4 2010 kcmba president Thomas V. Bender There s a Lawyer Passing Surely you have read the book or seen the movie, To Kill a Mockingbird. You may have even gone to law school because of it. Harper Lee s storytelling is powerful enough, but combined with Gregory Peck s movie depiction of Atticus Finch the images are unforgettable. I was recently reminded of just how powerful those images are. At the KCMBA Bench-Bar & Boardroom Conference just concluded at The Lodge of Four Seasons, Missouri Governor Jay Nixon reminded us of the historical nobility of our profession but observed how the public perception of attorneys has fallen in recent years. Though this unfavorable perception is generally unwarranted, it is ubiquituous, and in order to change it, Governor Nixon suggested we start from within. The Governor closed his comments with a reading from To Kill a Mockingbird, painting a picture of the stillness in the courtroom after Tom Robinson was convicted. Atticus Finch ordered the record for appeal, closed his briefcase, and took the oh-so-long walk out of the courtroom in which his client was unfairly convicted. The upper gallery, silent but supportive, rose out of respect for Atticus Finch as Reverend Sykes reminded Scout to do the same for her father, a lawyer, as he exited the courtroom: Jean Louise. Jean Louise, stand up. Your father s [a lawyer is] passing. Governor Nixon challenged us to lead our professional lives in a way that will cause others to once again show respect when there s a lawyer passing. I thought the Governor s speech was inspirational. We need to be reminded of the nobility and often heroic nature of what we do, and he did that simply and powerfully. (Granted, I may have cheapened the moment by thereafter announcing the location of the hospitality suite and suggesting it would be better to hear that night that a lawyer is passing rather than a lawyer is passing out, but I felt better about being a lawyer after hearing the speech). I appreciate Governor Nixon reminding us of the good that we do as attorneys and challenging us to do even better. We need those reminders and that encouragement. Let s face it we don t do a very good job of inspiring each other. Part of it is the nature of the beast. In our practices, we often are in adversarial positions, so from the start, half of those involved in the process aren t thrilled with us. Even our own clients, who 2 KC Counselor July/August 2010 F. Add to this cauldron the competitiveness of our profession and there is often an inability to genuinely praise someone else s success, with instead the often- heard grumble: Why wasn t that me? In short, this is often a hard profession in which to get positive reinforcement. Let s take to heart the message of Governor Nixon, a fellow attorney, and work to improve our profession from within. It would be great to work on ourselves to become better and more ethical lawyers, and if we would all do that, nothing would do more to help our image. But I realize that advertising a self-improvement regimen might, like the P90X or Hip Hop Abs ads on television, lead to an immediate changing of the channel. However, while our own practices may be hard to address, we can in other, easier ways still make improvements to the image of the legal profession by providing reinforcement and encouragement to other attorneys. We can help other attorneys do better and feel better about themselves. Inspire Attorneys Outside Your Firm When you hear that one of your fellow lawyers has done something admirable or well, send a short note or to let her or him know. (While there s no substitute for a handwritten note, it s better to send the than to never send a note at all). Today send an to someone outside your firm who has done one of the following:

5 Received an award or had a significant legal accomplishment. Taken the time and effort to run for office, for the school board or other public service. Taken a Voluntary Attorney Project case, pro bono assignment, or other charitable work. Just plain nice person stuff: acknowledge the good deeds of our colleagues, whether or not done as a lawyer (because people generally know they are a lawyer and they are indirectly helping the profession). Let them know you noticed. Extended you courtesies as opposing counsel (e.g. by consenting to your request for additional time to answer discovery, or to a stipulation for foundation of documents, or to a suggested approach to resolving a business dispute). Inspire People Within Your Firm Don t overlook people within your firm; your kind words will mean all the more to them. Younger lawyers need to be praised as much or more than they need to be criticized. More than 90 years ago, Dale Carnegie wrote How to Win Friends and Influence People and noted that criticism does little to encourage good performance. That still rings true. Find something that a young lawyer is doing that exemplifies the best of our profession, and let them know. Those non-attorneys who are involved in the profession: nice job answering the phones we get lots of compliments from our clients or thanks for making sure we met that deadline or thank you for not embezzling anything this year Find something to recognize or encourage and do it often you can never do enough. While this may seem self-serving, remember that older lawyers need to be praised just as much as younger lawyers. We all work best off of positive reinforcement, and frankly, there just is not enough of it any more. Trial lawyers are lucky if they are able to use their skills once or twice a year. As a result, confidence is lacking, and positive feedback from colleagues and particularly judges goes a long way. So if you see something an attorney is doing well, tell them. It makes no difference if you are a judge, co-counsel or a younger associate (though in the latter case you may be seen as the suck up you actually are, but as Richard Gere said to the clothing salesman in Pretty Woman, I think we need some major sucking up. ) I think effusive praise is underrated; we are so good at the sarcasm, the occasional barb or the dry criticism that we forget how helpful it is to hear a kind word or receive a sincere pat on the back. I ll start. Today I am extending a pat on the back to the following individuals who make me feel proud about our legal community: Bono Award they make us all look good by their commitment to others. Still more pats for our fellow attorneys from the KCMBA, who currently sacrifice so much to serve in the legislature: former KCMBA member and now U.S. Senator Claire Mc- Caskill, and current KCMBA Members Jolie Justus, Matt Bartle, Jason Grill, Jason Kander, Tim Flook, Mike Talboy, Bryan Pratt, John P. Burnett and John Vratil as well as those who have served in the past would likewise appreciate a kind word once in a while. Whether or not you agree with their political stances, let s recognize their dedication and sacrifice for all of us. A thank you to the Honorable Fernando J. Gaitan for his ongoing work to help educate the public on the importance of the third branch of government. Additional pats for those who help with Heart of America Stand Down: Brent Lagergren, Coult devries, and others providing help to our veterans who need a fresh start. Gratitude to the Honorable W. Brent Powell and the Honorable Robert E. Larsen for their dedication to programs that enhance the work of trial lawyers. Pats on the back for our new judges, who took the time and endured the process, and many times faced rejection to likely take a pay cut so that they could advance the administration of justice. I also want to acknowledge those who applied for a judgeship but weren t chosen; it takes guts to go through that process. Encouragement and thanks to Joseph Cambiano for his dedication to a quality fee dispute oversight program. A big pat for Jim Wyrsch and Dean Suni: It is apparent to me these attorneys love and respect the law, and they do everything they can do to help younger and older...attorneys do a better job through their constant participation in teaching and legal education. And a pat to Judge Michael Manners for allowing Gold E. Locks to face trial on a frequent and regular basis in a program designed to help introduce young boys and girls to the Rule of Law and courtroom procedures. That s just a portion of my list du jour; it grows daily. And I would love to add to it, so let me or the KCMBA know if there is someone in the legal profession whom you think warrants praise for a professional or personal accomplishment. We ll do what we can to get them appropriate recognition. If we can encourage each other to keep doing the good things, it might be infectious and encourage others to do the same. Little by little, we can continue to improve our image and restore a once favorable perception of our profession. Even if we don t, those we encourage and we ourselves will be the better for the effort. Enjoy the summer. It, too, is passing much too quickly. One for Governor Nixon, for taking the time to speak with us after a grueling day and to not just dial it in, but to instead give a thoughtful and inspirational speech. 8 bbbc wrap-up Members enjoyed an outstanding opportunity to participate in up to ten hours of educational seminars at this year s BBBC, including 3.0 hours of ethics and professional responsibility credits. The education planning committee gathered a league of instructors from our community s finest leaders. They provided plenary sessions as well as tracks of programming in litigation, family law, and business and corporate law. A new addition to this year s BBBC was the Young Lawyers Track, which paired itself with other tracks throughout the day. The seminars opened Friday morning with a plenary session entitled The Great Debate Changing the Missouri Non-Partisan Court Plan. State Senator Jolie Justus moderated the session with Randy Scherr and Edward Chip Robertson Jr. After a break, the education classes broke into tracks. Members had a choice of attending one of three seminar tracks. The Business & Corporate Law Track began with a presentation on How to Start a Business followed by sessions on Employment Issues for the Business Lawyer, Political Contributions by Corporations, A Corporate Lawyer s Top Ten Immigration Issues of 2010 From ICE Enforcement to Buying 1-9 Liability and Foreign Executive Transfers and Criminal Law and Handling Internal Investigations for the Business Lawyer. The Family Law Track opened with a session on Elements of Business Valuations followed by sessions on Mock Business Valuation Testimony Direct and Cross of a Business Valuation Expert in a Dissolution Case, Making Your Record, Preserving Your Issues for Appeal, The House Hasn t Sold Yet and a Judicial Panel of judges from Missouri and Kansas discussing the impact of 2009 legislative changes and current paternity and custody issues. The Litigation Track started the day with a presentation on Practical E-discovery Skills followed by presentations on Avoiding Costly & Time Consuming E-discovery Disputes, Growth Areas in Litigation Practice and concluded with a two-part Mock Voir Dire session that demonstrated approaches to dealing with our blue/red world and the difficult issues it presents to plaintiffs and defendants in jury selection. The Young Lawyers Track partnered with one of the three other tracks throughout the day for sessions of the most use and importance to the young attorneys that were in attendance at BBBC. Those tracks included Practical E-discovery, Avoiding Costly & Time Consuming E-discovery Disputes, Making Your Record Preserving Your Issues for Appeal, and the two-part Mock Voir Dire. Saturday morning offered a two-part plenary session from John C. Koski of Sonnenschein Nath & Rosenthal LLP (Chicago Office) and Christian A. Stiegemeyer from The Bar Plan which took place in the Lodge s movie theater. Part I What We Can Learn from Courtroom Trials in the Movies featured a variety of film clips of ethically challenged movie lawyers to illustrate the practical requirements of the rules of professional responsibility. Part II Ten Things Lawyers Still Can t Do (Although Many Try) highlighted the most common misperceptions about lawyers obligations under the Rules of Professional Conduct. 9 bbbc wrap-up Pete Smith and John Cowden received the 2010 Deans of the Trial Bar Award. KCMBA selected John W. Cowden, Baker Sterchi Cowden & Rice, LLC and R. Pete Smith, McDowell, Rice, Smith & Buchanan, P.C. as this year s recipients of the prestigious Deans of the Trial Bar Award. Presented annually, this award spotlights individuals whose superb litigation skills and professional demeanor are viewed as exemplary by their peers. Recipients of the honor must have practiced for at least 30 years or have reached age 60. Jeffrey M. Kuntz, Wagstaff & Cartmell LLP is the recipient of the Conway Award, which was instituted in 1997 to honor younger trial lawyers without regard to artificial age requirements. Recipients of the award also must exemplify two traits of the late Tom Conway: 1.) Outstanding trial skills, and 2.) The ability to be a fierce advocate and a good friend to opposing counsel at the same time. Jeff Kuntz was honored with the 2010 Thomas J. Conway Award. John Jack C. Craft, Lathrop & Gage LLP and Thomas W. Van Dyke, Bryan Cave LLP were selected for the 2010 Barons of the Boardroom Award. This award recognizes a distinguished career representing corporate and business clients. Amanda Mandy Pennington Ketchum, Dysart Taylor Lay Cotter & McMonigle, PC was presented the 2010 Young Lawyer of the Year Award. This award recognizes excellence in public service, professionalism and legal accomplishments. Jack Craft and Tom Van Dyke were honored with the 2010 Barons of the Boardroom Award. Tom Bender presented Mandy Ketchum the Young Lawyer of the Year Award. KCMBA President Tom Bender presented Bob Horn the 2010 Congenial Counselor Award. Robert A. Horn, Horn Aylward & Bandy, LLC is the 2010 recipient of the Congenial Counselor Award. Created in 1998, this award is presented annually to one or more members of the Kansas City Metropolitan Bar Association who to exemplify professional gallantry, peacemaking, harmony and friendship. Amanda Smith and Tom Roszak were present to receive the Robert C. Welch VAP Award. Each year the Robert C. Welch Volunteer Attorney Project Award is given to recognize attorneys, who, through their participation in the Volunteer Attorney Project (VAP), have demonstrated exemplary commitment to the delivery of pro bono services in our community. 17 volunteer attorney project Excellence in Pro Bono Services Recognized at BBBC Each year the Robert C. Welch Volunteer Attorney Project Award is given to recognize attorneys and law firms, who, through their participation in the Volunteer Attorney Project (VAP), have demonstrated exemplary commitment to the delivery of pro bono services in our community. Amanda Smith and Thomas E. Roszak were honored with the 2010 Robert C. Welch Volunteer Attorney Project Award for their outstanding contributions to pro bono legal services. Amanda Smith Amanda Smith is a staff attorney with Shook, Hardy & Bacon LLP and is being honored for her outstanding devotion to the provision of pro bono legal services. She received her B.S. degree in Communications from Missouri State University in 1998 and her J.D. from the University of Missouri Kansas City in She has been a member of VAP for less than two years yet, her contribution has been significant. Smith is also a member of the Christian Legal Society who, in conjunction with VAP, created the Zenas Outreach Project. Through Zenas, attorneys volunteer to meet with residents of Kansas City area homeless shelters. The project focuses on identifying and resolving legal issues they may help to ending their homelessness and making a fresh start. Not only does Smith help in coordinating visits and recruiting volunteers, she also regularly attends the site meetings providing counsel, advice and legal representation to shelters residents. The quality of her work is exemplary and the numbers of people she has helped through her work is extraordinary. Since January 2009, she has provided legal assistance to 160 pro bono clients. Thomas E. Roszak Thomas E. Roszak is Managing Partner of Dysart Taylor Lay Cotter & McMonigle, PC in Kansas City, Missouri. He received his B.S.E.E. from the University of Notre Dame in 1973 and his J.D. from Washington University in He then obtained his L.L.M. in Taxation from the University of Missouri Kansas City in Roszak is recognized for his outstanding and ongoing dedication to providing pro bono services. He was one of VAP s first volunteers, joining the project in Throughout the years, he has represented pro bono clients on a regular basis, representing client in the areas of probate, tax and real estate all with successful resolutions. One of his most memorable VAP cases was resolved last year. The matter involved a real estate dispute between family members. After months of including investigation, negotiation and mediation, Roszak was able to help his client reach a favorable settlement agreement. He donated 224 pro bono hours of service in this matter. 18 court news Dennis Eckold Appointed As New Associate Circuit Judge in Platte County Missouri Governor Jay Nixon recently appointed Dennis C. Eckold of Kansas City as an Associate Circuit Judge of the Sixth Circuit (Platte County). Eckold will fill the vacancy created by the Governor's appointment in January of the Honorable Gary D. Witt to the Missouri Court of Appeals, Western District. Dennis Eckold has gained strong and varied legal experience in his 27 years as an attorney in Missouri, including work on criminal, family law, juvenile, traffic and contract cases, Governor Nixon said. I am confident that he will serve the people of Platte County well on the bench. Eckold has been in private practice in the Kansas City area since 1983, for the past 11 years with his own firm, Dennis C. Eckold and Associates LLC. He has been trained as a certified mediator and arbitrator. From 1998 to 2003, he served as an appointed member of the Kansas City Board of Police Commissioners. Eckold is a1983 graduate of the University of Missouri School of Law. Eckold was a founding member of the Kansas City Keep Safe Committee to study police and fire department capital needs, which resulted in the eventual construction of a new police academy, police station and fire station. He also has been active in his church and in community youth sports activities. Thomas C. Fincham Appointed As Associate Circuit Judge in Platte County Missouri Governor Jay Nixon has appointed Thomas C. Fincham of Parkville, as an Associate Circuit Judge of the Sixth Circuit (Platte County). Fincham will fill the vacancy created by the retirement of the Honorable Daniel M. Czamanske. Tom Fincham has extensive experience in trying cases in many areas of both civil and criminal law, Governor Nixon said. That, combined with his work as a municipal judge for several years, will help him to ably serve on the bench in Platte County. Fincham, a1981 graduate of the University of Missouri-Kansas City School of Law, has practiced law in the Kansas City area for almost 30 years and currently is a partner in the Gladstone firm 16 KC Counselor July/August 2010 of Fincham & Salmon. His experience has included arguing cases before the Missouri Supreme Court and the Missouri Court of Appeals, Western District. In addition to his private practice, Fincham served as an appointed municipal judge for the communities of Ferrelview, Oakview, Platte Woods, Richmond and Riverside, and formerly was a municipal judge for the city of Lawson. Fincham sits on the board of directors for Northland Alternative Service Program, a not-for-profit organization which coordinates community service time for defendants who are placed on probation or diversion. From 1992 to 1997, he served as an adjunct professor of law teaching trial advocacy at the UMKC School of Law. Katherine McElhinney Appointed Lenexa Municipal Court Judge The Lenexa City Council approved the appointment of Katherine McElhinney as Lenexa s municipal court judge on May 4. Judge McElhinney succeeds former Judge Kate Baird, who left the city after 13 years on the bench to accept a position with the state of Kansas. Judge McElhinney brings to the city a deep passion for public service as well as 14 years of legal experience. She served as an assistant district attorney for the Third Judicial District as well as the city prosecutor for the cities of Shawnee and Overland Park. She earned her law degree at Washburn University School of Law and her bachelor s degree in economics at the University of Kansas. Eligible programs should advance the Kansas City Metropolitan Bar Foundation s mission to create, support and fund public service programs which promote education and the ideals of justice in the Kansas City metropolitan community. To be eligible, each program must meet one or more of the following criteria: 1. Public/education/understanding of the law through direct delivery of services; 2. Direct delivery of legal services; 3. Enhancement of the administration of justice in the Kansas City metropolitan area. In its first year, KCMBF awarded four grants totaling $30,000. Legal Aid of Western Missouri received $10,000 to expand the Volunteer Attorney Project. The Kansas City Tax Clinic also received $10,000 to enable them to serve the growing demand for their services. The Child Protection Center received $5,000 to provide resources for interviewing abused and neglected children and their families. The Kansas City Anti-Violence Project also received $5,000 to provide assistance to lesbian, gay, bisexual and transgender people dealing with domestic violence, sexual assault or bias crimes.
