History 1995 STAAR toric IOL 1997 AMO Array multifocal IOL History 2005 CMS Ruling Presbyopia-Correcting IOLs 2007 CMS Ruling Astigmatism-Correcting IOLs CMS Ruling A single presbyopia-correcting IOL essentially provides what is otherwise achieved by two separate items: an implantable conventional IOL (one that is not presbyopia-correcting), p and eyeglasses or contact lenses. Although presbyopia-correcting IOLs may serve the same function as eyeglasses or contact lenses furnished following cataract surgery, IOLs are neither eyeglasses nor contact lenses. CMS Ruling 05-01

2 CMS Ruling Therefore, the presbyopia-correcting functionality of an IOL does not fall into the benefit category and is not covered. Any additional provider or physician services required to insert or monitor a patient receiving a presbyopia correcting IOL are also not covered. For example, eye examinations performed to determine the refractive state of the eyes following insertion of a presbyopia-correcting IOL are non-covered. Medicare Never Covers Refractions Routine physical checkups; eyeglasses, contact lenses, and eye examinations for the purpose of prescribing, fitting, or changing eyeglasses; eye refractions by whatever practitioner and for whatever purpose performed are not covered Expenses for all refractive procedures, whether performed by an ophthalmologist (or any other physician) or an optometrist and without regard to the reason for performance of the refraction, are excluded from coverage. CMS Ruling MBPM Chapter Non-covered Items Medicare does not cover the accommodative change in eyeglass or contact lens power that is required to compensate for the gradual loss of near vision as presbyopia p progresses National Coverage Determination 80.7 The use of radial keratotomy and/or keratoplasty for the purpose of refractive error compensation is considered a substitute or alternative to eyeglasses or contact lenses, which are specifically excluded by 1862(a)(7) of the Act (except in certain cases in connection with cataract surgery). In addition, many in the medical community consider such procedures cosmetic surgery, which is excluded by section 1862(a)(10) of the Act. Therefore, radial keratotomy and keratoplasty to treat refractive defects are not covered. 3 Refractive Cataract Surgery Reimbursement Grid Facility Physician Covered Cat surgery & IOL Cataract surgery Non-covered Deluxe IOL, LRI Refractive care National Coverage Determination 10.1 In most cases, a comprehensive eye exam (ocular history and ocular examination) and a single scan to determine the appropriate pseudophakic power of the IOL are sufficient. In most cases involving a simple cataract, a diagnostic ultrasound A-scan is used. For patients with dense cataract, an ultrasound B-scan may be used. Patient shared billing: covered & non-covered services LRI Limbal relaxing incisions, refractive keratoplasty National Coverage Determination 10.1 Accordingly, where the only diagnosis is cataract(s), Medicare does not routinely cover testing other than one comprehensive eye exam (or a combination of a brief/intermediate examination not to exceed the charge of a comprehensive examination) and an A-scan, or if medically justified, a B-scan. Claims for additional diagnostic tests are denied as not reasonable and necessary unless there is an additional diagnosis and the medical need for the tests is fully documented. National Coverage Determination 80.8 When a presurgical examination for cataract surgery is performed if the only visual problem is cataracts, endothelial cell photography is covered as part of the presurgical comprehensive eye examination and not in addition to it.
