1 Freeport Plant Number: BCF Page: 1 of 5 Preparer: Owner: Approver: Manager Senior VP/Site Manager, Freeport Plant 1.0 Purpose and Scope 1.1 Purpose To provide direction for BASF Corporation employees, contractors, truck drivers, vendors, and visitors in the safe use of cell phones, cameras and other video or audio recording devices while on BASF Corporation s Freeport Site. 1.2 Introduction Cell phone usage has become commonplace in today s society, however it should be understood that the use of cell phones in the workplace exposes BASF Corporation and its employees to various safety and security concerns. These issues include, but are not limited to; electrically classified process areas, inefficiencies during production, distractions in the workplace, and loss of proprietary information. This Plant Standard is meant to provide the framework around which cell phones can be used at the Freeport Site The use of cameras or audio/video recording devices of any type are in principle not allowed on BASF property. Special approval can be issued by the unit Manager using an Authorization Pass or Badge. 1.3 Scope This procedure applies to all BASF Corporation employees, contractors, truck drivers, vendors, and visitors while on BASF Corporation property. 1.4 Definitions and Terms Recording Devices: Audio, photographic and video recording devices or devices with features or capabilities of recording audio or video Camera Phone: A cell phone that has a built-in camera, video and/or audio recording device.

2 Freeport Plant Number: BCF Page: 2 of Cell Phone: Cellular telephone is a type of short-wave analog or digital telecommunication in which a subscriber has a wireless connection from a mobile telephone to a relatively nearby transmitter. For the purpose of this Plant Standard, cell phone will include; cell phones, mobile phones, smart phones, satellite phones, and other similar devices used for making and receiving calls and/or text messaging. For general use of cell phones, making and receiving calls and/or text messages, there is no distinction made in this Plant Standard between cell phones and camera phones : The act of carrying a cell phone while it is powered on regardless of whether or not the person is making or receiving a call Company Business: The act of doing business on behalf of BASF or, in the case of a contractor, doing business in support of BASF objectives Control Room: Refers to any room where a process is monitored and/or controlled within the boundaries of BASF property Inside Perimeter: Refers to being inside the restricted and secured fenced perimeters of the facility including the barge dock and ammonia terminal. Additionally, the Mundy office, truck inspection area, buildings and surrounding grounds, and the contractor parking area and turn stiles which is considered "Inside the Fence designated by signs or a perimeter fence Office: A place where professional or clerical work is performed within the boundaries of BASF property Outside Perimeter: Refers to any location not part of the restricted Inside Perimeter but still on BASF property Process Units or Structures: Refers to buildings, walkways, storage sheds, equipment buildings, MCC rooms, I/O rooms, tank farms, pipe racks, operator stations that are considered part of a Process Unit, Incineration or Utilities area, Maintenance Shops, and Stores or other storage areas Vehicle: Any vehicle which transports individuals and/or materials on BASF Freeport Site. A vehicle is defined as both motorized and non-motorized forms of transportation. This includes, but is not limited to, bikes, golf carts, trucks, railcars, cars, forklifts, JLGs, cranes etc.

3 Freeport Plant Number: BCF Page: 3 of Responsibilities and Accountabilities 3.1 Site Management shall support an effective program throughout the site to ensure compliance with this Plant Standard. This support shall extend to all levels of management, supervision, and employees and include appropriate resources as necessary to enable success. 3.2 All employees, contractors, truck drivers, vendors, and visitors will abide by the requirements of this Plant Standard and will, when necessary, remind others of the requirements in the Plant Standard. 4.0 Procedures 4.1. Rules Governing the Use of Cell Phones: The unauthorized use of a, camera cell phone, camera, or video recording camera to take pictures, videos, and/or audio recordings while on BASF Corporation property is prohibited. Unauthorized picture taking, audio or video recording on BASF property is considered a breach of security and may result in discipline up to and including dismissal and/or criminal charges All pictures stored on a cell phone, camera, video or audio recorder will be made available for immediate review upon request Authorized Users of Cameras, Video and/or Audio Recording devices will be issued an Authorization Pass or Badge which identifies the recording device and all authorized users of said device Cell Phones may not be used while operating a vehicle on BASF property. Exception: Emergency Responders in the capacity of their duties. Vehicle should be stopped in a safe location and placed in park while the cell phone is in use. However, the use Hands Free devices are acceptable while operating a vehicle.

4 Freeport Plant Number: BCF Page: 4 of Texting, this includes sending or viewing text messages, is not allowed while operating a vehicle on BASF property. 4.2 Inside Perimeter As noted above, cell phones, camera cell phones, cameras, video recording and/or audio recording devices used in the Inside Perimeter is highly restrictive due to security and safety concerns. These devices are prohibited in the following areas without proper authorization: Process Units or Structures Laboratories Tank farms, including inside cabs of trucks delivering or picking up raw material or products Within 15 feet of any hazardous materials equipment/pipe rack, this includes overhead pipe racks. Maintenance shops, warehouses Vaults, server rooms, EOC or any other restricted or secured area There are locations where cell phones (NO CAMERA OR VIDEO/AUDIO RECORDING DEVICES OR FUNCTIONS) may be used in the Inside Perimeter. These include the following locations: Offices Break Rooms/Areas Conference rooms Trailers Parking lots Inside parked vehicles which are greater than15 feet away from process/hazardous materials/pipe racks or equipment Control Rooms only when the device does not have a camera

5 Freeport Plant Number: BCF Page: 5 of On Property Not Owned by BASF Corporation Businesses operating within their own fenced perimeter, but within BASF property, may implement their own cell phone policy as long as their policy meets or exceeds the BASF Freeport Site Cell Phone Plant Standard. Businesses being operated on BASF property that are being staffed by BASF Corporation employees will abide by this Plant Standard. 6.0 Consequences for Non-Compliance with this Standard 6.1 Any contractor, contract personnel, vendor, truck driver or visitor using a cell phone, camera cell phone and/or video/audio recording device inconsistent with this Plant Standard should be reported to security immediately. Violations of this Plant Standard may include up to removing the individual from the Site and permanent prohibited entry and/or criminal charges. will immediately report the incident to the supervisor(s) of the contractor, visitor, vendor or truck driver as well as the site manager. 6.2 BASF Corporation employees using cell phones inconsistent with this Plant Standard will be subject to appropriate disciplinary action. will immediately report the incident to the supervisor(s) of the employee as well as the site manager.
