Chicago s Best Lawyers helps take the mystery out of locating a platinum standard advocate to protect you, your family, your business and all other assets. The exceptional attorneys listed in this guide are listed in The Best Lawyers in America. These attorneys were nominated by and voted in by their peers. Lawyers cannot buy their way into this guide. Attorneys must earn a spot in Best Lawyers through exemplary legal work that attracts the notice of their colleagues. To remain in the guide, they must be at the top of their game, year after year. Best Lawyers, the leading referral guide in the legal profession, is for the first time self-publishing this invaluable resource for readers, whatever your legal needs may be. We hope this publication is easier to use and more valuable than ever. Lawyers in this guide are arranged by their legal specialty from Administrative/Regulatory Law to Workers Compensation Law which makes it easy to find the professional advice you need. Keep this comprehensive guide available for those times when you need a first-rate advocate to assist you. The lawyers listed in Chicago s Best Lawyers are eager to help. MethoD o L ogy This list is excerpted from the 2012 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation s top lawyers confidentially evaluate their professional peers. The 2012 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2012 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives fax or ballots; the other half is polled by phone. Voting lawyers were provided this general guideline for determining if a nominee should be listed among the best : If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them? All votes and comments were solicited with a guarantee of confidentiality a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. Stick Boutique complex commercial litigation firm Butler Rubin Saltarelli & Boyd (Butler Rubin) founding partner Jim Rubin says that there are two things potential clients look for when choosing a law firm for representation. Number one is expertise and number two is service, says Rubin, who helped establish the firm in 1980 with three other partners. Clients want lawyers who understand their business and the problems they face and who are responsive. If we ve done anything since 1980, we ve taught our lawyers that they are in the service business, and that makes a huge difference for our clients. That service-minded focus is an integral part of Butler Rubin s culture. But just as important is filling the firm with well-rounded attorneys who will be with Butler Rubin for the long haul creating stability and client relationships that are unmatched. We look for five-tool players, says partner Bob Hermes, referring to the baseball term for players who can deftly handle all aspects of the game. We demand that of everyone who works here, and it s made the firm a dynamic place. Butler rubin Saltarelli & Boyd LLP 70 West Madison Street, Suite PHONE FAX Butler Rubin expertly assists clients both here and abroad in its major practice areas of commercial litigation, including reinsurance, insurance coverage, shareholder suits, antitrust, class action defense, products liability and mass tort matters, among others. Most of our work certainly falls into the category of complex litigation, says Rubin. We handle difficult cases that have a lot of money at stake, and clients come to us because they understand it s what we do best. It doesn t matter if the case involves antitrust issues, a reinsurance dispute, a class action our clients leave here with the assurance that we can solve their problems. It s a reputation the firm has spent more than three decades building. At its core is an unshakable foundation. According to Hermes, we are experienced trial lawyers who focus on what our clients do and why they have come to us for help. What sets us apart is we understand in meticulous detail the business underpinnings of the disputes we re handling.

10 Matrimonial and Family Law Attorneys This year Berger Schatz, one of the largest and most respected matrimonial and family law firms in the country, celebrates its 25th anniversary. Firm founders Michael J. Berger and Barry A. Schatz agree that the firm s success during that time can be attributed to the quality of its attorneys and support staff, many of whom have been with the firm since its inception. We have many lawyers and other employees at the firm who have been here for 20 years or more, Michael Berger notes. So you have a concentration of very talented, experienced people both lawyers and staff members who have helped to create and shape the firm over 25 years. The firm s team of 36 attorneys draws upon a wide range of professional experience to provide insight into the most challenging and complicated family and matrimonial law matters. You re dealing with lawyers who have certain legal acumen and discretion, which they ve learned over a period of many years, Berger observes. And I think our clients appreciate the honesty, integrity, and quality of the work. They know they ll get the best lawyering in this field that they can get. Specializing in representing high-net-worth individuals and their spouses from all industries and professions, Berger Schatz prides itself on finding solutions to the most complex financial matters, including the division of substantial assets, tax issues, asset and income tracing, and business valuations. But along with financial matters, Berger Schatz attorneys have the experience and compassion needed to resolve difficult child custody, visitation, and paternity issues with sensitivity and discretion. The firm s lawyers also excel at negotiating and drafting premarital, postnuptial, and settlement agreements that safeguard a client s rights and assets while protecting against future litigation. The firm s guiding philosophy is to find reasonable approaches to resolving difficult situations. As Berger explains: Our lawyers are very good negotiators, but

11 they re equally good litigators. While we do our best to resolve everything we can amicably or collaboratively, based on mutual respect for not only our client but the spouse of our client, if we re not able to resolve the issue then we ll go to court to protect our client s interests. All of the firm s partners are Fellows of the American Academy of Matrimonial Lawyers (AAML) a membership that is the standard of excellence in the area of family law. Attorneys at the firm have held leadership positions in the AAML as well as the American Bar Association and the Illinois State Bar Association. Many are rated AV Preeminent by Martindale-Hubbell and named in Illinois Super Lawyers or Leading Lawyers; and Michael Berger is regularly named to the list of The Best Lawyers in America. Reflecting on the firm s continued ability to recruit and retain top-tier talent over the past 25 years, Berger credits the firm s family-like environment. It s a very close, friendly atmosphere among the lawyers here. They try to help each other not just because they re in the same firm, but because they genuinely care about each other. 12 C O ver sto ry: From left to right: Barry A. Schatz, Michael J. Berger and David H. Levy Even as a child, Michael Berger knew that he wanted to be a lawyer. I came from a family of lawyers so from the time I was a young boy I envisioned myself as an attorney, he says. Though I thought I was going to become a trial lawyer. Instead, Berger came to focus his career on matrimonial and family law. When I was growing up the concept of divorce was not very common. But as a young lawyer in the seventies I could see that divorce was becoming more commonplace, and I thought that this was a discipline that needed quality attorneys. Around that time, Berger met Barry Schatz, who was working for a competing law firm. Berger and Schatz discovered that they shared a vision of creating a law firm that was tailored to the emerging field of family law. We d talked about one day becoming partners and developing a practice that tried to do things a little differently from what we were experiencing as young lawyers, Berger says. Their vision was also a response to the growing complexity of matrimonial law in the state. Illinois used to be what they called a Title state, where whatever property was in your name was essentially yours, Berger explains. That changed in the late seventies when the Illinois Marriage and Dissolution of Marriage Act came along; it didn t matter from that point forward whose name was on what property. So the sophistication of everyone in the field evolved. In 1987, they founded a law firm dedicated to mastering the diffuse and difficult issues emerging under the new law issues that ranged from corporate, real estate, and tax law, to deferred compensation, stock options, and other kinds of executive and employee compensation benefits. We ve educated ourselves about these issues and continue to do so, because the law is ever changing and virtually any issue can come up in a divorce situation, Berger observes. That dedication to developing their expertise has helped Berger and Schatz build one of the largest family and matrimonial law firms in the country. To see this firm grow and prosper has been very rewarding, Berger reflects. We Michael Berger of Berger Schatz Building One of the Largest Firms for Family and Matrimonial Law in Chicago created the firm with six attorneys; now we have 36 attorneys and we re still growing. The firm s size has proved advantageous in handling the many financial issues that arise during family law proceedings. The cases we handle generally involve complex personal wealth issues, and you really can t get the client the best possible result without having more than one lawyer involved in the matter, Berger says. When you have a group of really good lawyers discussing an issue, you ll often develop ideas and strategies that you just wouldn t conceive of as a solo practitioner. Having the support of a larger team of talented attorneys also benefits the client in other ways, Berger notes. In this area of the law there are emergencies that come about from time to time, and if you don t have the people power to deal with that situation, then another client will end up suffering as a result of the firm not having enough talent to deal with all of the issues. The firm s attorneys include some of the most accomplished lawyers in the field of family and matrimonial law. In addition to being honored by Martindale-Hubbell, Illinois Super Lawyers, and Leading Lawyers, attorneys at the firm have held leadership positions in organizations such as the American Academy of Matrimonial Lawyers, the Illinois State Bar Association, and the Lake County Bar Association. Berger, who is regularly selected for inclusion in The Best Lawyers in America, attributes the firm s ability to retain top talent to its flexible workplace and family-like environment. We were one of the first firms to introduce flex-time and many of our attorneys who have had children continue to practice based on their availability; I ve never mandated that lawyers have to be inside the office or bill for so many hours. Looking beyond the firm s 25th anniversary, Berger reflects that the most gratifying aspect of his practice remains guiding his clients through the divorce process. The most rewarding part of handling these matters is helping people through these difficult times and assisting them in securing their futures as well as those of their children. In many cases, without the work of our firm, clients wouldn t be as well-situated at the end of the day. We re very proud of that. 12 CHICAGO s Best Lawyers

13 rinella & rinella, ltd. From left to right: (standing) Karen J. Bowes, Joseph G. Phelps and Nicole M. Onorato (seated) Maricarol Lacy, Bernard B. Rinella and Joshua J. Beyer Excellence in Family Law for 80 Years Bernard Rinella likes to tell people that he learned divorce law over the family dinner table. Not because his parents marriage was breaking up Samuel and Kathryn Rinella were married for over 50 years but because they were divorce lawyers. In fact, the firm they founded in 1932, Rinella & Rinella, Ltd., was one of the first family law practices in the country. Rinella joined the fi rm in 1961 and took the helm in 1982, determined to continue the tradition of superior client service and responsive, top-quality legal work established by his parents. Five decades later, Rinella & Rinella, Ltd. remains one of the foremost family law practices in the country, known for its ability to handle the most difficult situations. Over the years, the firm has represented captains of industry, professional athletes and members of prominent Chicago families, including the Halases, Wrigleys, Walgreens, SC Johnsons, Pritzkers and Crowns, as well as many small-business owners, professionals and homemakers. Rinella and his team of seasoned family law specialists are experienced in all areas of matrimonial law, including divorce, prenuptial and postnuptial agreements, judgment enforcement, custody and support actions, domestic violence and parentage actions. While the firm is a recognized leader in divorce litigation, the attorneys settle the majority of their cases. We are certainly not afraid to do battle, Rinella says. Still, in my experience, in the long run it is preferable to resolve these matters amicably if possible. Divorce is never easy, especially when there are children involved or complex marital assets to value and divide. Rinella and his team understand that the divorce process can be extremely stressful and emotionally difficult for clients. We believe it is part of our job to guide our clients through this process, to alleviate their stress as much as possible, and to help them move on with their lives, he says. At the same time, we don t let our compassion and empathy for our clients interfere with our knowledge and application of the law. If you can help someone out of a tough situation, if you can help make certain that their future is secure financially, or place kids with the right parent, then you ve really done something worthwhile. rinella & rinella, Ltd. 15 C O ver sto ry: Chicago s Butler Rubin Saltarelli & Boyd Finding Practical Solutions to Complex Problems Butler Rubin Saltarelli & Boyd (Butler Rubin) isn t your average law firm. For one, it s fairly uncommon to find a firm of its size dedicated solely to complex commercial litigation. But then again, the 36-attorney boutique doesn t handle your average cases. Founding partner Jim Rubin says that the firm has spent the last three decades helping highprofile clients resolve equally high-stakes problems and has built a reputation for being the go-to firm for clients who know that Butler Rubin attorneys will put them first above all else. If you can deliver both service and expertise, you re going to stand apart from the rest of the legal community, and that s what we ve been able to do, says founding partner Jim Rubin. As a result we get called upon to help clients who are facing large and complicated matters. Complicated indeed. The firm, which has eight attorneys selected by their peers for the 2012 Best Lawyers in America in a range of practice areas, is a leader in the area of reinsurance litigation, a practice area it has been developing since the firm was established in 1980, when the four founders left a larger firm to strike out on their own. Today, Butler Rubin is handling a significant number insurance and reinsurance issues involving mortgage-backed securities, an area of the practice that has grown in recent years as the housing market plummeted. The firm also handles cases involving shareholder litigation, class action defense, antitrust and competition law, products liability and mass torts, and employment disputes. We are deeply involved in helping clients deal with one of the most problematic aspects of the economic downturn, says partner Mike Hassan, who is acting as lead counsel for a client that wrote insurance policies for Countrywide Financial, which was purchased by Bank of America in 2008 at the height of the housing market collapse. We are helping credit and mortgage insurers resolve some of the problems that arise when mortgages are fraudulently made we ve got eight different cases involving that right now. Hassan says the firm s insurance and reinsurance practice is a specialty Butler Rubin has been able to pursue and immerse itself in. If you re going to be a boutique, you need to have a group with incredible depth, expertise and knowledge, says Hassan, a business litigator with over 25 years experience. We possess that across all of our practice areas. We are specialists. Partner Bob Hermes, who joined the firm as a young associate only a few years after it was established, agrees with Hassan and Standing from left: R. Douglass Bond, Gerald G. Saltarelli, Ira J. Belcove, Michael R. Hassan, Louis J. Aurichio, Robert N. Hermes. Seated from left: James I. Rubin, Teresa Snider. says the firm s size and setup is inherently beneficial to clients. A big firm wouldn t be able to handle the kind of work Mike [Hassan] is doing for our mortgage insurer clients, he says. We ve got half a dozen first-chair trial lawyers who can put a top-notch team together and run with a case. Indeed, Hermes says another big part of what makes Butler Rubin remarkable is the culture of knowledge-sharing and a sense of genuine trust among its colleagues. We operate that way because we know it s what is best for the client, says Hermes. It s really just about looking at a client s needs and determining the best combination of people and resources to put on the case from an expertise and cost standpoint. Everyone gets together to figure out the best way to solve really significant problems. Rubin says the firm which also has a history of providing pro bono legal services throughout the community has nurtured that kind of collegial atmosphere since its inception. We look for people we think have the same approach to working together that we ve always had, Rubin says. That means from the hiring process through the mentoring process, we try and make sure that everyone is working cooperatively. It also means that I can ask someone for help when I need it. Instead of fostering an atmosphere where I can only win if you lose, everyone here understands that we do best when the firm does best. Hermes puts it more simply. We pride ourselves on being lawyers lawyers, he says. We continue to adhere to the philosophy that we started out with, and we fiercely guard our independence because we know our way is tried and true. We always put our clients first and strive to achieve the best results possible. For more information go to 15

In 1988, the Firm Laner Muchin recruited him to start its litigation department. Today, Gagliardo is the Firm s Managing Partner and has represented prominent publicly and privately held corporations, such as the Trump Organization. He has also represented numerous public sector employers, including the State of Illinois and the City of Chicago. Gagliardo recently represented the State of Illinois in negotiations concerning labor rule changes at McCormick Place. The State, City and Unions were all able to work together to resolve the issue and as a result Chicago is now competitive again, Gagliardo notes. Clifford personal Injury litigation CHICAGO, Il Although robert Clifford has been practicing law for 36 years, his enthusiasm for the legal profession has never waned. I wake up every morning excited to help people, he says. It s very gratifying to see how the results we obtain for those in need are used to improve their quality of life. Clifford founded the nationally recognized personal injury law firm Clifford Law Offices in Today, the firm is comprised of 22 lawyers and about 60 staff members, who handle aviation, whistleblower, personal injury, medical malpractice, and product liability cases throughout the country. While Clifford has achieved many significant results during his career, he is particularly proud of a $14 million verdict he attained in the mid-1980s for a boy who was severely injured in an auto accident. Recently, he helped secure a $1.2 billion settlement as liaison counsel in a huge 9/11 lawsuit concerning property damage claims. If you look at the verdicts here in Illinois, I ve set the tone and the pace for the manner in which cases are presented to Illinois juries and argued, Clifford notes. Clifford has been selected as a Best Lawyers Chicago Lawyer of the Year three times in the past four years. He is the current President of the Chicago Bar Association and a member of the prestigious American College of Trial Lawyers and the International Academy of Trial Lawyers. Being able to provide leadership in my profession makes me very proud to be a lawyer, he says. Carlton r. MarCyan FAmIly law CHICAGO, Il As the executive Committee Chair of Schiller DuCanto & Fleck LLP, the largest family law firm in the United States, Carlton R. Marcyan relies on his extensive experience in divorce law, tax and accounting to successfully represent clients in the Chicago area and throughout the country. Family law is all-encompassing, he notes. Not only do you have to know divorce law but federal tax laws concerning divorce, as well as how to decipher financial statements and analyze employee benefits. Marcyan s background as an attorney/ CPA, Certified Financial Planner, and MBA candidate has proved advantageous in financial discovery, analysis, and litigation. Indeed, he is a skilled litigator and problemsolver, having twice been named a Best Lawyers Chicago Lawyer of the Year: first for collaborative law in 2011 and then for family law in Still, Marcyan notes: What others think makes a successful divorce lawyer is not really the case. The common perception is that of a cold, uncaring shark. In reality there is a higher calling of serving clients who are going through an extremely traumatic period so that they come out as whole as possible. Marcyan has been recognized by a number of organizations for his contributions to the community. He received the Distinguished Service Award from the Chicago Volunteer Legal Services Foundation for his pro bono work; the Michael Cohen Award from the Illinois Chapter of the American Academy of Matrimonial Lawyers for his contributions to continuing legal education; and the Alumni Association s Distinguished Service Award from his alma mater, John Marshall Law School. 19 Senior Partners Left to Right: Meighan Harmon, Timothy Daw, Donald Schiller, Karen Pinkert-Lieb, Burton Hochberg, Tanya Stanish, Carlton Marcyan, Charles Fleck, Anita Ventrelli and Arnold Stein. Schiller DuCanto & Fleck LLP Size is Only a Small Part of What Distinguishes the Firm from Other Family Law Practices If numbers told the whole story, then all you need to know about the Chicago family law firm of Schiller DuCanto & Fleck LLP (SDF) would be summed up with one figure: 43. That is how many attorneys the three-office firm currently has on its roster making it the largest family-law firm in the country, a distinction it has held for more than two decades. But size is only a small part of what distinguishes the firm from other family law practices. Founding partner Donald Schiller, who began the firm in 1981 with Joseph DuCanto and Charles Fleck, says what truly makes SDF unique is the way it approaches its work. When we started the firm we wanted to break the mold of the divorce practice and handle the cases more like civil litigation firms handled corporate litigation, says Schiller, who notes that the firm generally represents high net worth clients in virtually all aspects of family law, including divorce, custody and visitation, property division, and alimony, among others. We handle cases with a team approach. It s what we are best known for, where we have experts within the practice working to get the best possible results for our clients. That means, says Schiller, that the firm has lawyers who are experts in tax issues, banking and finance, the psychology of custody matters, and so on and all work together to serve the varied needs of their individual clients. We are the embodiment of the whole being greater than the sum of its parts, says Schiller. We put three attorneys on one case, instead of having one attorney handle 10 cases. The firm abides by a big stick ideology: whereby its attorneys 17 of whom are listed as 2012 Best Lawyers, with 3 being named as Lawyer of the Year conduct themselves with the utmost courteousness and civility, yet will fight aggressively if called to. It s a balance that SDF works hard at striking, especially in an area of practice that is so emotionally driven. A settlement in a divorce case is usually the best result, because the people have to deal with each other after the case is over, says Schiller. But if someone won t be reasonable, you have to have the ability to try and win the case. For the attorneys at SDF, it often escalates further than that. If you re in high-stakes cases as we are, the ability to handle appeals is also important, Schiller says. We re fortunate to have the depth that we have which includes two former appellate court law clerks. Depth can be somewhat an understatement at SDF. Becoming immersed in the law is something that s ingrained in its attorneys from the first minute of their first day which, for many of them, begins with the firm s acclaimed clerking program, which nurtures potential future associates after their first year of law school. Indeed, the culture of mentoring is ingrained at SDF. Associates shepherd the firm s law clerks, who are in turn mentored by partners, a process that instills a culture of knowledge-sharing and values among SDF s attorneys. It s the kind of hard work and dedication that pays off. Three of our equity partners worked up from being student clerks, and two from associates, says Schiller, who also adds that four of the 10 equity partners are women. We grow primarily from within, and that s how we ve created something of an all-star team. SDF also has a history of giving back to the community in which it serves with its robust pro bono program, and has been recognized as a leader through countless accolades as well as through the actions of its attorneys, with associates each committed to providing at least 40 hours of service a year. The firm is also firmly devoted to education; DePaul University named its family law center after the firm, and stands as the largest center in the country at an accredited law school that is dedicated to teaching family law. It all adds up to a firm that exemplifies commitment: to its attorneys, to the community, and above all to the clients it serves. We take what are very unhappy people and give them hope and the promise of a new chapter in their lives, says Schiller. If their problems are handled properly and appropriately, we are giving them a fresh start, and that s what keeps us coming to work every day. For more information go to 19
