9 Admission Requirements The entry requirements for the LL.M are drawn up in accordance with the University s regulations, as indicated below. A) The candidate must satisfy one, or combination, of the following conditions; hold one of the following prior to commencement of the Programme: 1. A UK first degree with honours at a minimum of 2:2 or above. 2. A non-graduate qualification which the University deems to be of satisfactory standard for the purpose of post-graduate admission. 3. In the absence of a UK first degree with honours (or equivalent), the candidate should have relevant work experience and have held a position of responsibility in a legal department for a minimum of three years within the previous five years. B) For non UK degree programmes, the University will use the NARIC database to determine its equivalence to a UK honours degree. C) Applicants presenting nonstandard qualifications with substantial legal practice and law related experience may be invited for an interview to present their experiential learning. D) If an applicant s first language is not English, he or she must be able to demonstrate oral and written fluency in English. Working or studying in an English-speaking environment will usually be sufficient to demonstrate an acceptable competence. Otherwise applications for admission must be accompanied by a certificate of competency in the English language from a recognised institution or programme - English language requirements for non- English-speaking students are a minimum IELTS score of 6.5 or minimum TOEFL score of 600, or equivalent. 12 Module Descriptions There are no average courses within our LL.M in International Business Law programme. We are committed to providing an exceptional learning experience, and there is no better way to achieve this than with outstanding courses. Instead, you are given reallife case studies to work on and essays to write, which allow you to think critically about current legal issues that might be directly relevant to your own career. All this might seem too glossy but there is one catch: we do not accept average candidates. Only individuals as outstanding as our values are accepted for admission to Robert Kennedy College. Induction Not-for-credit module A not-for-credit induction module will be the starting point of the programme. The induction process is designed to familiarise you with the programme design, requirements and resources, as well as with the way that the online interaction, learning and grading will take place. After the induction you will be familiar with academic life, including academic writing, library services and library access, the OnlineCampus access, and academic support services. LAWS 7100 Advanced Legal Skills Core module This module, which is compulsory for all LL.M students, provides an opportunity for students to develop core skills in legal research. Expert guidance is provided in locating and using international law sources especially electronic sources. Particular attention is also paid to analysis of legal texts, reasoning skills, presenting research, both orally and in writing, and appropriate referencing.

13 LAWS 7101 International Investment Law Elective module The aim of this module is to provide students with a solid understanding of international investment law with particular emphasis on collective investment schemes, including Exchange Traded Funds, and the law relevant to other investment vehicles such as unsecured debt obligations, exchange traded notes and tracker certificates. The module is particularly relevant to address the needs of the increasing compliance requirements in the financial sector and updates to the regulations to address new financial products such as synthetic exchange traded funds and synthetic financial products. The module will also allow students to explore comparative aspects between the laws of Switzerland, the European Union and the United States. LAWS 7102 International Trade Law Elective module To provide an appreciation of the laws governing the trading of goods on the international marketplace. To examine the development and influence of the laws governing areas such as export trading, legal relationships between the parties, the nature of the particular types of contracts, and the rights and liabilities that arise. LAWS 7103 Corporate Governance Elective module This module allows students to gain a comprehensive understanding of International Corporate Governance. The topics covered range from the core OECD principles to an exploration of corporate governance in international bodies such as the IMF and the World Bank and in several jurisdictions such as the U.S.A., the UK, Canada, Australia, New Zealand, Europe and Japan. Topics include auditing liabilities, board oversight and liabilities, and the detection and prevention of management fraud. LAWS 7104 International ADR Core module - Requires one week residency at the University of Cumbria London campus The purpose of this module is to familiarise students with a wide range of dispute resolution processes as alternatives to conventional forms of adjudication and their impact on legal system. The module will equip you with basic tools which can help you in representing your client in an Alternative Dispute Resolution (ADR) process, primarily in mediation. The module in particular aims to form ones own approach to help clients and society select and employ the most effective, just, and humane methods of dispute resolution. The module will cover a wide range of jurisdictions where ADR is possible, developing a comparative standpoint and focusing more on the broad area of commercial disputes. ADR is a truly interdisciplinary field comprising law, social science, economics, psychology and others. However, the module is primarily designed for lawyers and experts directly involved in resolution of legal disputes. ADR is also a newly emerging and vibrant area of scholarship where it is impossible to give simple yes or no answers to most questions. Therefore the module will employ critical thinking and an open discussion approach. 13

14 LAWS 7105 International Human Rights Elective module The aim of this module is to provide students with a comprehensive overview of International Human Rights law as a global legal system including international human rights treaties and committees. It will also allow students to develop an understanding of international human rights as jus cogens norms, the various protection mechanisms and the contemporary jus commune of human rights. LAWS 7106 International Intellectual Property law Elective module This module covers Intellectual Property law including copyright, trade-marks, patents and trade secrets. It includes a coverage of the relationship between IP law and new technologies such as domain names and the treatment of a variety of intellectual property issues in the modern age. It combines theory with practice through the analysis of a variety of cases and enforcement procedures. LAWS 7107 Dissertation Core module This dissertation module aims to enable students to provide a major piece of summary evidence as to the student s understanding of a topic selected from the optional topics offered on the international business law degree. It will provide an opportunity for the students to demonstrate how they can synthesise their acquired knowledge and skills into an analytical or empirical study of a legal topic relevant to their degree. 14

15 Aims and Outcomes The programme aims to provide students with a rigorous academic experience whilst also developing innovative methods of delivery, particularly in the use of technology enhanced learning. Much emphasis is placed on deep learning whereby learners grasp and apply principles to different contexts and experiences. Skill usage is integrated with subject knowledge, and skill and subject coverage is designed to be incremental. Methods of innovative delivery use pedagogical approaches such as active learning from quizzes and experiments, role play and debates, enquiry-based learning and interactive learning using group discussions and clinical legal education methods. Students are encouraged to critically reflect on their skills development in order to develop their ability to make sound professional judgments. This allows students to actively apply and integrate the theory of law with legal and professional skills. The main aims of the programme are: 1. To facilitate a critical awareness of current issues and the transnational business environment, informed by leading edge research and practice. 2. To equip students, through the use of seminar/workshop-based learning, with the ability to demonstrate effective skills of team work, self-confidence in group situations, and critical and analytical reasoning skills. 3. To develop a systematic understanding and critical appreciation of the complex legal, economic and political issues surrounding international trade relations, global business and their regulation. 4. To develop skills to enable the synthesis and interpretation of course material and enable students to develop their own theories and hypotheses in the context of existing recorded material applied to new situations, and be able to communicate their ideas effectively. 5. To provide the basis, in particular through the undertaking of the dissertation but also through the undertaking of coursework, for the development of critical analytical skills and application of academic knowledge for further research within the area of International Business Law. 15
