The defeat of California s Prop 46 last November would seem to suggest that the once trend-setting limit on medical malpractice liability is here to stay both in California and well over half the states. This concept of limiting liability was reaffirmed in Howell v Hamilton Meats, leading to subsequent cases holding that the reasonable value of the medical services for tortiously caused injuries is the reasonable value of the medical services paid, not billed.
