Paul Trantow BABICH RECALLS, COMING OUT OF LAW SCHOOL in 1981, I was offered positions with insurance defense firms but I turned them down because it is just not who I am or what I wanted to do. I ve always been on the side of individuals, never insurance companies or corporations. My allegiance has always been to people. 5 AVIATION: WHEN LITIGATION TAKES FLIGHT NEED TO KNOW If you ve been involved in an airplane or aviation accident, the resulting lawsuit will be complex. If you ve found an aviation lawyer to take your case, learn about the scope of work going into it. The process starts with investigating your case, working with expert witnesses and preparing for a trial. INVESTIGATION OF THE ACCIDENT SCENE One of the first steps your lawyer will take is to investigate the crash scene and hire a consultant to help with the lawsuit. The consultant won t be a witness in your trial, but helps your lawyer build your case. Typically consultants have strong backgrounds in the aviation industry. They often worked for aviation companies or the government, and know the key people in the industry. Gathering information about the accident and possible causes helps your lawyer focus on the types of experts and evidence needed to prove your case. Three main areas investigated are: Possible pilot error. Your lawyer looks to see if a pilot s training, mistakes, health conditions or other behavior were factors in the accident LEGAL LEADERS BRUCE A. Were there problems with a plane s equipment or systems that caused or contributed to the crash? Types of problems include parts breakage or failure, controls for the plane s systems, such as fuel system or landing gear or problems with maintenance and repairs External factors. Other factors or causes in accidents include problems with air traffic control, airport and runway conditions, weather and fuel quality ACCESS IN ACCIDENT INVESTIGATIONS Access to the accident scene, and more importantly, plane wreckage, is an issue in aviation lawsuits. While there s a need to preserve and examine the salvaged plane or parts, access is limited. In the U.S., the National Transportation Safety Board (NTSB) takes control and custody of the plane wreckage, and often keeps it for 6 to 18 months. The statute of limitations, the time for filing your lawsuit, may not be much longer, 24 months in many states. Your lawyer may have to find other methods to gather needed information for your case. He received his Bachelor s Degree with Honors from the University of Colorado in While at the University, he was active in the Kappa Sigma Fraternity, Naval ROTC, and intramural athletics. After leaving active duty with the Navy, Mr. Lampert enrolled at the University of Denver College of Law, where he earned his Juris Doctorate in While in law school, he was a member of the Order of the Coif, and served as a writer for the Denver Law Journal. Upon graduation he was selected as a law clerk to the Honorable Hatfield O. Chilson, U.S. District Court, Colorado. Mr. Lampert has distinguished experience in air disaster litigation as an aviation safety lawyer, having represented RECONSTRUCTING THE ACCIDENT Accident reconstruction experts are hired by your lawyer to gather information from the crash site. These experts glean information from damage to vegetation and trees, marks on the ground from impact, and burn marks from fires, for example. It s possible experts will find physical evidence, such as plane parts at the scene, or in nearby areas, missed by NTSB crews. Visual inspections, diagrams and measurements and photography are used in examining the crash site. 6 NEED TO KNOW WHAT TO DO IF YOU ARE A VICTIM OF IDENTITY THEFT Identity theft can strike anyone, anytime. If you find yourself to be a victim, be prepared to take immediate action. Your quick response can stop the thief and start repairing the damage. Use resources from Federal Trade Commission to cope with identity theft losses. PLAN YOUR RESPONSE TO IDENTITY THEFT IN THREE STEPS Three things are vital in stopping an identity thief and minimizing your losses, reclaiming your identity and repairing your credit profile. File a police report and clearly document all of your losses. Contact creditors about the accounts opened by the thief, or your accounts used by the thief. Notify the major credit bureaus. FILING POLICE REPORTS Contact the police department for the city or town where the identity theft took place and file a report. Ask for copies of the report. Your creditors, bank or insurance company may ask for them, and they can help as you work to clean up the credit mess. CONTACT CREDITORS Alert any creditor, both for your existing accounts and new ones opened by the identity thief. Creditors include major credit card issuers, store credit cards, gas cards, phone and other utility providers and consumer loans, such as auto or other personal loans. It is okay to get things started with each creditor s fraud department by phone, but you need to follow up in writing. You may be sent forms by the creditor after your call. Some creditors, such as your credit card issuer, may have procedures in place to streamline this step. For example, they may cancel your existing credit card number, confirm your legitimate charges and send new cards out to you right away. Prompt action is important because consumer protection laws set time limits for identifying, challenging and resolving billing errors. When your new accounts are set up, choose all new passwords, personal ID numbers (PINs) and user names. Contact creditors if the thief tampered with your existing accounts. Ask for accounts to be closed, for new ones to be opened and to require a password before making any more account changes. CONTACT MAJOR CREDIT BUREAUS There are three major credit bureaus TransUnion, Equifax and Experian. Contact each company s fraud department to report the identity theft. Place a fraud alert on your profile and add your victim s statement so that credit providers call you before making changes to your accounts or opening new ones. These companies also follow crossnotification plans and share information about fraud. Your initial request for a fraud alert lasts for 90 days, and there s no fee for this service. The fraud alert status may complicate some credit transactions, such as instant credit offers. The next step up from a fraud alert is a credit freeze, which locks up your credit profile to almost all activity, and fees apply. Obtain copies of your credit reports and review them; there s no fee when you make a written request for your reports when there are errors due to fraud. Ask the bureaus to remove inaccurate credit data, and do the same for the inquiries section of your reports if there are entries for those creditors that opened accounts for the identity thief. Follow up after two or three months, and review reports for status, accuracy and corrections. MORE FOLLOW-UP STEPS Hopefully your fast action in notifying the police, creditors, and credit bureaus halted the teft and minimized the damage. Keep track of your credit and accounts, and make sure the identity theft has completely ended. If your case involved the mail, contact the U.S. Postal Inspections Service. If the theft involved stolen mail, or a thief changing your address and redirecting your mail, it is a crime. There are online complaint and report forms available. Contact your bank if those accounts were misused or there s a chance they were violated. You can ask the bank to set up new accounts, including ATM and debit cards, and checks. Check verification companies can provide more help for your stolen or misused checks. These companies include: SCAN: TeleCheck: CrossCheck: Other areas for follow-up include utilities and personal documents. Watch for fraudulent phone accounts; a thief could try to bill calls to your cell phone, for example. Monitor your social security number (SSN) and driver s license for fraudulent use. If you still have your SSN on your license, get a new one without it. It is also wise to contact your insurance agent; your homeowner s policy may cover costs related to an identity theft, and provide support services. Identity theft is a serious crime. Your fast action goes a long way in reclaiming what is yours and bringing a criminal to justice. QUESTIONS FOR YOUR ATTORNEY Before meeting with your attorney prepare yourself with questions such as: If the identity thief is found, do I have any say on whether criminal charges are pressed? If identity theft took place at my home, will my insurance cover the loss, even if I do not have a special rider for these losses? Will my credit score be affected by identity theft? For how long? If a phone company opens fraudulent accounts after I give notice of my identity theft, can it try to collect payment from me? Isn t the company harassing me? AS SEEN ON

7 DIVORCED PARENTS: KNOW YOUR CHILD CUSTODY AND VISITATION RIGHTS NEED TO KNOW As a parent, losing full-time access to your children in the wake of a divorce can be a difficult experience. Unless a court has terminated your parental rights, you still have the right to limited visitation and participation the welfare of your children. YOUR VISITATION RIGHTS The court will issue a written custody order that sets out your rights as a noncustodial parent. Even if you disagree with the custody order, it has the force of law and you could face legal consequences for violating its terms. The custody order will explain your visitation rights in detail and outline responsibility for transportation to your home or another location where you will spend time with your children. MAKING IMPORTANT DECISIONS Most states recognize two types of child custody: physical custody and legal custody. If physical custody is granted to only one GUTTERMAN GRIFFITHS PC FAMILY LAW parent, the child will live with that parent most or all of the time. Legal custody is the right to make important life decisions for your children. These include matters of religious upbringing and school selection. ENFORCING THE CUSTODY ORDER If the custodial parent refuses to comply with the custody order, keep a written record of each violation. With this information, your attorney may be able to convince the court to enforce the custody order. Keep in mind that requesting court intervention is a serious decision, and it may have legal consequences that could make a strained relationship even more difficult. REMARRIAGE OF THE NON-CUSTODIAL PARENT If you did not request or receive custody of your children in a divorce, your remarriage can change the picture in a positive way. If your home life is now more stable and wel- PAGE PROOF FOR APPROVAL ONLY coming than it was when you divorced, most courts will give you additional visitation with your children if you ask. Many states will consider the wishes of minor children in custody and visitation decisions along with many other factors. If you want to change custody because your ex has remarried, you ll also have to give the court proof of negative impact of this change on your children. This can be done by hiring a custody evaluator to talk with your children, or by showing that their grades are dropping or that they ve been acting out and misbehaving since the change. 9 LEGAL TRENDS Lawmakers and lawyers near the Mile-High City examined cases that touched on hot-button issues like medical marijuana and same-sex marriage, while high-profile cases, including James Holmes upcoming murder trial for the Aurora movie theater shooting, continued to make waves. COLORADO PREPARES FOR TRIAL OF AURORA THEATER SHOOTING In July 2012, Aurora, Colo., resident James Holmes killed 12 and injured 70 when he shot into the audience during a midnight screening of the film The Dark Knight Rises. It was the largest mass shooting in Colorado since the 1999 Columbine High School massacre. Holmes has pled not guilty by reason of insanity, and his muchdelayed trial, in which he will face 166 charges (including 24 counts of first-degree murder and 116 counts of attempted murder, among others), was scheduled to begin in December. Howver, according to filings released on Oct. 23, the possibility of a four- to five-week delay arose in order for the defense to further review Holmes sanity exam. The lead-up to the trial has already proved contentious. In October, several victims of the theater shooting wrote to Arapahoe County Chief District Court Judge Carlos A. Samour Jr., who is overseeing the case, about his decision to allow news organizations to broadcast the trial. Judge Samour ruled that the news media will be allowed to broadcast the courtroom s closed-circuit feed. But news crews will be prohibited from filing the proceedings with their own cameras. According to Samour, The purpose of this order is strictly to make the trial accessible to a larger portion of the public, including some victims. In his ruling, he also noted, The parties are naive if they believe that denial of EMC in this case will prevent or noticeably reduce the intense and widespread publicity of the trial. The closed-circuit feed does not have the ability to zoom in or out, or to pan the courtroom. [A]ny desire to make the broadcast more interesting or entertaining, while understandable, is not relevant to the Court s determination, Samour wrote in his ruling. Samour also denied the Denver Post s request to have a still photographer present during the proceedings. We are deeply disappointed that the Judge has relegated the public to view this trial essentially though a tiny peephole covered by a fuzzy mesh, Steven Zansberg, the attorney who represented the Denver Post and Associated Press, said in a statement. High quality miniaturized cameras are readily available that would allow the public a meaningful view without creating any impact within the courtroom. The ruling is not able to be appealed. STATE SUPREME COURT JUDGEMENT FOR SAME-SEX MARRIAGE In 2006, Colorado voters approved a state-wide ban on same-sex marriage. In subsequent years, that law faced a number of legal challenges. Now, according to Colorado Attorney General John Suthers, There are no remaining legal requirements that prevent same-sex couples from legally marrying in Colorado. Legalizing same-sex marriage in the state required clearing several hurdles. In July 2014, Adams County District Court C. Scott Crabtree declared that the state ban on same-sex marriage was unconstitutional, writing that The Court holds that the Marriage Bans violate plaintiffs due process and equal protection guarantees under the Fourteenth Amendments to the U.S. Constitution. But as soon as he issued his ruling, Crabtree immediately stayed it, in order to avoid the instability and uncertainty which would result otherwise. The Colorado Supreme Court recently lifted that stay and dismissed an appeal, meaning that Crabtree s ruling stands. Beginning today, Colorado s 64 county clerks are legally required to issue licenses to same-sex couples who request them, Suthers said on Oct. 7, After decades of patience, Colorado s State Capitol has finally been given the legal green light to stand with every loving couple, Denver Clerk and Recorder Debra Johnson said in a statement. Equality at last wins. COLORADO S CONSTRUCTION LAW CAUSES CONTROVERSY Colorado s construction-defects law allows homeowners associations to bring suit against builders of multifamily homes for construction defects. Supporters of the law say that it provides important protection for homeowners. The law s opponents claim that it discourages investment by making the building of owneroccupied condominium units too risky for developers. In October, the city of Lakewood became the first municipality in the state to pass an ordinance that amends the state s constructiondefects law. The Lakewood City Council introduced the ordinance in September. It passed one month later in a 7-4 vote, after more than two hours of public comment. Under the Lakewood measure, developers have the right to repair defects once they re discovered, instead of immediately facing potential litigation. However, some experts say that the Lakewood ordinance may not be long-lived, given that it conflicts with state law. Jared Berg, a construction litigation attorney with Denver-based Sherman & Howard, pointed out that recent rulings against oil and gas activity passed by Colorado municipalities have been struck down. Those decisions are the precedent that anybody challenging the ordinance would look at, Berg told The Denver Post. Lakewood mayor Bob Murphy is optimistic the new ordinance will stand. We re a home rule city and believe we have the authority to do it, he told the Post. We did this for Lakewood. Debra Johnson, Denver Clerk and Recorder Continued from page 9 COLORADO HIGH COURT CONSIDERS MARIJUANA FIRING CASE Brandon Coats was working as a customer service representative at Dish Network in 2010, when he failed a random drug test given by his employer. He was subsequently fired for violating Dish Network s drug policy. Coats, who had been rendered quadriplegic after a car accident, had been prescribed medical marijuana to help with his leg spasms; he maintained that he never used marijuana at work. He appealed the decision, noting that Colorado voters approved medical marijuana in The state went on to legalize recreational use of the drug for adults in Coats and his lawyers argued that he should not have been fired for partaking in a substance that is legal in the state. Colorado s Lawful Activities statute makes it discriminatory for employers to fire employees for engaging in any lawful activity off the premises of the employer during nonworking hours. However, Dish Network s legal representation argued that marijuana use shouldn t be considered lawful activity, as it s still illegal under federal law. Furthermore, the state constitutional amendment legalizing marijuana in Colorado noted that it should not be construed as requiring any employer to accommodate the medical use of marijuana in any work place. The amendment also did not enshrine a right to use marijuana, but rather an affirmative defense, or an exemption from prosecution for its use. The lower courts sided with Dish Network. The Colorado Court of Appeals ruled that because the federal government bans it, marijuana use could not be considered lawful under the ordinary meaning of the term. In late September, the state Supreme Court heard Coats appeal. JURORS AWARD RECORD SETTLEMENT TO FAMILY OF PRISONER Marvin Booker, 56, was a homeless street preacher in 2010 when he was arrested on drug paraphernalia charges. While deputies in Denver s downtown jail were processing Booker, he tried to retrieve his shoes even after the law enforcement officials told him to stop. According to witnesses, four deputies and a sergeant held Booker down, shocked him with a Taser, and left him facedown in a holding cell. Booker was pronounced dead later that morning. Now, four years later, a federal jury has awarded Booker s family a record settlement of $4.65 million. City officials argued that Booker s death was a result of his underlying health problems. However, Booker s family s attorney deemed the case a clear example of excessive force. A jury of seven agreed with the Booker family, awarding the record settlement to cover punitive damages, funeral costs, and the loss of enjoyment of life. The Booker family attorney, Mari Newman, called the verdict a wake-up call for the city of Denver. According to The Denver Post, the city has paid more than $13 million to settle legal claims over the past decade. Booker s case was the third settlement amounting to more than $2 million Denver police have faced this year. We re obviously disappointed in the verdict, Denver City Attorney Scott Martinez said in a statement. Nonetheless, we thank the jurors for their effort and respect the legal process. The city remains committed to its ongoing efforts to improve the Denver Sheriff s Department. Four of the five law enforcement officers involved in the case still work for the sheriff s department. Marvin was an urban preacher. He saw how the marginalized were pushed aside. And he, himself, became a victim of that which he tried to protect others from, Marvin Booker s brother, the Rev. Spencer Booker, said after the verdict. Those who were supposed to protect and serve him, killed him.
