The driver turned left across the lane, dragging Veronika under the lorry s wheels. She was rushed to St Mary s Hospital in Paddington where she received emergency Commenting on the development, Veronika Pete said: I hope that I have been through will help other victims in a similar situations stay strong in the face of legal pressure. But I hope especially that the insurence industry will this as a wake up call and realise the importance of being fully accountable for insuring fleets of ill equiped vehicles. life saving treatment. Her leg had to be amputated above the knee and her other leg was severely damaged. This was amongst many other soft tissue and orthopaedic injuries. She was transferred to Charing Cross Hospital where she spent several months undergoing multiple operations and recovering from the impact of the accident. Veronika now uses a wheelchair and is learning to walk using a prosthetic limb. She is receiving intensive rehabilitation and requires help from her partner, James, carers, family and friends. The road to recovery will be long and difficult. Veronika is now involved in campaigning for cucysle safety. Her case continues. A criminal trial was held in the summer of 2012, in which the Defendant driver was found guilty of careless driving, fined 1,300 and given 5 penalty points on his licence. Surprisingly the argument continued with the Defence maintaining that Veronika should accept to being partially at fault. RSA suggested that she should accept a 20% reduction in her damages claim to reflect this. Following lengthy civil litigation a trial date was set for May But just weeks before the trial the Defence finally agreed to judgement being entered which means that Veronika will recover her damages on a 100% basis Caring for our clients Commitment to our cases Cutting edge expertise 1

4 Seriously injured Cyclist obtains Judgement against HGV driver Ildiko Skulteti added: Driver s perceptions of road cyclists need to be changed so they re not treated as secondclass citizens. It s very sad that drivers don t take the effort to correctly use their equipment to ensure the safety of more vulnerable road users. Ildiko Skulteti, aged 35, was cycling along Southampton Row, London on 11th July A van was parked in the bus lane and so she rode down the centre of the road, passing a large HGV vehicle as she did so. The HGV vehicle was stationery in the traffic. She then stopped in front of the HGV waiting for the traffic to move ahead when traffic lights ahead turned to green. It was our case that this was the primary cause of the accident. Ildiko has had a slow recovery. She spent nearly 2 months in hospital undergoing various surgeries. She had suffered a very nasty injury to her ankle for which she is still having treatment. She also suffered spinal fractures, a shattered pelvis, a badly broken leg, lung damage and a head injury. She now walks with a stick and is still undergoing surgery. The Claim was due to go to trial to determine liability in July. The defence initially denied any responsibility for the accident stating that the Claimant had placed herself in an unsafe position. This was despite the fact that it was known that the proper adjustment of the Class VI mirror would have avoided the accident. But at a meeting between the parties, Ildiko s lawyer Jill Greenfield of Fieldfisher reached an agreement with the driver s insurers whereby they accepted that he bore the majority (80%) of the responsibility for the accident. The value of the case is yet to be determined. Unfortunately, the HGV vehicle driven by an employee of XL Video did not have its Class VI mirror correctly adjusted. Class VI mirrors are sometimes known as Cyclops or front blind spot mirrors and eliminate the blind spot immediately in front of a HGV van. 1.7 million recovered for catastrophic farm injury The Claimant was crushed by falling straw bales whilst he was working at a farm. He suffered paralysis from the waist down, an amputation and a head injury. Liability was eventually admitted. Whilst the value of the claim is currently being assessed it was clear that the Claimant needed to buy housing to be adapted. For that he would need over 1million. The Defence refused to provide that level of interim payment and this led to a fully contested hearing in the High Court which was successful, and which led to a total interim payment award of damages of over 1.7 million pounds. 2 Freephone

5 Back and neck injuries sustained while cycling to work Changing Solicitors isn t that bad Nichola rides competitively for the Dulwich Paragons. She is also a cycling specific physiotherapist and has set up her own business, VeloPhysio. Nichola was knocked off her bike whilst passing a T-junction on her way to work. She had the right of way and an oncoming car failed to stop at the junction, pulled out and actually sped up into her path. The car collided with Nichola, resulting in nasty spinal injuries. Nichola said: I was hit by a car when cycling to work last year sustaining injuries to my back and neck. It was a very traumatic time. My initial solicitor did not handle the case particularly well. I was recommended Fieldfisher through a friend. As soon as they took the case on, everything was dealt with swiftly and professionally, I was promptly seen by top medical experts, all my concerns were dealt with immediately and empathetically, and the case was resolved promptly. This significantly eased the emotional stress during a very difficult time. I could not recommend them enough. Jill Greenfield and Jennifer Bradley have successfully settled a case for Julian Fixon-Owoo. Julian was involved in a very nasty road traffic accident. He was a front seat passenger of his cousin s car. Whilst driving home from Brighton, his cousin lost control of the vehicle and collided with a lamp-post. Julian suffered significant injuries to his spleen, kidney, pelvis, jaw and teeth. Julian had originally instructed solicitors from a television advert. He was concerned that his case was not being properly investigated. Fieldfisher were instructed as a result of a personal recommendation. We were able to turnaround Julian s case within a very short period, obtaining relevant medical reports, witness statements from family and friends and other much needed evidence. This enabled us to be able to negotiate a 6 figure sum settlement and an increase of an offer made when Julia was with his previous solicitors. Jennifer said People can be concerned about changing solicitors but 60% of the cases that we deal with are taken over from other law firms. We offer a very personal service to our clients and that allows us to get a lot of key information to the Defence, ultimately in this particular case allowing us to negotiate a better settlement. 6 Over 3 million compensation recovered for above knee amputee requiring osseointegration surgery Personal Injury Mark Bowman was instructed by Mark following an accident at work on 16 June Mark was operating a JCB telescopic handler on a construction site on St Michael s Drive in Kent. The machine was not suitable for the job that Mark was being asked to carry out and toppled over, causing Mark to suffer severe crush injuries, in particular injuries so severe to his left leg that it required a trans femoral, or above knee, amputation. In addition he suffered severe injuries to his right leg including compound fractures to both the tibia and fibula. The injury to the right leg was so severe that there was a high risk of it also requiring amputation, but following multiple surgical procedures, and the use of an Ilzarov frame for over five months, it was saved. Due to the nature of his injuries Mark remained at in patient at the Royal London Hospital until 08 September 2008 at which point he was discharged to Queen Mary s Hospital in Roehampton for further rehabilitation. He was not discharged home until 21 December 2008, some 6 months after his accident. Mark required specialist accommodation and we were able to obtain sizeable interim payments in order to secure suitable, single level, rental accommodation for him throughout the conduct of the litigation. Despite liability being firmly in dispute we were also able to obtain significant interim payments in order to enable Mark to obtain private prosthetics. Unfortunately Mark s residual stump kept changing shape meaning that he was unable to use a socket with his prosthetic limb. This placed him in a very difficult position, as the most readily available alternative would be to use a wheelchair, something Mark was determined to avoid. Investigations commenced as to appropriate alternatives for Mark and it soon became clear that osseointegration surgery was a possibility. Unfortunately such treatment is not available in the UK and therefore we persuaded the Defendants that it was necessary for Mark to be treated in Sweden, the only European country offering such surgery. Over the course of his litigation Mark frequently travelled back and forth to Sweden for osseointegration surgery, whereby a titanium rod was implanted into his femur, and to which the prosthetic is attached, thereby removing the need for a conventional socket. We were able to secure a favourable liability outcome for Mark, and following a settlement meeting in July 2013, Mark was awarded a gross award of over 3,000,000 in compensation. This money will help secure Mark s future, and in particular enable him to purchase a suitable property, state of the art prosthetics and ensure he has sufficient money to pay for his complex care needs. Mark Bowman commentated: I was delighted to be able to achieve this result for Mark. More importantly we were able to arrange for Mark to receive revolutionary treatment, in the form of osseointegration surgery, during the course of his case. As far as we are aware the team in Sweden had never received a patient with an on-going personal injury claim in the UK, and we hope that other victims of personal injuries will be able to benefit from the experience that we gained in Mark s case. I fully expect osseointegration to become more and more popular over the next five to ten years, and look forward to the day when it is available in the UK. 4 Freephone

7 Mina Shah Fieldfisher act for the victims of the Apollo Theatre disaster Paul McNeil and Jill Greenfield both experienced personal injury lawyers at Fieldfisher said: Personal injury lawyers at Fieldfisher are coordinating a number of claims against Nimax Theatres on behalf of theatregoers. Many have suffered serious physical and psychological harm. It is believed that more than 70 people were hurt and taken to hospital. Many more were terrified and shocked when the roof collapsed and there was a panic to exit the theatre for fear that the building was about to collapse and cause death and further injury. The disaster occurred on Thursday, 19th December 2013 during the performance of The Curious Incident of the Dog in the Night Time at about Some of those in attendance thought that the cracking sounds were part of the special effects particularly when the We are asking Zürich, who insure Nimax Theatres, to meet as early as possible. We want to obtain immediate medical and financial support for those injured in this shocking incident and disbelief that so many had been injured in London s West End so close to Christmas. It is clear that the psychiatric consequences should not be underestimated. Tragically we now know that the roof had collapsed and the roof rafters were falling on to the audience below. 8 Success for children exposed to E.Coli We have been successful in our group action against the farm. We represent 27 children who suffered serious health problems following exposure to E.Coli 0157 at Godstone Farm and have received confirmation from the farm this week that they will not be disputing liability in this case. In August 2009 over 90 children and adults suffered serious health consequences due to their exposure to E.Coli 0157 while visiting the farm in Surrey. The E.Coli 0157 outbreak was the largest ever linked to an open farm in the UK. E.Coli 0157 is a particularly dangerous strain of e coli and can cause serious illness, including renal failure and death in children under 5 and the elderly. It is specifically carried in farm animals and it was only discovered in It is a relatively new strain of bacteria and is distinct from the e coli that we all carry. It has to be ingested by humans and is carried in the gut of animals and consequently their faeces. It does not cause any illness in animals. Proceedings issued In June 2010, we issued proceedings in a group action against the farm on behalf of Todd and Aaron Furnell, twins who were exposed to E.Coli Both of the twins, now aged three, suffered kidney failure and spent weeks in hospital after being infected with the bacteria. Medical evidence obtained in the course of the litigation indicated that some of the children are at risk of renal failure which could lead to dialysis and the need for kidney transplants in future years. Jill commented: We need to establish what went wrong and who if anyone is at fault. I would hope that the farm representatives and the Health Protection Agency will agree to meet with me as soon as possible in order that I can establish the facts as quickly as possible. I have contacted both the farm and the HPA today suggesting a meeting this week and I wait to hear. 6 Freephone

9 in Godstone Farm outbreak litigation One of the main arguments against the farm centred on the fact that small children visiting the farm were allowed to enter the pens of animals. A deep bedding system was in operation which meant that straw was piled on top of other faeces contaminated straw. Such straw would have remained in place for many weeks. It was the Claimant s case that toddlers were therefore put into direct contact with animal faeces at close quarters, which could then be on their clothes and shoes, not just their hands. The Griffin inquiry The farm initially defended the claim, despite the publication of the Health Protection Agency s report, The Griffin Inquiry, into the outbreak which found there were numerous failings in the way in which the farm handled the outbreak and in its appreciation of the risk associated with E.Coli Today s confirmation by Godstone Farm that it will not be disputing the claim applies to all of the children represented in the group action who were exposed to E.Coli 0157 between 8 August and 4 September 2009 and have suffered personal injury and consequential loss as a result. The level of financial support awarded to the families involved will be decided at a later hearing at which the court will approve any damages to be awarded. The BBC wrote Aaron needed a feeding tube for liquids for several months, and both children may need kidney transplants in the future. Other toddlers were also seriously ill on dialysis, and many of the children affected now have compromised kidney functioning. The farm was criticised by an independent investigation a year after the outbreak. The Independent reported Eight out of the children had to undergo dialysis for between eight to 35 days, leaving many with physical scars as well as a fear of hospitals, doctors and needles. The Telegraph commented A total of 36 people have been taken ill with the potentially lethal bacterial infection including 12 children who are in hospital. Four of the children are said to be in a serious condition after developing complications such as kidney failure as well as diarrhoea. Fieldfisher hosts the Wordswell conference On 19 June 2014, Fieldfisher hosted the Wordswell Towards a Positive Future annual conference at our new offices in Swan Lane, in what proved to be a thoughtprovoking and informative day. Wordswell is a group of speech and language therapists dedicated to developing the communication skills of children and adults. Fieldfisher have been proud sponsors of the Wordswell conference since The event is chaired and organised by Janet O Keefe, speech and language therapist, parent, author and expert witness. The annual conference welcomed parents of children with special educational needs and the legal, health, education and social care professionals that support them. A great line up of speakers covered topics such as the changes to the Special Education Needs landscape, the importance of strong community circles and innovative ways to support children with learning difficulties and the families that care for them. 11 Fieldfisher hosts the Medico Legal Forum seminar in April 2013 The Personal Injury Team at Field Fisher Waterhouse were delighted to host a seminar on behalf of the Medico Legal Association of Chartered Physiotherapists (MLACP) on Thursday 18th April Mark Bowman, Senior Associate at Fieldfisher will be speak on The role of an expert in the context of access to justice along side, Edwina Rawson who will spoke on Being a Medico-Legal expert. There were other presentations by practising physiotherapists throughout the day covering topics such as quantum report writing and procedures as well as causation and liability report writing and procedures. Physiotherapy plays an essential part in an injured person s rehabilitation and in the litigation process, so we are very pleased to have the opportunity to assist the MLACP Mark commented: The event was highly informative for physiotherapists who are new to medico-legal issues or those who want to develop their skills. It was also fun and we all had a great day of informative learning and development. Neuro legal conference 2013 and Litigation. Fieldfisher were proud to present its first Neuro- Legal Conference: Managing Complex Neurological Injuries through Rehabilitation This event took place in the spectacular surroundings of the St Pancras Renaissance Hotel on Thursday 11th July 2013; with over 260 delegates attending the event making it a huge success. The event included talks from brain injury specialists in this area, including Jill Greenfield (head of the catastrophic injury unit at Fieldfisher) amongst other leading professionals such as Brian Gardner, Professor Udo Kishcka, Frank Burton QC, Maggie Sargent, Rod Evans, William Latimer-Sayer, Elizabeth Ann Gumbel QC and Henry Witcomb. There also was a post conference drinks reception held in the stunning Hansom Hall Terrace. It was excellent to have so many distinguished people speak to a very high calibre audience. Often the only time that rehabilitation providers and lawyers talk to one another is when dealing with a specific case. We wanted to get people together in a different context to hopefully make it a useful and interesting day. 12 Seven figure compensation secured after catastrophic motorcycle accident At the end of the case, Martin said: Personal Injury Solicitor Mark Bowman was instructed by Martin following a motorcycle accident. Martin was initially referred to a panel solicitors through his motorcycle insurance policy but came to Fieldfisher in March On 10 May 2009 Martin was riding his motorcycle along the A41 Bicester Road. He was proceeding a safe distance behind a BMW car. On the other side of the road, a Mercedes car was being driven by the Defendant. The Defendant driver fell asleep behind the wheel of his car and veered across the road, colliding with the BMW motor car that was in front of Martin. As a result of this impact, the BMW was shunted backwards. Martin was unable to avoid this collision and as a result he suffered devastating injuries. Martin was subject to above the knee amputation to his right leg, hypoxic brain injury following respiratory arrest on the side of the road, severe injury to his left knee (which subsequently required a total knee replacement), facial fractures, weakness to the left hand, burning hypersensitivity to the left arm, Peyronie s disease and urinary complications. In spite of the circumstances of the collision, the Defendants refused to admit liability. They alleged that Martin was riding too close to the BMW vehicle and that he was not just partially, but totally, to blame for his injuries. At the time Fieldfisher were instructed Martin had received interim payments totalling 255,000 in the best part of three years. He was living in rented accommodation and was about to be forced to move as his landlord would not extend his tenancy. He did not have sufficient money to purchase suitable accommodation. Notwithstanding the Defendants stance, we were able to obtain an interim payment of 540,000 within 3 months of being instructed so that Martin could purchase suitable accommodation in which to live. Following a settlement meeting in January 2013 during which the Defendant legal team finally admitted full liability, Martin was awarded a seven figure sum in compensation, including 50,000 per year for the rest of his life to cover the cost of requiring professional care at home. Martin s compensation means that he will be able to afford state of the art prostheses in the form of c-legs and water activity limbs. He will have sufficient funds to provide him with the private care regime that he needs and so that his loving wife can return to work. Mark we really just want to say how brilliant you and Fieldfisher were in handling the case for us. We only moved to you guys less than a year before the case settled. I don t think the previous solicitors that our insurers appointed would have pushed quite as hard as you did to get us the settlement you achieved. They would certainly not have got the interim payments that you did, so we might have been forced to stay in another rented property somewhere with everything else going on still hanging over our heads. Thanks to you we were able to purchase a bungalow during the case, and it has made a huge difference to us. You, and Marise put up with us so well. You were very patient with us and always explained things well and kept us up to date with what was going on. We were never out of the loop. 13 Fieldfisher in the News Jennifer Bradley passionate about cycle safety Jennifer Bradley is a keen cyclist and passionate about safety. She launched the Fieldfisher Safe Cycling campaing working with Brake and various clients. Clients took part in a short video to be sent to the office of the Lord Mayor and various press articles were published, often with key clients involved. The focus of the campaign is Cyclists and HGV s and we have very many examples of cases whereby if the HGV vehicle had been better equipped or if the driver had been better trained the accident and its life changing consequence could have been avoided. BBC Jennifer Bradley said London s roads needs to be safe for all users, this includes cyclists. Our campaigning will help make that happen. Jill Greenfield appeared on ITV during a live debate focused on the safety of Londons cyclists with Steve McNamara of the Licensed Taxi Drivers Association Largest UK personal injury claim settlement Maisha Najeeb, now aged 13, brought a claim for compensation for treatment received at Great Ormond Street Hospital for the accidental injection of glue into her brain, which left her profoundly brain damaged. A total recovery of 24 million was reached for Maisha to pay for the her treatment and care. Sadir Hussain, Maisha s father said: We are sad and devastated by what happened to our daughter. Her life is ruined. All her dreams have been broken. I hope that by bringing this case, lessons will have been learned to avoid this happening to other families. We are grateful that agreement has been reached with Great Ormond Street to ensure that Maisha s care needs are met. Mark Bowman speaks to LBC news Mark Bowman, in our Personal Injury department was interviewed this morning and asked to provide his thoughts on the deaths of 5 cyclists in London within the past 9 days. 15 Meet the team Paul McNeil e: t: Paul heads the personal injury and medical negligence department and has specialised in serious injury claims for over 25 years.
