In Attendance: Andrew Roach (Chief Executive Officer), David Tuxford (Director Business & Community Services), Eric Kraak (Manager Works Construction) and Ken Harris (Director Planning & Environment) 2. APOLOGIES THAT the apologies of Cr C Gow, Meiklejohn and Pennisi be recorded and leave of absence be granted. Moved Cr D Ingram Seconded Cr J McNally. 9.06am Cr Bartley joined the meeting. 3. DECLARATION OF CONFLICTS OF INTERESTS Item Item Precis No 5.1 Proposed Engagement of Consultant to Project Manage and Contract Administer NDRRA Restoration Project for January 2013 Event 6.1 Evaluation of Tenders for SDRC NDRRA Flood Restoration Project (Contract No. SDRCNDRRA004) Restoration of January 2013 Event Nature of Conflict Cr Mackenzie declared that a perceived conflict of interest in this matter (as defined in section 173 of the Local Government Act 2009), may exist due to the fact that he was well known to the Duff family. Cr Mackenzie dealt with the perceived conflict of interest by stating that it was his determination that his personal interest is not of sufficient significance that it would lead to him making a decision on this matter that is contrary to the public interest. Cr Mackenzie participated in the discussion and voting on this matter. Cr Mackenzie declared that a perceived conflict of interest in this matter (as defined in section 173 of the Local Government Act 2009), may exist due to the fact that he was well known to the Duff family. 4 4. CAT REGISTRATION 4.1 Cat Registration THAT Council 1. Under Section 226 of the Animal Management (Cats and Dogs) Act 2008 Council resolves to not make itself a Declared Local Government and does not wish to make a Local Law for cat registration. 2. As the registration period for cats is about to expire no refunds of registration fees will be undertaken. 3. Write to the State Government advising that due to the timeframe Council was unable to undertake community consultation on this matter. Moved Cr J Mackenzie Seconded Cr G Rees. 5. PROPOSED ENGAGEMENT OF CONSULTANT TO PROJECT MANAGE AND CONTRACT ADMINISTER NDRRA RESTORATION PROJECT FOR JANUARY 2013 EVENT 5.1 Proposed Engagement of Consultant to Project Manage and Contract Administer NDRRA Restoration Project for January 2013 Event CONFIDENTIAL THAT Council resolves, to engage GHD to Project Manage and Contract Administer NDRRA Restoration Project for January 2013 Event for the estimated amount of $616,000 (excluding GST). 5 6. EVALUATION OF TENDERS FOR SDRC NDRRA FLOOD RESTORATION PROJECT (CONTRACT NO. SDRCNDRRA004) RESTORATION OF JANUARY 2013 EVENT 6.1 Evaluation of Tenders for SDRC NDRRA Flood Restoration Project (Contract No. SDRC NDRRA004) Restoration of January 2013 Event CONFIDENTIAL THAT Council resolves, that subject to successful negotiation of commercial and legal terms and subject to no adverse finding in relation to the financial capacity assessment, the Council accepts and enters into a contract for its NDRRA 2013 Flood Restoration Project (SDRCNDRRA004) with Probuild Civil (Qld) Pty Ltd in the amount of $9,870,887 (excluding GST) Moved Cr J McNally Seconded Cr R Bartley.
