6 Preface Preface It was an essential year in 2010 for fully implementing the National Trademark Strategy, for realizing the Three-Five Targets and for clearing out the backlog of trademark examination and review cases. Under the firm leadership of the State Administration for Industry and Commerce (SAIC), officials in charge of trademark tasks from China's Administration for Industry and Commerce (AIC) system dedicatedly translate the spirit of the 17th National Congress of Chinese Communist Party and the 5th plenary session into reality, spare no efforts to deliberate and practice the Scientific Development Outlook, thoroughly materialize the Outline of National Intellectual Property Strategy and the Opinions concerning the implementation of Outline of National Intellectual Property Strategy to advance the trademark strategy implementation and the Opinions on practice and realization of Scientific Development Outlook and actively promote the transformation of economic growth mode. On the other hand, they put priority on the realization of the Three-Five Targets with the realization of Five-Fours and Five-More as the purpose. Equal stress has been put both on trademark examination and administration, quality and quantity for trademark review. Identify the model work of Trademark Strategy Implementation as focus and take it as a driving force to promote the transformation of economic growth mode, build the innovation-oriented country and to transform China from a trademark big country to a strong one. Thus, significant achievements were scored during the implementation of various trademark tasks of AIC authorities. Completely cleared out the backlog of trademark examination and review cases In 2010, the Trademark Office examined 1.48 million trademark applications with high quality, and the examination period shortened from over thirty-six months to less than one year, and completely cleared out the backlog of trademark examination and review cases which was highly concerned home and abroad, two months ahead of time, achieving the outstanding results of "one historical change, two break-through over one million and three world first-place". By the end of 2010, the Trademark Office had received million trademark registration applications and accumulatively registered million trademarks, million valid registered trademarks, all ranking No. 1 in the world. This year a total of 39,000 trademark review cases had been concluded. The Office managed to shorten the review time period of refusal cases to twelve months and the examination period of complicated cases to eighteen months, completely cleared out the backlog of trademark review cases, and reached the goal of "closing 81,000 review cases and shortening the pending time to less than twenty-four months during 2010", six months ahead of the schedule. Remarkable achievements were made in the deepening of the National Trademark Strategy implementation In 2010, SAIC set up 53 model cities (districts) and 41 model enterprises to implement the National Trademark Strategy, organized a medal presentation ceremony in Beijing and adopted measures to support for these model cities (districts) and enterprises. Furthermore, SAIC held two symposiums on the implementation of the National Trademark Strategy for the whole AIC system and two conferences on experience exchange and trademark protection for model cities (districts) and enterprises, during which Wuhu Initiative and Suzhou Consensus were signed by all the model cities (districts) and enterprises with positive social feedbacks. The implementation of Trademark Strategy has now gradually escalated from departmental move of SAIC to governmental actions and became a highlight of AICs in serving economic development. The revision of Trademark Law provides legal assurance for the Trademark Strategy implementation In the year of 2010, SAIC held expert discussion 5

7 meeting and China-EU International Workshop on Trademark Law in coordination with legal Affairs Office of State Council, Legal Work Committee of NPC. Meanwhile, SAIC also organized investigations and workshops over the revision of Trademark Law in collaboration with the Legal Affairs Office of State Council in Beijing, Fujian, Guangdong provinces respectively. During the Experts Meeting on the Revision of Trademark Law jointly held by SAIC and the Legislative Affairs Office of the State Council, opinions on the Revised Draft of Trademark Law from departments at various levels were discussed and ideas on many problems were exchanged. In addition, promoting the legislation process of Special Signs Regulation and Trademark Agents Regulation has also provided legal assurance for the Trademark Strategy implementation. The Protection of trademarks helped to maintain a favorable market environment for fair competition In 2010, focusing on the protection of trademarks and putting emphasis on both daily supervision and special enforcement actions, AIC authorities at all levels investigated a total of 56,034 trademark cases and transferred 175 cases involving 163 suspects to judicial organizations. Seriously implementing the working arrangement of the State Council, 722,000 enforcement staff were dispatched to deal with IRP infringement and the production and marketing of counterfeit and shoddy goods. Altogether, they handled 16,000 infringement and counterfeit cases, receiving and handling 17,000 consumer complaints, retrieving an economic loss of million yuan for consumers. Big progress has been made in the protection of Shanghai World Expo signs and Guangzhou Asian Games signs. The determination and protection of well-known trademarks were enhanced in order to safeguard the rights of trademark owners home and abroad as well as consumers. All of these have safeguarded the lawful rights of trademark owners and consumers and helped to maintain a favorable market environment for fair competition. Remarkable achievements were made in the project of enriching farmers through trademark with trademark for agricultural products and geographical indications as the core In 2010, by studying documents of the third Plenum of the 17th Communist Party of China Central Committee and the Party Central Committee's "Document No. One", SAIC strengthened the protection and registration of agricultural product trademarks and geographical indications, actively promoted the project of enriching farmers through trademark and focused on cultivating agricultural product trademarks and geographical indications with international competitiveness. SAIC supported the characteristic industry to drive structural adjustments. Great improvements were made in reform and development of rural areas, making agriculture develop steadily, and farmers' income increase continuously. By the end of 2010, a total of 950,000 agricultural product trademarks and 1,040 geographical indications have been accumulatively approved and registered. International trademark registration helped Chinese enterprises to implement the Going Global Strategy In 2010, SAIC attached greater importance to international trademark registration and the protection of Chinese enterprises' trademark rights at international markets in order to encourage Chinese enterprises to implement the Going Global Strategy. 16,142 applications for Madrid International Trademark territorial extension submitted through the International Bureau of WIPO were accepted and 1,820 Madrid trademark international registration applications submitted by domestic enterprises and individuals through the Trademark Office of SAIC were processed. By the end of 2010, China accepted 154,302 applications designating China of territory extension under Madrid System, ranking No. 1 for six consecutive years in the world. Chinese enterprises and individuals presented 11,427 applications in total, ranking the seventh from previous the eighth in the world for the first time and still the first among developing countries. International exchanges and cooperation on the trademark field were beefed up In the year of 2010, SAIC conducted a series of Annual Development Report on China's Trademark Strategy

8 Preface projects in multilateral and bilateral exchanges and cooperation in the trademark field. SAIC signed a Memorandum of Understanding of Strengthening Further Cooperation between SAIC and WIPO and jointly held a seminar on new problems in trademark applications in partnership with the United States, EU and Japan, carried on further cooperation under EU-China IPR2, and held discussion forums respectively with IP Offices of Japan and France and UK to exchange opinions on trademark system and intellectual property protection. In addition, new progress was made in the administration of trademark agency, trademark publicity and the enhancement of team building, providing strong support to trademark development in China. The remarkable achievements in the trademark field in 2010 got extensive concern and massive compliments from both the central government and the other peers domestically and internationally. SAIC was awarded the Shanghai World Expo Outstanding Unit by the CPC Central Committee and the State Council, and was honored as the Friends of Spanish Brands on Shanghai World Expo. WIPO stated in World Intellectual Property Indicators 2010 that China's trademark applications contrarian increased despite of the global environment. The press conference of the State Council Information Office on Dec 9th, 2010, CCTV Xinwen Lianbo and the Main Edition of People's Daily on Dec 10th, 2010 had covered the news and announced that China's trademark application in 2010 had reached a total number of 1 million and ranked first in the world. Director-General of WIPO Francis Gurry spoke highly of it and said that China set a good example in the trademark field with the biggest trademark office in the world and with its remarkable achievements in clearing out the backlog of trademark examination and review cases. To better and comprehensively display new achievements of trademark work and Trademark Strategy implementation, further popularize knowledge of Trademark Law and strengthen awareness of trademark protection and innovation of the whole society, direct the local trademark work, enhance the enterprises' capabilities to develop larger and stronger by utilizing trademark strategy, and better serve the development of economy and society, under the instruction of Minister Zhou Bohua and Vice Minister Fu Shuangjian of SAIC, CTMO and TRAB compiled the Annual Development Report on China's Trademark Strategy (2010) (hereinafter referred as Annual Development Report) to wrap up China's trademark developments in The Annual Development Report (2010) consists of 13 chapters starting with Implementation of Trademark Strategy. It systematically recorded the achievements made by AIC system in terms of trademark application and registration, trademark administrative enforcement, geographical indications and trademarks for agriculture products, the determination and protection of wellknown and famous trademarks, trademark review and adjudication, trademark legislation, trademark agents, local trademark progress, international registration and overseas lawful rights protection, international exchanges and cooperation and trademark publicity. Major and important events have been pooled in the field of trademark and statistical analysis of various categories of trademark data also has been conducted. As an important reference and comprehensive annual report, the report is authoritative, informative and practical. It aims to guide the trademark work, help the public learn and understand China's trademark development, and assisting enterprises to make full use of trademark strategy. Great appreciation is extended to the SAIC General Affairs Office, all relevant departments and bureaus and directly affiliated institutions as well as AICs at different levels for their unreserved support and contribution to the report. 9 Chapter 1 Implementation of Trademark Strategy In 2010, SAIC focused on the demonstration of the National Trademark Strategy implementation as an effective method to promote economic growth transformation, aiming to build innovation-oriented country and transform China from a trademark big country to a strong one. The significant achievements became a highlight of the AICs in serving economic development. 1. Remarkable achievements were made in the demonstration of the Trademark Strategy implementation 1.1 The first batch of model cities (districts) and enterprises to implement the National Trademark Strategy were identified, and a medal presentation ceremony was held. In order to advance the Trademark Strategy, cultivate enterprises with its own trademarks and international competiveness, and make fully leverage trademark strategy to promote transformation of local economic development mode, SAIC has been working on the establishment of model cities (districts) and enterprises for the National Trademark implementation since From the cities (districts) and enterprises recommended by local AICs and State-owned Assets Supervision and Administration Commission (SASAC), SAIC screened out and confirmed the first batch of 53 model cities (districts) and 41 model enterprises. Attendants exchanged experience in promoting the development of local economy and enterprises by implementing the Trademark Strategy, discussed the Measures on Supporting Model Cities (Districts) and Enterprises to Implement the Trademark Strategy (The draft for discussing), and listened to the suggestions on the establishment of model cities (districts) and enterprises. Main stream news media reported the conference, and got good feedback from the public. To c a r r y o u t t h e M e a s u r e s a n d p r o m o t e communication between model cities (districts) and enterprises, SAIC framed Liaison System of Model Cities (Districts) and Enterprises to Implement the Trademark Strategy to specify their responsibilities, composition, working mechanism and meeting system of liaison staff. Moreover, SAIC has channeled special funds for distributing free materials regularly to the model cities (districts) and enterprises such as Annual Development Report on China's Trademark Strategy, China Industry and Commerce News, Trademark Newsletter, China Trademark. 1.3 Meetings of experience exchanges and trademark protection for model cities (districts) and enterprises were convened For better implementation of the Outline of National Intellectual Property Strategy and Trademark Strategy, and for promoting the special actions of cracking down on counterfeit and infringement, a meeting of experience exchange and trademark protection for model enterprises was held in Wuhu, Anhui Province on Dec 21st and 22nd, Representatives from the first batch of 41 model enterprises, provinces, autonomous regions and municipalities as well as AICs at various levels and enterprises owned well-known trademarks in Anhui attended this meeting. In the meeting, representatives from 9 model enterprises including Chery Automobile Co. Ltd. exchanged their experience on Trademark Strategy implementation, and Vice Minister Fu Shuangjian of SAIC made a summarizing speech. Tasks of cracking down on counterfeit and infringement were properly arranged, and some model enterprises gathered for further discussion. During January 12th to 13th, 2011, a meeting of experience exchange and trademark protection for model cities (districts) was held in Suzhou, Jiangsu Province. Representatives from AICs and Department of Market Supervision and Inspection of the first batch of 53 model cities (districts), provinces, autonomous regions, municipalities, cities specifically designated in the state plan and cities enjoying deputy provincial level, as well as from Jiangsu AICs at various levels attended this meeting. During the meeting, representatives from 11 model cities (districts) including Suzhou exchanged their experience and made speeches on the Trademark Strategy implementation and promoting innovation of cities. Also a press conference on the special action of Annual Development Report on China's Trademark Strategy

12 Chapter 1 cracking down counterfeit and infringement was held to introduce the special action and ten typical cases encountered during the action, and some model cities (districts) gathered together for further discussion. During these two meetings, 41 model enterprises j o i n t l y i s s u e d N a t i o n a l Tr a d e m a r k S t r a t e g y Implementation Model Enterprises Wuhu Initiative which called for thoroughly implementing the Trademark Strategy, enhancing the protection of trademarks, helping independent brands to create good images and improving core competence of enterprises. At the same time, 53 model cities (districts) jointly signed National Trademark Strategy Implementation Model Enterprises Suzhou Consensus and committed to sincerely implement the Trademark Strategy, crack down counterfeit and infringement, speed up the economic transformation and upgrading, promote the transformation of developing mode and with the guidelines of stimulation of innovation, useful utilization, protection by law and scientific administration to improve the international competitiveness of enterprises and their brands. December 21st to 22nd, the National Trademark Strategy Implementation Model Enterprises Experience Exchanging and Trademark Utilization and Protection Conference was held in Wuhu, Anhui province. Forty-one National Trademark Strategy Implementation Model Enterprises attending the conference jointly initiated Wuhu Initiative. The issuance of Wuhu Initiative and Suzhou Consensus aroused strong response and would help the model cities (districts) and enterprises give full play to their roles and enhance their senses of social responsibility so as to improve public consciousness on trademark and create a favorable social atmosphere for intellectual property protection.. 2. Significant achievements were made during the implementation of Trademark Strategy In mid October, 2010, SAIC convened working conferences of national AIC system on the Trademark Strategy implementation of AICs at all levels in Hangzhou of Zhejiang Province and in Wuxi of Jiangsu Province respectively. On the conferences, 46 representatives from Deputy Provincial level AICs reported their implementation of Trademark Strategy and work plans for next stages, and shared their views on the nationwide implementation of Trademark Strategy. Vice Minister Fu Shuangjian of SAIC made two important speeches, hashed over the remarkable achievements AICs had made in terms of Trademark Strategy implementation, analyzed situation and problems currently faced, emphasized on the priorities at present and in the future, and put forward expectations for further implementation of Trademark Strategy. By the end of 2010, the trademark strategy leading groups had been set up in over 30 provinces, autonomous regions and municipalities, with Tianjin, Liaoning, Jilin, Jiangsu, Anhui, Chongqing, Qinghai and Ningxia having senior government leader as the group's head, which strongly promote the implementation of Trademark Strategy of various regions from an organization perspective. Among the 30 provinces, autonomous regions and municipalities, 29 had already issued their documents regarding the implementation of the Trademark Strategy. Among them, Liaoning, Jiangsu, Anhui, Shandong, Hubei, Yunnan, Shanxi and Qinghai handed out the documents by local governments, while other 21 provinces, municipalities and autonomous regions issued the documents by AICs and channeled by local governments or government offices. AICs at various levels adopted strategies and action plans in the light of realities and economic development demands of local areas and achieved great results. 3. Further enhancing training and instruction to implementation of Trademark Strategy 3.1 Training program was held to facilitate Implementation of Trademark Strategy 11

13 organization and implementation of Trademark Strategy of AICs at all levels. On July 6th and 7th, 2010, the Second Session of Nationwide Training Program on Trademark Strategy and the Protection of Signs of 2010 Guangzhou Asian Games was held in Guangzhou, attracting 46 deputy provincial level attendants who are responsible for trademark work of AICs at various levels, leading group of Trademark Office and personnel in charge from other departments or sections of SAIC as well as AICs officers from various cities of Guangdong Province. This training program is not only a significant part of the Trademark Strategy implementation, but also an important measure for the protection of signs of 2010 Guangzhou Asian Games. During the program, officials from AICs and scholars made detailed analysis on the implementation of National Intellectual Property Strategy and Trademark Strategy, the international protection of trademarks and the promotion of national industry development via Trademark Strategy; AICs of Hebei, Jilin, Zhejiang, Fujian, Shandong, Hunan, Guangdong, Yunnan and Xinjiang exchanged their experience on how to promote implementation of Trademark Strategy. AICs of Beijing and Shanghai introduced their experience on the protection of Olympic Signs and World Expo signs. Representatives from Guangzhou Asian Games Organizing Committee and SAIC Trademark Office made speeches on Guangzhou Asian Games and the protection of its signs. 3.2 Further enhancing instruction to local trademark administration On March 25th, 2010, Minister Zhou Bohua and Vice Minister Fu Shuangjian attended the Liaoning Accelerating Trademark Strategy Implementation and Well-Known Trademark Commendation Conference. The important speech Minister Zhou Bohua made on the meeting is not only an instruction to Liaoning's implementation of Trademark Strategy, but also a guideline document for carrying out China's Trademark Strategy. In the year of 2010, Vice Minister Liu Yuting attended the Youth Intellectual Property Forum of State Organs of the CPC and Jiangsu Trademark Strategy Implementation Conference and made important keynote speeches. Vice Minister Fu Shuangjian went to Anhui, Henan, Zhejiang, Shanxi, Guangdong, Xinjiang, Xizang, Qinghai, Beijing, Jiangsu, Hubei, Sichuan and Ningxia to exercise investigations, instruct the implementation of Trademark Strategy, present at the trademark event and made very important speeches. Besides being escorting the top leaders of SAIC during study tour and inspection, the Trademark Office sent staff to attend activities regarding trademark administration in Shanghai, Jiangsu, Xizang, Jilin, Zhejiang, Guangdong, Henan, Inner Mongolia, Gansu, Jiangxi, Sichuan, Chongqing and Beijing, provide instruction to local trademark administration, and give lectures to local AIC officials in SAIC Administration Institute. All of these have enhanced instruction to local trademark administration, strongly promoted the implementation of Trademark Strategy, and made great contributions to sound and rapid growth of local economy. 3.3 Make innovations on the implementation mechanism of trademark strategy. In the past one year since its establishment, Zhongguancun Office of SAIC Trademark office has solidly practiced the Opinions of State Council over the agreement of support to establish Zhongguancun Science Park National Innovation Demonstration Zone, closely translated the 43 policies and 8 concrete measures launched respectively by SAIC and Trademark Office designed to support the establishment of Zhongguancun Science Park National Innovation Demonstration Zone and provide scientific service accordingly and unreservedly. In total, they have accepted over 12,000 pieces of trademark applications, 37 applications for the registration of trademark pledge and helped business to finance over 87,60 million RMB, which have been given positive compliments from the leaders of Beijing Municipal Party Committee, Municipal government and SAIC and enterprises as well. 14 Chapter 2 Chapter 2 Trademark Application and Registration In 2010, the Trademark Office of the State Administration for Industry and Commerce (hereinafter referred to as "CTMO") focused on "solving the backlog of trademark examination in three years", actively pushed on "the transformation from attaching importance to trademark examination to giving equal stress to examination and management, and the transformation from attaching importance to examination quantity to giving equal stress to examination quantity and quality", created many miracles and over-fulfilled its tasks. 1. Information about Trademark Application and Registration in 2010 In 2010, CTMO received 1,072,187 trademark applications, a year-on-year increase of 29.1%, a record high, ranking first in the world for consecutive nine years. In terms of the Classes as defined in the International Classification of Goods and Services for the Purpose of the Registration of trademarks, Classes 25, 9, 35, 30 and 11 were among the top ones with the largest number of applications, which were 115,195, 65,237, 64,584, 63,012 and 48,689 respectively. The top five provinces (municipalities) with the largest number of domestic applications were Guangdong Province, Zhejiang Province, Beijing City, Jiangsu Province and Shanghai City, with 171,352, 123,739, 74,954, 66,306 and 60,243 applications respectively, altogether amounting 51% of the total domestic applications. Provinces with over 40,000 applications also included Fujian and Shandong Provinces, numbering 56,931 and 49,941 respectively. The top ten countries or regions with the largest number of foreign trademark applications (including Madrid trademark applications for territorial extension) were the USA, Japan, the United Kingdom, Germany, Republic of Korea, Australia, British Virgin Islands, France, Italy and Sweden, with 23,346, 20,021, 6,614, 6,333, 5,688, 3,295, 3,077, 2,880, 2,084 and 1,902 applications respectively. Trademark applications from the above ten countries or regions accounted for 76.2% of the total foreign applications in China. The top five provinces (municipalities) with the largest number of applications for international registrations were Zhejiang Province, Guangdong Province, Liaoning Province, Jiangsu Province and Beijing City, with 506, 484, 160, 151 and 139 applications respectively. In 2010, CTMO accepted 78,016 applications Trademark Application and Registration China's Trademark Applications from 1999 to 2010 (Unit:Piece) filed for renewal, 48,930 for opposition, 127,995 for modification of registered items, 86,182 for trademark transfers, 16,358 for invalidation or cancellation, and 20,524 filing record of trademark license contracts. In 2010, CTMO approved and preliminarily examined 269 geographical indication applications,a big rise compared with By the end of 2010, the Office had approved 950,000 trademarks of agricultural products and 1,040 geographical indications. In 2010, CTMO organized ten spot checks on examination quality and randomly checked 29,960 trademark examination cases. The pass rate of the spot checks was 99.14%. 2. Thoroughly solving the backlog of trademark examination which is a common concern at home and abroad In 2010, while ensuring the quality of trademark examination, CTMO kept accelerating trademark examination and realized "a historic change, two breakthroughs of one million and three world number ones". "A historic change": Since 2008, examination has outnumbered application, reversing the passive situation that application outnumbers examination since 2000, and realizing a historic change. "Two breakthroughs of one million": Firstly, the examination of trademark registration has exceeded one million for two consecutive years. In 2009, 1,415,000 applications were examined. World Intellectual Property Organization (WIPO), International Trademark Association (INTA) and the trademark authorities of EU, USA, Japan, the United Kingdom and Germany sent congratulatory letters. The State Administration for Industry and Commerce (SAIC) also specially sent a congratulatory letter. In 2010, CTMO created a new record and examined 1.48 million applications, equivalent to the total workload in five years before the acceleration of examination. Secondly, the application of trademark registration exceeded one million in the year. Solving the problem of backlog has driven the increase of applications of trademark registration against global decline. On the basis of a record high in 2009, the application quantity exceeded one million in 2010, reaching million. "Three world number ones": By the end of 2010, CTMO had received million trademark registration applications,finished million registrations,4.604 million valid registered trademarks, all ranking No. 1 in the world. In the recent three years, the number of applications is 2.6 million, equivalent to 45.7% of the total number in the previous 28 years; the number of examinations is 3.64 million, equivalent to the total workload in the 12 years before examination acceleration; and the number of registrations is 2.59 million, equivalent to 85.3% of the total number in the previous 28 years. 3. Significance of thoroughly solving the backlog of trademark examination CTMO cleared out the backlog of trademark examination, satisfactorily fulfilled the immense task assigned by SAIC, solved in advance the major difficulty which aroused concern at home and abroad, realized the work target which was considered impossible by ordinary people, made unprecedented achievements and fully proved it is correct that SAIC set "three-five targets"; it is forceful that the leaders of SAIC put forth the general reform concept of "one reliance", "four helps" and "renewing concepts, introducing new mechanisms, handling affairs according to the law, promoting a clean government and raising efficiency" and the important instruction of "taking multiple measures, addressing both the short-term needs and the long-term needs, raising efficiency and attaching importance to quality"; and it is effective to take a series of important measures such as: "energetically implementing the trademark strategy, increasing examination divisions and offices, hiring Annual Development Report on China's Trademark Strategy

16 Chapter 2 additional 300 examining assistants, making active use of high-tech means and signing responsibility contract with examiners". Implementing the trademark strategy, accelerating trademark examination and thoroughly solving the backlog of trademark examination has important realistic meaning and far-reaching historical significance. Firstly, it honored the commitment to domestic and foreign communities, won wide praise and consolidating the good international image of Chinese government in forcibly and effectively protecting the intellectual property of trademarks. Secondly, it enhanced the capacity in trademark registration, administration and protection, established the position of China as a large trademark country in the world and laid a solid foundation for China's development from a large trademark country to a strong trademark country. Thirdly, it boosted the confidence of domestic and foreign trademark registration applicants and promoted the continuous and steady growth of trademark registration applications. Fourthly, the practice for solving the backlog of trademark examination created experience, tempered teams, hardened willpower and provided powerful ideological, moral and organizational guarantee for deepening the trademark strategy and serving in a better way building an innovation-oriented country. 4. The trademark work of China won full recognition of all social circles in China and abroad The trademark work of China achieved the remarkable result of "three world number ones" and won wide praise from all social circles at home and abroad. The news once released at the press conference of the Information Office of the State Council on December 9 aroused sensation in the world. CCTV News reported the news that China ranked No. 1 in the world in terms of the number of trademark registration applications on December 9. People's Daily published a roundup on China's achievements in trademark at the page of Important News on December 10. Yesterday's Important Information edited and published by the Secretariat of On December 9th, State Council Information Office (SCIO) held the news conference. SAIC Vice Minister Mr. Fu Shuangjian introduced the situation of SAIC solving the problems of trademark examination and review backlog as well as the results of the Action Plan of cracking down on trademark infringements and counterfeits. CTMO DG Mr. Li Jianchang accompanied Mr. Fu to the conference and answered reporters questions. the General Office of the State Council published on December 14 the news: "Up till December 9,2010, the number of trademark registration applications in China in 2010 had reached million, a big rise compared with The problem of backlog of trademark examination is thoroughly solved. The period of examination is shortened from more than 36 months to less than one year". Mr. Gurry, Director-General of WIPO commented: "China has the world largest trademark office. Last year alone, the number of trademark applications reached 830,000 in China. In the Madrid system of WIPO, China ranks top 10 in the world in terms of international trademark applications. China is also a country designated by most foreign trademark applicants. This fully reveals the importance and attraction of Chinese market." On November 18, 2010, Director-General Gurry visited SAIC. During the meeting with SAIC Minister Zhou Bohua and Vice Minister Fu Shuangjian, he spoke highly of the outstanding performance of Chinese Trademark Office in solving backlog of trademark examination and the good example it set in trademark work. 17 Chapter 3 Trademark Administrative Enforcement In 2010, AICs at all levels seriously implemented relevant instructions and requirements issued by State Council, brought into full play their functions, strengthened the law enforcement efforts for trademark, actively conducted special activities about cracking down the infringement and counterfeiting, severely investigating and handling trademark infringement and counterfeiting, focused on the works of protecting well-known trademarks, foreign-related trademarks, signs of World Expo and Asian Games and transferring suspected trademark crimes to the judicial organizations, energetically explored long-term supervision mechanism for controlling trademark infringement and counterfeiting, gradually perfected the trademark administrative protection mechanism, which effectively adjusted and standardized the market orders, created a positive environment for China's IPR protection and made positive contribution to stimulating sound and fast development of economic society. 1.Comprehensively promote the protection of World Expo signs, to create favorable circumstance for IPR protection for successfully holding the Shanghai World Expo. Since The Regulation on World Expo Signs Protection issued by China State Council in 2004, AICs at all levels have brought into full play their functions, seriously implemented the document of Methods of World Expo Signs Recordal, Action Plan on Serving for 2010 Shanghai World Expo, Action Plan for Protecting Exclusive Rights of World Expo signs, Notice on Issues of Protecting the Exclusive Rights of Shanghai World Expo signs issued by SAIC, and Special Campaign Plan for Intellectual Property Protection of 2010 World Expo issued by SAIC associated with other 7 departments, made an all out effort for World Expo signs protection through a high sense of responsibility and mission, careful arrangement and best effort of implement, and created a good intellectual property protection environment for holding a successful, fantastic and memorable Shanghai World Expo. CTMO of SAIC actively conducted the archival recordal works and trademark registration for World Expo signs according to The Regulation on World Expo Signs Mark Protection and Methods of World Expo Signs Mark Recordal. Through strictly scrutiny and as per prescribed procedures, in 2010, trademark office legally filed 63 pieces of signs respectively on 45 class of goods and service categories, 2835 pieces in total, filed 45 special signs based on Regulations on the Special Signs Protection and filed 227 trademark applications on 45 class of goods and services based on Trademark Law and Trademark Law Implementing Regulations. According to the requirements of Action Plan for Protecting Exclusive Rights of World Expo, the action for protecting the exclusive rights of World Expo started in August 2009 and finished by the end of AICs at all levels, according to actual situation, respectively conducted three centralized regulating activities in October 2009, April 2010 and August 2010, completely checked the usage of World Expo signs around the product manufacture, commodities circulation and trademark printing fields, severely cracked down the acts of illegal use of World Expo signs, sales of the commodities that infringe the World Expo signs and illegal printing of World Expo signs. In January 2010, State Intellectual Property Office associated with SAIC and other 6 departments issued Special Action Plan for Intellectual Property Protection of 2010 World Expo. According to the plan, CTMO fully implemented its functions and brought into full play its major role of intellectual property protection of World Expo signs, and constructed, together with other departments, a close defense line for protecting the intellectual property of the World Expo. On Apr. 7th 2010, CTMO organized a World Expo signs protection seminar in Shanghai. Chiefs of trademark management divisions under AICs in 9 key provinces and cities, including Shanghai, Guangdong, Beijing, etc., presented this meeting, discussed and Annual Development Report on China's Trademark Strategy

18 Chapter 3 solved, in an orientated way, the problems of proactive enforcement, complaining and recordal existed in the protection of World Expo signs, which achieved obvious result and provided a good basis for the further work. On Apr. 30th 2010, aiming at solving the problems raising during the work, SAIC issued a Notice on Issues of Protecting the Exclusive Right of Shanghai World Expo (No. 92 GSBZ [2010]), which further specified the basic situation of World Expo signs rights and the licensee's rights. AICs at all levels were required to specify their duties, standardize the enforcement procedures, straighten the communication channel and set up the information report system and emergency response mechanism during the protection of exclusive right of Shanghai World Expo signs, to make sure a successful, effective and steady enforcement. CTMO timely directed the problems of case determination, law application, investigation assistance, etc.,which occurred during the protection of exclusive right of Shanghai World Expo signs by AIC. From Aug. 31st to Sep. 2nd 2010, CTMO joined the World Expo Intellectual Property Protection Team jointly organized by 8 departments, including State Intellectual Property Office, Ministry of Public Security. CTMO checked the protection work of Shanghai World Expo signs and participated in the Conference on the Progress of Special Action of World Expo Intellectual Property Protection jointly organized by relevant departments in Shanghai. On Sep. 15th and 16th 2010, according to the case of infringement of World Expo signs, CTMO called a specialized regulating meeting in Shanghai on cracking down the acts of manufacturing and selling the products infringing the right of World Expo signs in some districts of Guangdong, Zhejiang, Fujian, Shandong, etc.. Trademark officials of AICs and relevant chiefs of Bureau of Shanghai World Expo taking part in the meeting introduced the situations about developing protection of the World Expo signs. AICs are required to continually pay great attention to the protection of the World Expo signs, improve inter-region and interdepartment cooperation, strengthen the coordination between AIC and the rightholders of World Expo signs, and improve the level of intellectual property protection of World Expo signs in all respects. In order to implement relevant regulations on unblocking communication channel and setting up information sharing system in the Notice on Issues of Protecting the Exclusive Right of Shanghai World Expo, CTMO actively communicated with Shanghai World Expo Signs Management Office under Bureau of Shanghai World Expo and Shanghai AIC. On 14th Oct. 2010, CTMO took part in the Intellectual Property Promoting Meeting for Bureau of Shanghai World Expo Serving World Expo Exhibitors and introduced about the trademark registration system, exhibition priority, etc.. According to statistics, AICs at all levels totally handled 1132 World Expo signs infringement cases with the case value up to RMB 8,170,000 Yuan and confiscated World Expo signs infringement commodities of 200,000 in CTMO was awarded "Shanghai World Expo Outstanding Unit" by Chinese Communist Party Central Committee and State Council. CTMO of SAIC is awarded the title of Shanghai World Expo Outstanding Unit. 2.Strengthening the protection efforts on Asian Games signs, to serve for the successful opening of Guangzhou Asian Games In order to bring into full play AIC functions and further strengthen the protection of Asian Games signs, Trademark Administrative Enforcement 17

19 SAIC issued Measures on Protection of Asian Games Signs (No.48) on Apr. 2nd 2010, provided a strong legal guarantee for intellectual property protection of Asian Games. Up to the end of 2010, CTMO had examined and approved 2539 pieces of Asian Games signs, among them, 296 pieces were approved and registered through common trademarks and 2243 pieces were approved and registered through special signs. SAIC issued Special Action Plan for Protecting Asian Games Signs on Apr. 29th 2010 and decided to launch special action plan for protecting Asian Games signs around the country from May to December 2010, to further enhance the awareness of protection of Asian Games signs in the whole society and strictly crack down all sorts of infringement on the exclusive rights of Asian Games signs. In order to strengthen the enforcement level and ability of AICs for protection of Asian Games signs, CTMO organized, together with Guangdong Province Administration of Industry & Commerce and Guangzhou Asian Games Organising Committee (GAGOC), the 2nd Training Class of Trademark Strategy and Asian Games Signs Protection for National AIC System in Guangzhou on Jul. 6th and 7th 2010, and conducted training for principals and key staff of the trademark management department of 31 provincial AICs, 15 sub- provincial AICs and AICs at prefecture and city level of Guangdong Province, which completely promoted the awareness of the significance on protection of Asian Games signs and strengthened the protection efforts on Guangzhou Asian Games signs. 3. Special campaign of crackdown on IPR infringement and counterfeits has been conducted steadily and achievements of the current stage have been made On November 5, 2010, the State Council held a national telephone and vedio conference on Protection and Law Enforcement Work of Intellectual Property Rights and decided to carry out a 6-month nationwide special campaign to fight against infringement of intellectual property rights and production and sale of counterfeits and shoddy goods starting from October, In accordance with the overall deployment of the State Council, the State Administration of Industry and Commerce took the task seriously, meticulously arranged, organized and pushed forward the special campaign and obtained significant interim achievements. On November 8, SAIC collectively met to learn the essential points of Premier Wen Jiabao and carefully deploy specific implementation program in accordance with the requirement of Vice Premier Wang Qishan of "Make implementation downright". It is decided to set up the leading group in which Vice Minister of SAIC acts as the group leader, the chiefs of each department under SAIC are the members; the SAIC Special Campaign Plan for Crackdown on IPR Infringements and Counterfeits and SAIC Propaganda Plan for the Special Campaign of Crackdown on IPR Infringements and Counterfeits are adopted; it is decided to hold the telephone and video conference on the protection of intellectual property and the enforcement work in the AICs at all leveals on November 11 for the purpose of making an overall deployment to carry out the special campaign to crack down infringement and counterfeits in the industrial and commercial system. On November 10, SAIC issued SAIC Special Campaign Plan for Crackdown on IPR Infringements and Counterfeits and SAIC Propaganda Plan for the Special Campaign of Crackdown on IPR Infringements and Counterfeits, requesting that it should be carried out seriously in every place, and the special campaign to strike infringement and counterfeits should be executed in a real sense. On November 11, SAIC held the telephone & vedio conference on the protection of intellectual property and the enforcement work attended by AICs above-county level. All the SAIC Ministers available in Beijing were present at the meeting. Zhou Bohua, the Minister of SAIC, made important speech to mobilize and deploy the special campaign in AICs in an all-round way. On November 12, the meeting was reported in Xinwen Annual Development Report on China's Trademark Strategy

On December 17th, SAIC Vice Minister Mr. Fu Shuangjian inspected the situation of the Action Plan of Cracking down on IPR Infringements and Sales and Production of Counterfeits. From November 15 on, SAIC sent 15 supervision and inspection groups led by SAIC Ministers and attended by the chiefs of each department under SAIC to go to every place to make inspection, supervision and guidance of the implementation of the special campaign to strike infringement and counterfeits as key point. On November 16, at the first plenary meeting of the leading group for the special campaign to crack down on infringement and counterfeits nationwide presided over by Vice-premier Wang Qishan, Fu Shuangjian Vice- Minister of SAIC, made a report of the progress about the SAIC special campaign. On November 17, the director of the office of the leading group for the nationwide special campaign,jiang Zengwei convened the first meeting of all the members, requesting that every department should propose specific implementation measures in accordance with the essential points of "Highlight key points, seek practical effect, strengthen publicity" delivered by Vice Premier Wang Qishan. With quick action, based on the campaign program of SAIC, through careful study, SAIC has further specified the key points in work and publicity of the special campaign: Firstly, to make serious investigation and handling infringement on the rights and interests of foreign-related trademarks and well-known trademarks; secondly, to prevent the bad-faith trademark applications; thirdly, to strictly crackdown on the illegal printing of trademark labels as well as unfair competition involving packaging and decoration of famous products, it is specified that 12 provinces and cities including Beijing, Tianjin, Hebei, Shanghai, Jiangsu, Zhejiang, Anhui, Fujian, Shandong, Henan, Guangdong and Sichuan will be taken as the key regions to carry out the special campaign. On November 19, Vice-Minister of SAIC, the group leader of the leading group for the special campaign of SAIC, Fu Shuangjian convened the first plenary meeting of the leading group for the special campaign, deployed the task assignment of the special campaign, and proposed three requirements: Firstly, to further specify key points, strengthen strike, reinforce work effect; secondly, to specify responsibilities, strictly implement responsibilities, do a good job in carrying out the special campaign; thirdly, make good publicity, pay attention to the combination with daily work. On November 26, the director of the office of the leading group for the special campaign nationwide, Jiang Zengwei convened the meeting of major members. 14 member units including SAIC participated in the meeting, making report about the key points in work and publicity in the special campaign of their respective departments. Li Jianchang, Director General of the CTMO under SAIC, the deputy leader & the office director of the leading group for the special campaign of SAIC made a report. On December 6, SAIC issued the Notification on Printing and issuing The Implementation Plan for Effectively Preventing Trademark Bad Faith Applications, The Implementation Plan for Investigating and Handling Cases of Foreign-related Trademarks and Well-known Trademarks and The Implementation Plan for Crackdown on Unfair Competition Involving the Illegal Printing of Trademark Labels as well as Packaging and Decoration of Famous Products. Focusing on three kinds of infringement and counterfeit acts, the work objectives, measures, arrangements and requirements were proposed respectively. The leading group office of the special campaign of SAIC submitted 10 key cases to Trademark Administrative Enforcement 19
