3 Your Motorcycle Insurance Policy This insurance is a contract between the insurer and you, the insured. The information that you gave us when entering into this contract must be complete and true to the best of your knowledge and belief. The contract will be in force for any period for which you have paid or agreed to pay and we have accepted or agreed to accept the premium. In return the insurer will insure you against those losses and liabilities detailed in the policy documents during the period referred to in the policy schedule and during any further period for which the insurer may accept premium. If the law of any country in which you are covered by this policy says the insurer must settle a claim which we would not otherwise have paid we can ask you or the person who incurred the liability to pay us that amount. A person or company who was not a party to this contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this policy but this does not affect the right or remedy of a third party which exists or is available apart from that Act. 5 Definitions Relating to your policy To save lengthy repetition wherever the following words or phrases are used in your policy, they will have the precise meanings described below, these definitions only apply to the standard policy and not to the additional policy options which have their own definitions: The Insured/You/Policyholder The person described as the policyholder on the current Certificate of Motor Insurance. Your Motorcycle Any motorcycle described in the Policy Schedule and any other motorcycle for which the details have been supplied to us and a Certificate of Motor Insurance bearing the registration mark of that motorcycle has been delivered to you and remains effective. Motorcycle A mechanically propelled two wheeled vehicle with or without a sidecar or trailer attached. A three wheeled vehicle having two wheels on one axle where the centres of the points of contact of such wheels and the road are less than 18 inches apart shall also be classed as a motorcycle. Policy Schedule Details of you, your motorcycle and the insurance protection provided to you. We/Us/The Insurer The authorised Insurer or Lloyd s syndicate shown at the foot of the Certificate of Motor Insurance and/or on the current Policy Schedule. Most insurers are authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and Prudential Regulation Authority. Some may be authorised in countries outside the UK and subject to limited regulation by the Financial Conduct Authority and the Prudential Regulation Authority in respect of underwriting business in the UK.. The Financial Conduct Authority website which includes a register of all regulated firms can be visited at or they can be contacted on Certificate of Motor Insurance A document that you must have as proof that you have the motor insurance necessary to comply with the law. It shows who can ride your motorcycle, what purposes it can be used for and whether you are permitted to ride other motorcycles. The Certificate of Motor Insurance does not, however, indicate the full policy cover and for this you need to refer to the main text of this policy booklet. Market Value The cost of replacing your motorcycle with one of a similar make, model, age, mileage and condition. Endorsement Changes in the terms of your policy. These are shown in your Policy Schedule. Fire Fire, self ignition, lightning and explosion. Theft Theft or attempted theft, which has been reported to the police. Accessories Additional or supplementary parts of your motorcycle not directly related to its function as a motorcycle. These 1

6 include top boxes, tank bags and other luggage carriers while permanently fitted to your motorcycle. This would not include motorcycle helmets or protective clothing. Territorial Limits Andorra, Austria, Belgium, Channel Islands, Croatia, Cyprus, Czech Republic, Denmark (including the Faroe Islands), Estonia, Finland, France (including Monaco), Germany, Gibraltar, Great Britain, Greece, Hungary, Iceland, Isle of Man, Italy (including San Marino and the Vatican City), Latvia, Lithuania, Luxembourg, Malta, Netherlands, Northern Ireland, Norway, Poland, Portugal, Republic of Ireland, Slovakia, Slovenia, Spain, Sweden, Switzerland (including Liechtenstein). Excess The amount of any claim you will have to pay if your motorcycle is lost, stolen or damaged. Green Card A document required in certain non-eu countries to provide proof that you have the minimum insurance cover required by law to ride in that country. Permitted Riders Any person permitted to drive as described under the section of your effective Certificate of Motor Insurance headed Persons or classes of Persons entitled to drive. Contract This insurance is made up of four important documents: 1) this Insurance Booklet 2) the Certificate of Motor Insurance 3) the Policy Schedule 4) the Statement of Insurance All four documents should be read together as part of the contract. Period of Insurance The dates shown on your current Certificate of Motor Insurance and Policy Schedule. Statement of Insurance The document containing information supplied by you. Policy Cover Statement of Demands and Needs This product meets the demands and needs of those who wish to ensure that in the event of being involved in a motor accident, claims against them by third parties for personal injury or damage to property during the policy terms will be met. Cover may be extended to include, fire, theft and accidental damage to the insured vehicle. The decision to take this product is entirely the customer s and therefore we cannot offer you a personal opinion or recommendation to take it. Policy Cover If the cover shown in the Policy Schedule is: Comprehensive - Sections 1 to 9 inclusive apply. Third Party Fire and Theft - Section 1 is operative only in respect of loss or damage caused directly by fire or theft. Sections 2, 3, 4, 5, 6, 7, 8, 9 are operative. Third Party Only - Section 1 is inoperative. Sections 2, 3, 4, 5, 6, 7, 8, 9 are operative. Law Applicable to Contract you are free to choose the law applicable to this policy. Your policy will be governed by the law of England and Wales unless you and the insurer have agreed otherwise. 2

7 SECTION 1 Loss or damage Loss of or Damage to Your Motorcycle Subject to the exceptions set out below and to the general exceptions and general conditions contained in the policy, if your motorcycle is stolen, damaged or destroyed, we will, at our option, either: pay for your motorcycle to be repaired or replace your motorcycle or pay the amount of the loss or damage. The same cover also applies to accessories and spare parts relating to your motorcycle while these are on your motorcycle. The maximum amount we will pay will be the market value of your motorcycle immediately prior to the loss but not exceeding your estimate of value shown on your Policy Schedule. Accident Recovery If your motorcycle is disabled through loss or damage insured under this policy we will pay: the cost of protection and removal to the nearest repairers. the cost of delivery to you after repair but not exceeding the cost of transporting your motorcycle to your address in Great Britain. New Motorcycle Replacement we will replace your motorcycle with a new motorcycle of the same make and specification (subject to availability) if, within 6 months of purchase new by you: any repair cost or damage covered by the policy exceeds 70% of its list price (including VAT) at the time of purchase: or your motorcycle is stolen and not recovered. Replacement is subject to: your motorcycle being owned by you or having been purchased under a hire purchase or credit sale agreements (any motorcycle the subject of any type of leasing or contract hire agreement is not eligible for replacement). the agreement of any interested hire purchase company. you being the first registered owner of your motorcycle. Exceptions to Section 1 of Your Policy Your policy does not cover the following: 1 loss of use, wear and tear, depreciation, deterioration. 2 mechanical, electrical, electronic, computer failures or breakdowns or breakages. 3 damage to tyres caused by braking or by punctures, cuts or bursts. 4 loss of/or damage to accessories and spare parts by theft if your motorcycle is not stolen at the same time. 5 loss or damage directly occasioned by pressure waves caused by aircraft or other aerial devices travelling at sonic or supersonic speed. 6 loss of or damage to helmets and protective clothing. 7 loss of value following repair. 8 loss or damage arising from theft whilst the ignition keys of your motorcycle have been left in or on your motorcycle. 9 the first amount of any claim specified under Excess details in the schedule. 10 loss of or damage to your motorcycle as a result of legal repossession. 11 any loss or damage caused by theft or attempted theft if the security system fitted to your motorcycle at the time of the loss was not activated and working properly. All keys used to activate/deactivate the alarm/immobiliser fitted to your motorcycle must be submitted to your insurer with the claim form. 12 theft, or attempted theft, that involves somebody lying to get your motorcycle. 13 any extra costs caused by the parts or replacements not being available in the United Kingdom. 14 confiscation or requisition or destruction by or under order of any Government or Public or Local Authority. 15 loss of or damage to your motorcycle deliberately caused by you or anyone riding with your permission. 16 loss of or damage to your motorcycle caused by an inappropriate type or grade of fuel being used. 17 an amount of more than 100 for any one claim for spare parts or accessories fitted. 3

8 SECTION 2 Liability to third parties Liability to Third Parties Subject to the exceptions set out below and to the general exceptions and general conditions contained in the policy, we will insure you in respect of all sums which you may be required to pay by law arising from death or bodily injury to third parties, or damage to their property as a result of an accident caused by: your motorcycle. any trailer while it is being towed by your motorcycle. any sidecar attached to your motorcycle. we will also pay any expenses for which you have our written authority to incur. Except in respect of sums which you may be required to pay arising from the death of or bodily injury to third parties the most we will pay under this section of the policy is 20,000,000 per any one event. This limit is inclusive of all costs and expenses up to 5,000,000. Liability of other Persons Riding Your Motorcycle we will also insure the following persons under this section in respect of all sums which they may be required to pay by law arising from death or bodily injury to third parties or damage to their property as a result of an accident caused by your motorcycle or any trailer while it is being towed by your motorcycle: any person you give permission to ride your motorcycle provided that your effective Certificate of Motor Insurance allows that person to ride. any passenger on your motorcycle, travelling or getting into or out of your sidecar. we will also pay any expenses for which you have our written authority to incur. Except in respect of sums which you may be required to pay arising from the death of or bodily injury to third parties the most we will pay under this section of the policy is 20,000,000 per any one event. This limit is inclusive of all costs and expenses up to 5,000,000. Indemnity to Legal Personal Representatives In the event of the death of anyone insured under this section, we will indemnify his/her legal personal representatives against any liability of the deceased person to the extent that liability is insured under this section. Legal Costs we will pay for: solicitors appointed by us if anyone we insure under this section is represented at a coroner's inquest or fatal accident inquiry or is defending any proceedings in a court of summary jurisdiction. legal services arranged by us up to an amount not exceeding 1000 to defend anyone we insure under this section in the event of proceedings being taken for manslaughter or reckless or dangerous driving causing death, provided that at the time of the occurrence the rider is 21 years of age or more. we will only pay these legal costs if they relate to an incident which is covered under this section. Exceptions to Section 2 The cover under this section will not apply: 1 if any person insured under this section fails to observe the terms exceptions and conditions of this policy as far as they can apply. The cover will also not apply if they can claim under another policy. 2 to death or injury to any employee of the person insured which arises out of or in the course of such employment except where such liability is required to be covered by the Road Traffic Acts. 3 to loss of or damage to property belonging to or in the care of anyone we insure who claims under this section, and to property being conveyed by your motorcycle. 4 in respect of damage to any motorcycle where cover in connection with the riding of the motorcycle is provided by this section. 5 if being used in or on restricted areas of airports or airfields. We will not pay for any claim concerning an aircraft within the boundary of the airport or airfield. 4

9 6 to death or bodily injury to any person or damage to property caused by pollution or contamination unless the pollution or contamination is directly caused by a sudden identifiable, unintended and unexpected incident during the period of insurance. We will treat all pollution and contamination arising from one incident as having happened at the time of the incident. This exception does not apply when any compulsory motor insurance legislation operating within this policy's territorial limits must be met. 7 for fines, penalties, punitive exemplary or aggravated damages of any kind or any additional damages resulting from the multiplication of compensatory damages. 8 to any amount over 20,000,000 for any one claim or series of claims arising from one event that causes loss or damage to property. This limit is inclusive of all costs and expenses up to 5,000,000. These limits do not apply to claims occurring in other countries where the territorial limits and green card section is operative if the maximum liability required by law in that country is greater. SECTION 3 Payments Payments made under Compulsory Insurance Regulations and Rights of Recovery If the law of any country in which this policy operates requires us to settle a claim which, if this law had not existed, we would not be obliged to pay, we reserve the right to recover such payments from you or from the person who incurred the liability. SECTION 4 Emergency Treatment Emergency Treatment we will reimburse any person using any motorcycle which is covered under this policy for payments made under the Road Traffic Acts for emergency treatment. A payment under this section will not prejudice your No Claims Discount. SECTION 5 Continental Use Continental Use/Compulsory Insurance Requirements In compliance with EU directives this policy provides, as a minimum, the necessary cover to comply with the laws on the compulsory insurance of motor vehicles in: any country which is a member of the European Union. any country which the Commission of the European Communities is satisfied has made arrangements to meet the requirements of Article 7(2) of EC Directive 72/166/CEE relating to civil liabilities arising from the use of a motor vehicle. Cover under this section includes Transit by sea, air or rail in or between countries within the territorial limits provided it is by a recognised route which takes 65 hours or less under normal conditions or via the Channel Tunnel fixed link. Reimbursement of any customs duty you may have to pay after temporarily importing your motorcycle into any country within the territorial limits, subject to your liability arising as a direct result of a claim covered under this policy. 5

10 General Average contributions, Salvage charges and Labour charges whilst your motorcycle is being transported by sea within any countries within the territorial limits, provided that your motorcycle is covered for loss or damage under this policy. Subject to your motorcycle normally being kept in Great Britain this policy provides the cover shown in the Policy Schedule in any country in the territorial limits subject to you not exceeding 45 days in any one period of insurance. A green card will not be issued as this is not necessary for cross border travel and your Certificate of Motor Insurance should, therefore, provide sufficient evidence that you are complying with the laws on the compulsory insurance of motor vehicles in any of these countries that you visit. There is no cover for countries outside the territorial limits. If you cannot ride the motorcycle because of loss or damage covered by this policy, we will also pay the cost of delivering it to your address in the United Kingdom. we will also pay the amount of customs duty you have to pay as result of the loss or damage. SECTION 6 No Claims Discount No Claims Discount If you or others do not make a claim under this policy we will reduce the premium you pay when you renew it according to our current scale of no claims discount. If a claim is made or arises before the renewal date and your No Claims Discount is not protected or guaranteed your no claims discount entitlement will be reduced at renewal in accordance with the step-back scale printed on your current Policy Schedule. we will not give any proof of your no claims discount unless you have paid all the premiums you owe. we will not reduce your no claims discount if we pay a claim for emergency medical treatment because payment is needed under the Road Traffic Acts. Protected or Guaranteed No Claims Discount If a protected or guaranteed no claims discount applies the appropriate endorsement is shown on your current Policy Schedule. SECTION 7 Making a Claim If you need to make a claim, phone the Customer Claim Line telephone number shown on the back cover of this policy. Four important points to help you after an accident: make a note of the registration number of any vehicles involved, and any witnesses; do not admit responsibility; ask for the names, addresses and telephone numbers of all people involved and details of any property damaged; if anyone other than you is injured in the accident, you must show your Certificate of Motor Insurance to the police. If you cannot do this at the time of the accident, take it to the police as soon as possible or within 24 hours. 6

11 SECTION 8 General Exceptions General Exceptions Your policy does not cover the following: 1 Any accident, injury, loss or damage while any motorcycle insured under this policy is being: used otherwise than for the purposes described under the Limitations as to Use section of your effective Certificate of Motor Insurance. ridden by any person other than as described under the section of your effective Certificate of Motor Insurance headed "Persons or Classes of Persons entitled to ride" ridden by you unless you hold a licence to ride your motorcycle or you have held a licence and are not disqualified from holding or obtaining such a licence. ridden by anyone else with your general consent who, to your knowledge, does not have a licence to ride your motorcycle, has never held one or is disqualified from holding or obtaining such a licence. ridden by, or is in the charge of for the purpose of being ridden by any person to whom your motorcycle has been hired. ridden by or in the charge of any person who holds a provisional driving licence and does not keep to the conditions of that licence. 2 any liability you have accepted solely by virtue of an agreement but which would not attach if that agreement did not exist. 3 loss or destruction of or damage to any property whatsoever, or any loss or expense whatsoever, resulting or arising from: any legal liability, of whatsoever nature directly or indirectly, caused by or contributed to by, or arising from: i) ionising radiation or contamination by radioactivity from an irradiated nuclear fuel or from any nuclear waste from the combustion of nuclear fuel. ii) the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof. 4 any consequence of war, invasion, act of foreign enemy hostilities (whether war be declared or not), civil war, rebellion, revolution, terrorism (as described in the Terrorism Act 2000 or equivalent legislation in any other country), insurrection of military or usurped power except so far as is necessary to meet the requirements of the Road Traffic Acts. 5 any accident, injury, loss or damage (except under Section 2) arising during or in consequence of: a) earthquake b) riot or civil commotion occurring outside of Great Britain, the Isle of Man or the Channel Islands. 6 legal liability arising out of any judgement in any court outside the territories to which your policy applies. 7 if being used in or on restricted areas of airports or airfields. We will not pay for any claim concerning an aircraft within the boundary of the airport or airfield. 8 death or bodily injury to any person or damage to property caused by pollution or contamination unless the pollution or contamination is directly caused by a sudden identifiable, unintended and unexpected incident during the period of insurance. We will treat all pollution and contamination arising from one incident as having happened at the time of the incident. This exception does not apply when any compulsory motor insurance legislation operating within this policy's territorial limits must be met. 9 being ridden in an unroadworthy, unsafe or damaged condition or does not have a valid MOT Certificate when needed. 10being ridden with a load or a number of passengers which is unsafe. 7

12 SECTION 9 General Conditions Cancelling your Policy If you wish to cancel this policy within 14 days of the start of the policy or 14 days of receipt of the policy documents (if later) you may do so by writing to or calling the administrator and returning your Certificate of Motor Insurance. Where this happens you will receive a proportionate refund of the premium paid for the unexpired portion of the period of cover less any agreed charges detailed in the terms of business. After 14 days of receipt of your policy documents you may cancel this policy by writing to the administrator and returning your Certificate of Motor Insurance. Where this happens you will receive a proportionate refund of the premium paid (see scale below) less any agreed charges detailed in the terms of business, provided: you have returned the Certificate of Motor Insurance; and you have paid the premium in full; and a claim has not been made where no recovery occurred during the current period of insurance. The administrator or we may cancel your policy where there is a valid reason to do so by giving you 7 days notice by letter to your last known address. You will receive a proportionate refund of the premium paid (see scale below) less any agreed charges detailed in the terms of business, provided: you have returned the Certificate of Motor Insurance; and you have paid the premium in full; and a claim has not been made where no recovery occurred during the current period of insurance. If you or we cancel this policy and there has been a claim during the current period of insurance and the premium is being paid by instalments, the outstanding balance including interest charges will become payable by you. If you miss a premium If you are paying your premium by monthly installments on direct debit we reserve the right to apply a charge for unsuccessful collection of a monthly installment. Please refer to the Administrator s Terms of Business and Important Details. 8

13 Claims As soon as possible after any accident, injury, loss or damage, you or your legal personal representatives must give us full details of the incident. Any communication you receive about the incident should be sent to us immediately unanswered. you or your legal personal representatives must also let us know immediately if anyone insured under this policy is to be prosecuted as a result of the incident or if there is to be an inquest in connection of a fatal accident. You, or anyone else claiming under this policy, must not admit to any claim, promise any payment or refuse any claim without our written consent. If we want to, we can take over and conduct in your name, or in the name of the person claiming under the policy, the defence or settlement of any claim or take proceedings for our own benefit to recover any payment we have made under this policy. we shall have full discretion in the conduct of any proceedings or the settlement of any claim. The person who is seeking payment under this policy shall give us all the information and assistance necessary for us to achieve a settlement. if at the time of any claim arising under this policy there is any other insurance policy covering the same loss, damage or liability, we will only pay our share of the claim, this provision will not place any obligation upon us to accept any liability under Section 2 which we would otherwise be entitled to exclude under Exception 1 to Section 2. you shall at all times take all steps to safeguard your motorcycle from loss or damage. you shall maintain your motorcycle in an efficient roadworthy condition and we shall have, at all times, free access to examine such motorcycle and trailer. under the laws of any country where this policy applies we may have to make payments which are not insured by this policy. you or the person who caused the accident must repay us any money which we have paid because of the law of the country in which this policy applies which we would not otherwise have paid. you or the person who caused the accident must also repay to us any money we had to pay because of any agreement with the Motor Insurers Bureau. our provision of insurance under this policy is conditional upon you observing and fulfiling the terms, provisions, conditions and endorsements of this policy. if any claim is in any way fraudulent or if you or anyone acting on your behalf has used any fraudulent means, including inflating or exaggerating the claim or submitting forged or falsified documents, all benefits and premiums under the policy shall be forfeited. Changes to your details All information you give us verbally or in writing during a quote, the sale of insurance, when renewing your policy, making changes to your insurance or making a claim must be accurate and complete to the best of your knowledge and belief. You need to tell us about any changes to the information on your Statement of Insurance as soon as you are aware these details are incorrect or have changed. Changes to your policy may affect the terms of your policy and the premium you pay. Failure to notify us of changes or to disclose information accurately could invalidate your policy or claims made under it. Endorsements Certain Endorsements apply to this policy which are shown on your current Policy Schedule. These must be read in conjunction with this policy document. 9

However, occasionally disputes or misunderstandings can happen. If you have any enquiry or complaint about us or your policy or a claim made under it, you should first phone Customer Services on the telephone number shown on the back cover of this policy. or write to... Referral to FOS will not affect your right to take legal action against the administrator or The Insurer. Financial Services Compensation Scheme If your insurer or administrator were unable to meet our obligations you might be entitled to compensation under the Financial Services Compensation Scheme (FSCS). 15 SECTION 10 Optional Motorcycle Legal Protection Your policy schedule will indicate if you have taken out the cover under this part of the policy. Cover under this part of the policy is underwritten by Inter Partner Assistance SA with services provided on their behalf by Arc Legal Assistance Limited and Carpenters Solicitors. Your Motor Legal Protection is provided to you by Carpenters Solicitors through BDML Connect Limited, who arrange and administer the policy. If you are involved in a motor accident, we are here to help you 24 hours a day, 365 days a year. Motor accidents are always stressful, particularly if you or a passenger has been injured. The last thing you need is a long and expensive legal dispute to worry about. This is where Motor Legal Expenses Insurance can help. If you are involved in an accident which is caused by a third party you have a legal right to claim back your uninsured losses from the person who caused the accident. In addition a Legal Helpline is available to you for advice on any private legal problem by telephoning There is nothing to pay beyond the cost of the call. Uninsured losses can include the following: Compensation for you if you are injured, or compensation for your family in the event that you incur fatal injuries. Your policy excess that you may have to pay under your comprehensive motor policy. If we can recover your losses in full, your no claims bonus should not be affected. Reasonable hire charges for a replacement vehicle while yours is being repaired or compensation for you not being able to use your vehicle. What to do after an accident If you are involved in an accident, remember to write down as many details as possible, including the names and addresses of anyone who may have seen the accident. Let us have this information as soon as you can by calling us on the number on the back cover of this booklet, 24 hours a day, 365 days a year. Definitions Adviser A Carpenters solicitor or other specialist panel solicitors or their agents appointed by Us to act for You, or, where agreed by Us, another legal representative nominated by You. Advisers Costs Reasonable legal costs incurred by the Adviser. Third party s costs shall be covered if awarded against You. Conflict of Interest There is a conflict of interest if We administer and / or arrange legal expenses insurance on behalf of any other party in the dispute which is the subject of a claim under this insurance. Insured Incident The incident or the first of a series of incidents which may lead to a claim under this insurance. Only one Insured Incident shall be deemed to have arisen from all causes of action, incidents or events that are related by cause or by time. 11

16 Insured Period The period of insurance stated on Your Schedule. Legal Action The pursuit of civil proceedings and appeals against judgement following a Road Traffic Accident Maximum Amount Payable The maximum amount payable in respect of an Insured Incident as indicated in Your Schedule. Road Traffic Accident A traffic accident involving the Vehicle occurring during the Insured Period for which You are not at fault and for which another known insured party is at fault. Standard Advisers Costs The level of Advisers Costs that would normally be incurred by Underwriters in using a nominated Adviser of Our choice. Territorial Limits Great Britain, Northern Ireland, Channel Islands and the Isle of Man. Underwriter(s) Inter Partner Assistance S.A. Vehicle The motor vehicle covered by Your Schedule including a caravan or trailer whilst attached to it. We/Us/Our Arc Legal Assistance Ltd You/Your The person responsible for insuring the Vehicle and named as the policyholder. This is extended to include the authorised driver and passengers for Uninsured Loss Recovery and Personal Injury. What is insured You are covered for Advisers Costs to pursue damages claims arising from a Road Traffic Accident: i whilst You are in, boarding or alighting the Vehicle against those whose negligence has caused Your injury or death, and/or ii against those whose negligence has caused You to suffer loss of Your insurance policy excess or other out of pocket expenses. If a claim is accepted under this insurance, We will appoint Our panel solicitors, or their agents, to handle Your case. You are not covered for any other legal representatives fees unless it is necessary to start court proceedings or a Conflict of Interest arises. Where it is necessary to start court proceedings or a Conflict of Interest arises and You want to use a legal representative of Your own choice, You will be responsible for any Advisers Costs in excess of Our Standard Advisers Costs. The insurance covers Advisors Costs as detailed under the separate sections of cover, up to the Maximum Amount Payable where:- a The Insured Incident takes place in the Insured Period and within the European Union, the Isle of Man and the Channel Islands; and b The Legal Action takes place within the Territorial Limits. This insurance does not provide cover where something You do or fail to do prejudices Your position or the position of the Insurer in connection with the Legal Action. 12

17 What is not insured:- Claims Relating to an agreement You have entered into with another person or organisation Directly or indirectly arising from stress, psychological or emotional injury For Applications for payment to the Motor Insurers Bureau under the Untraced Driver's Agreement, or Uninsured Driver's Agreement or any future agreements funded by the Motor Insurers Bureau There is no cover: - Where the Insured Incident occurred before You purchased this insurance Where You fail to give proper instructions to Us or the Adviser or fail to respond to a request for information or attendance by the Adviser Where You have provided any false, inaccurate or misleading information. Where Advisers Costs have not been agreed in advance or exceed those for which We have given Our prior written approval For Advisers Costs incurred in avoidable correspondence or which are recoverable from a court, tribunal or other party Where You have alternative insurance cover For claims made by or against the Underwriters, Us or the Adviser Where Your motor insurer repudiates the motor insurance policy or refuses indemnity For any claim arising from racing, rallies, competitions or trials For an application for Judicial Review For appeals without Our prior written consent For any Legal Action that We reasonably believe to be false, fraudulent, exaggerated or where You have made misrepresentations to the Adviser Where at the time of the Insured Incident in which You were driving the Vehicle, You were disqualified from driving, did not hold a licence to drive or the Vehicle did not have a valid MOT certificate or Tax Disc or comply with any laws relating to its ownership or use For disputes between the Adviser and any other party which is solely over the level of Advisers Costs Conditions 1 Claims a You must notify Us as soon as possible and within a maximum of 180 days once You become aware of the Insured Incident. There will be no cover under this policy if, as a result of a delay in reporting the claim Our position has been prejudiced. To report a claim You must follow the instructions under What to do after an accident above. b c d We shall appoint the Adviser to act on Your behalf. We may investigate the claim and take over and conduct the Legal Action in Your name. Subject to Your consent which must not be unreasonably withheld, We may reach a settlement of the Action. You must supply at Your own expense all of the information which We reasonably require and ask You for to decide whether a claim may be accepted. If court proceedings are issued or a Conflict of Interest arises, and You wish to nominate a legal representative to act for You, You may do so. Where You have elected to use a legal representative of 13

18 Your own choice You will be responsible for any Advisers Costs in excess of Our Standard Advisers Costs. The Adviser must represent You in accordance with Our standard conditions of appointment which are available on request. e The Adviser must: - i Provide a detailed view of Your prospects of success including the prospects of enforcing any judgement obtained without charge. ii Keep Us fully advised of all developments and provide such information as We have requested. iii Keep Us regularly advised of Advisers Costs incurred. iv Advise Us of any offers to settle and payments in to court. If against Our advice such offers or payments are not accepted there shall be no further cover for Advisers Costs unless We agree in Our absolute discretion to allow the case to proceed. v Submit bills for assessment or certification by the appropriate body if requested by Us. vi Attempt recovery of costs from third parties. vii Agree with Us not to submit a bill for Advisers Costs to Underwriters until conclusion of the Legal Action. f g h i j In the event of a dispute arising as to costs We may require You to change Adviser. Underwriters shall only be liable for costs for work expressly authorised by Us in writing and undertaken while there are reasonable prospects of success. You shall supply all information requested by the Adviser and Us. You are responsible for any Advisers Costs if You withdraw from the Legal Action without Our prior consent. Any costs already paid by Us must be reimbursed by You. You must instruct the Adviser to provide Us with all information that We ask for and report to Us as We direct at their own cost. 2 Disputes Any disputes between You and Us in relation to Our assessment of Your prospects of success in the case or nomination of solicitor may, where We both agree, be referred to an arbitrator who shall be either a solicitor or a barrister. If the parties cannot agree on their choice of arbitrator the Law Society may be asked to make a nomination. The arbitration shall be binding and carried out in accordance with the Arbitration Act. The costs of the arbitration shall be at the discretion of the arbitrator. 3 Prospects of Success At any time We may, but only when supported by independent legal advice, form the view that You do not have a more than 50% chance of winning the case and achieving a positive outcome. If so, We may decline support or any further support. Examples of a positive outcome are: a Being able to recover the amount of money at stake b Being able to enforce a judgement c Being able to achieve an outcome which best serves Your interests 4 English Law This contract is governed by English Law unless otherwise agreed. 5 Language The language for contractual terms and communication will be English. 14

19 6 Cancellation We hope You are happy with the cover this policy provides. However, You have the right to cancel it within 14 days of receiving the policy, without giving any reason by contacting Your insurance adviser. If You do cancel in the first 14 days, We will refund any premium paid subject to no claim being made on the policy. After the first 14 days You may cancel this insurance at any time by providing fourteen days written notice to Your insurance adviser but no refund of premium will be provided. Your insurance adviser or Us may cancel the insurance by giving fourteen days notice in writing to You at Your last known address advised to Your insurance adviser, if this happens You will receive a refund of the premium paid providing You have not claimed against the policy. 7 Data Protection Act Your details and details of Your insurance cover and claims will be held by Us and/or the Underwriters for underwriting, processing, claims handling and fraud prevention, subject to the provisions of the Data Protection Act Customer Service We aim to get it right, first time, every time. If We make a mistake, We will try to put it right promptly. If You are unhappy with the service that has been provided, You should contact Us at the address below. We will always confirm to You, within five working days, that We have received Your complaint. Within four weeks You will receive either a final response or an explanation of why the complaint is not yet resolved plus an indication of when a final response will be provided. Within eight weeks of Us receiving Your complaint, You will receive a final response or, if this is not possible, a reason for the delay plus an indication of when a final response will be provided. At this point, if You are not satisfied with the delay, You may refer the matter to the Financial Ombudsman Service. You can also refer to the Financial Ombudsman Service if You are not happy with Our final response. 21 SECTION 11 Your Questions Answered This does not form any part of the policy and is for peace of mind only. I am at the scene of the accident - what do I do? a) Note the registration number of the other vehicle(s) involved. b) Ask the names, addresses and telephone numbers of the other people involved and any witnesses. Also ask for the name, address and policy number of the other party s insurer. c) Make a sketch plan of the scene of the accident and make a note of the road name, and the address of any property that has been damaged. d) Do not admit responsibility or sign any statement to this effect. It is appreciated that due to the circumstances of the incident this may cause offence to the other party involved. Your best response is to state that your insurance policy prohibits you from admitting liability without your Insurer s written agreement. e) If the accident results in damage to another vehicle, an animal or other property, to comply with the Law you must stop and give your name and address,and registration particulars of the vehicle (along with the owner s name and address, if different) to anybody requiring the information. f) If anyone other than yourself is injured you must show your Certificate of Motor Insurance to the police or to any other person reasonably asking. If you cannot do this at the time of the accident, report the accident to the Police as soon as possible and, in any case, within 24 hours. g) If you have caused damage to another vehicle or property, you must also show your Certificate of Motor Insurance to any person reasonably requiring you to do so. My vehicle is disabled - what should I do? If your cover is Comprehensive the reasonable cost of removal of your vehicle will form part of your claim against your Insurer, subject to the deduction of an excess applicable. If, however, you do not have Comprehensive cover then you must make your own arrangements to have the vehicle removed at your own expense. If the accident was not your responsibility then you may be able to recover the cost from the other party involved. How do I inform my insurer of the accident? Call the Customer Claim Line telephone number shown on the back cover of this policy. They will arrange for a report form to be sent to you for completion and will give you initial advice on how the claim may proceed. If you are only reporting an accident and do not intend to make a claim under your policy, it is still necessary to complete an accident report form. You should, in these circumstances, place a tick in the box at the top of the form to state that the accident report is for information purposes only. As a result of the accident, my vehicle has been damaged - can I go ahead and get it repaired? If you have Comprehensive cover and wish to claim under your policy, specific instructions will be given to you when you contact the Administrator to notify them of the accident. you should not authorise repairs without our approval. If you are not insured for Comprehensive risks then your own damage is not covered under your policy and you are therefore free to arrange repairs, at your own expense, at a garage of your choice. If the accident was not your responsibility you may be able to recover the cost from the other party involved. I have now received a report form - what do I do? Ensure that you complete every question on the form - providing as much detail as possible. Date and sign the form where indicated and return to sender. The processing of many claims is substantially delayed by the policyholder failing to provide full information or omitting to include details requested. 17

22 Your Questions Answered - continued I have received some correspondence relating to the accident - do I answer it myself? It is a requirement of your policy to notify your Insurer of every letter, claim, writ, summons and any other document that you receive. Please forward any correspondence received immediately to your Insurer (do not answer or acknowledge it). You must also tell us of any impending prosecution, coroner s inquest or fatal accident inquiry involving any person insured by the policy. The other party involved in the claim seemed a reasonable person, can I negotiate my claim with them? No, you should not enter into any negotiation yourself with Third Parties relating to any claim which you are making under your own insurance policy. My vehicle has now been repaired and the garage has asked me to pay them the Policy Excess - should I pay them? Yes, but only if you are satisfied with the quality of the repair. You should always obtain a receipt as this will be required if a claim for uninsured losses is to be pursued. Am I entitled to hire a vehicle whilst my vehicle is off the road? Not under your policy. If the accident is the fault of someone else and you feel it is necessary to hire alternative transport then it may be possible to recover your outlay against the other party. Just because someone damages your vehicle it does not necessarily mean you can go out and hire another vehicle at their expense. Will the accident affect my No Claim Discount? It is important to appreciate that your Insurer provides a no claim discount - not a no blame discount - for example, if your vehicle is parked and is hit by another vehicle whose driver leaves the scene without providing his name and address then unfortunately if you make a claim under your policy (except for windscreen/glass breakage) your entitlement to a no claim discount will be affected. However, this would not have been so if your Insurer had been able to recover their outlay in full from the guilty party. If you enjoy no claim discount protection under your policy your entitlement will not be affected provided you have not exceeded the permitted number of claims. You should refer to the no claim discount clause on your policy schedule and if you are in any doubt please ring the Administrator. My windscreen has been smashed - how can I arrange for a replacement? Provided that windscreen/glass is covered by your policy you can: a) Contact our approved glass repairer for a replacement (refer to Part 5 of this policy). You will be required to pay the excess and our approved glass repairer will invoice your Insurer for the balance. This excess is not payable if the glass is repaired and not replaced. b) Pay for the repair/replacement and claim back the cost, less the excess from your Insurer. If you chose not to use our approved glass repairer then you must obtain a claim form from the administrator and then send this to your Insurer, fully completed, together with the receipted account for repair/replacement. Your Insurer will then reimburse, less the excess, up to a maximum value of 150 in respect of any one occurrence. My insurer tells me my vehicle is a write-off - how much should I settle for? Many people think that if their vehicle is a write-off they are entitled to sufficient money to be able to purchase a similar vehicle from the Motor Trade. In fact, the basis of motor insurance write-off payment is for the Insurer to pay the Insured the amount of money that could have reasonably been expected for the sale of the vehicle on the open market immediately prior to the damage occurring. If, however, your vehicle is within one year of its first registration by you please refer to your motor insurance policy. With certain Insurers your entitlement is limited to the market value of your vehicle. If this limit applies then your policy schedule will have been endorsed accordingly. The damage to my vehicle is not severe - should I claim? There are many considerations which you should take into account - such as the policy excess which will be deducted, the potential loss of your no claim discount, whether or not the other party is going to claim against your policy - which may affect your discount entitlement. You have a duty to inform the administrator of the incident and if you have any doubts over whether you should claim or not this would be an opportune time to discuss it with them. 18
