PRACTICE AREAS Personal Injury Industrial Disease Health & Safety Inquests PERSONAL INJURY Tom has extensive experience of personal injury litigation including the following specialist areas: EMPLOYER'S LIABILITY Regularly instructed in accident cases involving all key EL areas including Work Equipment, Manual Handling, CONDAM, Workplace and COSHH issues. Considerable experience of claims involving assaults by service-users in a variety of social care situations. PUBLIC LIABILITY
2 Very considerable experience of highway tripping and nuisance claims, Defective Premises/Landlord and Tenant cases, and a wide variety of cases involving accidents at School. Notable cases in 2013 including representing a local authority in the context of a playground accident involving unusual climbing equipment (multi-track liability trial; Court of Appeal), and a claim against a hotel in negligence and vicarious liability arising from an assault by an offduty employee. ROAD TRAFFIC/RTA FRAUD/RTA QUANTUM CASES Regularly instructed to defend RTA cases involving suspicions of fraud. Considerable experience of assessing quantum in serious injury cases. Tom started 2014 with back-toback conferences with a Consultant Neurologist and a Consultant Neuropsychologist in an RTA brain injury case. FATAL ACCIDENTS In 2013 successfully defended a fatal RTA claim involving detailed cross-examination of an accident reconstruction expert. Regularly instructed to assess quantum in fatal accident claims. QUANTUM Tom is experienced for both sides in assessments of damages, particularly cases involving cross-examination of medical experts. SEMINARS/TRAINING/LECTURES Tom has always enjoyed making time to assist in the delivery of relevant training, and has visited clients' premises to help conduct 'mock trials' in HAVS, Manual Handling and Highways claims. Tom represented Mrs Smith in her successful multitrack first instance trial in 2007 when he was less than 5 years call. He was subsequently led by Patrick Limb QC in the House of Lords. 3 INDUSTRIAL DISEASE Tom joins Guildhall from Ropewalk Chambers in Nottingham with a long-established pedigree in industrial disease work including asbestos, noise-induced hearing loss, HAVS, WRULD, and stress at work claims. In HAVS cases Tom has regular involvement at all stages for claimants and defendants; he has group litigation experience (led by Dominic Nolan QC) in the context of multiple claims by Potash miners. In 2013 he co-defended a multi-track HAVS claim for over 150K, reducing the award of damages to below 10K. In Noise-Induced Hearing Loss claims Tom has regular involvement at all stages (both sides). He is regularly instructed in limitation hearings. In 2013 Tom was instructed by a local authority in successfully defending an unusual claim for skin disease caused by exposure to the sun in outdoor work. The case gave rise to complicated issues on breach of duty and causation, and required detailed crossexamination of a Consultant Oncologist. HEALTH & SAFETY Tom is regularly instructed via Insurers on behalf of companies facing Health and Safety prosecutions. He has particular experience of cases involving serious or fatal injuries to employees. Notable cases in included the prosecution of a public school in relation to asbestos offences and the prosecution of two companies (a small local roofing firm and their large client) following the death of a scaffolder in a fall from height. Seminars delivered by him on related subjects include Sections 2 and 3 of the Health and Safety at Work, etc, Act 1974 in the Appellate Courts. INQUESTS Tom has considerable experience of appearing at Inquests on behalf of bereaved families, local authorities, employers and other interested parties. SIGNIFICANT CASES
4 Instruction on behalf of the family of a teenage boy tragically killed in a fall on a mountaineering expedition to Spain. Instruction on behalf of a local authority in the high-profile case of Re: Michael Barnett, involving a young man who became trapped in a storm drain during severe flooding in the East Riding of Yorkshire. Instruction on behalf of the family of an engineer who became trapped in a printing machine, involving complicated expert engineering evidence from employers, manufacturers and the HSE. Instruction on behalf of the family of a glass worker who was trapped in between two heavy loads in the course of a mechanical lifting operation. Instruction on behalf of a local authority in a railway Road Vehicle Incursion case, featuring underlying issues between Network Rail and the local Highway Authority. Instruction on behalf of the family of a metalworker killed when the side of a metal barge collapsed onto him in a recycling depot.
