14 Uvod Knjiga sažetaka sadrži ukupno 18 sažetaka radova koji će biti prezentirani na Konferenciji MALOLJETNIČKA DELINKVENCIJA Dijalog, razmjena iskustava i znanja. Konferencija se organizuje s ciljem upoznavanja naučne, stručne i šire javnosti sa rezultatima višegodišnjeg rada na međunarodnom projektu pod nazivom: Utjecaj različitih konteksta socijalizacije na razvoj maloljetničke delinkvencije u poslijeratnoj Bosni i Hercegovini Preporuke za mjere prevencije i intervencija. Prema sadržaju tema koje će biti prezentirane sažeci se mogu grupirati u tri skupine. Prvu skupinu sačinjava osam sažetaka vezanih za plenarna izlaganja, dok druga skupina sadržava pet sažetaka vezanih za radionice. Treću skupinu sačinjava šest sažetaka najvažnijih rezultata istraživanja Utjecaj različitih konteksta socijalizacije na razvoj maloljetničke delinkvencije u poslijeratnoj Bosni i Hercegovini Preporuke za mjere prevencije i intervencija. 15 Introduction The book of abstracts contains a total of 18 abstracts that will be presented at the JUVENILE DELINQUENCY - The Dialogue, Exchange of Experiences and Knowledge Conference. The Conference is organized with the aim of presenting scientific, professional and general public with the results of years of work on an international project titled: The Impact of the Different Contexts of Socialization on the Development of Juvenile Delinquency in post-war Bosnia and Herzegovina - Recommendations for Prevention and Intervention Measures. Abstracts can be grouped in three groups according to the topics that will be presented. The first group contains abstracts related to the plenary sessions and contains eight abstracts while the second group contains five abstracts related the workshops. The third group consists of six abstracts with the most important results of the research: The Impact of the Different Contexts of Socialization on the Development of Juvenile Delinquency in post-war Bosnia and Herzegovina - Recommendations for Prevention and Intervention Measures. 16 GLAVNI REZULTATI ISTRAŽIVANJA UTJECAJ RAZLIČITIH KONTEKSTASOCIJALIZACIJE NA RAZVOJ MALOLJETNIČKE DELINKVENCIJE U POSLIJERATNOJ BOSNI I HERCEGOVINI PREPORUKE ZA MJERE PREVENCIJE I INTERVENCIJA Meliha Bijedić, Edukacijsko-rehabilitacijski fakultet Univerziteta u Tuzli Istraživanje koje je provedeno na području Tuzlanskog kantona u periodu od do godine, imalo je za cilj analizirati faktore utjecaja na razvoj maloljetničke delinkvencije i koje su potrebe u resocijalizaciji maloljetnika. Uzorak je činilo 38 maloljetnika delinkventnog ponašanja, 31 roditelja/staratelja i 44 predstavnika institucija i nevladinih organizacija koji rade u oblasti maloljetničke delinkvencije. Korištena je kombinacija kvantitativnog i kvalitativnog istraživačkog metoda. Dobiveni rezultati su predstavljeni kroz model koji uključuje karakteristike maloljetnika, funkcioniranje porodice, uloge vršnjaka, uloge škole, susjedstva, razvijenosti lokalne zajednice i socijalnih servisa, kao i primjenjivosti sudskih mjera. Došlo se do pokazatelja da su faktori u pojavi maloljetničke delinkvencije snažno vezani uz dob i spol, a da su mogući doprinoseći faktori rano javljanje poremećaja u ponašanju i odrastanje u traumatizirajućem okruženju. Dosta maloljetnika se u dječijoj dobi suočilo sa različitim gubicima, sa smrću jednog od roditelja, brata odnosno sestre ili drugog bliskog člana porodice. Izloženost različitim oblicima nasilja u porodici, zlostavljanja i zanemarivanja od članova porodice ili od drugih odraslih osoba, kao i međuvršnjačko nasilje je dio životne priče većine maloljetnika. Unutar porodice vidljive su teškoće u porodičnim relacijama, oskudna komunikacija s djecom i nedostatno roditeljstvo što su faktori rizika za razvoj delinkvencije. Za poboljšanje odnosa u porodici i funkcionalnosti u nekim slučajevima dovoljan je samo suport porodici ili druga manja intervencija. Posebno je primjetan vršnjački utjecaj, većina maloljetnika u delinkventne aktivnosti ušla je na nagovor vršnjaka. Rezultati pokazuju da je napuštanje osnovnog obrazovanja, često kažnjavanje u školi i promjene škole povezano s recidivizmom. Nerazvijenost socijalnih servisa, slaba međusobna saradnja i nedovoljno koordinirana aktivnost, nedostatna mreža nevladinih i drugih neformalnih organizacija, nedostatni kulturno-sportski sadržaji, slaba društvena potpora porodici, slabo razvijena solidarnost u zajednici, kažnjavajuća i osuđujuća politika doprinose razvoju maloljetničke delinkvencije, slaboj integraciji maloljetnika u zajednicu, stigmi i izolaciji maloljetnika i njihovih porodica. Istraživanje jasno ukazuje na potrebu snažnijeg uvezivanja institucija sistema i nevladinih organizacija u sačinjavanju više manjih i u lokalnim zajednicama lako primjenjivih programa za resocijalizaciju i reintegraciju maloljetnika. 17 THE MAIN RESULTS OF THE STUDY THE IMPACT OF THE DIFFERENT CONTEXTS OF SOCIALIZATION IN THE DEVELOPMENT OF JUVENILE DELINQUENCY IN POST-WAR BOSNIA AND HERZEGOVINA - RECOMMENDATIONS FOR PREVENTION AND INTERVENTIONS Meliha Bijedić, Faculty for Education and Rehabilitation Sciences, University of Tuzla Study that was conducted in Tuzla Canton in the period from 2010 to 2013, was aiming to analyze the factors affecting the development of juvenile delinquency and the needs in re-socialization of minors. The sample consisted of 38 juvenile delinquency, 31 parents / guardians and representatives of 44 institutions and NGOs working in the field of juvenile delinquency. Used a combination of quantitative and qualitative research methods. The results are represented by a model that includes the features of the juvenile, family functioning, role of peers, the role of schools, neighborhoods, community development and social services, as well as the applicability of judicial measures. There are indications that the factors in the occurrence of juvenile delinquency is strongly related to age and gender, and that the possible factors are contributing to early occurrence of behavioral disorders and growing up in a traumatizing environment. Lot of minors in the child s age faced with a variety of losses, with the death of a parent, brother or sister or other close family members. Exposure to various forms of violence, abuse and neglect by family members or other adults, and bullying is part of the life stories of most of the minor. Within the family are evident difficulties in family relations, communication with children is scarce and inadequate parenting as risk factors for delinquency. To improve family relationships and functioning, some cases require only suport of the family or other smaller interventions. Particularly notable peer influence, most juvenile delinquent activities entered at the urging of her peers. It is found that the abandonment of basic education, often punishment in schools and school changes associated with recidivism. Underdeveloped social services, poor mutual cooperation and not well coordinated activity, insufficient network of NGOs and other informal organizations, insufficient cultural and sports facilities, poor social support for families, underdeveloped community solidarity, punishing the guilty policies contribute to the development of juvenile delinquency, poor integration of minors in community, stigma and isolation of juveniles and their families. Study clearly indicates the need for stronger binding system institutions and nongovernmental organizations in the creation of smaller and local communities easily applicable program for re-socialization and reintegration of minors. Koje je značenje transdisciplinarne suradnje? Istraživački projekt o maloljetničkoj delinkvenciji je pilot projekat za inter i trans disciplinarnu suradnju i proces kolektivnog učenja, poboljšanje transfera znanja između različitih disciplina, između istraživanja, prakse i politike kao i između države i civilnog društva (NVO). Nadalje, delinkventi i njihove obitelji su takođe integrirani u istraživanje kao izvor znanja. Njihov život u svijetu, njihova perspektiva o tom pitanju su istraživani kroz prodođenje polu-strukturiranih intervjua. Ovaj kooperacijski pristup stvara znanje koje može poslužiti kao temelj za društveno planiranje i intervencije koje su prilagođene lokalnim uslovima, ali i orjentirane na osnovu potreba i resursa. Sa ciljem djeljenja iskustava iz ovoga načina rada prateći proces analize je proveden. Koje su prednosti takvog pristupa i što su bili izazovi? Koja je korist? Prezentacija će pokušati rasvijetliti ova pitanja. U cjelini gledano, može se reći da je ovaj proces kooperacije bio veoma izazovan za sve zainteresirane koji su uključeni. Glavni problem bio je stvaranje zajedničke radne kulture s naglaskom na temu, dok su hijerarhije i statusi stavljeni u pozadinu. Otvorenost je bila potrebna za neobičnu raspodjelu uloga i odgovornosti. Ali, članovi istraživačkog tima su također naglasili činjenicu da je kroz ovaj pristup bilo moguće dobiti mnogo dublje znanje i cjelovitije razumijevanje problema u pitanju. What is the meaning of trans-disciplinary cooperation? The research project on juvenile delinquency has been a pilot project for inter- and trans-disciplinary cooperation and a collective learning process, enhancing the transfer of knowledge between different disciplines, research, practice and politics as well as between state and civil society (NGOs). Furthermore, also the delinquents and their families have been integrated as a resource of knowledge. Their life worldand their perspective on the issue was investigated by conducting semi-structured interviews. This cooperative approach generates knowledge that can be used as a basis for social planning and interventionstrategies which are adapted to the local context as well oriented towards needs and resources. In order to share the experience of this working approach an accompanying process analysis was conducted. What were the strengths of this approach and what challenges were faced? What is the benefit? The presentation will try to shed light on these questions. On the whole it can be stated that this cooperation process was challenging for all stakeholders involved. The main issue was to create a common working culture which focused on the subject matter whereby hierarchies and status were put in the background. Openness for an unusual distribution of roles and responsibilities was required. But the research team members also stressed the fact that through this approach it was possible to get a much deeper knowledge and a more comprehensive understanding of the research issues. Last not least it opened new doors for all stakeholders. Ovim zakonom, koji sada na jednom mjesto objedinjuje sve odredbe važne za postupanje sa djecom u krivičnom postupku uvedeno je niz novina usmjerenih na humanizaciju krivičnog postupanja prema maloljetnicima. Radi se o novinama koje otvaraju nove mogućnosti u reagovanju na kriminalitet maloljetnika, ali o takvim koje će za cjelokupni sistem krivičnog pravosuđa u Federaciji Bosne i Hercegovine predstavljati svojevrstan izazov. 21 ALTERNATIVE MEASURES WITHIN THE LAW ON THE PROTECTION OF CHILDREN AND TREATMENT OF CHILDREN IN CRIMINAL PROCEDURED OPTIONS AND CHALLENGES Almir Maljević, University of Sarajevo, Faculty of Criminal Justice Sciences With the beginning of 2015, new Law on Protection of Children and Dealing with Children in Criminal Proceedings is coming into force in the Federation of Bosnia and Herzegovina. With this law, the law which gathers all provisions relevant for dealing with juveniles within a criminal justice system, a number of new provisions directed towards humanisation of the criminal proceedings for juveniles have been introduced. These provisions provide opportunities, but also pose a number of challenges for the criminal justice system of the Federation of Bosnia and Herzegovina. In this paper, tri important preconditions for successful implementation of the new legislation will be discussed. Firstly, the issue of institutional readiness to implement new legislation will be analysed. Secondly, the issue of understading the essence of the new law will be touched upon. And thirdly, the role of motivation of judges and prosecutors to implement the new law will be discussed. 22 DOBRE PRAKSE I IZAZOVI U KONTEKSTU MALOLJETNIČKE DELINKVENCIJE U HRVATSKOJ Neven Ricijaš, Edukacijsko-rehabilitacijski fakultet Sveučilišta u Zagrebu Procesne i materijalno-pravne odredbe prema maloljetnim počiniteljima kaznenih djela u Hrvatskoj definirane su Zakonom o sudovima za mladež (Narodne Novine, 84/11, 143/12, 148/13), dok je pravna podloga izvršavanja maloljetničkih sankcija određena Zakonom o izvršavanju sankcija izrečenih maloljetnicima za kaznena djela i prekršaje (Narodne Novine, 133/13). S teorijskog aspekta, spektar intervencija prema mladim počiniteljima kaznenih djela u Hrvatskoj moguće je kategorizirati na izvaninstitucionalne, poluinstitucionalne i institucionalne sankcije. Pri tome je važno težiti razvoju intervencija koje se temelje na dokazima dobre prakse, a podloga za implementaciju i unaprjeđivanje sustava može biti raznovrsna. U ovom izlaganju sustav maloljetničkog pravosuđa u Hrvatskoj bit će analiziran kroz prednosti i izazove iz različitih perspektiva - primjenom (1) Konvencije o pravima djeteta, (2) Smjernicama Odbora ministara Vijeća Europe o pravosuđu prilagođenom djeci, (3) teorijskim postavkama uspješnih sankcija u zajednici temeljem inozemnih studija i meta-analizama, te (4) rezultatima istraživanja provedenih u Hrvatskoj. 23 GOOD PRACTICE AND CHALLENGES WITHIN JUVENILE DELINQUENCY IN CROATIA Neven Ricijaš, Faculty of Education and rehabilitation Sciences, University of Zagreb Croatian Law on Juvenile Courts (Official Gazette, 84/11, 143/12, 148/13) is lex specialis that determents both criminal process as well as material elements towards juvenile offenders. Execution and implementation of sanctions is furthermore defined in the Law on Execution of Sanctions Pronounced to Juveniles for Criminal Offences and Misdemeanours (Official Gazette, 133/13). From theoretical perspective, spectrum of interventions for juvenile offenders in Croatia can be categorized into community, half-residential and residential sanctions. Within this context, it is important to develop and improve interventions on evidence-based research, while frameworks for implementation can vary. In this presentation, Croatian juvenile justice system will be analyzed through strengths and challenges, using different policy and theoretical perspectives: (1) UN Convention on the Rights of the Child, (2) Guidelines of the Committee of Ministers of the Council of Europe on child-friendly justice, (3) Theoretical principals of successful community sanctions based on foreign studies and meta-analysis, and (4) Empirical research results from Croatian studies. The advantages of transdisciplinary projects especially in the phase of transfer of the results and the development of innovations in practice will be discussed. In the second part we will treat the role of qualitative methods and their enhancement of the research design and investigative contents - also in combination with quantitative instruments to create mixed methods approaches. The resource persons will talk about their experiences they made working with qualitative methods, going into the field and getting into direct contact with the concerned persons or users of services. The analysis and output of qualitative methods as well as the communication and publication of qualitative data with special concern to the acceptance of qualitative methods in the Bosnian context, as well within the scientific community as in public will be discussed. 32 POSTOJEĆI MODELI TRETMANA MALOLJETNIKA U TUZLANSKOM KANTONU. KAKVU PODRŠKU NUDIMO MALOLJETNICIMA DELINKVENTNOG PONAŠANJA? Lejla Kuralić-Čišić 1, Teufika Ibrahimefendić 2, Melisa Slavuljica 3 Edukacijsko-rehabilitacijski fakultet Univerziteta u Tuzli 1, Vive Žene, Centar za terapiju i rehabilitaciju Tuzla 2, Disciplinski centar Tuzla 3 S obzirom da smo svjedoci svakodnevnog porasta problema maloljetnčke delinkvencije na području TK, potrebno je posebnu pažnju posvetiti kreiranju i realizaciji pojedinih modaliteta tretmana u postupanju sa djecom i mladima sa poremećajima u ponašanju. Ova radionica će istražiti i razgovarati o modelima tretmana maloljetnika u Tuzlanskom kantonu. Nakon upoznavanja sa ciljem radionice, stručno lice iz discplinskog centra će prezentirati model rada koji se primjenjuje u njihovoj instituciji, a nakon toga će se otvoriti diskusija na osnovu primjera dobre prakse kako bi se unaprijedio model pristupa delinkventima. U radu sa delinkventima planovi tretmana se prave zajedno sa delinkventom i u obzir uzimaju kompletnu osobu. Planiranje tretmana samo po sebi djeluje terapeutski jer se izgrađuje odnos sa delinkventom, čuje se priča konkretne osobe, dobije bolje razumijevanje historije i iskustva delinkventa, unutrašnji i vanjski resursi i trenutna životna situacija delinkventa. Klinička procjena može uključivati dokumentaciju delinkvencije, testiranje i dijagnozu, ali je mnogo bogatija i dublja ukloliko se stekne povjerenje kao i dogovor oko korištenja i spremanja podataka oko delinkvencije. Planiranje tretmana podrazumijeva takođe i dogovor oko broja sesija, psihoobrazovanje prema potrebama delinkventa, pripremanje za sudski proces (ukoliko u međuvremenu ide na Sud). U tretmanu je veoma važno pokazati povjerenje, poštovanje, razumijevanje, pružiti prostor i vrijeme koji su potrebni za obavljanje ovog teškog posla. Na blag način suočiti delinkventa sa jasnim kontradiktornostima i zajedno istražiti sisteme podrške na koje se može osloniti u porodici ili bližoj okolini i preuzimanju odgovornosti za učinjeno djelo. Cilj radionice je prezentiranje i diskutovanje oko postojećih modela tretmana delinkvenata kao i unapređenje i uvođenje novih i efikasnih pristupa u radu sa delinkventima. Lejla Kuralić-Čišić 1, Teufika Ibrahimefendic 2, Melisa Slavuljica 3 Education and Rehabilitation Faculty 1, Vive zene, Center for Therapy and Rehabilitation in Tuzla 2, Disciplinary center Tuzla 3 Given that we are witnessing an increase in the daily problems of juvenile delinquency in the area of TK, it is necessary to pay special attention to the creation and implementation of specific treatment modalities in the treatment of children and youth with behavioral disorders. This workshop will explore and discuss models of treatment of juveniles in Tuzla Canton. After getting acquainted with the aim of the workshop, the practitioner from disciplinary Center will present a working model that is applied to their institution, and after that will be a discussion based on examples of good practice in order to improve the model approach delinquents. In working with delinquents treatment plans are made together with delinquents and take into account the whole person. Planning the treatment itself is very therapeutic because it builds relationships with delinquents hear the story of the person, gain a better understanding of the history and experiences of delinquent, internal and external resources and current life situation delinquent. Clinical evaluation may include documentation of delinquency, testing and diagnosis, but it is much richer and deeper if they gain confidence as well as an agreement on the use and storage of data about delinquency. Planning treatment implies also an agreement on the number of sessions, psychological education to the needs of delinquent preparation for trial (if in the meantime go to court). The treatment is very important to show trust, respect, understanding, provide space and time required to perform this difficult job. On gentle way to deal with delinquent clear contradictions and explore together the support systems on which they can rely in the family or immediate environment and take responsibility for the work done. The aim of the workshop is to present and discuss some of the existing models of treatment of delinquents and the promotion and introduction of new and effective approach in dealing with delinquents.
