2 Introduction This Agreement is the standard agreement for the supply of the Digital Mobile Telecommunications Service Post Paid if you initially applied through the Service Provider to be Connected. This Agreement sets out the terms and conditions on which: we will provide the Service to you; and you may use the Service provided by us. This Agreement is in the following parts: Section 1 Description of Service Features and Charges which describes the Service and its features and sets out the charges applicable to the Service; Section 2 Call Plans which sets out the sets out the various Call Plans available under the Service, and the charges specific to each; Section 3 Dictionary which sets out the words that have a special meaning in this Agreement; and Section 4 Terms & Conditions which sets out the terms and conditions which apply to the Service. 6 Section 1 Description of Service Features and Charges This part of this Agreement describes the features of the Service and sets out the Charges which apply to use of each feature of the Service. 7 Part 1 Access Access Enjoy access to the Network via Your Mobile Phone and the use of Your SIM Card. Charges We will charge you, monthly in advance, the Monthly Access Fee* applicable to Your Call Plan. If a bill we send you covers only part of a month (for example, if you connect or disconnect part of the way through our monthly billing cycle), we will pro-rata the Monthly Access Fee for that part of the month which you are Connected. ** * Some Call Plans provide you with Included Calls in the Monthly Access Fee or Included TXT Messages in the Monthly Access Fee. Refer to Your Call Plan in Section 2 of this Agreement and paragraphs 2.2 and 2.3 of Section 4 of this Agreement for details. ** We will also pro-rata any Included Calls in the Monthly Access Fee and Included TXT Messages in the Monthly Access Fee for that part of the month you are Connected. 8 Part 2 Voice Calls Type of voice call Charges (unless otherwise specified, excludes Roaming) Standard Calls Make voice calls from Your Mobile Phone to, and receive voice calls to Your Mobile Phone from: any other mobile phone connected to any mobile telecommunications network in Australia; and any fixed line phone connected to any fixed line telecommunications network in Australia, other than: international calls (for which you will be charged at the rates set out below); calls to Special Numbers listed below (for which you will be charged at the rates set out below); calls you make to access Special Services (for which you will be charged at the rates set out in Part 4 below); and calls you make to access Value-Added Services (for which you will be charged at the rates set out in Part 5 below). You will be charged at the rates set out in Your Call Plan for each of these type of calls you make which are actually connected. For example, there is no charge for calls to an engaged number. There is no charge for receiving these types of calls. However, please note that calls connected to a recorded message announcing that the number has been temporarily disconnected or that the call cannot be completed are connected calls and will be charged. Depending upon Your Call Plan, these types of calls will be charged at either: one-second intervals; or 30 or 60 second intervals (rounded up to the nearest interval), and may include a flagfall, that is, an amount which you will be charged for making the call in addition to an amount charged in respect of the duration of the call.* Under most Call Plans, calls rates vary by call type and MARTIN DAWES SFOA NOVEMBER WHAT IS A CONNECTED CALL 30/11/04 8:54 Page 3

9 Type of voice call Charges (unless otherwise specified, excludes Roaming) destination and are charged at different rates depending upon when the call is made, that is, at: "Peak" times; "Off-peak" times; or "Super Off-peak" times (only available on some Call Plans).* * Refer to Your Call Plan in Section 2 of this Agreement for details. International Calls Make voice calls from Your Mobile Phone to, and receive voice calls to Your Mobile Phone from: any mobile phone connected to any mobile telecommunications network overseas; and any fixed line phone connected to any fixed line telecommunications network overseas. Unless you are on the red SIM Call Plan, you will need to seek s approval before this service is activated. If you are on the red SIM Call Plan, this service is automatically activated from when you connect to the Service. 11 Part 3 TXT TXT Messaging Charges (unless otherwise specified, excludes Roaming) TXT messages Send TXT messages from Your Mobile Phone to, and receive TXT messages to Your Mobile Phone from: any other mobile phone* connected to a mobile telecommunications network in Australia; and any mobile phone* connected to certain mobile telecommunications networks overseas, the supplier of which, we have arrangements with to enable the sending and receiving of TXT messages,** other than: TXT delivery status reports (for which you will be charged at the rate set out in Part 4 below); Premium TXT messaging (for which you will be charged at the rate set out in Part 4 below); and SIM2 TXT messaging (for which you will be charged at the rate set out in Part 4 below). Unless Your Call Plan states otherwise, you will be charged 25c per TXT message of 160 characters you send (regardless of whether the TXT message is actually received by the person to whom you are sending it). There is no charge for TXT messages you receive. * TXT messages may only be sent and received by mobile phones that have the necessary technical capability ** Go to or phone Customer Service for information about overseas mobile telecommunications network suppliers with whom we have arrangements for sending and receiving TXT messages. 12 Part 3A GPRS GPRS Charges (unless otherwise specified, excludes Roaming) GPRS Access mobile internet content, office network and use compatible through your GPRS Capable Phone. Unless Your Call Plan states otherwise: When using GPRS in a Coverage Area: You will be charged: a Monthly Fee in advance; and Usage Charges Over Monthly Fee (for any data you send or receive in excess of the Included Data in Monthly Fee), at the Pay As You Go rates set out below unless you otherwise select another Rate (also set out below) by phoning Customer Service. 15 Part 4 Special Services Special Service Charges (unless otherwise specified, excludes Roaming) Customer Service Phone 1555 from Your Mobile Phone to speak with our customer service representatives who are available 24 hours a day, 365 days a year for your general service and account enquiries. Free Operator Services Assistance By dialling 123 from Your Mobile Phone or from any other phone, a assistant will endeavour to provide you with any information you need or help you to access any service. Your ability to be connected to Value-Added Services is subject to the capabilities of Your Mobile Phone and other requirements which we may impose under this Agreement. Call Plans other than Corporate and Government Call Plans: $1.30 flag fall + 65c per each 30 seconds (billed per second) Network Services Navigator By dialling 123 from Your Mobile Phone or from any other phone, a assistant will look up and give you directions to addresses in all Australian capital cities and in some major regional areas $1.30 flag fall + 65c per each 30 seconds (billed per second) THRUConnect By dialling 013 or 1223 from Your Mobile Phone when in Australia or 0103 from Your Mobile Phone when overseas, the operator will look up any domestic (Australian) number and offer to connect the call straight through. No redialling is necessary. Free Free. INtouch Services INtouch services are a suite of answering and message services which you access from Your Mobile Phone. For assistance with any of these services, dial 122 from Your Mobile Phone. INtouch services include: CALLBack + You will be charged the flagfall and standard call rates applicable to Your Call Plan when dialling 122.* DEFAULT: As soon as you are in a Mobile Coverage Area, a TXT message will be sent to Your Mobile Phone to let you know you have new voic messages. 17 Special Service Charges (unless otherwise specified, excludes Roaming) Alternatively, by dialling 121, a personalised voic message service can be activated to take messages for you if you are unable to take a call. There are 2 methods of receiving that voic message: (1) You can dial 121 to retrieve any new voic messages. (2) As soon as you are in a Mobile Coverage Area, the voic message service will call you to let you know you have new voic messages. Call Plans other than red SIM Call Plan: You will be charged the flagfall and standard call rates applicable to Your Call Plan when dialling 121 to retrieve messages. You will be charged the flagfall and standard call rates applicable to Your Call Plan for diversion of incoming calls to voice mail.* red SIM Call Plan: You will be charged standard call rates when dialling 121 to retrieve messages. You will be charged standard calls rates for diversion of incoming calls to voic .* CALLback+ can store up to 20 messages of up to three minutes per message. Played messages will be automatically saved for five days. Unplayed messages will automatically be deleted after three days. CALLScreen By dialling 122, an answering service/paging system is activated with the assistance of a operator, which allows you to divert incoming calls to a operator, who takes a message on your behalf. The operator will then send a text message, of up to 160 characters, to the screen of Your Mobile Phone. * Refer to Your Call Plan in Section 2 of this Agreement for details. Call Plans other than Corporate or Government Call Plans: You will be charged a flat fee of: 5.5c if the diverted call is 10 seconds or less; or 99c if the diverted call is over 10 seconds Corporate or Government Call Plans: You will be charged a flat fee of: 0c if the diverted call is 10 seconds or less; or MARTIN DAWES SFOA NOVEMBER WHAT IS A CONNECTED CALL 30/11/04 8:54 Page 12

18 Special Service Charges (unless otherwise specified, excludes Roaming) 66c if the diverted call is over 10 seconds CALLidentity If Your Mobile Phone has the necessary technical capability, this default service allows you to: identify an incoming caller by his/her phone number before you answer the call; and send your mobile phone number when you make a call. To de-activate the service dial 122. To de-activate on a call-by-call basis dial 1831 before the called number. You may also be able to activate or de-activate the service through a function on Your Mobile Phone, if it has the necessary technical capability. Free CALLwait and CALLhold If Your Mobile Phone has the necessary technical capability, these services allow you to switch between calls by using commands on your mobile phone keypad. Free Call Forwarding This service diverts incoming calls to another mobile phone connected to the Network or a fixed line telephone within Australia. 7.7c for each 30 seconds of the diverted call or part thereof Call Barring This service is a security option which allows incoming and/or outgoing calls to be barred. To activate this service, phone Customer Service. Free Call Conference If you have a conference call capable mobile phone, this service enables you to initiate a conference call and flagfall and standard call rates applicable to Your MARTIN DAWES SFOA NOVEMBER WHAT IS A CONNECTED CALL 30/11/04 8:54 Page 13

19 Special Service call multiple parties to join the conference call. A maximum of 8 parties may participate in a conference call, depending upon the model of Your Mobile Phone and its conference call support features. Charges (unless otherwise specified, excludes Roaming) Call Plan per each person connected to the conference call* *Refer to Your Call Plan in Section 2 of this Agreement for details. Premium TXT Send TXT messages from Your Mobile Phone to: enter and/or third party promotions, competitions and vote in polls; or use third party messaging applications e.g. ICQ, MSN messaging. Receiving confirmation TXT messages in relation to competitions and voting polls you have entered. You will be charged for each of these types of TXT messages you send and/or receive at rates published on our website or as disclosed to you by third party competition promoters. If you accidentally call a number instead of sending a TXT message to the number, you will be charged the flagfall and standard call rates applicable to Your Call Plan.* *Refer to Your Call Plan in Section 2 of this Agreement for details. TXT delivery status reports You can set up Your Mobile Phone (usually via its "Messages" menu) to request that you be sent a TXT message confirming whether each TXT message you have sent has been delivered. 5c per each delivery status report sent to you My A variety of personalised information services and productivity tools are available to you through My, including , an online address book and calendar, news, sport, horoscope and entertainment Registering for My is free. To be able to access My you must register at Charges (unless otherwise specified, excludes Roaming) terms and conditions of use which you may view at Mobile Bank If you have a Commonwealth Bank account, you can use Mobile Bank to obtain access to certain information on Your Commonwealth Bank account and carry out certain bank transactions. You can request access to the Fax & Data Service by phoning Customer Service. You will be charged: a $33 connection fee when you request and we provide you access to our Fax & Data Service; a $5.50 access fee per month; and call rates vary by Call Plan for data you send or receive via the Fax & Data Service.* *Go to or phone Customer Service for information about specific call rates PXT Send digital photos from your PXT Capable Phone to any PXT Capable Phone or any address. Receive digital photos on your PXT Capable Phone sent from any PXT Capable Phone or any address. 75c per each PXT you send. There is no charge for taking photos with your PXT Capable Phone or for receiving photos. live! Access a range of new mobile services on your live! If your connection to a live! site is broken during a download, you will still be charged for the item you were downloading. You can complete the download by reconnecting to the site. You will not be charged again for downloading the item if you reconnect to the site within an hour after being disconnected. If you subscribe to weekly subscriptions, you will continue to have access to the subscription and will be charged every week for the subscription until you cancel the subscription. * Go to or phone Customer Service for SIM2 Access a range of new TXT services on your SIM2 Capable Phone, including My Account**, the Buzz, The Zone and M-Club.* **Account balance is not available if you have more than one connection under your account. 25 Part 6 Roaming Roaming Charges Use the Service (except for some of its features)* when you Roam on the mobile telecommunications networks of other carriers in Australia and overseas. You will be charged for using the Service at the rates set out in this Description + additional fees which vary by call origin, destination and type*. You will also be charged for receiving voice and data calls at rates which vary by call origin, destination and type*. Charges for using GPRS when you Roam internationally are set above in Part 4 of this Description under "GPRS". * GPRS is currently not available when you Roam nationally.
