5 Carbon Capture and Storage CDM projects UK-based fund on the contractual arrangements, legal due diligence and local law issues for purchasing Certified Emission Reductions (CERs) from wind farm/ landfill gas/hydro/sf6 CDM projects in China, Peru and Brazil. UK-based fund on the contractual arrangements, risk allocation, legal due diligence and local law issues for a series of debt and equity investments, using template documents and intended to realise in addition the acquisition of a stream of CERs, in CDM projects involving reduction of biogas emissions in Thailand and the Philippines. The contracts advised on included a suite of contracts to fund and develop the projects. Central Electricity Board of Mauritius on the procurement of electricity from a 70MW bagasse/coal fired plant in Mauritius which is a candidate for CDM accreditation. Emissions Trading Development and implementation Administrator of the UK s EU Emissions Trading Scheme Registry on the development of their registry terms and conditions ahead of Phase 1 of the EU ETS. Administrator of the UK s Emissions Trading Scheme Registry on the necessary amendments to their registry terms and conditions ahead of Phase 2 of the EU ETS to reflect in particular the possibility of trading and using CERs and ERUs under the EU ETS. UK regulatory body on its potential role as regulator in new carbon trading schemes to be implemented in the UK such as the Carbon Reduction Commitment Pannonpower Rt on the terms of a Consulting and Brokerage Services Agreement and Emissions Reduction Purchase Agreement in relation to sales of emissions reductions arising from the re-powering of an IPP in Hungary. EU ETS Northern Ireland Electricity plc on issues arising out of the EU Emissions Trading Scheme and the preparation of EU emissions allowances reallocation agreements in respect of all contracted power stations in Northern Ireland. Talisman on the group s EU ETS compliance strategy and emission trading transactions by using both ISDA and IETA documentation for emissions trading in the EU, including advising on the various trading platforms. Several energy companies, including Viridian group, in relation to ISDA and IETA documentation for EU emissions trading as well as standalone emissions trading documentation. Japanese power companies on the development of the international greenhouse gas trading market to understand how they could position themselves to take advantage of the emerging market. NIE Energy Limited on disputes regarding the cost-efficient reallocation of emission allowances between all the contracted power stations in Northern Ireland. Gas storage <
6 Emission Swap Transactions Several energy companies in Europe in relation to EUA CER swap transactions by using ISDA documentation. This included making substantial amendments to the standard ISDA documentation to reflect the complexity of such transactions and, in particular, allow for the swap of EUAs against CERs and for the payment of a cash differential from the buyer of EUAs to reflect the different monetary value between both types of credits. Other commodities trading European energy trader on an electronic trading platform. This included advice on a range of products including swaps, options, spreads and virtual IPPs involving trading in coal, power, gas and emissions using both the ISDA and EFET master agreements. Suppliers and a wholesale trader on the master agreements for power trading the ISDA and GTMA agreements. Northern Ireland Electricity plc on its trading and settlement code for IPP access to the market, and subsequently innovative trading and settlement rules for wind energy. European energy trader on master netting agreements and an internet energy exchange participation agreement in respect of transactions relating to the purchase and sale of electricity, natural gas and other energy products.
