1 CHEMSKILL RETURN TO WORK AND RISK MANAGEMENT PROTOCOL (This document can be found under the Contractor s Section at ChemSkill is committed to providing a safe and healthy work environment for all its employees. As part of this commitment, in the event of a work related injury we will take all necessary steps to minimise the potential for a repeat occurrence of the same or a similar incident. In the event that an injury does occur in the workplace and an individual is unable to continue their normal work we will provide the necessary assistance for them to remain at work, or return to work as soon as it is safely possible. We will do this through our Return to Work and Risk Management protocol. Risk Management Protocol ChemSkill will endeavour to meet its commitments to providing a safe and healthy workplace by implementing the strategies below: - Provide all ChemSkill employees with a Safety Pack including a Safety Schedule to enhance their awareness of the commitment made to the provision of a safe and healthy workplace and the means of which they have to participate in the process. - Provide all ChemSkill employees with a copy of the WorkSafe document, Labour Hire Workers: OHS Rights and Responsibilities, so that they are aware of their rights and obligations if an incident occurs. - An on-line Safety Course that must be completed within two weeks of the link being supplied to the Contractor. Completing this course within this period is a mandatory requirement of the Contractors Agreement with ChemSkill. - Periodically conduct workplace surveys in an endeavour to ascertain whether any potential risks are present in the workplace. - In the event of an incident occurring, undertake discussions with all relevant parties to identify, assess and control as far as is reasonably practicable any known or potential risks that caused or contributed to the incident to minimise the chance of the same or a similar incident occurring. - Request that all employees report any incident, near miss or injury that has occurred in the workplace. - Comply with our legal requirements under the Occupational Health and Safety Act. If any actions taken indicate the potential for an incident to occur, ChemSkill management will address the issue in an endeavour to minimise this risk. In the event that the risk management protocol does not stop the occurrence of a workplace injury, then ChemSkill has a Return to Work Protocol that incorporates an Occupational Rehabilitation Process to address such workplace issues.
2 Return to Work Protocol The purpose of Return to Work Protocol is the process designed to assist an injured worker to stay at work or return to work as soon as is practicable after an injury has occurred. What to do if you are Injured at Work If you are injured at work, you should refer to the instructions contained in the WorkSafe, If you are injured at work poster. This will be displayed at your workplace usually on the Safety Board. This poster is also available online at Return to Work Process ChemSkill has developed the following Process to assist employees to return to work if they have sustained an injury. The Policy entails: - ChemSkill will commence return to work planning as soon as possible after assessment of the injury by a medical practitioner. - It is ChemSkill s expectation that you will remain at work if this is possible. - If it is not possible to remain at work, the basic aim of the Policy is to return an injured worker to the workplace as soon as is practical after the injury. The current thought process is that the sooner you return to work, the speedier the rehabilitation. - Treatment, return to work activities and any reasonable occupational rehabilitation services will begin as soon as is practical. - If it is deemed by your medical practitioner that you require alternate or modified duties this type of work will be made available at the earliest opportunity. - As soon as ChemSkill is notified that an injured worker is making a claim for weekly payments, an individual return to work plan will be established. This individual plan will be developed in consultation with the injured worker and their treating practitioner(s). - The Company will maintain confidentiality in respect to the worker s information obtained during their return to work program or whilst undergoing occupational rehabilitation services. - Although an injured worker can nominate their own doctor, ChemSkill reserves the right to obtain a second opinion about the person s injury or work capacity. ChemSkill will pay for this second opinion and under current legislation can only request you undergo an additional examination once every three months. - ChemSkill s WorkCover agent may also request an independent medical examination. - The development of this documentation is based upon the requirements under the Accident Compensation Act 1985.
3 Benefits of Return to Work There are benefits for both employees and employers if there is a workplace incident where a person is injured and requires time off work. The benefits to employees include: - Can assist with recovery and on-going job prospects. - It can minimise the negative financial burden on a worker who is receiving reduced wages. - The emotional impact upon the worker can be minimised by them returning to the workplace where they are surrounded by colleagues which allows them to maintain their social network. - Assist workers to retain job skills and promotional opportunities. Obligations under the Accident and Compensation Act 1985 Under the Accident and Compensation Act 1985, ChemSkill has return to work obligations that relate to the management of injured workers. These obligations are covered in detail in the WorkSafe publication, What to do if your Worker is Injured A Guide for Employers. A synopsis of these obligations follows. Provide Employment For the duration of the employment obligation period ChemSkill, to the extent reasonable to do so, will provide injured workers with suitable employment, if the worker has a current work capacity, or pre-injury employment, if the worker no longer has an incapacity for work. Plan Return to Work From the time that ChemSkill becomes aware that a worker has incapacity to work, plan for that worker s return to work. This includes: - Obtain relevant information about the worker s capacity for work. - Consider reasonable workplace support, aids or modifications to assist in the worker s return to work. If this is an on-hired worker, this will be in consultation with the host employer. - Assessing and proposing options for suitable employment or pre-injury employment, again, if necessary, with the host employer. - Engage in consultation with the worker, the insurer, medical/rehabilitation staff, as well as anyone else as applicable, such as the host employer for an on-hired worker. - As necessary, provide the worker with clear, accurate and current details of the workers return to work arrangements. - Monitor the worker s return to work.
4 Consult about the Worker s Return to Work ChemSkill will consult with the injured worker, the worker s doctor or healthcare provider (where the worker has given their consent) and the occupational rehabilitation provider, where one is engaged, about their return to work. Nominate a Return to Work Coordinator ChemSkill will have a nominated Return to Work Coordinator who has the appropriate level of seniority and is competent to assist ChemSkill to meet their obligations under the return to work requirements. Make Specific Return to Work Information Available ChemSkill will make return to work information available to all workers and information will be made available following a workplace injury. This will include the If you are injured at work poster. What You Can Expect and Your Obligations as an Injured Worker As an injured worker you have Obligations under the Act, however there are also things that you can expect to happen. As an injured worker you can expect the following: - The ability to choose your own doctor or healthcare provider. - Choose an occupational rehabilitation provider from a list of a minimum of three providers if you require this service. - Be assisted, represented and supported in the return to work process. This person can be a family member, friend, colleague or union representative. Their role is to provide support and encouragement during the process. The support person cannot meet your obligations under the Accident Compensation Act, Be provided with suitable employment after a workplace injury, to the extent that is reasonable to do so. - You are entitled to the privacy of your confidential information. - The opportunity to appeal decisions made regarding your claim. Your Obligations as an injured worker include: - Make reasonable efforts to return to work with ChemSkill or another employer. - Make reasonable efforts to actively participate and cooperate in planning for return to work. - Actively use an occupational rehabilitation service when required and cooperate with the service provider. - Participate and cooperate in assessments of your capacity for work, rehabilitation progress or future employment prospects. - If requested to do so, participate and cooperate with our WorkCover insurance provider in an interview for the purposes of enhancing your return to work opportunities.

Return to Work Issues Resolution Procedure If a return to work issue arises within the workplace, ChemSkill will refer to the WorkSafe document, Information about Steps to Resolving Return to Work Issues. A copy of this document can be obtained from the WorkSafe website. Nomination of Occupational Rehabilitation Providers Sometimes it is necessary for an injured worker to be referred to an Occupational Rehabilitation provider to assist with their return to work. Nominally, ChemSkill will seek assistance from CGU who will then provide a list of three potential Occupational Rehabilitation Providers from which the injured worker may choose. Return to Work Coordinator The ChemSkill Return to Work Coordinator is Mark Giroletti who can be contacted during working hours on (03) or after hours, Helen Patronis (Managing Director) can be contacted on She will then liaise with Mark to ensure access is available for any issues in respect to the injured worker. Our return to work coordinator will draw on the expertise available with the Company s other staff and through its WorkCover agent Authorised WorkCover Agent ChemSkill s current WorkCover Agent is CGU Insurance. In the event of a workplace injury, ChemSkill utilises the resources of CGU for an approved occupational rehabilitation provider in the injured worker s area. WorkSafe Advisory Service The WorkSafe Advisory Service provides free assistance to the public in relation to all workers compensation related issues.
