5 Maryland Higher Education Commission Regular Session Minutes of Meeting February 25, :30 a.m. The Maryland Higher Education Commission (MHEC) met on Wednesday, February 25, 2015 at 6 N. Approval of Minutes Action Item Commissioner Yaeger motioned for approval for the December 18, 2015 open meeting minutes. The motion was seconded by Commissioner Siddiqi. The motion was approved unanimously. Commissioner MacFarlane motioned for approval of the January 28, 2015 open meeting minutes. The motion was seconded by Commissioner Siddiqi. The motion was approved unanimously. Commissioner Schuckman motioned to add the January 28, 2015 closed meeting minutes to the agenda and for approval. The motion was seconded by Commissioner Boyd. The motion was approved unanimously. 1

6 Chairman s Remarks Chairman Hasan gave brief remarks on the legislative session including the Secretary s and his testimony to the House Appropriations Subcommittee on Education and Economic Development and the Senate Budget & Taxation Subcommittee on Education, Business, and Administration opposing any reports regarding a study and potential merger between MSDE and MHEC due to each agency s unique mission. He remarked that the Commissioners should be active in working with the staff and legislature on this issue and others throughout the session. Secretary s Remarks Acting Secretary Hunter-Cevera thanked the Commissioners and the staff for their support and hard work in the legislature thus far. She remarked that legislators and the State Police are both interested in working with MHEC on advancing efforts to prevent sexual misconduct at Maryland s colleges and universities. Additionally, Dr. Hunter- Cevera commented that the staff have completed a survey and an effectiveness and efficiency review and the results will be presented to the Commissioners at the next meeting. Next steps will include developing a strategic plan and meeting individually with each Commissioner. Commissioner Reports Performance Based Funding (PBF) Commissioner MacFarlane Commissioner MacFarlane reported that he testified in support of PBF alongside staff at a recent legislative hearing. He remarked that there was general opposition to the concept of PBF from the colleges and universities at the hearing. New Delivery Model Commissioner Yaeger Commissioner Yaeger reported that before Dr. Forsythe departed there was significant progress in moving competency based initiatives forward with institutions beginning to submit their policies to staff. He remarked that now may be a good time to examine the direction of the workgroup and chart out a path forward in consultation with the Acting Secretary. Stakeholder Relations Commissioner Schuckman Commissioner Schuckman reported that the Legislative Reception will be moving forward in conjunction with next month s Commission meeting in Annapolis. College and university presidents, legislators, the Governor and his staff, and MHEC staff will be invited to attend. Experiential Learning Commissioner Boyd Commissioner Boyd reported that workgroup had determined there is sufficient evidence of the value of experiential learning experiences for students. The next steps will include meetings with the Chairman and Acting Secretary to chart a path forward towards implementation. Regulation Review Commissioner Packer 2

7 Commissioner Packer reported that the Faculty Advisory Council is reviewing proposed regulatory changes to the Faculty Waiver process with the hope of a revised regulation coming before the Commission later in the Spring. Financial Assistance and Outreach Chairman Hasan Chairman Hasan reported that he had a productive conversation with Ms. Donna Thomas on a path forward for implementing several reforms highlighted in the recent 2014 Joint Chairmen Report (JCR). Additionally, Ms. Thomas commented that the staff had rolled out a 3 rd party authorization or release of information process, and that the Financial Assistance Advisory Council will develop recommendations for legislative action in the next general assembly session. Advisory Council Reports The Student Advisory Council submitted a written report. Additionally, the Student Advisory Council requested the Commission to support HB667 regarding sexual assault. The Commissioners committed to reviewing the legislation and making a determination on whether to issue a letter of support. Academic Affairs Report Academic Program Actions Quarter 4 Report (October 1, 2014 December 31, 2014) Information Report Chairman Hasan recognized Dr. Shawna Acker-Ball. Dr. Shawna Acker-Ball and Ms. Monica Wheatley gave an overview of the Secretary s actions concerning degree programs, certificate programs, area of concentration, out-of-state institutions, academic program approvals, withdrawals, denials, objections, discontinuances, and online registrations. Commissioner Schuckman inquired about the potential for oversupply of nursing students in conjunction with a shortage of practica placements. Ms. Wheatley replied that staff place conditions on out-of-state institutions approval that they are responsible for helping arrange placements for their students. Placement information is provided as part of the approval process. Additionally, she remarked that the supply data indicates a continued shortage of nurses in the State. Chairman Hasan followed up on remarks from the last meeting regarding the importance of an ongoing and open dialog between MHEC, and the proposing and objecting institution(s) to ensure each institution has an opportunity to submit additional information to be considered in the review process by staff. Dr. Acker-Ball responded that the analysts work closely with the proposing and objecting institutions, and provide each party an opportunity, within the constraints of the statutory timeline, to submit additional information to be considered in the decision making process. Mr. Blom remarked that these processes are often conducted on an informal basis on a case by case basis, and a more formal documentation process for objections may be put in place. Chairman Hasan remarked that the Commissioners may want to consider creating a workgroup to thoroughly examine the program review process and suggest potential reforms such as creating specified windows for new applications. 3

8 Academic Affairs Report Private Career School Actions Quarter 4 Report (October 1, 2014 December 31, 2014) Information Report Chairman Hasan recognized Mr. Dean Kendall. Mr. Kendall provided an overview on the approval of new schools, new program approvals, change of ownership, separate classrooms, other business, certificate renewals, cease and desist orders, notices of deficiencies, and program approval denials and withdrawals. Attorney General Report Information Report Chairman Hasan recognized Mr. Mark Blom. Mr. Blom provided an overview of the staff s recent actions including a review of sexual assault policies and training for community colleges regarding the U.S. Department of Education s Office of Civil Rights enforcement of federal statues (Title IX, Cleary Act, and Violence Against Women Act) on college and university campuses. Further, Mr. Blom remarked another training would be taking place later in the spring. Finance Policy Report FY2017 Public Four-Year Colleges and Universities Capital Budget Priorities Action Report Chairman Hasan recognized Mr. David Beard. Mr. Beard reported that the capital budget priority list has not changed from the prior year. He recommended that MHEC continue approval and adoption of the FY 2017 Capital Budget Prioritization model for Public Four-year Colleges and Universities. Chairman Hasan and other Commissioners inquired why the priorities have not changed, and suggested that more information be included regarding prior year funding levels and return on investment outcomes. Mr. Beard responded that the prioritization model was designed to be broad in order to allow institutions flexibility within the framework and that MHEC reviews Facilities Master Plans (FMP) and works in collaboration with DBM and the Governor s Office on specific funding levels. Commissioner Packer motioned to recommend that the Maryland Higher Education Commission adopt the FY 2017 Capital Budget Prioritization model for Public Four-year Colleges and Universities. The motion was seconded by Commissioner Siddiqi. The motion was passed unanimously. Finance Policy Report FY2017 Community College Capital Budget Priorities Action Report Mr. Beard continued and reported that these priorities were developed in collaboration with the Maryland Association of Community Colleges and adopted by the Commission in FY There are no proposed changes to the prioritization model. He recommended that MHEC continue approval and adoption of the Capital Project Prioritization Model of the Maryland Association of Community Colleges as the MHEC Capital Project Prioritization process for community colleges. Mr. Beard further recommended that the Commission staff report on any future revisions or modifications to the Capital Project Prioritization Model. Commissioner MacFarlane motioned to recommend that the Maryland Higher Education Commission adopt the FY 2017 Capital Budget Prioritization model for Public 4

9 Four-year Colleges and Universities. The motion was seconded by Commissioner Schuckman. The motion was passed unanimously. Finance Policy Report FY2017 Community College Construction Grant Program State and Local Cost-Sharing Formula Information Report Mr. Beard continued and reported that all the community colleges, except for the Baltimore City Community College, are locally controlled entities that have the opportunity to request state capital funding support through this grant. He gave a brief overview of the percentage of State share, developed in collaboration with the Maryland State Department of Education, for newly introduced projects in the FY2017 community college capital budget request. Other Business Commissioner Yaeger requested an update regarding Sojourner Douglas. Acting Secretary Hunter-Cevera responded that information would be distributed to the Commissioners following a meeting later this afternoon. Approval of Minutes Action Item The approval of the February 25, 2015 meeting minutes was deferred to the April Commission meeting. Chairman s Remarks Chairman Hasan gave greetings to the Commissioners, staff, and audience members, specifically thanking Phyllis Reese for organizing the legislative reception occurring later in the evening, and Acting Secretary Hunter-Cevera for sharing the results of the effectiveness and efficiency (E&E) review. He introduced a new appointment to the Commission, Dr. John Joliday, who will be effective on July 1,

12 Dr. Holiday thanked the Commissioners and expressed his enthusiasm in joining the Commission and for engaging in the work of postsecondary education Secretary s Remarks Acting Secretary Hunter-Cevera welcomed everyone to the meeting, and provided a brief overview of the staff s E&E review and remarked that next steps would include developing a strategic plan. She remarked that staff would be working more closely with the Commissioners on workgroups focused on specific areas of State interest. In response to an inquiry from Commissioner Boyd, Dr. Hunter-Cevera provided a brief overview of the conversations with Sojourner Douglas including the development of teach out agreements for approximately 700 students. Additionally, she remarked that after session the Commissioners would receive a list of all of the year s upcoming reports. Commissioner Reports Experiential Learning Commissioner Boyd Commissioner Boyd reported many of the goals in the Maryland State Plan for Postsecondary Education relate to the workgroups ongoing efforts and that staff were examining which initiative(s) may be the best to move forward on. Performance Based Funding (PBF) Commissioner MacFarlane Commissioner MacFarlane had no report. Financial Assistance and Outreach Chairman Hasan Ms. Donna Thomas reported that the Office of Student Financial Assistance had completed its first round of awarding for AY , and was moving forward on several other initiatives. Commissioner Packer inquired about a recent article concerning MHEC and Towson University in the Baltimore Sun. Ms. Thomas replied that the issue had been resolved and new processes and personnel had been put in place to better bolter the unit s capacity to assist Guaranteed Access Grant students. Stakeholder Relations Commissioner Schuckman Commissioner Schuckman reported that the Legislative Reception will be occurring this evening. P-20 Perspective Commissioner DeMattos Commissioner DeMattos had no report as the P-20 Council has not met yet this year but remarked that several initiatives are ongoing in the interim. New Delivery Model Commissioner Yaeger Commissioner Yaeger reported he was interested in beginning a new workgroup focused on Veterans Completion. The work of the new workgroup would focus on issues related to veterans, specifically improving the accessibility of online programs, and the 8

13 expansion of the Department of Veteran s Affairs Yellow Ribbon program to more Maryland institutions. Regulation Review Commissioner Packer Commissioner Packer remarked that the first round of revisions will be coming forward later in the spring. Advisory Council Reports Chairman Hasan recognized Mr. Justin Fiore. Mr. Fiore reported that the Student Advisory Council has been working on issues related to the college and university sexual misconduct policies, bylaw updates, and legacy planning. Acting Secretary Hunter- Cevera responded that student input on issues such as sexual misconduct is critical. The Faculty Advisory Council had no report. Academic Affairs Report Final Action for COMAR Amendments Area of Concentration (13B ) Action Report Chairman Hasan recognized Dr. Shawna Acker-Ball. Dr. Acker-Ball reported that the Commission adopted 13B at the November 24, She outlined the amendments; explaining it allows community colleges to convert their current options or tracks to areas of concentration that were in existence before June 30, 2014, and are not currently recognized by the State. Many community colleges currently offer hundreds of options or tracks that are not recognized by the State. Commissioner Packer motioned to recommend that the Maryland Higher Education Commission adopt for final approval regulations governing the Review of Extant Curricular Offerings as an Area of Concentration at Community Colleges as drafted for COMAR 13B The motion was seconded by Commissioner Demattos. The motion was passed unanimously. Student Financial Assistance Report Proposed Action for Guideline Amendments Workforce Shortage Student Assistance Grant Program - Action Report Chairman Hasan recognized Ms. Donna Thomas. Ms. Thomas reported the amendment consisted solely of a name revision to the social work scholarship after former Delegate Ruth Kirk. Additionally, she remarked that the Workforce Shortage Advisory Council will be reconvened this year in order to review and potentially update the shortage fields. Commissioner Packer motioned to recommend that the Maryland Higher Education Commission adopt for approval the proposed guidelines revisions governing the Workforce Shortage Student Assistance Grant. The motion was seconded by Commissioner Schuckman. The motion was passed unanimously. Finance Policy Report Harford Community College/Electrical Contractors Association Lease Approval Action Report Chairman Hasan recognized Mr. Geoff Newman. Mr. Newman provided an overview of the Commission s responsibility for oversight of community college space that has been supported with State funds. He continued by providing an overview of Harford 9

14 Community College's request for approval to extend a lease of office and classroom space in Edgewood Hall to the Harford County Electrical Contractors Association. Mr. Newman further explained that community colleges are owned by the local counties and that they do occasionally lease space on a long term basis if it is not being used. This is a separate process from general auxiliary fee revenue which may be generated by short term utilization. Commissioner MacFarlane motioned to recommend that the Maryland Higher Education adopt for approval the lease extension as drafted and authorize the Secretary to forward a recommendation to the Department of General Services for review and presentation to the Board of Public Works. The motion was seconded by Commissioner Siddiqi. The motion was passed unanimously. Finance Policy Report Harford Community College/Harford County Sheriff s Office Lease Approval Action Report Mr. Newman continued by providing an overview of Harford Community College s request to extend a lease of office, classroom, and adjacent space in Edgewood Hall to the Harford County Sheriff s Office Training Academy. The Commissioners discussed the value of such partnerships between the community college and local entities, and need for an additional focus on Northeast Maryland for targeted partnerships and resources. Commissioner Schuckman motioned to recommend that the Maryland Higher Education adopt for approval the lease extension as drafted and authorize the Secretary to forward a recommendation to the Department of General Services for review and presentation to the Board of Public Works. The motion was seconded by Commissioner MacFarlane. The motion was passed unanimously. Other Business Acting Secretary Hunter-Cevera provided a brief overview of the results from the E&E review and emphasized that the agency needs to be flexible, accountable, and responsive. She continued explaining that in the face of the agency s ever growing responsibilities there is a need for additional human and information technology resources. She remarked that Commission MacFarlane and Commissioner Siddiqi will be leading the efforts to design a new strategic plan. Commissioners Boyd and Siddiqi suggested staff should consider developing an external survey to identify areas of strength and potential improvement. Commissioner Schuckman suggested a renewed effort to attain tuition remission parity for Commission staff in alignment with the colleges and universities. Chairman Hasan, Commissioner MacFarlane, and others discussed the potential of establishing a non-profit foundation and various ideas on how to incentive business participation with a potential link to concurrent or subsequent student internships with participating companies. Chairman Hasan proposed establishing a new workgroup or committee to begin work on such a plan. Adjournment 10

Hunter-Cevera Acting Secretary MEMORANDUM DATE: April 22, 2015 TO: Maryland Higher Education Commission FROM: Dr. Shawna Acker-Ball STAFF: Monica Wheatley Sheila Coleman SUBJECT: Report on Programs Reviewed from January 1, 2015 to March 31, 2015 SUMMARY: During the current reporting period, the Secretary of Higher Education acted on a total of 215 academic program proposals requiring review under Code of Maryland Regulations (COMAR) 13B and COMAR 13B.02.03, and they are outlined immediately below. Degree Programs: 5 at independent year colleges and universities 4 at public year colleges and universities 1 at public community colleges Certificate Programs: 9 at independent year colleges and universities 1 at public year colleges and universities 6 at public community colleges 1 at out-of-state institutions Area of Concentration: 5 at independent year colleges and universities Out-of State Institutions: 53 new programs 45 renewal programs Proposals Withdrawn: 1 at independent colleges and universities 1 at public community colleges Programs Denied: 0 at independent or public colleges and universities Proposals Discontinued: 43 at independent year colleges and universities 5 at public year colleges and universities 4 at public community colleges Programs Suspended: 13 at independent year colleges and universities 1 at public colleges and universities Partnerships: 3 new partnership agreement 14 closed partnership agreement Total Program Proposal Actions: 215 Additionally, in accordance with COMAR 13B online registration, the Commission registered 82 out-of-state institutions to offer 1,601 programs to Maryland residents. 18 I. PROGRAMS FAVORABLY REVIEWED AND APPROVED During this reporting period the Commission received objections to 1 program from 3 in-state institutions. The institution that received objections was an in-state institution. The Secretary approved the programs with conditions. Code of Maryland Regulations (COMAR) 13B B requires the Commission to circulate program proposals for thirty days for comment or objections from in-state institutions. The Secretary or an institution may file an objection to implementation of a proposed program if the objection is based on: (a) Inconsistency of the proposed program with the institution s approved mission; (b) Not meeting a regional or Statewide need consistent with the State Plan; (c) Unreasonable program duplication which would cause demonstrable harm to another institution; or (d) Violation of the State s equal educational opportunity obligations under State and federal law. What follows is a report on all objections the Commission has received to programs submitted for review, upon which the Secretary has issued a decision between January 1, 2015 and March 31, This report also identifies the Secretary s decision and its rationale. 14

PROGRAMS FAVORABLY REVIEWED AND APPROVED Independent Colleges and Universities Capitol Technology University Doctor of Philosophy in Management and Decision Sciences (Recommended 2/26/2015) Capitol Technology University is proposing the Doctor of Philosophy (Ph.D.) in Management and Decision Sciences. The program is designed to enable professionals from the field to understand and evaluate the scope and impact of decision sciences and associated technology from the institutional as well as from an industry and global perspective. The intent of the program is to provide the student an academic environment to support the development of high-level critical thinking and leadership skills as they relate to management and decision sciences, to develop high-level decision science technical skills, and to provide doctoral level research experience allowing innovative and practical contributions to the management and decision sciences body of knowledge. The proposed curriculum program provides a balance between a strong theoretical foundation, hands-on experience and innovative research. Graduates will be prepared to lead local, national, or global organizations in related fields and provide expert guidance for the understanding of and the utilization of organizational information assets. Eighty-three percent of the program curriculum will be delivered via distance education. Hood College Master of Science in Counseling (Recommended 2/10/2015) The Master of Science () in Counseling will provide students with the knowledge and skill set needed to work as Clinical Mental Health Counselors or pre-k through 12th grade School Counselors. The program conforms to the standards set by the Council for the Accreditation of Counseling and Related Education Programs (CACREP). Graduates of the program will demonstrate the professional knowledge, skills and practices necessary to address a wide variety of counseling activities in various settings. Graduates will be instructed in the following domains: foundations; counseling, prevention, and intervention; diversity and advocacy; assessment; research and evaluation; diagnosis; academic development; collaboration and consultation; and leadership. 16

21 Johns Hopkins University Master of (Recommended 4/1/2015) Johns Hopkins University (JHU) is proposing to offer its existing Master of Business Administration (M.) with eleven Areas of Concentration via distance education. The existing Concentrations are: Enterprise Risk Management; Financial Business; Interdisciplinary Business; Management; Marketing Management; Medical Services Management; Information Systems; Real Estate and Infrastructure; Entrepreneurship; Health Care Management; and Marketing. The M. program is designed for students who have at least two years of related full-time work experience in private, governmental or public sector organizations. The program emphasizes the latest concepts, practices and skills that professionals need to be effective managers and leaders in a wide variety of organizations. The curriculum is intended to be completed in three years. Loyola University Maryland Master of Education in Literacy Education, Reading Specialist (Recommended 1/20/2015) The Master of Education (M.Ed.) in Literacy Education, Reading Specialist concentration employs research-based practices that directly address the literacy needs of struggling readers and helps students assume leadership positions within their schools. Notre Dame of Maryland University Post-Master s Certificate in Cultural Proficiency (Recommendation 3/9/2015) The Post-Master s Certificate in Cultural Proficiency was developed at the request of the Professional Development Schools administrators to support the Maryland Teaching Consortium s new manual, Preparing Educators for High Poverty/Culturally and Linguistically Diverse Schools. The program will be available to practicing teachers and school leaders in order to gain the knowledge, skills and attitudes necessary to promote equity and employ research-based practices to meet the needs of culturally and linguistically diverse students in their schools and school systems.
