DEFINITIONS - Policy holder: The physical or moral person taking out the insurance contract at his/her own expense or at the expense of another person whose name is specified in the policy. - Insurer: EUROPESE GOEDEREN EN REISBAGAGE VERZEKERINGSMAATSCHAPPIJ N.V., hereinafter referred to as THE EUROPEAN, enterprise registered under code number 0420, with registered office at the Tweekerkenstraat 14, 1000 Brussels, and with enterprise number BE Insured person: the physical person specified in the insurance contract and who is covered by this policy. - Family member up to the second degree: parents (in law), grandparents, children (in law), grandchildren, brothers (in law), and sisters (in law). - Travel companion: the unique person or the unique couple, including the family members who live under the same roof, with whom the insured person or the insured couple decided to take a trip or rent a holiday accommodation. - Life partner: the person with whom the insured person forms an actual or legal life partnership and who lives together with him/her long term at the same place of residence. 2. ESTABLISHMENT OF THE INSURANCE CONTRACT The insurance contract is established upon signing by the policy holder and after acceptance by the insurer. The insurance contract must be established prior to the date of departure and for the cancellation cover no later than 5 calendar days after booking the trip if this is over 30 days before departure and on the day of booking if this is within 30 days before departure. In case of insurance contracts with a term of more than 30 days, the parties are entitled to terminate the insurance by registered letter within 30 days after entering into the insurance contract. If the policy holder terminates the contract, termination will take effect immediately. If the insurer terminates the contract, termination will take effect 8 days after giving notice of termination. 3. COMMENCEMENT AND TERM OF THE INSURANCE CONTRACT The insurance contract is entered into for the term specified in the policy, with the minimum term being the full duration of the trip. The commencement date of the insurance contract is the same as the date on which the contract was signed, provided the total premium was paid. 4. COVER VALIDITY Cover is provided to insured persons who reside in Belgium. Cover is also provided to insured persons who reside in an EU member state or Switzerland, insofar as the trip is organised or sold by a tour operator or travel agency that operates in Belgium or the Grand Duchy of Luxembourg. 5. COVER DURATION Cover is provided for the period specified in the policy and shall take effect as soon as the insured person leaves his/her place of residence and run until the insured person s return to his/her place of residence. Cover is limited to a maximum stay abroad of 180 consecutive days. Cover provided by the cancellation insurance is effective during the period specified in the policy and shall take effect upon signing of the insurance contract and run until the end of the trip. 6. GEOGRAPHICAL SCOPE Cover is valid, as per specifications in the policy: - either for Europe (including Turkey, Morocco, Tunisia, Egypt, Israel, the Canary Islands, the Azores, Madeira, and Iceland); - for the Russian Federation; - for Cuba; - or globally; - for vehicles, the geographical scope of the cover is limited to countries listed on the insured vehicle s international motor insurance certificate. For Turkey, cover is limited to the European part of Turkey. 7. APPLICABLE LAW - LIMITATIONS PERIOD The insurance contract is governed by Belgian law. Any claim ensuing from this insurance contract shall expire after 3 years from the day of the event giving rise to the claim. 8. SUBROGATION The European automatically acquires the rights of the insured person with regard to liable third parties up to the amount of the cover, except for the amounts paid in the context of the C. Physical Accidents cover. 9. PLACE OF RESIDENCE The place of residence of the contracting parties is chosen by operation of law: - for The European: at its registered office; - for the policy holder: at the address specified in the policy. All correspondence with The European must be sent to its registered office in order to be valid. 10. MEDICAL EXPERTISE In the event of physical accident or illness, The European may opt to proceed to a possible medical examination. The insured person shall grant The European access to his/her medical file. 11. GENERAL EXCLUSIONS Unless specifically specified as insured in the cover, The European shall not be required to accept claims caused by: a. intentional acts of the insured person; b. suicide by the insured person; c. excessive consumption of alcohol, drugs, use of medication or narcotics not prescribed by a physician; d. natural disasters, such as avalanches, falling rocks, rock slides, landslides, earthquake, snow loads, hail, high water, forest fire, flooding, storm, hurricane, and all other weather conditions; e. fallout of nuclear or atomic accidents or radiation; f. war, strike action, or uprising including civil war or violence with a collective motive, as well as the g. threat of one of these events, unless the insured person can prove that there is no causal link with the event that may have caused the damage; h. indirect costs. 12. QUALITY CONTROL - COMPLAINT HANDLING The European tries to provide you with high-quality products and excellent service at all times. However, if, despite our efforts, you are not satisfied and wish to lodge a complaint, please do so by contacting our Ombudsman Service. The European will handle your complaint with due care and try to give you an answer and/or solution as soon as possible. If necessary, you can also submit the dispute to the competent court in Belgium. COMBINED GTI PLANS FULL OPTION This plan provides the cover specified in the following sections: a. Assistance for persons for the amounts and with the conditions specified in the policy conditions. b. Baggage insurance with an insured amount of 2,500. c. Physical accident insurance with the following insured amounts: 1. death: 25,000 per insured person; 2. permanent disability: 25,000 per insured d. Cancellation insurance for the total cost price of the trip as specified in the policy up to a maximum of 20,000. f. Holiday interruption for the total cost price of the trip as specified in the policy up to a maximum of 20,000. g. Additional cover: Home assistance, Delay, Civil Liability Private Life. FULL OPTION ALL RISKS This plan provides the cover specified in the following sections: a. Assistance for persons for the amounts and with the conditions specified in the policy conditions. b. Baggage insurance with an insured amount of 2,500. c. Physical accident insurance with the following insured amounts: - death: 25,000 per insured person; - permanent disability: 25,000 per insured d. Cancellation insurance for the total cost price of the trip as specified in the policy up to a maximum of 20,000. e. Cancellation ALL RISKS. f. Holiday interruption for the total cost price of the trip as specified in the policy up to a maximum of 20,000. g. Additional cover: Home assistance, Delay, Civil Liability Private Life. ASSISTANCE PLUS This plan provides the cover specified in the following sections: a. Assistance for persons for the amounts and with the conditions specified in the policy conditions. b. Baggage insurance with an insured amount of 1,250. c. Physical accident insurance with the following insured amounts: - death: 12,500 per insured person; - permanent disability: 12,500 per insured f. Holiday interruption for the total cost price of the trip as specified in the policy up to a maximum of 10,000. COVER A. ASSISTANCE I. ASSISTANCE FOR THE INSURED PERSON ABROAD 1. REPATRIATION IN THE EVENT OF ILLNESS OR PHYSICAL ACCIDENT OF THE INSURED Immediately upon receipt of the call at its alarm centre, The European will contact its medical team and attending physician to make the necessary arrangements in line with the medical advice. If the physicians recommend repatriation, The European will organise, completely at its own cost, the repatriation of the insured person to his/her place of residence or the local medical centre, or if necessary to a more appropriate medical centre by: a. air ambulance; b. scheduled flight or charter flight; c. first class train, sleeping car, or couchette car; d. ambulance; e. another appropriate means of transport, taking into account the circumstances of the repatriation. Repatriation shall be executed under the supervision of a physician and/or nurse, as required by the medical condition of the insured The choice of the means of transport for repatriation and the medical centre is determined solely by the medical welfare of the insured person, and will be made by The European medical team s physician after consultation with the local attending physician. For countries outside Europe, the Mediterranean, the Canary Islands, or Madeira, repatriation will only be provided via regular scheduled airline flights. REPATRIATION IN THE EVENT OF DEATH OF THE INSURED PERSON a. The European shall cover and organise the following as per the unanimous wishes of the next of kin: - either the full costs of transport of the body from the place of death abroad to the cemetery in Belgium, in an EU member state, or in Switzerland; - or the funeral costs at the location abroad following death abroad up to a maximum of the amount that would be covered for repatriation of the deceased. 1

The European shall furthermore cover: - the costs of post-mortem treatment abroad; - the coffin abroad up to a maximum of 1, MEDICAL EXPENSES DUE TO ILLNESS OR PHYSICAL ACCIDENT In the event of illness or a physical accident befalling an insured person during a trip abroad, The European shall cover the following for each insured person up to a total amount of 2,000,000 per insured person: a. medical or paramedical fees; b. medication prescribed by the attending physician abroad; c. admission and treatment costs in case of hospitalisation abroad; d. local transport costs for transportation of the injured or ill person to a medical centre as prescribed by the attending physician; e. furthermore: 1. dental care abroad up to a maximum of 250 including costs of urgent repair of an insured person s dental prosthesis up to a maximum of 50; 2. hotel accommodation costs up to 65 per day for a maximum of 10 days for the insured person and insured partner or travel companion for the extension of the stay for medical reasons; 3. additional hotel accommodation costs for a higher comfort level on medical advice up to 25 per day for a maximum of 10 days; 4. taxi expenses incurred by the partner or travel companion abroad to visit the insured The European s cover is capped at 100 for all insured persons together; 5. reimbursement, up to a maximum of 250, of costs incurred abroad for contact lenses, prescription glasses, or prostheses, following a physical accident abroad; 6. the costs of one-time ambulance transport in Belgium to the medical centre that is located closest to the place of residence; 7. up to 12,500 of the costs of psychological assistance or treatment of the insured person abroad after a disaster, attack, or kidnapping, of which the insured person is the victim or a direct witness. The European shall also reimburse, for insured persons resident in Belgium and up to 6,200 per insured person, the costs of medical and/or paramedical care prescribed in Belgium for one year, insofar as they result from a physical accident that occurred on a trip in Belgium or abroad. Cover for paramedical costs is capped at 500. This reimbursement does not apply to the costs of medical and/or paramedical care prescribed in Belgium after illness. 8. LOSS OR THEFT OF TRAVEL DOCUMENTS ABROAD In case of loss or theft of required travel documents (ID card, passport, driving licence, visa, etc. ) of the insured person abroad, The European shall reimburse administrative fees incurred abroad for replacement of the document, on the condition that the insured person has met all of the required formalities abroad (reporting to the authorities, police, embassy, consulate, etc.). 9. RETURN OF PETS Domesticated pets will be transported/repatriated along with the insured persons if they would otherwise stay behind abroad as a result of an early and insured return home by all the insured persons. 10. VET FEES In the event of illness or accident abroad of the insured person s pet, The European shall reimburse a maximum of 250 of the costs of veterinary care abroad. 11. INTERPRETING AND TRANSLATION EXPENSES The European shall cover a maximum of 125 of expenses incurred for interpreting and translation services used by the insured person abroad in looking after his/her interests. 12. DOMESTIC ASSISTANCE If the insured person is hospitalised in Belgium after repatriation through The European s assistance service, The European shall cover the costs of domestic assistance up to an amount of 30 per day up to a maximum total of THEFT OF TRAVEL TICKETS ABROAD In the event of reported theft of travel tickets abroad, The European shall cover a maximum of 1,000 of the cost of a return ticket (first class train or economy class flight) purchased abroad. 14. ASSISTANCE IN CASE OF HOSPITALISATION OF ONE OF THE INSURED PERSON S CHILD- REN IN BELGIUM The European shall arrange and pay for repatriation of all insured persons up to the 2nd degree, if one of the insured person s children (up to a maximum age of 18) needs to be hospitalised in Belgium for at least 48 hours. The European shall upon the insured person s request and in consultation with its medical team, arrange the hospitalisation and cover any transport costs. The development of the hospitalised person s state of health shall be monitored by The European s medical team up to the moment the parent(s) has (have) returned to the place of residence. The costs of hospitalisation of the child shall remain the responsibility of the insured II. ADDITIONAL COVER FOR THE INSURED PERSON ABROAD 1. INTERRUPTION OF THE TRIP AS A RESULT OF EARLY RETURN The European shall organise and cover either the return journey of the insured person and insured family members up to the second degree, or the outbound and inbound journey by train (1 st class) or by scheduled flight (economy class) of one insured person to his/her place of residence, as a result of: a. death, serious illness, or physical accident of the insured person s partner or a family member up to the 2 nd degree; b. serious material damage to the insured person s real estate for which he/she needs to return to the property; c. call-up of the insured person for an organ transplant, on the condition that he/she is on the Eurotransplant waiting list; d. urgent summons of insured by a Belgian court, which was not known on or announced before the departure date. The European shall also reimburse the actual transport costs by train (1 st class) or scheduled flight (economy class) of the other insured travel companions of the insured person who are dependent on the insured person if they are unable to make the return trip with the planned transport arrangements on their own. 2. FAMILY ASSISTANCE In the event of hospitalisation of the insured person abroad as a result of illness or a physical accident, The European shall organise and cover: a. the outbound and inbound journey of one single family member up to the 2 nd degree by train (1 st class) or scheduled flight (economy class) to join the insured person, provided this is justified by the gravity of the medical condition; b. the outbound and inbound journey by train (first class) or scheduled flight (economy class) of one single family member or another person designated by the family to look after the insured underage children included in the policy, on their return journey to their place of residence, provided their place of residence is in Belgium, the European Union, or Switzerland, and provided these children are unable to manage on their own. Transport costs for the return journey of the insured under-age children are also covered. c. furthermore: costs of local accommodation of the family member or other designated person up to a maximum of ADDITIONAL RETURN COSTS When The European proceeds to the repatriation of the insured person to his/her place of residence or in the event of the death of the insured person abroad, The European shall cover additional transport costs for the return journey by train (first class) or scheduled flight (economy class) to the place of residence of the insured family members and the insured travel companions who depend on the insured person and are unable to take the return journey using the initial transport arrangements on their own. The European shall furthermore cover additional costs of transport to the place of residence by train (first class) or by scheduled flight (economy class) of the insured person and insured life partner or travel companion who joins him/her, if the return journey cannot start on the initially scheduled date due to an extended stay on medical advice owing to illness or physical illness of the insured 4. MEDICAL ADVICE The European s medical team is available 24 hours a day to any insured person who wishes to obtain further information or medical advice relating to the country of destination of a trip that the insured person is planning. 5. SENDING MEDICATION ABROAD In the event of illness abroad, The European shall provide the insured, after consultation with the medical team, with the essential medication prescribed by a physician if this medication is not available at the location but is available in Belgium. 6. LOSS OR THEFT OF BAGGAGE Upon loss or theft of the insured person s baggage abroad, The European shall organise and pay for sending one suitcase with personal items to the insured person s accommodation abroad. This suitcase must be delivered to The European s alarm centre by a family member or by a person designated by the insured 15. CASH ADVANCE ABROAD As soon as The European has received the required sum (maximum of 3,750), The European shall proceed to make this amount available to the insured person to cover unforeseen and urgent expenses of the insured person abroad. 16. REIMBURSEMENT OF SKI PASS In the event that, as a result of illness or an accident abroad, the insured person is unable to continue to ski, The European shall reimburse, after submission of a medical certificate issued by the physician abroad, the unused days left on the insured person s ski pass up to a maximum of SENDING OF PROFESSIONAL ACCREDITATION DOCUMENTS In the event of loss or theft of documents abroad on a trip abroad for professional purposes, The European shall arrange and pay for the sending of replacement documents. 18. SENDING OF A REPLACEMENT PROFESSIONAL In the event of illness, an accident, repatriation, or early return, The European shall cover the costs involved in getting a replacement professional to the location abroad. 19. SEARCH AND RESCUE COSTS The European shall cover justified expenses incurred abroad, after consultation with and with the approval of its alarm centre, in bringing in a search and rescue team to save the insured person s life. 20. FORCED EXTENDED STAY If the insured person cannot return on the scheduled date from the foreign destination due to a general or local closing of airspace, owing to a natural disaster or exceptional weather conditions, even if these did not occur locally at the location abroad, The European will reimburse an amount of 65 per night, per person, for a maximum of five nights, of proven extra accommodation costs. TERRORISM - NATURAL DISASTERS EPIDEMICS Terrorism If the insured person is prevented from embarking on his/her return trip on the scheduled date due to a terrorist attack, which is recognised as such internationally, in the country of destination, The European shall reimburse the corresponding extra accommodation costs up to a maximum of 125 per day for a maximum of ten days. The European shall furthermore cover possible rebooking fees if the insured person is unable to return on the initially booked return flight. The European shall also cover, up to the insured amount, medical expenses incurred abroad for the injured insured person, and arrange, within the boundaries of the available possibilities, repatriation of the injured Natural disasters and epidemics If the insured person, due to a natural disaster (avalanche, flooding, forest fire, earthquake, etc.) or epidemic recognised as such by the WHO, in the country of destination, is prevented from embarking on his/her return trip on the scheduled date, The European shall reimburse the corresponding extra accommodation costs up to a maximum of 125 a day for a maximum of 10 days. The European shall also reimburse any rebooking fees if the insured person is prevented from returning on the originally planned flight. LEGAL ASSISTANCE - JUDICIAL DEPOSIT The European shall advance funds to cover lawyer fees abroad up to a maximum amount of 1,250 per insured person to defend the interests of the insured person following a road accident that occurred abroad, and insofar as the insured person does not have legal assistance under a motor vehicle liability insurance policy. The advance must be repaid to The European by the insured person within 3 months after his/her return. In the event that the insured person is required by the local authority to pay a judicial deposit following a road accident, The European shall advance a maximum of 12,500 per insured The judicial deposit must be repaid to The European within 3 months after his/her return, or immediately if the deposit is released by the local authority before then. 2

ASSISTANCE REGARDING THE INSURED VEHICLE AND THE INSURED OCCUPANTS This plan is available only as a supplement to Assistance for insured persons and is conditional on payment of a surcharge. 1. FOR THE INSURED VEHICLE DEFINITION OF VEHICLE The private vehicle, not older than 15 years, with registration number as specified in the policy, registered in Belgium, intended for transport of passengers and with a gross vehicle weight of no more than 3.5T, with a maximum of 8 seats, including the driver s seat, as well as a towed caravan or trailer. Also covered: motorcycles with a cylinder capacity of over 125cc. The private vehicle, not older than 15 years, with registration number as specified in the policy, registered in Belgium, intended for transport of passengers and with a gross vehicle weight of no more than 3.5T, with a maximum of 8 seats, including the driver s seat, as well as a towed caravan or trailer. Also covered: motorcycles with a cylinder capacity of over 125cc. In the event of immobilisation of the vehicle as a result of a mechanical defect, damage caused by an accident, fire, or theft, The European shall cover: a. costs of towing the vehicle to the nearest garage or local transport costs to a car repair shop, amounting to 500; b. costs of shipping spare parts that are essential for the correct functioning of the vehicle and which are unavailable abroad. The cost price of the spare parts shall always be borne by the insured person, who commits to their repayment within 15 days after his/her return; c. repatriation of the vehicle from abroad to the insured person s place of residence or the local garage on the condition that the vehicle cannot be repaired at the location abroad within five working days. Costs covered by The European shall never exceed the actual value of the repatriated vehicle at the time the cover is invoked; d. parking/storage fees for the vehicle from the day of immobilisation up to the day of repatriation, as well as any toll costs for the insured vehicle; e. expert or bailiff fees up to 625 in order to protect the interests of the insured person as a result of material damage to the vehicle due to a road accident abroad; f. in addition: expert fees up to 250 for the documentation of incorrect repairs performed on the vehicle abroad. In the event of theft of the insured vehicle abroad: a. if the vehicle, after the return of the insured person to his/her place of residence, is recovered in an undrivable condition, The European shall cover the costs of repatriation of the vehicle up to the limit of the actual value of the vehicle at the moment of the recovery; b. if the vehicle is recovered, after the return of the insured person to his/her place of residence, in a drivable condition, The European will either arrange for a driver for the insured person, or a train ticket (first class) or a ticket for a scheduled flight (economy class) for the purpose of recovering the vehicle. 2. FOR THE INSURED OCCUPANTS In the event of immobilisation of the vehicle en route as a result of a mechanical defect, damage caused by an accident, vandalism, or fire, The European shall cover: a. in the event that the vehicle is repaired locally, and the expectation is that the trip can be continued, up to 250 per insured person: 1. costs of hotel accommodation or 2. the costs of a taxi or rental car in order to reach the destination or the insured person s place of residence. The costs of fuel, repair, tolls, and taxes remain at the expense of the insured b. in the event that the vehicle cannot be repaired within 5 working days and will be repatriated from abroad by The European or the car wreck is left behind at the site or upon theft of the vehicle: the return trip costs of the insured occupants to their place of residence by train (first class) or scheduled flight (economy class); c. if, as a result of illness or accident, the insured person is no longer able to drive his/her vehicle, and no other occupant can replace him/her, The European will arrange to have a replacement driver available for the purpose of bringing the vehicle back to the place of residence in Belgium by the most direct route. The costs of fuel, tolls, and taxes remain at the expense of the insured 3. OPTIONAL COVER REPLACEMENT VEHICLE ABROAD This cover is provided only after payment of a surcharge and on the condition that a plan that extends the assistance offered for vehicles is taken out. 1. Definitions Alternative transport Usage, after approval of the alarm centre, either of a class-b replacement car or similar in case of immobilisation of the insured vehicle or another means of transport when provision of a replacement is impossible. Insured vehicle This cover applies only in case of immobilisation or theft of the vehicle with the registration number specified in the policy for which this cover was taken out. 2. Geographical scope This cover applies in all of geographical Europe, except for Turkey. 3. Obligations of the insured person The insured person shall be required to: a. maintain the vehicle and take due care of the vehicle; b. immediately report any damage to the vehicle to the rental company or insurer of the vehicle; c. return the vehicle in good condition at the agreed place and on the agreed date; d. respect the general rental terms and conditions of the rental company providing the vehicle. 4. Cover Cover is provided in case of breakdown, accident, or theft of the vehicle abroad, provided that the vehicle cannot be repaired or is not recovered within 48 hours. In Belgium, this cover is provided only if the vehicle is immobilised due to an accident 7 days or fewer prior to departure and repair is not possible before the date of departure. 5. Reimbursement The European shall reimburse the following costs: - either the actual rental fee, limited to the duration of the originally insured trip and up to a maximum of 30 days. In case of breakdown or accident at the end of the trip, this cover shall be limited to a maximum of 7 days. If the vehicle can be repaired within a reasonable term and the distance to the place of residence is under 250 km, The European may request that the insured person return the replacement vehicle and pick up the repaired insured vehicle at the place of repair. If repair is possible within five days, the insured person is required to have the vehicle repaired. The actual rental costs are made up of the rental fee and the possible drop-off charge. The costs for the journey on public transport from and to the place where the rental car is picked up and returned shall also be reimbursed. The costs of fuel, repair, damage, tolls, and possible additional insurance for the rental car shall always be excluded from cover. - or the costs of public transport to the holiday destination up to a maximum of 650, in the event that the insured person cannot dispose of a replacement vehicle or if The European is unable to provide one. Possible additional transport expenses for baggage that cannot be taken on public transport or does not fit in the replacement car shall be reimbursed up to a maximum of Premium vehicle If the insured person wants a vehicle from a class that is higher than class B, The European can accommodate this. Any additional costs shall, however, be borne by the insured For these additional costs, The European may ask the insured person for a payment. 7. Exclusion Rental cars, rented in Belgium or abroad, shall always be excluded from cover. IV. EXCLUSIONS a. Physical injury due to an accident, illness, or chronic illness, for which medical or paramedical treatment was required on the date the insurance contract was signed, according to the attending physician, and which comes with exceptional complications during the trip. b. Mental, nervous, or emotional disorders, including anxiety issues, depression, neurosis, or psychosis. c. Voluntary interruption of pregnancy, childbirth, and related interventions and consequences. d. Performance in relation to repatriation, without prior consent of The European. e. Assistance in relation to minor conditions or injury that can be treated locally and do not keep the insured person from continuing his/her trip, except for medical costs. f. Work performed by the insured person insofar as it involves exceptional occupational hazards. g. Sports: 1. engaging in sports as a profession or in exchange for payment; 2. engaging in the following activities: mountaineering, speleology, canyoning, rafting, bobsleigh, skeleton, ice hockey, ski jumping, winter sports, martial arts, bungee jumping, deltaplaning, paragliding, parapenting, kite surfing, parachute jumping, scuba diving, big-game hunting, and all motor sports (incl. quad bike, jet ski, banana boat, snow scooter, speedboat, etc.) If the combined FULL OPTION or FULL OPTION ALL RISKS plan was taken out, or the additional premium was paid for cover extension to cover sports, ASSISTANCE PLUS, or the assistance cover was paid, cover will be extended to cover the following sports: all motor sports (incl. quad bike, jet ski, banana boat, snow scooter, speedboat, etc.), scuba diving and winter sports. h. Air travel, unless this is as a paying passenger on an aircraft approved for public transport of travellers. i. Medical costs for: 1. thermal treatments, preventive medicine; 2. normal childbirth; 3. aesthetic interventions or treatment (unless medically required following physical injury); 4. treatments and medication for illness prescribed in the insured person s country of residence; 5. dental care in Belgium; 6. prostheses and medical material prescribed in Belgium. j. Vehicle: 1. regular maintenance expenses; 2. costs for parts and repair; 3. apparent poor condition of the vehicle. V. OBLIGATIONS OF THE INSURED PERSON The insured person is obliged to: a. Immediately notify The European s alarm centre, follow the instructions and provide its medical team with all information and/or documents that they consider necessary or expedient; b. In case of urgent hospitalisation abroad, the insured is required to take the necessary steps, upon his/her return to Belgium in order to obtain the compensation legally due from his/her health insurance fund and/or other health insurance and to transfer this to The European if the latter has already paid the medical costs. Medical costs paid by the insured person abroad will be paid by The European after the health insurance fund and/or any other insurer have paid the part to which the insured person is entitled under the state health insurance scheme and/or other insurance. Medical and hospitalisation costs in Belgium, as a result of a physical accident occurring in Belgium or abroad, will be reimbursed by The European after settlement of amounts due under social security cover and/or any other insurance. c. If the insured is not correctly covered by social security and/or any other insurer, or does not comply with the requirements of these organisations, The European shall only pays for the part that cannot be repaid by the state health insurance fund. d. In the event of death or a road accident, have a report drawn up by the local authorities. e. Justify the costs by presenting relevant documents. Assistance that does not fall under the headings of the cover provided can be performed by The European, albeit that this can be made conditional on prior written agreement to repay the actual costs by the insured or the requesting party. The European cannot be held liable for any delay or obstruction in the execution of the assistance in the event of force majeure such as natural disasters, epidemics, climatological phenomena, strike action, and suchlike. B. BAGGAGE INSURANCE 1. DEFINITION OF BAGGAGE All items, property of the insured person, which he/she brings along on the trip for his/her personal use, including: a. items of clothing or items to wear; b. special and valuable items such as jewellery, timepieces, furs, binoculars, photo cameras, portable audio players or video equipment, mobile phone, laptop computers, all I products (ipods, iphones, and suchlike) up to a maximum of 50% of the total insured capital for the total of special and valuable items; c. sports equipment: if this equipment is composed of a set of multiple objects, each object is insured separately for an amount equal to the total value of the equipment divided by the number of objects; d. camping equipment, limited to a tent and camping necessities. Each item is insured separately to a maximum of 25% of the total insured capital. 2. INSURED CAPITAL Either: for the combined plans: - Full Option and Full Option All risks: 2,500 for first risk per insured person; - Assistance Plus: 1,250 for first risk per insured person; Or: for a per-person amount specified in the policy: maximum of 5,000 for first risk per insured 3. COVER a. The European insures baggage against complete or partial damage, theft, as well as theft and non-delivery of baggage entrusted to a transport company. b. In the event that baggage is delivered abroad by a transport company with a delay of at least 12 hours, The European shall furthermore reimburse a maximum of 250 per insured person for proven purchase of essential items. c. Baggage transported in a personal vehicle, mobile home, or caravan used by the insured person is only covered against complete or partial damage as a result of a road accident, including fire and theft with visible signs of break-in, committed between 6am and 10pm, on the condition that they were placed out of view in a boot space separated from the passenger area of a fully locked 3

4 vehicle. If the type of vehicle does not permit this, cover is not provided. d. Baggage under supervision of the insured person, as well as the items and clothing worn on the body, are only insured against complete or partial damage as a result of a physical accident, fire, explosion, forces of nature, or against theft committed with physical violence against the e. Baggage that is located in a hotel room or holiday accommodation is only covered against complete or partial damage as a result of fire, explosion, or water damage and against theft with visible signs of break-in. f. Camping material set up on a regulated camping area is covered against complete or partial damage as a result of fire, flooding, lightning, storm, or other forces of nature, as well as resulting from an established case of attempted theft. g. The European shall furthermore cover breakage of skis that are the property of the insured person when he/she engages in winter sports, up to a maximum of 250. h. Theft of skis or snowboard owned by the insured person, up to 250, also if these were left unsupervised in a designated area. An official police report drawn up in situ must be submitted. i. In the event of loss or theft of the international passport or the identity card abroad, The European shall cover administrative replacement expenses incurred abroad up to a maximum of 125. j. Loss, damage, or non-delivery of wheelchairs, entrusted to a transport company, are covered up to a maximum of 2,000, on top of the normally insured amount. An official document corroborating that the matter was reported to the carrier and, in case of a bus journey, an official statement by the bus company or driver must be submitted. 4. EXCLUSIONS a. - Works of art, antiques, carpets, furniture, musical instruments, non-portable film, video and audio equipment, goods, samples, and equipment of a professional nature; - prostheses, contact lenses, and glasses; - documents, money or valuable papers, collections; - all weapons or ammunition. b. Complete or partial damage of the baggage due to: - weather conditions, vermin, own fault, normal wear and tear, inadequate packing, electrical, electronic or mechanical malfunctions or due to repair, cleaning or restoration; - spillage from containers, dents, scratches, the peeling of enamel and the breakage of fragile objects, unless this damage is the result of a road accident. c. Complete or partial damage and theft of: - sports equipment (except skis), motorcycles, bicycles, baby carriages, wheelchairs and such during their use; - baggage transported with a two-wheel vehicle, in a convertible vehicle or open-top vehicle or outside of or on the vehicle, unless as a result of a road accident; - special or valuable items entrusted to a transport company as well as the non-delivery of these items. d. Theft of special or valuable items from a private vehicle or any other form of transportation, tent, or caravan. e. Theft of baggage in a vehicle at night between 10pm and 6am. f. Forgetting or losing baggage (except for identity papers) or the theft of baggage left unsupervised, as well as any damage incurred in these circumstances. g. Confiscation, withholding, or seizure of baggage by any authorities, as well as any damage done in such circumstances. h. Loss of use and all other indirect damage. i. The costs of replacement of locks and keys. j. Exclusions provided under the common policy conditions. 5. DETERMINATION OF COMPENSATION AMOUNT a. The European shall reimburse, within the limits of the insured amount and a maximum of 25% of the insured amount per object, the purchase value of the damaged, stolen, or non-delivered baggage, taking into account the decrease in value as a result of age or wear and tear, established at a flat-rate of 10% per year or part of a year, calculated from the invoice date of the goods in question. b. Reimbursement by The European under the cover for Purchase of essential articles and Ski breakage, will in any case remain limited to a maximum of 250 per insured person, regardless of the number of baggage policies entered into with The European by the insured c. In the event of partial or total loss and lack of sufficient justification, The European reserves the right to calculate the amount of the claim based on the proportion of the missing weight to the total weight of the insured baggage. d. If the amount of the claim cannot be determined by mutual agreement, it will be estimated by two experts appointed by both parties and possibly a third expert, chosen by the first two experts, in order to resolve the issue. Their decision shall be binding on both parties. e. Specific claim regulations in the event of irreparable damage to or non-delivery of a checked-in suitcase: If checked-in luggage is damaged irreparably or is lost and the purchase value of the suitcase was above 100, the insured person can opt for free-of-charge replacement of the damaged or lost suitcase by a SAMSONITE suitcase of the CABIN COLLECTION type, which shall then be handed to the insured person through his/her travel agent or insurance broker. 6. OBLIGATIONSOF THE INSURED PERSON The insured is required to meet the following obligations: a. to take all necessary and expedient measures to protect the baggage; b. if the baggage is located in a vehicle, lock the doors and the suitcase and fully close the windows and the sunroof; c. special or valuable items and jewellery that the insured person is not wearing should be stored in the safe of the hotel or the holiday accommodation; d. when submitting a claim: 1. in the event of theft: have a police report drawn up immediately by the local authorities where the theft occurred or was established and have the signs of break-in recorded; 2. in the event of complete or partial damage or non-delivery by a transport company: hold the transporter liable within the legal term and create and present a statement of objection and a certificate of definitive loss by the carrier; 3. tickets and baggage labels must be retained; 4. in the event of complete or partial damage due to a road accident: have a police report drawn up immediately by the local authorities where the accident occurred; 5. reserve all rights with respect to any potentially liable third party; 6. in all events, to notify The European within 48 hours after return to Belgium or the place of residence (except in the event of force majeure) to comply with The European s instructions and to provide The European with all the documents and/or information that are necessary or expedient; 7. to demonstrate the gravity and extent of the damage and to present proofs of purchase of special and exceptional items. C. PHYSICAL ACCIDENT INSURANCE 1. DEFINITION OF ACCIDENT Accident is understood to mean: an unexpected and sudden occurrence that causes physical injury and of which the cause or one of the causes is outside of the victim s body. The following occurrences are considered accidents: - drowning, poisoning; - effects of freezing, severe cold, or extreme heat; - injury sustained during rescue of persons in distress; - complication of injury that was initially caused by a accident that is covered under this policy; sprains, strains, fractures, bruises, or muscle ruptures due to sudden physical effort. 2. INSURED CAPITAL Either: for the combined plans Full Option and Full Option All Risks: - in case of death: 25,000 per insured person - in case of permanent disability: 25,000 per insured person Assistance Plus: - in case of death: 12,500 per insured person - in case of permanent disability: 12,500 per insured Or: for the amounts for death and permanent disability specified in the policy up to a maximum of 125,000 per insured 3. COVER If the insured person becomes the victim of a covered accident, The European shall cover: a. in the event of sudden death or within three years of the covered accident, the defined insured capital to the legal heirs or to the beneficiary indicated in the specific policy conditions; b. in the event of permanent disability, an amount calculated on the basis of the defined insured capital in proportion to the extent of disability determined using the official Belgian scale of disabilities which applies in the consolidation. If several permanent partial disabilities result from the same accident, the total claim may not exceed the specified insured capital. The determination of disability may not be increased by a pre-existing disability. The degree of permanent disability will be determined no later than three years after the insured accident. Cover for death or permanent disability will never be combined. Cover remains provided, subject to the exclusions from Article 5 for accidents befalling the insured person: a. as the driver or passenger of a private motor vehicle; b. as a paying passenger of a recognised transport company on land, by sea or in the air. Cover for the death of persons under five years of age will be replaced by the reimbursement of funeral expenses up to a maximum of 1,250. Cover for the death of persons over 75 years of age will be limited to 50% of the insured capital. In the event of a permanent disability of persons who are 65 years or older at the time of the accident, an annual annuity will be paid, equal to 8% of the calculated permanent disability. 4. FAMILY COVER If, during the trip, both parents become victims of a fatal accident, the death capital sum payable to the surviving under-age children will be doubled, but with a maximum of 125,000 per parent. 5. EXCLUSIONS The European shall not provide cover for accidents resulting from: a. activities arising from the exercise of professions that are known to be hazardous, such as, among others, entering mines and quarries, presence in factories where explosives are manufactured, demolition works, etc.; b. engaging in sports as a profession or in exchange for payment; c. engaging in the following activities: mountaineering, speleology, canyoning, rafting, bobsleigh, skeleton, ice hockey, ski jumping, winter sports, martial arts, bungee jumping, deltaplaning, paragliding, parapenting, kite surfing, parachute jumping, scuba diving, big-game hunting, and all motor sports (incl. quad bike, jet ski, banana boat, snow scooter, speedboat, etc.) If the combined FULL OPTION or FULL OPTION ALL RISKS plan was taken out, or the additional premium was paid for cover extension to cover sports, ASSISTANCE PLUS, or the assistance cover was paid, cover will be extended to cover the following sports: all motor sports (incl. quad bike, jet ski, banana boat, snow scooter, speedboat, Etc.), scuba diving and winter sports, except for off-piste skiing. d. the use of a two-wheel vehicle with a cylinder capacity of over 50cc with or without a side-car; e. air travel, unless this is as a passenger on an aircraft approved for public transport of travellers; f. the exclusions specified in the common policy conditions. 6. OBLIGATIONS OF THE INSURED PERSON OR BENEFICIARY The insured person or beneficiary must: a. immediately notify The European and send The European a written report within 7 days as of the moment that the insured person has the opportunity to do so; b. comply with the instructions from The European and provide The European with all the information and/or documents that it considers necessary or expedient. D. CANCELLATION INSURANCE 1. DEFINITIONS a. Travel contract: any transportation, stay, or rental of a holiday accommodation, combined or separately, purchased by the insured person in the capacity of traveller and/or tenant from a professional travel organisation and/or agent or from a carrier. b. Date of departure: a. the date of departure of the trip specified in the travel contract. b. the start date of the rental of a holiday home, taking reasonable account of the length of the journey to reach the holiday destination directly on the date specified in the travel contract. c. Booking date: the date on which the reserved services were booked with a professional travel organisation and/or travel agent. If only flight tickets are involved, the booking date is equal to the issue date of the ticket. d. Family: all members of a family who reside under the same roof, including children who temporary live elsewhere for a university education. e. Travel companion: the unique person or the unique couple, including the family members who live under the same roof, with whom the insured person or the insured couple decided to take a trip together or rent a holiday accommodation. f. Life partner: the person with whom the insured person forms an actual or legal life partnership and who lives together with him/her long term at the same place of residence. g. Illness: impairment of health, determined before the date of departure or during the trip by a qualified physician and that makes the travel contract entered into, medically speaking, impossible, or that requires an early return in case the trip has already started. h. Accident: impairment of physical soundness caused by an external cause, determined by a qualified physician before the departure date and that makes that the travel contract cannot be honoured. i. Major material damage to real estate: exceptional and accidental damage, including the consequences of theft, which occurred within 30 days before departure, to the real estate or to the company buildings that the insured person owns or rents. 2. INSURED SUM The total cost price of the trip as specified in the policy up to a maximum of 20,000 per 3. COVER The cover is intended to compensate the costs of cancellation or the modification that, according to the application of the terms and conditions of the travel contract, are to be borne by the insured person in the event of cancellation or modification due to one of the following reasons: 1. illness, accident, or death of: - the insured person, his/her life partner, a blood relative or kin up to the second degree, including family-in-law; - a person who lives together with the insured person in the same residence and who is in his/ her care or is his/her dependent; - an official fiancé(e), as well as his (her) family members up to the first degree; 2. acute aggravation of a pre-existing illness that makes the planned trip impossible, on the condition that this illness did not constitute an obstruction for the trip at the moment of booking and that 4

5 the required medical treatment is limited to keeping the medical condition under control through maintenance medication. In case of palliative care, the cover shall be limited to death or acute life-threatening illness; 3. when the insured person is medically unable to sustain the vaccinations required for the trip, and this was not known when the policy was taken out; 4. complications with the pregnancy of the insured person or a first-degree family member, including premature delivery at least one month before the due date; 5. pregnancy of the insured person or his/her life partner, on the condition that the trip is scheduled for the final trimester of pregnancy and the insured person did not know she was pregnant when the trip was booked; 6. illness or accident affecting the insured person s physical condition to such a degree that he/she is no longer able to partake in the sporting activities that constitute the actual purpose of the trip; 7. when the insured person or a family member up to the first degree is summoned for: - legal transactions by official bodies as part of a child adoption procedure; - an urgent organ transplant (as donor or as recipient); 8. if a family member of the insured person to the first degree, or a person in his/her actual or legal care, has to move to a nursing home or home for the elderly within one month prior to departure or during the planned trip; 9. the necessary presence of the insured person due to the death of a family member up to the third degree within 15 days prior to departure or in case of hospitalisation of a family member up to the third degree living on his/her own; 10.unavailability due to illness, accident, or death of the person specified in the policy as the person in charge of caring for an under-age or disabled child of the insured person; 11.illness, accident, or death of a former life partner of the insured person, due to which the care arrangements for the children who are not joining the insured person on the trip are made impossible; 12.divorce of the married or cohabiting insured life partners on the condition that one of them officially changed his/her residence after the date on which the trip was booked. 13.cancellation of the insured person s honeymoon due to cancellation of the civil wedding of the insured persons; 14.death or hospitalisation of a member of the host family with whom the insured person had planned to spend his/her vacation, insofar as this family member would have lived at the same residence as the host family; 15.termination of the insured person s or his/her life partner s employment contract by his/her employer for economic reasons within thirty days prior to departure; 16.one of the parents of an insured student losing their job due to economic reasons; 17.cancellation by the employer of the insured person s already granted leave due to the unavailability of a colleague who was to replace the insured person as a result of illness, accident or death; 18.necessary presence of the insured person who practices a free or independent profession due to unavailability of the insured person s professional replacement as a result of illness, accident or death, as specified in the policy; 19.revocation of the insured professional soldier s leave due to an international assignment, on the condition that the order was given after the date on which the trip was booked; 20.mandatory presence of the insured person following the entering into of a new employment contract with a minimum term of at least 3 consecutive months; 21.professional relocation of the insured person, provided this forces the insured person to move house; 22.mandatory presence of the insured person as: - witness or jury member in court; - student to retake an exam in the period between the departure date and 30 days after the date of return from the trip; 23.major material damage to the insured person s rented or owned real estate, including damage to the real estate due to theft, which occurred within 30 days prior to the date of departure; 24.in the event that the rental contract for the home where the insured person has his permanent residence is terminated by the landlord within three months prior to the planned date of departure; 25.in the event that the insured person or a family member up to the 2nd degree is the victim of kidnapping, including tiger kidnapping, as well as disappearance or kidnapping of children by one of the parents; 26.in the event that the insured person fell victim to a car or home jacking within 7 days prior to the date of departure; 27.violent robbery or robbery involving break-in, within five days prior to departure, of identity documents or tickets needed for the trip; 28.theft or total immobilisation due to a road accident or fire of the insured person s private vehicle within 7 days prior to departure or during the journey to the holiday destination. Cases of mechanical failure, however, are not covered; 29.delay at the time of embarkation as specified in the travel contract, on initial departure or at a later stage of the journey, as a result of immobilisation for more than one hour caused by a road accident en route to the point of embarkation. Cover will be extended to delay in the event of a mechanical failure, on the condition that a certificate from a towing company or known automobile club can be presented; 30.wildcat strike action (not announced) at the place of departure in Belgium, as a result of which the point of embarkation could not be reached on time; 31.refusal of the entry visa by the authorities of the country of destination. If Cancellation All Risks cover was taken out, either in a combined plan, or as separate cover, the insured person can furthermore rely on the cover specified in section Documentation, administration, visa and other similar costs. 4. EXCLUSIONS a. Medical conditions for which at the time of signing the policy and/or booking the trip specific examinations and/or treatments had already been scheduled (except for routine examinations). b. Mental, nervous, or emotional disorders, including anxiety conditions, depression, neurosis, psychosis, or psychosomatic conditions, unless these require hospitalisation (or outpatient treatment). c. Voluntary interruption of pregnancy. d. Accidents or disorders as a result of: - mountain climbing along unbeaten trails, big game hunting, speleology and undersea fishing or martial arts; - participation in any races, speed records attempts, or competitions; - engaging in sports in a professional capacity or in exchange for payment, including any associated training sessions; e. Delay due to traffic difficulties and other normal incidents. f. Insolvency of the insured g. Documentation, administration, visa and other similar costs. h. Trips not booked during the term of the insurance contract. i. Trips that do not match the definition under D.1.a, definition of Travel contract. j. Exclusions specified in the common policy conditions. The aforementioned exclusions apply not only to the insured person, but also to the persons whose medical condition is the reason for the claim. Also excluded: all claims on policies taken out over 5 calendar days after booking the trip. 5. DETERMINATION OF COMPENSATION AMOUNT The European shall cover: a. 1. for each booking except flight only: upon cancellation before the start of the travel contract: 100% of the cancellation charge the insured person is contractually held to pay the travel organisation, possibly plus costs charged by the travel agent up to a maximum of 10% of the cost of the trip; 2. for flight only: in the event of cancellation by the insured person before the start of the flight, the cancellation costs charged by the airline and/or the agent plus any costs of issuance by the travel agent, capped at 25% of the purchase price of the ticket. Cover shall never exceed 100% of the insured amount. b. if, in the event of cancellation by the travel companion, the insured person decides to go on the trip alone: the corresponding extra hotel and/or modification costs. The amount covered by The European will, in any case, be capped at the contractually mandatory cancellation charge; c. In the event of immobilisation of their private vehicle, the insured person can still start the trip with a rental car. In that case, The European will pay the net price of the rental car up to an amount equal to the payable cancellation costs. Tolls, petrol, and/or any insurance costs will not be covered. In no case will payments by The European exceed the defined insured amount, as specified in the travel contract, and they will always be calculated based on the cancellation costs due on the basis of the terms and conditions of the travel contract for cancellation within 48 hours after the insured person found out about the event that caused the cancellation. The proportionality rule shall be applied if the insured amount does not cover the actual cost price of the insured trip or if an incorrect or lower premium rate was applied. 6. OBLIGATIONS OF THE INSURED PERSON The insured person shall the following obligations: a. send a written report to The European within 48 hours of the insured person finding out about an event that necessitates cancellation of the trip; b. comply with the instructions from The European and provide The European with all the information and/or documents that it considers necessary or expedient; c. take all necessary and expedient measures in order to reduce the cancellation costs to a minimum, meaning that as soon as the insured person finds out about an event that may cause the cancellation of the trip, he/she will immediately inform the travel agency or the tour operator. E. CANCELLATION ALL RISKS COVER 1. COVER In the event that the insured person cancels his/her trip for a reason other than the reasons specified under D.3 of the Cancellation Insurance or in the policy conditions of a cancellation insurance policy with another insurer, The European shall reimburse up to a maximum of 75% of the nonrecoverable part of the insured cost of the trip as follows: - for each booking except flight only: 75% of the cancellation charge the insured person is contractually held to pay the travel organisation, possibly plus costs charged by the travel agent up to a maximum of 10% of the cost of the trip; - for a flight only: 75% of cancellation costs charged by the airline and/or agent, plus the possible travel agent s fee up to a maximum of 25% of the purchase price of the ticket. The proportionality rule shall be applied in calculating the payment if the insured amount does not cover the actual cost price of the insured trip or if an incorrect or lower premium rate was applied. 2. EXCLUSIONS a. anxiety conditions, depression, neurosis, or psychosis, unless these require hospitalisation or outpatient treatment or are related to eating disorders. b. excessive consumption of alcohol, drugs, narcotics, or medication not prescribed by a physician. c. any event that was known to the insured person at the time of booking the trip, except for illness or accident. d. intentional acts of the insured e. cancellation due to a reason that is not specified, materially intangible, or not verifiable. f. cancellation citing a lack of sun or excess sun or rain. g. cancellation for which the travel organisation does not charge or is not allowed to charge, or for which they offer a free-of-charge alternative. h. cancellation due to non-performance or late performance of (a part of) the trip by a liable party (such as a carrier, tour operator, etc.), even if the segments of the trip were booked separately or through different suppliers. i. cancellation due to events or occasions in the country (countries) of destination that will or did not go ahead. j. interruption of the holiday. k. claims on policies taken out over 5 calendar days after booking the trip or taken out after the booking date and/or for trips with a departure date within thirty days after booking. l. trips that do not match the definition under D.1.a, definition of Travel contract. All other exclusions specified in the policy conditions do not apply. 3. OBLIGATIONS OF THE INSURED PERSON The insured person shall the following obligations: a. send a written report to The European within 48 hours of the insured person finding out about an event that necessitates cancellation of the trip; b. clearly state the reason for cancellation in the claim and submit the necessary proof to The European; c. comply with the instructions from The European and provide The European with all the information and/or documents that it considers necessary or expedient; d. take all necessary and expedient measures in order to reduce the cancellation costs to a minimum, meaning that as soon as the insured person finds out about an event that may cause the cancellation of the trip, he/she will immediately inform the travel agency or the tour operator. F. HOLIDAY INTERRUPTION 1. DEFINITIONS Refer to D.1. of the Cancellation Insurance cover. 2. INSURED SUM The total cost price of the trip as specified in the policy up to a maximum of 20,000 per insured For the combined Assistance Plus plan, cover shall remain limited to 10,000 per insured 3. COVER The cover is intended compensate for holiday days that were not used if the insured person has to end his/her trip early or postpone his/her departure for one of the following reasons: a. illness, accident, or death of: - the insured person, his/her life partner, a blood relative or kin up to the second degree, including family-in-law; - a person who lives together with the insured person in the same residence and who is in his/her care or is his/her dependent; - an official fiancé(e), as well as his (her) family members up to the 1 st degree; b. death or hospitalisation of a resident member of the host family, with whom the insured is spending his/her holiday, and on the condition that the hospitalised person lives under the same roof as the host family; c. necessary presence of the insured person who practices a free or independent profession due to unavailability of the insured person s professional replacement as a result of illness, accident or death, as specified in the policy; d. unavailability due to illness, accident, or death of the person specified in the policy as the person in charge of caring for an under-age or disabled child of the insured person s; e. considerable material damage to the insured person s real estate that occurred during the trip, including theft from the insured person s home; f. mandatory presence of the insured person as a witness or jury member in court; g. when the insured person or a family member up to the first degree is summoned for: 5

6 - legal transactions by official bodies as part of a child adoption procedure; - an urgent organ transplant (as donor or as recipient); h. complications with the pregnancy of the insured person or a first-degree family member, including premature delivery at least one month before the due date; i. theft or total immobilisation due to a road accident or fire of the insured person s private vehicle at the moment of departure or during the journey to the holiday destination. Cases of mechanical failure, however, are not covered; j. delay at the time of embarkation as specified in the travel contract, on initial departure or at a later stage of the journey, as a result of immobilisation for more than one hour caused by a road accident en route to the point of embarkation. Cover will be extended to delay in the event of a mechanical failure, on the condition that a certificate from a towing company or known automobile club can be presented. Cover will also be granted to the insured person in the event of interruption of the holiday by the travel companion as a result of one of the aforementioned reasons, insofar as he/she also entered into an insurance contract with The European with cover for holiday interruption, and the insured person is forced, due to the interruption of the trip by the travel companion, to continue the trip alone. 4. EXCLUSIONS Refer to point 4. Cover exclusions for D. Cancellation Insurance. These exclusions apply not only to the insured person, but also to the persons whose medical condition is the reason for the claim on the policy. 5. DETERMINATION OF COMPENSATION AMOUNT The European shall cover: a. the part of the paid travel sum which cannot be recovered, in proportion to the number of unused holiday days, to be calculated from the moment of return to the place of residence or the day of hospitalisation. The unused holiday days are calculated as follows: - if the insured person s return is paid for through any assistance cover, the claim will be calculated on the basis of the hotel nights not used; - if the insured person pays for his/her return himself/herself, the reimbursement amount will be calculated on the basis of the hotel nights not used and the originally purchased ticket; - if the insured person has rebooked his/her return ticket, the price of the rebooking will be reimbursed (and therefore not the original return flight) on the condition that the rebooking does not exceed the price of the return ticket; - if the travel contract only includes transport, The European shall reimburse the part of the transport price which cannot be recovered, to the extent that the return trip costs were not covered by a different insurance cover (assistance, etc.). When claiming on the policy, the insured person can choose from different cover options: - either immediate reimbursement of unused holiday days; - or a voucher to book a trip through the same agency within one year. In this case, the covered amount will be increased by 10%. The proportionality rule shall apply if the insured amount does not cover the actual cost price of the insured trip or if an incorrect or lower premium rate was applied. b. in the event of immobilisation of the private vehicle, the insured person can still continue the trip with a rental car. In that case, The European will pay the net price of the rental car up to an amount equal to the normally calculated compensation for holiday interruption. Tolls, petrol and/or any insurance costs will not be covered. c. aside from that, The European shall in the event of postponement of departure for any reason specified in the cover, pay compensation based on the number of days not used, calculated using the price of the trip without flights. If the insured person is forced to purchase a new ticket, The European shall reimburse, up to a maximum of 25% of the total cost price of the trip and on top of holiday days not used, the purchase price of a one-way ticket to enable the insured person to get to his/her holiday destination. 6. OBLIGATIONS OF THE INSURED PERSON The insured person shall meet the following obligations: a. immediately notify The European and send The European a written report within 7 days as of the moment that the insured person has the opportunity to do so; b. comply with the instructions from The European and provide The European with all the information and/or documents that it considers necessary or expedient; c. in case of illness or accident abroad, a medical certificate issued by the attending physician abroad which recommends a return home. G. EXTRA COVER ADDITIONAL COVER WHEN TAKING OUT A COMBINED FULL OPTION PLAN If the combined Full Option or Full Option All Risks plan was taken out, the insured person can rely on the following cover: I. HOME ASSISTANCE 1. UNINHABITABLE HOME In the event that the insured person s residence in Belgium is damaged or uninhabitable due to fire, explosion, implosion, water damage, theft, vandalism, or glass breakage, and the insured persons cannot live there, The European shall cover: a. Surveillance of the home: costs of surveillance of the home if the home needs to be protected to make sure goods remaining in the home are not stolen. b. Hotel accommodation: expenses incurred by the insured person for a maximum of 5 nights. The European shall also cover reservation of hotel room(s) and cover transport costs for the insured person if the insured person is unable to get to the hotel by his/her own means. Costs specified under a. and b. shall be reimbursed up to a maximum of 125 per night and per insured person, and up to a maximum of 5 nights. c. Moving household effects: The European shall arrange a suitable vehicle or hire a removal company and cover rental fees to enable the insured person to move objects left behind in the home to a safer place. The European shall cover these costs up to a maximum of LOCKSMITH In the event that the insured person is unable to enter the insured residence due to the theft or loss of house keys, The European shall cover a locksmith s call-out charge and repair costs up to a maximum of EXCLUSIONS AND OBLIGATIONS OF THE INSURED PERSON Refer to sections IV and V of the A. ASSISTANCE cover. II. TRAVEL DELAY INSURANCE 1. COVER The cover intends to provide a travel voucher as compensation in case of delay in reaching the final destination abroad, as stated on the ticket (train or aircraft) that is the object of the current policy. Only tickets for the outbound and inbound journey can be insured. 2. DETERMINATION OF COMPENSATION AMOUNT The European shall award compensation in the form of a travel voucher that can be exchanged at the travel agency where the policy was taken out. The voucher shall be valid up to 1 year after issuance. The amount of the compensation shall be calculated as follows: DELAY IN REACHING FINAL DESTINATION PAYMENT PER INSURED PERSON 2 HOURS 50 3 HOURS 70 4 HOURS 85 6 HOURS OR MORE EXCLUSIONS The European is not obliged to provide cover in case of: a. delay at transfers or transits; b. cancellation of flights or trains by the transport company; c. delays at the place of departure for the return journey; d. exclusions specified in the common policy conditions. 4. OBLIGATIONS OF THE INSURED PERSON The insured person is obliged to: a. have a certificate corroborating the delay drawn up by the carrier (airline or railway company); b. submit a written claim to The European within 7 days after arrival in Belgium; c. conform to the guidelines of The European and submit the following documents: - certificate drawn up by the carrier; - boarding/embarkation card; - ticket; - order form and/or invoice; - a written statement specifying the circumstances that caused the delay. III. CIVIL LIABILITY 1. OBJECT OF THE COVER In compliance with the Royal Decree of 12 January 1984 and 24 December 1992 specifying the minimum guarantee conditions, The European covers, up to the insured amounts, civil liability to which the insured person could be held under Articles 1382 to 1386 bis inclusive of the Belgian Civil Code and under similar decrees in foreign law, due to damage to third parties caused during the private life and during the insured trip. 2. DEFINITIONS Insured person: the person in whose name the policy has been taken out Third party: all persons other than the insured person s family members Private life: all acts, deeds, or negligence, excluding those ensuing from the exercise of a professional activity 3. INSURED AMOUNTS, EXEMPTION, AND INDEXATION a. Cover is provided: - for physical injury up to an amount of 12,500,000 per claim; - for material damage up to an amount of 620,000 per claim. Out-of-court settlements with the Public Prosecution Service, judicial, out-of-court, or administrative fines, as well as the costs of criminal proceedings, shall not be covered by The European; b. a deductible of 125 per claim shall apply in case of material damage. This deductible can neither be reduced in return for additional payment, nor insured; c. the insured amounts and deductible are linked to the development of the consumer price index, whereby the consumer price index of December 1983 or (based on 100 in 1981) is taken as the basic index figure. The index figure applicable to a claim shall be that of the month prior to the claim. 4. COVER EXTENSION IN CERTAIN EXCEPTIONAL CASES a. Pets Cover provided to insured persons for damage caused by the insured person s pets accompanying him/her on the trip. Damage caused by horses owned by the insured person is, however, excluded. b. Journeys and means of transport 1. Cover is provided for insured persons during journeys, also for professional purposes, as pedestrians, owners, holders, or users of bicycles and other unpowered two-wheel vehicles, and as passengers on any kind of means of transport (except for liability cases specified in Belgian and foreign law regarding compulsory motor vehicle insurance). 2. Insofar as motorised or rail-based vehicles subject to compulsory insurance requirements are concerned, cover shall only be provided for damage caused to third parties by insured persons who, without their parents knowledge, without their legal guardians knowledge, and without the owner of the vehicle s knowledge, operate a vehicle prior to reaching the statutory driving age. 3. Damage caused by the following is excluded from cover: - the use of aircraft owned by an insured person or rented or used by him/her. - the use of sailing boats of over 200kg or motorboats owned, rented, or used by the insured c. Damage caused by fire, explosion, or smoke Damage caused by the following is excluded from cover: material damage caused by fire, explosion, or smoke due to fire that is the result of or spread by the building owned, rented, or used by the insured person, except for damage caused in hotels or similar accommodation where the insured persons are staying during a temporary or accidental sojourn, either for private or professional reasons. d. Guarded property Damage to movable and immovable property and to animals cared for by an insured person are excluded from cover. This exclusion is without prejudice to application of Art. 4.a. above. e. Leisure activities Cover is provided for regular leisure activities such as gardening and handicrafts, even for the use of powered equipment required for these activities, as well as the use of toys or small motorassisted gear, either remote-controlled or not, such as small model airplanes or ships. 5. EXCLUSIONS Without prejudice to requirements that are inherent to certain cases specified under Article 4, the following is excluded from cover: a. damage ensuing from civil liability covered by statutorily compulsory insurance (such as motor vehicle insurance that is required by law); b. damage covered by another insurance policy, insofar as this latter policy covers the insured person s liability as stipulated by the Royal Decree of 12 January 1984; c. damage caused by game during the hunt; d. damage ensuing from civil liability of leaders, employees, or organisers of youth organisations for the actions of persons for whom they are responsible; e. damage ensuing from personal civil liability of the insured person who has reached the age of discretion and has caused a claim, either on purpose, or as a result of the use of narcotics, under the influence of alcohol, or due to alcohol intoxication; f. material damage caused by landslides; g. damage or aggravation of damage caused by: - weapons or other gear that is intended to explode due to modification of the composition of the atomic nucleus; - nuclear fuel, radioactive product or waste, or by any other source of ionising radiation and that compromises the exclusive liability of the operator of a nuclear plant; 6

7 h. also excluded are, except in case of special agreement, damage or aggravation of damage caused by any source of ionising radiation (in particular any radioisotope) used or intended for use outside a nuclear plant and which the insured person or any person for whom he/she is responsible holds ownership, usufruct, or is in charge of surveillance. 6. CLAIM a. Claims must be submitted to The European in writing as soon as possible, and no later than 7 days after the event, or, if that is not possible, as soon as reasonably possible. All judicial and extrajudicial documents regarding a claim must be submitted to The European immediately after notification, service, or delivery to the insured person, failing which the insured person must compensate the company for the damage it has suffered. The insured person must go to every reasonable effort to prevent or mitigate the consequences of a liability claim. The insured person must, without delay, provide all expedient information to The European, and answer questions put to him/her, in order to enable The European to assess the circumstances and scope of the claim. The insured person is required to notify The European of any other insurance policies that cover the same risk. Failure to comply with one of the aforementioned obligations on the part of the insured person entitles The European to reduce its performance under the policy to the extent of its loss or refuse to provide cover if the insured person acted with fraudulent intent. b. From the moment The European is held to provide cover and insofar as this cover is invoked, The European shall be obliged to support the insured person within the boundaries of the cover. With regards to interests under civil law and insofar as the interests of The European and the insured person coincide, The European is entitled to, taking the place of the insured person, dispute the claim submitted by the aggrieved party. The European can pay compensation to this latter party if there are grounds to do so. Support provided by The European under the policy does in no way constitute acknowledgement of the insured person s liability and it can also not disadvantage the insured person in any way. c. Steps aimed at reaching a mutual agreement in settling a liability claim are the sole competence of The European.
