5 Environmental Compliance Report 1 Executive Summary This Report has been prepared in accordance with the requirements of Condition of Approval (CoA) 4. for the Wynyard Walk Project commenced in December This Report addresses the environmental performance of the Project between December 2013 and May 2014 inclusive ( the reporting period ) and is the third 6 Monthly Environmental Compliance Report (CECR) for Wynyard Walk. This report is divided up into the following sections: Section 2 specifies the requirements of this Report and the status of construction activities; Section 3 details all permits, licenses and approvals granted and lodged (pending approval) for Project construction activities during the reporting period; Section 4 briefly explains how track compliance with the CoA and any other environmental conditions. Compliance is shown through the Compliance Matrix in Appendix 1; Section 5 describes the Environmental Management System (EMS) and outlines the role of the key EMS document, Environmental Management (CEMP). This section also outlines the status of other key plans associated with the EMS; Section 6 outlines the environmental performance of the Project. It provides information on the sources of potential environmental impacts from construction activities and summarises measures implemented to meet the relevant CoA, subsequent approval conditions and the environmental monitoring undertaken. Actual impacts encountered through the reporting period are compared to the impacts anticipated in the Review of Environmental Factors (REF) and supplementary studies to measure the Projects performance against predictions; Section 7 summarises the complaints received to date and outlines complaints management procedure; Appendix 1 provides comment on the Project s compliance against all CoA through the Compliance Matrix; Appendix 2 is the Initiatives Register which demonstrates compliance with the sustainability requirements as set out in TSR-E1 (Transport for NSW (TfNSW) standard environmental requirements); and Appendix 3 contains the complaints register. 6 Environmental Compliance Report 2 Introduction 2.1 Project overview Wynyard Walk will provide a world-class, fully-accessible pedestrian link between Wynyard Station and the developing CBD western corridor and Barangaroo (as shown in Figure 1 below). The walkway will allow pedestrians to travel from Wynyard transport hub to the Barangaroo waterfront in approximately six minutes, avoiding steep inclines and eliminating road crossings. The project will increase the entry/exit capacity of Wynyard Station to meet current and future demands for the CBD s western corridor and waterfront. This includes catering for the full Barangaroo development which, when complete, is expected to accommodate up to 23,000 office workers and attract up to 33,000 visitors per day. The Works under the proposed Contract for the project includes the following key elements: Railway House/Transport House works - A new tunnel, with underpinning works to Railway House structural basement supports to reconfigure the existing Kent Street tunnel to provide pedestrian tunnel access 3.5 metres high and 9 metres wide from Wynyard Station concourse through to new Clarence Street entrance building; Clarence Street building - Following demolition of the existing buildings, a new multi-storey building (above and below ground) forming the western entrance to Wynyard Station (from Clarence Street) with direct access to the station concourse; Tunnel - A new 3.5-metre high and 9-metre wide (internal dimensions) pedestrian tunnel, approximately 110 metres long, providing a grade-separated link from the Clarence Street entrance building under Clarence, Margaret and Kent Streets to the Napoleon Plaza; Western Portal / Napoleon Plaza Tunnelling site which will ultimately become a paved, public pedestrian plaza at the Napoleon Street node (bounded by Sussex Street, Westpac Plaza, Kent Street and Napoleon Street), which will connect the Wynyard Walk tunnel and bridge components; and Pedestrian Bridge - A pedestrian bridge over Sussex Street providing a grade-separated connection between the Napoleon Plaza and Shelley Street. The bridge will provide a 6 metre wide pedestrian deck and a 5.5 metre vertical clearance to Sussex Street. 7 Environmental Compliance Report 2.2 Purpose Figure 1: Wynyard Walk Staging This report addresses the environmental performance of the project between December 2013 and May 2014 inclusive. began initial demolition works at 30 and Clarence Street in December 2012 following the approval (dated 30 th November 2012) of the Stage 1 Pre- Environmental Compliance Report required under Condition of Approval (CoA) No. 3. This Report is the third six-monthly Compliance Report to be submitted by in accordance with CoA 4. CoA 4 states that: The Proponent shall prepare a Environmental Compliance Report (CECR) which addresses the following matters: a) compliance with the CEMP and these CoA; b) compliance with any approvals or licences issued by relevant authorities for construction of the Project; c) implementation and effectiveness of environmental controls. The assessment of effectiveness should be based on a comparison of actual impacts against performance criteria identified in the CEMP; d) environmental monitoring results, presented as a results summary and analysis; e) number and details of any complaints, including summary of main areas of complaint, action taken, response given and intended strategies to reduce recurring complaints (subject to privacy protection); f) details of any review and amendments to the CEMP resulting from construction during the reporting period; and g) any other matter as requested by the Principal Manager ning and Assessments and Principal Manager Environment. 8 Environmental Compliance Report a) submit a copy of the CECR to the EMR for review. The EMR is to be given a minimum period of 7 days to review and provide any comments to the Proponent in relation to the CECR; b) upon completion of the EMR review period submit a copy of the CECR to the Principal Manager Environment for approval; and c) within 7 days of approval of the CECR by the Principal Manager Environment make publicly available a copy of the CECR by posting the CECR on the TfNSW website. The first CECR shall report on the first six months of construction and be submitted within six weeks after expiry of that period (or at any other time interval agreed to by the Principal Manager Environment). CECRs shall be submitted within six months after the date of submission of the preceding CECR (or at other such periods as requested by the Principal Manager Environment) for the duration of construction. Table 1 below summarises compliance with the sections of CoA 4 within this report. 11 Environmental Compliance Report Western Portal Piling was completed around the perimeter of the portal; Capping beam and crash barrier were formed; Rock anchors were completed; Connection of high voltage power to the Western Portal was completed from a mains power location in Sussex Street The water treatment plant continues to be assembled; Telstra completed works to install a metal protection plate beneath the Telstra asset which crosses Margaret Street and is above the invert of the tunnel; Works were stopped in late April 2014 to allow unhindered archaeological excavation works as required by existing heritage permits. 13 Environmental Compliance Report Bridge Works A temporary pedestrian bridge was installed to maintain public access through the work site and allow excavation of the Eastern abutment site beneath. Soil nails have been installed and piling commenced at the eastern abutment; The western abutment site remained closed as it is within the exclusion zone which has been set up since the Barangaroo fire. 16 Environmental Compliance Report 2.4 Previous Reports The CoA specifies a number of reporting protocols for the project. Prior to the commencement of Stage 1, submitted a Pre- Environmental Compliance Report Stage 1 (PCCR) in accordance with CoA 3 that demonstrated compliance with relevant CoA prior to the commencement of construction/demolition. This Report was approved by TfNSW on 30 November Prior to the commencement of Stage 2, a PCCR was submitted through TeamBinder on 22 May This report detailed compliance with relevant CoA prior to any stage 2 works commencing. This report was approved by TfNSW on 9 July 2013 following a final submission on 2 July This Pre- Compliance Report was updated on 6 March 2014 to include CoA which are applicable prior to stage 3 commencing. This was endorsed by the EMR on 6 March 2014 and approved by TfNSW on 7 March CoA approved prior to the commencement of construction have not been replicated in this Report, however, Appendix 1 details s compliance with all CoA including those approved prior to construction and demolition. This report details compliance throughout the third reporting period for the Wynyard Walk Project. Period 1 (December 2012 till May 2013) is covered by the CECR no. 1 and Period 2 (June 2013 till November 2014) is covered by CECR no Consents, Licences and Approvals The following section summarises any licences, consents or approvals obtained during this reporting period. The majority of approvals were for Out-of-Hours Works. Most of these were approved by EMR with some determined as high risk endorsed by EMR and approved by Principle Manager Environment and others determined by as being Emergency Works. Minor pruning and tree removals are approved by TfNSW in consultation with City of Sydney Council and/or other relevant landowners however there were none required during this reporting period. The Heritage approval outlined in section 3.2 was provided by the Office of Environment and Heritage (OEH) (Aboriginal Heritage Impact Permit) and is regulated by the National Parks and Wildlife Act Out-Of-Hours Approvals In accordance with TSR-E1, Section 8.7, any justified works which require completion outside standard working hours are to be applied for via an Out-of-Hours Work (OOHW) application. OOHW with a low to medium risk must be approved by the EMR and those with a high risk must also be approved by TfNSW. 22 new OOHW applications were submitted during this reporting period and 12 OOH applications approved in previous reporting periods were updated for works to continue. Not all applications required EMR or TfNSW approval as they were deemed inaudible or less than 5dBA above background noise levels at any noise sensitive receiver. determined some works to be Emergency Works and progressed without specific approval under CoA 22(d). There were no minor works approvals sought during the reporting period in accordance with TSR-E1, Section Minor works are works which are minor in nature and do not meet the definition of construction under the planning approval. 20 Environmental Compliance Report 3.2 Heritage Permits During this period, an application was submitted to the NSW Office of Environment and Heritage for an Aboriginal Heritage Impact Permit (AHIP) on 28 October 2013 under section 90A of the National Parks and Wildlife Act 1974 for the excavation and tunnelling works at the Western Portal and the bridge construction works around Sussex Street and Shelley Street. An AHIP was subsequently granted on 5 February An AHIP in effect permits works to be undertaken in areas where harm to an Aboriginal object or Aboriginal place cannot be reasonably avoided. A summary of heritage permits applied for during this reporting period are located in table 4 below. No applications were submitted during the reporting period. 4 CoA Compliance CoA compliance is tracked through the Compliance Matrix in Appendix 1. Approximately 19 of these conditions related to pre-construction with the rest being continuously updated, tracked and achieved. In addition to this Report (covering December 2013 to May 2014 inclusively) there were 2 Environment Compliance Reports completed and approved prior covering December 2012 till May 2013 and June 2013 till November 2013 which demonstrates compliance during those periods. All relevant CoA have been generally complied with during the reporting period. For further detail on compliance with all conditions of approval refer to the Compliance Matrix (Appendix 1). Four Non-Compliances Reports (NCRs) were raised during the reporting period against CoA 8, 10, 22 and 23. Please refer to the table below detailing the CoA non-compliance and the corrective and preventative actions. Respite periods are discussed during the weekly programme meeting. 5 CEMP Compliance and Review 5.1 Environmental Management The Environmental Management (CEMP) details and addresses the requirements of CoA 14 and is one of the key documents forming part of s Environmental Management System (EMS). The Stage 1 CEMP was reviewed and approved by the EMR and TfNSW on 30 November 2012 prior to commencement of construction. The stage 2 CEMP was reviewed and approved on 11 June 2013 prior to York Lane works commencing. The Stage 2 CEMP was then updated to include stage 3 works and the Stage 2&3 CEMP was approved on 28 February A number of Management Sub s were prepared as part of the CEMP and approved by TfNSW prior to the commencement of demolition relating to Traffic and Pedestrians, Noise and Vibration, Air Quality, Soil and Water, Heritage, Waste, Contaminated Land, Hazardous Materials, Flora and Fauna, Greenhouse Gas and. As required in the CoA, three separate management plans on Noise and Vibration, Soil and Water and Waste were prepared. These plans are overarching and look at the project as a whole and do not provide stage specific information as the sub plans do. Details of the approval history of these management plans are present in the table below. 22 Environmental Compliance Report 5.2 Inspections CEMP compliance is tracked through the weekly environment checklists which are filled out every week and involve checking all aspects in the CEMP. These inspections are undertaken by environmental staff. The first section involves a tick and cross checklist with the final page being any issues which were raised. The issues raised are given a time frame for fix up or comment and an owner is assigned. This needs to be signed off once the supervisor agrees that the issue has been closed out satisfactorily. Environmental inspections are tracked in the Activity Register. During this reporting period, 23 environmental inspections were undertaken by including both scheduled weekly inspections and spot inspections with only 8 minor issues being raised and closed out appropriately. All scheduled inspections were undertaken. Daily inspections are undertaken by the site supervisor. These inspections involve safety aspects as well as environment. These inspections are stored in the system and items are generally raised by exception only. Compliance against targets as well as any conditions set out by TfNSW is explained in further detail in section 6. The EMR undertakes weekly inspections covering aspects also covered in the weekly inspections. Twenty EMR inspections were undertaken during the reporting period with and TfNSW being present at all. In total 21 minor issues were raised and closed during the reporting period. No incidents were raised during site inspections during the reporting period. 5.3 Audits A TfNSW compliance audit conducted by an external consultant was undertaken on 29 July The scope included systems and controls for the management of the key environmental and sustainability issues and associated risks for the project deliverables. There were 2 minor issues and one improvement opportunity identified: Not all incidents are being recorded in INX in a timely manner. o Response: On being made aware of an incident the Environmental Manager / Officer will contact the TfNSW Environment and ning Manager and will confirm that the incident will be entered into the INX system within 4 hours. Complaints not always being responded to in the required time. o Response: The Communications Manager / Officer will endeavour to respond to complaints within the required time frames. Note: Generally responses have been conducted within the required time frames over the last 3 months. Failure to meet complaint response times not being recorded as an NCR. o Response: will toolbox the Communications and Environmental staff on the need to ensure that failure to meet CEMP and TSR requirements is recorded as a Non-conformance in INX. Note: Training by TfNSW on INX took place on 2 September 2014 by Jonathan Zea. toolbox was conducted by the Project Director on 12 September An internal audit of the Carbon Foot Print and Emission Tracking Reports was undertaken in January This audit was the second during project start up and focused on internal assurance that data reported is accurate. There were no actions picked up during this audit and the one action from the last audit which included reporting Electricity information has been closed. Wynyard Walk Pty Ltd Page 22
23 Environmental Compliance Report Quarterly audits continued during the reporting period with one being conducted on 6 February 2014 and another on 26 May No non-compliances were found and investigation into construction related initiatives is still ongoing. All scheduled audits were undertaken during the reporting period. 5.4 Reviews and/or Updates A Stage 2 CEMP Part B Implementation review was undertaken in January This review is a requirement of the management system. There were 17 minor changes or suggested actions noted during the review. These changes were incorporated into the Stage 2/3 CEMP which was endorsed and approved on 28 February A review of the Significant Environmental Hazards was undertaken on 9 of January 2014 as required by the management system. These aspects were reviewed to determine if they were still applicable to the project or if there were any others which may need to be added. The review concluded that all hazards are still relevant and covered adequately through the sub plans. During this reporting period there was a review of the Project Environmental Rules in January The rules are reviewed and up-dated every 6 months or in response to any issues or complaints received. The review determined that the Project Environmental Rules are adequate and well enforced on site. 5.5 Training Wynyard Walk has adopted a three stage induction process. This process consists of two online inductions covering overarching legislation and policies followed by Wynyard Walk specific safety, environment and community conditions. The final step is an onsite orientation familiarising personnel with the current conditions in the workplace. Training is crucial to the implementation of the CEMP and in turn ensures compliance. Training can be in the form of a toolbox talk or organised formal training. The following training has been undertaken by various personnel during this reporting period: A toolbox talk was conducted by Godden Mackay Logan (GML) on 14 February 2014 at the Western Portal site covering the Aboriginal Impact Permit, S140 Excavation Permit and the Excavation Protocols for indigenous and non-indigenous heritage; A toolbox talk was conducted on 11 of March 2014 at the Clarence Street site covering the potential to find heritage during the break out of the slab; A toolbox talk was conducted on 29 May 2014 at the Clarence Street worksite to run through 13 environmental topics covered in the CEMP. Topics included noise and vibration, air quality, soil and water management etc. Daily toolboxes are undertaken which regularly include environmental elements relevant to the work at hand. 5.6 Environmental Non-Compliance Report During this reporting period all recorded non-compliance reports were against a Condition of Approval (CoA). Please refer to section 4 for details of NCRs in relation to CoA. 6 Impacts, Monitoring and Controls This section aims to show how effective the implementation of environmental controls and monitoring regimes were in meeting applicable CoA, guidelines, standards and/or Key Performance Indicators (KPIs). 24 Environmental Compliance Report following environmental issues were selected through the risk assessment process as areas with the potential to cause significant risk to the environment. Effectiveness of controls, in this case, will be measured by results from inspections, monitoring, incidents and performance against KPIs. The following sections are divided into: Background and Implementation This provides an overview of the risks and potential impacts which maybe encountered for a specific aspect. These impacts have been determined through the Review of Environmental Factors (REF) process as well as the risk assessment process. This section also discusses how we have implemented management measures (reflected in the CEMP) to ensure the potential impacts are decreased or eliminated; Monitoring and Review This details the monitoring regime and any monitoring results which have been compiled during this period. These results are compared to the predictions in the REF as well as the CEMP which contains targets. 6.1 Traffic and Pedestrian Management Background and Implementation Due to the confined nature of the construction sites, traffic and pedestrian management is extremely important. Ultimately, traffic and pedestrians will be managed in compliance with the Traffic Management s which were prepared by Parsons Brinckerhoff (November 2011). The Traffic and Pedestrian Management Sub-s which form part of the Stage 1 and 2&3 CEMPs specify areas of pedestrian and traffic control specific to that stage of works. The sub-plans are general and detail regarding each individual set of works is set out in an approved Traffic Control which specifically identifies the hazards and risks in the area and mitigation measures to ensure safe execution Monitoring and Review During this reporting period there were some major works which involved works within roadways. All lane closures need to be approved by RMS. A Road Occupancy Licence (ROL) needs to be issued by the Roads and Maritime Services (RMS) before or their subcontractors can take possession of the road. These ROLs specify the dates and hours in which lanes can be closed. The following works involved the use of ROLs during this reporting period: Closure of the Kent and Margaret Street intersection. This was to allow piling at the Western Portal; Closure of Shelley Street to enable the traffic switch to take place; Temporary closure of the Clarence Street footpath and 2 lanes so Ausgrid could complete works on their assets running into the Clarence Street site; Temporary closure of Kent Street south bound to enable a concrete pump and truck to be parked adjacent to the 1 Margaret Street car park. This was to enable concrete to be pumped into the transfer structure works; A section of York Lane was closed in October2013 under an ROL and re-opened on 20 December York lane was closed again on 29 May 2014 and remains closed. These closures were to enable works to proceed in York Lane and not hamper works to be undertaken on Clarence Street. York Lane is currently 2 ways at both the Western and Southern end which maintains access to all properties. Pedestrian access was temporarily blocked to enable the temporary bridge construction between the Sussex Hotel and Westpac Plaza. All Traffic Management s (TMP) and Traffic Control s (TCP) which include pedestrian movements have been implemented with no incidents. Wynyard Walk Pty Ltd Page 24
25 Environmental Compliance Report 6.2 Noise and Vibration An assessment of the Noise and Vibration impacts of the project was completed by Wilkinson Murray in November This overarching Noise and Vibration Management (CNVMP) describes the legal requirements for noise and vibration on the project as well as the sensitive receivers. This plan describes the background noise levels and the project noise and vibration criteria. It also describes construction activities and the likely noise and vibration levels. A Noise and Vibration Management Sub- (NVSP) which forms part of both the Stage 1, 2 and 3 CEMPs, specifies the noise levels expected for the specific type of works being undertaken. Within this plan are the suggested mitigation measures for on-site management of noise and vibration and Out-of-Hours works. The subplan assesses the scope of activities for the relevant stage and the effective noise management levels. For any activity which exceeds the following levels noise monitoring is required: more than 20dBA above the background noise level during standard construction hours (Mon-Fri 7am- 6pm, Sat 8am-1pm); more than 20dBA above the background noise level during OOHW period 1 (Mon-Fri 6pm -10pm, Sat 7am-8am, 1pm -10pm, Sun/Public Holidays 8am-6pm); and more than 10dBA above the background noise level during OOHW period 2 (Mon-Fri 10pm-7am, Sat 10pm-8am, Sun/Public holidays 6pm-7am). Noise and vibration monitoring is also required as detailed in the Noise and Vibration Management sections and These requirements are as follows: Noise: Vibration: Periodic noise monitoring at nominated sensitive receiver locations to determine the effectiveness of mitigation measures against predicted impacts. Where complaints are received, additional noise monitoring (as required) will be undertaken at sensitive receivers to determine if the actual construction noise generated exceeds the predicted worst case construction noise levels identified in the NVSP. Noise monitoring may be carried out for the purpose of refining construction methods or techniques to minimise noise. Maximum noise levels of noise intensive plant items will be measured when plant initially arrives on site. In addition, ongoing spot checks of noise intensive plant and equipment will be undertaken throughout construction to ensure compliance with manufactures specifications and Table 2 of TfNSW CNS. During tunnelling for the protection of buildings / structures, monitoring will be carried out in accordance with CoA19. When vibration intensive activities are required, vibration monitoring will be carried out within the established buffer zones, or where there is considered to be a risk that levels may exceed the relevant structural damage goals. Vibration monitoring may be carried out in response to complaints, exceedances or for the purpose of refining construction methods or techniques to minimise vibrations. Vibration monitoring will continue throughout construction, where appropriate, at nominated sensitive receiver locations to determine the effectiveness of mitigation strategies. Where vibration is found to exceed safe levels, impacts will be avoided by changing work methods and/or equipment, or through the provision of building protection measures where possible. The following mitigation measures have been implemented to ensure noise and vibration impacts are minimised. Please refer to both the Stage 1 and Stage 2/3 CEMP for further mitigation measures: Identification of appropriate sensitive receivers; Adequate consultation with surrounding residential and commercial premises as well as stakeholders; Approved hours of work will be adhered to unless Out-of-Hours Work Approval has been sought and gained; Out-of-Hours work protocol will be followed; and Non-tonal reversing beepers or quackers used on plant and equipment Monitoring and Review Noise There were 36 noise complaints received during the reporting period of which the vast majority (22) were received from Napoleon on Kent as a result of out of hour s service relocation works adjacent to the site on Kent and Margaret Streets. 12 complaints were received as a result of works being undertaken at the Clarence Street site and in Railway House and 2 as a result of works at the Sussex Street bridge site. Noise monitoring is undertaken regularly and as a result of any complaints received where required. There have been no exceedances of predicted noise levels at any locations during the reporting period. Monitoring conducted during this period is included in the table below.
