MethoD o L ogy This list is excerpted from the 2012 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation s top lawyers confidentially evaluate their professional peers. The 2012 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2012 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives fax or ballots; the other half is polled by phone. Voting lawyers were provided this general guideline for determining if a nominee should be listed among the best : If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them? All votes and comments were solicited with a guarantee of confidentiality a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. I came from a family of lawyers so from the time I was a young boy I envisioned myself as an attorney, he says. Though I thought I was going to become a trial lawyer. Instead, Berger came to focus his career on matrimonial and family law. When I was growing up the concept of divorce was not very common. But as a young lawyer in the seventies I could see that divorce was becoming more commonplace, and I thought that this was a discipline that needed quality attorneys. Around that time, Berger met Barry Schatz, who was working for a competing law firm. Berger and Schatz discovered that they shared a vision of creating a law firm that was tailored to the emerging field of family law. We d talked about one day becoming partners and developing a practice that tried to do things a little differently from what we were experiencing as young lawyers, Berger says. Their vision was also a response to the growing complexity of matrimonial law in the state. Illinois used to be what they called a Title state, where whatever property was in your name was essentially yours, Berger explains. That changed in the late seventies when the Illinois Marriage and Dissolution of Marriage Act came along; it didn t matter from that point forward whose name was on what property. So the sophistication of everyone in the field evolved. In 1987, they founded a law firm dedicated to mastering the diffuse and difficult issues emerging under the new law issues that ranged from corporate, real estate, and tax law, to deferred compensation, stock options, and other kinds of executive and employee compensation benefits. We ve educated ourselves about these issues and continue to do so, because the law is ever changing and virtually any issue can come up in a divorce situation, Berger observes. That dedication to developing their expertise has helped Berger and Schatz build one of the largest family and matrimonial law firms in the country. To see this firm grow and prosper has been very rewarding, Berger reflects. A big firm wouldn t be able to handle the kind of work Mike [Hassan] is doing for our mortgage insurer clients, he says. We ve got half a dozen first-chair trial lawyers who can put a top-notch team together and run with a case. Schiller DuCanto & Fleck LLP Size is Only a Small Part of What Distinguishes the Firm from Other Family Law Practices If numbers told the whole story, then all you need to know about the Chicago family law firm of Schiller DuCanto & Fleck LLP (SDF) would be summed up with one figure: 43. That is how many attorneys the three-office firm currently has on its roster making it the largest family-law firm in the country, a distinction it has held for more than two decades. But size is only a small part of what distinguishes the firm from other family law practices. Founding partner Donald Schiller, who began the firm in 1981 with Joseph DuCanto and Charles Fleck, says what truly makes SDF unique is the way it approaches its work. When we started the firm we wanted to break the mold of the divorce practice and handle the cases more like civil litigation firms handled corporate litigation, says Schiller, who notes that the firm generally represents high net worth clients in virtually all aspects of family law, including divorce, custody and visitation, property division, and alimony, among others. We handle cases with a team approach. It s what we are best known for, where we have experts within the practice working to get the best possible results for our clients. That means, says Schiller, that the firm has lawyers who are experts in tax issues, banking and finance, the psychology of custody matters, and so on and all work together to serve the varied needs of their individual clients. We are the embodiment of the whole being greater than the sum of its parts, says Schiller. We put three attorneys on one case, instead of having one attorney handle 10 cases. The firm abides by a big stick ideology: whereby its attorneys 17 of whom are listed as 2012 Best Lawyers, with 3 being named as Lawyer of the Year conduct themselves with the utmost courteousness and civility, yet will fight aggressively if called to. It s a balance that SDF works hard at striking, especially in an area of practice that is so emotionally driven. A settlement in a divorce case is usually the best result, because the people have to deal with each other after the case is over, says Schiller. But if someone won t be reasonable, you have to have the ability to try and win the case. For the attorneys at SDF, it often escalates further than that. If you re in high-stakes cases as we are, the ability to handle appeals is also important, Schiller says. We re fortunate to have the depth that we have which includes two former appellate court law clerks. Depth can be somewhat an understatement at SDF. Becoming immersed in the law is something that s ingrained in its attorneys from the first minute of their first day which, for many of them, begins with the firm s acclaimed clerking program, which nurtures potential future associates after their first year of law school. Indeed, the culture of mentoring is ingrained at SDF. Associates shepherd the firm s law clerks, who are in turn mentored by partners, a process that instills a culture of knowledge-sharing and values among SDF s attorneys. It s the kind of hard work and dedication that pays off. Three of our equity partners worked up from being student clerks, and two from associates, says Schiller, who also adds that four of the 10 equity partners are women. We grow primarily from within, and that s how we ve created something of an all-star team. SDF also has a history of giving back to the community in which it serves with its robust pro bono program, and has been recognized as a leader through countless accolades as well as through the actions of its attorneys, with associates each committed to providing at least 40 hours of service a year. The firm is also firmly devoted to education; DePaul University named its family law center after the firm, and stands as the largest center in the country at an accredited law school that is dedicated to teaching family law. It all adds up to a firm that exemplifies commitment: to its attorneys, to the community, and above all to the clients it serves. We take what are very unhappy people and give them hope and the promise of a new chapter in their lives, says Schiller.
