1 PRIVACY POLICY Note: The definition of Staff in this policy refers to all Employees, Contractors, Healthcare Providers at Adelaide Unicare and Students who attend the practice as part of their studies. A. PURPOSE To ensure patients who receive care from Adelaide Unicare Pty Ltd ( Adelaide Unicare ) are comfortable in entrusting their personal information to Adelaide Unicare. This policy provides information to patients explaining how their personal information (which includes their health information) is collected and used within Adelaide Unicare, and the circumstances in which Adelaide Unicare may disclose it to third parties. B. BACKGROUND & RATIONALE This Privacy Policy describes how Adelaide Unicare including its related business units ( Practices ) collect, hold, use and disclose personal information in a manner which is consistent with the Privacy Act In this policy, the terms Adelaide Unicare and The Practice are used interchangeably and mean the same. An individual who provides personal information to Adelaide Unicare may access this Privacy Policy via Adelaide Unicare s website at By providing personal information to Adelaide Unicare and having access to this Privacy Policy, an individual consents to Adelaide Unicare collecting, holding, using and disclosing personal information in accordance with this Privacy Policy. C. PRACTICE PROCEDURE Adelaide Unicare s Practices will: provide a copy of this Policy to patients upon request. ensure staff comply with this policy and with the Australian Privacy Principles ( APPs ) and deal appropriately with inquiries or concerns. take such steps as are reasonable in the circumstances to implement practices, procedures and systems so as to ensure compliance with the APPs and deal with inquiries or complaints. 2 collect personal information for the primary purpose of managing a patient s healthcare and for managing the billing and receipting processes associated with the cost of the patient s healthcare. D. STAFF RESPONSIBILITY The Practice s staff will take reasonable steps to ensure patients understand: what information has been and is being collected. why the information is being collected, and whether this is due to a legal or administrative requirement. how the information will be used or disclosed. why and when patient consent is necessary. the Practice s procedures for access to and correction of information, and responding to complaints of information breaches, including by providing a copy of this policy. E. PATIENT CONSENT The Practice will only interpret and apply a patient s consent for Adelaide Unicare to use such personal information for the primary purposes for which it was provided. The Practice staff must seek additional consent from the patient if the personal information collected is to be used for any other purpose. F. PRIMARY PURPOSES FOR THE COLLECTION OF PERSONAL INFORMATION A patient s personal information is used or disclosed primarily for purposes directly related to their health care and in ways that are consistent with a patient s expectations. In the interests of providing high quality and continuity of health care this may include sharing such information with other health care providers who comprise a patient s medical team from time to time. In addition relevant components of a patient s personal information is routinely used or disclosed to Medicare and other third party payers for the purposes of managing the billing and receipting processes associated with the cost of the patient s healthcare. G. INFORMATION COLLECTED & METHOD OF STORAGE Collected personal information will include a patient s: name, address and contact details. 3 healthcare identifiers. medical information including medical history, medications, allergies, adverse events, immunisations, social history, family history and risk factors A patient s personal information may be held at the Practice in various forms including: as paper records. as electronic records. as visual records x-rays, CT scans, videos and photos. as audio recordings. The Practice holds all personal information securely, whether in electronic format in which case such information is stored in protected information systems, or in hard copy format in which case such information is stored in a secure environment. H. MANNER OF COLLECTION OF PERSONAL INFORMATION The Practice s procedure for collecting personal information is set out below:- Practice staff collect patients personal and demographic information via registration when a patient presents to the Practice for the first time. Such information is usually collected via a Patient Registration Form. The format of this form will change from time to time as will the relevant information that is collected from the patient. Patients are encouraged to pay attention to the patient registration form and the information contained therein about the management of collected information and patient privacy. Personal information may be updated each time the patient presents to the Practice. During the course of providing medical services, the Practice s healthcare providers will by necessary collect further personal information. Personal information may also be collected from the patient s guardian or responsible person (where practicable and necessary), or from any other involved healthcare provider. I. USE & DISCLOSURE OF PERSONAL INFORMATION Unless otherwise consented to, patient s personal information will only be used for the purpose of providing medical services and for managing the billing and receipting processes associated with the cost of the patient s healthcare. In addition some disclosure of patient s personal information may occur to third parties engaged by or for the Practice for business purposes, such as for accreditation and risk Authorised by Chief Executive Officer Review Date: 03 June 2016 Page 3 of 5

4 management purposes, research and education or for the provision of information technology. These third parties are also required to comply with this policy. The Practice will also inform the patient where there is a statutory requirement to disclose certain personal information (for example, some diseases require mandatory notification). Other than for the abovementioned reasons, the Practice will not disclose patient s personal information to any other third party without full disclosure to & consent from the patient or the patient s guardian or other responsible person. Notwithstanding the above there are some occasions where patient s personal information, including their health information, may be disclosed without the patient s explicit consent. These circumstances include where such disclosure is:- Required by law. Necessary to lessen or prevent a serious threat to a patient s life, health or safety or public health or safety, or it is impractical to obtain the patient s consent. To assist in locating a missing person. Required to fulfil a medical indemnity insurance obligation. To establish, exercise or defend an equitable claim. For the purpose of a confidential dispute resolution process. The Practice will not disclose personal information to anyone outside Australia without need and without patient consent. The Practice will not use any personal information in relation to direct marketing to a patient without that patient s express consent. Patients may opt-out of direct marketing at any time by notifying the Practice via letter or . The Practice evaluates all unsolicited information it receives to decide if it should be kept, acted on or destroyed. J. ACCESS TO & CORRECTIONS OF PERSONAL INFORMATION The Practice acknowledges patients may request access to their medical records. Patients are encouraged to make this request in writing, and the Practice will respond within a reasonable time frame. Where a patient wishes to be provided with a copy of their medical records, then such request should be provided in writing. The Practice has the right to charge a fee for providing a patient with a copy of their medical records providing such fee is reasonable and commensurate with the cost to the Practice in providing such information. 5 The Practice will take reasonable steps to correct personal information where it is satisfied that such information is not accurate or up to date. From time to time, the Practice will ask patients to verify that the personal information held by the Practice is correct and up to date. Patients may also request the Practice to correct or update their information, and patients should make such requests in writing. The Practice takes complaints and concerns about the privacy of patients personal information seriously. Patients should express any privacy concerns in writing. The Practice will then attempt to resolve it in accordance with its complaint resolution procedures. K. CHANGES TO PRIVACY POLICY From time to time it may be necessary for Adelaide Unicare to review and revise its Privacy Policy. Adelaide Unicare reserves the right to change its Privacy Policy at any time, and it may notify patients about changes to its Privacy Policy by posting an updated version on its website. L. FURTHER INFORMATION This Privacy Policy is designed to show how Adelaide Unicare aims to comply with the Privacy Act 1988 and the Australian Privacy Principles ( APPs ).
