(ProFac) to conduct surveys for asbestos and other designated substances within buildings in the ORC Eastern Ontario portfolio, and provide recommendations for the management, repair or removal of identified designated substances. ORC has implemented an asbestos management program for use at all buildings where asbestos-containing materials are present, to comply with the requirements of Ontario Regulation 278/05. This survey meets the building owner s legal obligations to maintain a record of asbestos containing materials, as required by Ontario Regulation (O.Reg.) 278/05 Designated Substance: Asbestos on Construction Projects and in Buildings and Repair Operations, and the requirement to maintain a record of materials containing the 11 designated substances listed in the Occupational Health and Safety Act, as required by Section 30 of the, R.S.O. 1990, Chapter 0.1. DST performed an asbestos and designated substance survey of the MTO Regional Office Installation (N00724) in Kingston, Ontario, on November 26 th to the 30 th and on December 19 th, The following tables summarize the findings and recommendations for each individual building surveyed. Details of the findings and recommendations can be found in the survey report and appendices. B11145 Regional Office Designated Substance Findings Asbestos The following friable ACMs were identified: Grey cement compound pipe fitting insulation The following non-friable ACMs were identified: Transite Paneling 9 x9 Vinyl floor tiles Exterior tar duct insulation Window caulking (suspected) Drainpipe joint packing (suspected) Roofing materials (suspected) Lead Lead levels detected in the paint samples analysed were low, less than 5,000 ppm but greater than 600 ppm. Lead may be present as a normal constituent in ceramic tile glazing, solder on copper pipes, emergency light batteries and cast iron drainpipe caulking. Mercury Mercury may be present as a normal constituent in fluorescent light tubes and thermometers. Recommendations Damaged asbestos-containing grey cement compound pipe insulation must be removed from one elbow in the west mechanical penthouse. Benzene may be present as a normal constituent of the fuel in the emergency generator fuel storage tank. B11146 Repair Garage Designated Substance Findings Asbestos Friable asbestos-containing materials (ACMs) were not identified in the building. The following non-friable ACMs were identified: Transite 12 x12 Vinyl floor tile Vinyl Sheet Flooring Roofing Material (Suspected ACM) Lead Lead levels detected in the paint samples analysed were low (<5,000 ppm but greater than 600 ppm), with the exception of one sample that had 160,000 ppm lead. The countertops in the ground floor Battery Room are constructed of a soft malleable metal, suspected to be lead. Lead may be present as a normal constituent in ceramic tile glazing, solder on copper pipes, emergency light batteries and cast iron drainpipe caulking. Mercury Mercury may be present as a normal constituent in fluorescent light tubes and thermometers. Silica Silica is present as a normal constituent in concrete building materials, plasters and in ceramic tiles. Recommendations A transite panel on top of a cabinet in the mechanical room must be removed. It appears to have been used as a cutting board. Other detailed recommendations concerning ACMs are outlined in the report. The grey floor paint sample that had the high concentration of lead was peeling throughout the second floor and is recommended for removal or repair. (ProFac) to conduct surveys for asbestos and other designated substances within buildings in the ORC Eastern Ontario portfolio, and provide recommendations for the management, repair or removal of identified designated substances. This survey meets the building owner s legal obligations to maintain a record of asbestos containing materials (ACMs), as required by Ontario Regulation (O.Reg.) 278/05 Designated Substance: Asbestos on Construction Projects and in Buildings and Repair Operations, and the requirement to maintain a record of materials containing the 11 designated substances listed in the Occupational Health and Safety Act, as required by Section 30 of the, R.S.O. 1990, Chapter Scope of Work The major tasks of the survey program were to: Conduct surveys for ACMs and other designated substances for designated buildings of each installation; Collect and analyze the required number of suspect ACM samples to satisfy the requirements of O.Reg. 278/05; Collect and analyze paint chip samples of representative paint coatings of suspected lead-based paints in each building; Provide a summary of findings and recommendations for each installation including: o prioritized recommendations for remediation work; o digital photographs illustrating the location and current condition of representative ACMs (principally those for which high priority recommendations are provided) and other designated substances; o floor plans illustrating locations of samples collected; o recommendations for the remediation of any deficient or degraded condition ACMs and other designated substances; and o supply, host, and maintain an online updatable database accessible to ORC and ProFac with observations and findings for each building. Results of the asbestos and other designated substances survey are documented in individual reports for each ORC installation surveyed. Information for all buildings surveyed within an installation is grouped within the report for that installation Background Information Asbestos Asbestos is a naturally occurring form of fibrous silicate minerals. Asbestos has historically been added to a wide variety of building materials due to several beneficial properties, including DST CONSULTING ENGINEERS INC.

10 Survey Report: Asbestos and other Designated Substances Page 2 MTO Regional Office (N00724), Kingston, Ontario DST File No.: BE-OT March 30, 2008 durability, flexibility, high tensile strength, and resistance to heat, wear and corrosion. Historically, asbestos has been known to be added to the following materials: spray-on or trowel-applied fireproofing and acoustic plaster, drywall joint compound, thermal insulation, gaskets, flooring, ceiling tiles, roofing, coatings, cement products (transite), and various other miscellaneous materials. ACMs are commonly divided into two types, friable and non-friable. Friable materials can be easily crushed by hand pressure and readily release fibres when disturbed. Friable materials include such things as thermal insulation on pipes and other mechanical equipment, and ceiling tiles. The regulations include materials that are crumbled, pulverized or powdered (i.e., asbestos-containing debris) as friable. Non-friable materials generally release fibres when they are cut or shaped, and include such products as floor tiles, intact hard plaster finishes, and asbestos cement products. Some non-friable materials may become friable when damaged, such as by water infiltration or weathering. Asbestos fibres can become airborne when ACMs are disturbed. Inhalation of airborne asbestos fibres in significant quantities poses health risks and can cause asbestosis (a scarring of the lungs which makes breathing difficult), mesothelioma (a rare cancer of the lining of the chest or abdominal cavity) or lung cancer. Asbestos is a designated substance regulated under the Ontario Occupational Health and Safety Act (OHSA), R.S.O. 1990, Chapter O.1, as amended. In Ontario, a material is defined as an asbestos-containing material if the material has an asbestos content of 0.5% or more. The disturbance of ACMs on construction and building maintenance projects is controlled by the O.Reg. 278/05, Designated Substance Asbestos on Construction Projects and in Buildings and Repair Operations. This Regulation classifies all asbestos work procedures as Type 1, Type 2, or Type 3, each of which has defined precautionary measures. All ACMs are subject to specific handling and disposal precautions, and must be removed before partial or full demolition, or prior to performing work that may disturb the ACMs. The Ministry of Labour must be notified of any project involving removal of more than a minor amount of friable asbestos material. In Ontario, the time-weighted average exposure limit for a worker to airborne asbestos is 0.1 fibres per cubic centimeter (f/cc) of air, as defined in O.Reg. 837, Designated Substance Asbestos, as amended. Disposal of asbestos waste is controlled by the Ontario Environmental Protection Act, R.R.O., 1990, Regulation 347, General Waste Management, as amended by O.Reg. 395/07. This regulation requires that asbestos waste be sealed in double containers resistant to puncture and tears, and appropriately labeled. The waste must be disposed at a licensed waste disposal site. Proper notification must be issued to the site representative prior to transportation of waste. The transport of the waste to the disposal site is controlled by the federal Transportation of Dangerous Goods Act, 1992 (TDGA). DST CONSULTING ENGINEERS INC.

11 Survey Report: Asbestos and other Designated Substances Page 3 MTO Regional Office (N00724), Kingston, Ontario DST File No.: BE-OT March 30, Lead Lead has been used in numerous building materials, coatings, mechanical and electrical equipment, and other objects that are often found in buildings. Lead can be found in the following materials and products: paints, ceramic glazes, pipe solder, caulking in drainpipes, lead-acid batteries, munitions, and as shielding around equipment. The Occupational Health and Safety (OHS) Branch of the Ontario Ministry of Labour (MoL) has published the document Guideline: Lead on Construction Projects. This document classifies all disturbances of lead-containing materials as Type 1, Type 2a, Type 2b, Type 3a or Type 3b work, based on presumed airborne concentrations of lead generated during the work. The MoL assigns different levels of respiratory protection and work procedures for each classification. The Occupational Exposure Limit (OEL) for inorganic lead in air is 0.05 mg/m 3, as prescribed by Ontario Regulation 843, Designated Substance Lead, as amended by O.Reg. 109/04. The OEL is an 8-hour daily or 40-hour weekly time-weighted average. Work procedures and personal protective equipment must be used to ensure that workers are not exposed to airborne lead levels that exceed this OEL. The disposal of construction waste containing lead is governed by O.Reg. 347, as amended. The classification of the waste in this regulation is dependent upon the results of a leachate test. The transport of the waste to a disposal site is controlled by the federal TDGA. Although the MoL has published a guideline for control of lead exposures on construction projects, it does not include criteria for the classification of lead-paint. Instead, it uses presumed airborne lead concentrations as criteria for classifying work. However, in regulations set by the U.S. Department of Housing and Urban Development, Lead-Based Paint is classified as any paint application containing at least 1.0 milligrams of lead per square centimetre of surface area (1.0 mg/cm2), or at least 0.5% lead content by weight (5,000 ppm). This criteria was widely, although not universally, used in Canada. In Canada, the Federal Hazardous Product Act has recently lowered the allowable concentration of lead in paints for new consumer products to 0.06% lead content by weight (600 ppm) Mercury Mercury is a transitional metal that is liquid at room temperature. Numerous reports have cited mercury as being highly toxic, in particular to children and the fetus. Mercury can be found in the following equipment often found as part of mechanical systems in buildings: thermostats, barometers, thermometers, pressure gauges, and electrical switches. Fluorescent light tubes contain mercury vapour equivalent to a single droplet of liquid mercury. There are no regulations that specifically govern the disturbance of mercury on construction projects. However, the OHS Branch of the MoL has published The Safe Handling of Mercury: A Guide for the Construction Industry. This document provides advice on how to reduce the risk of mercury exposure and outlines clean-up methods for spills. The OEL for airborne mercury is prescribed by Ontario Regulation 844, Designated Substance Mercury, as amended by O.Reg. 390/00. Liquid mercury is classified as a hazardous waste under O.Reg. 347, as amended. The transport of the waste to a disposal site is controlled by O.Reg. 347 and by the federal TDGA. It is now common practice to recycle fluorescent light tubes, and other items containing mercury vapour or liquid mercury, recovering the component materials, and avoiding the generation of hazardous waste Silica Silica is an abundant mineral that occurs naturally in sand and rock containing quartz. Silica is therefore a normal constituent present in many building materials, including concrete, terrazzo and hard plaster finishes. There are no regulations that specifically govern the disturbance of silica on construction projects. However, the OHS Branch of the MoL has published the document Guideline: Silica on Construction Projects. This document classifies the disturbance of materials containing silica as Type 1, Type 2 or Type 3 work, and assigns different levels of respiratory protection and work procedures for each classification. The OEL for airborne silica is prescribed by Ontario Regulation 845, Designated Substance Silica, as amended by O.Reg. 391/00. Work procedures and personal protective equipment must be used to ensure that workers are not exposed to airborne silica levels that exceed this OEL Benzene Benzene may be a constituent of liquid petroleum and related products (e.g.: fuels, oils, paints, thinners, and cleaning solvents) that may be stored in storage tanks and containers. There are no regulations that specifically govern the disturbance of benzene on construction projects. Industrial processes involving benzene are regulated under the Ontario Regulation 839 Designated Substance Benzene, as amended by O.Reg. 105/04. The transport of the waste to the disposal site is controlled by O.Reg. 347 and by the federal TDGA Other Designated Substances The following Designated Substances are not expected to be present in any buildings at the installation in forms or quantities that would impact future work: Acrylonitrile; Arsenic; Coke Oven Emissions; Ethylene Oxide; Isocyanates; and, Vinyl Chloride. Survey and Sampling Methodology DST conducted the ACM and designated substance surveys and sampling in accordance with general health and safety requirements, a project-specific health and safety plan, and quality assurance/quality control (QA/QC) protocols to ensure the collection of high quality data. The assessment of ACMs was performed for ongoing management, and may be used for future construction or renovation purposes. Where assumed ACMs have been identified in this report, or where ACMs may be present within concealed spaces, additional intrusive investigation, sampling and laboratory analysis of samples may be required. The objective of the building surveys was to complete an inspection of the building exterior and of building interior components (e.g. mechanical systems, floors, ceilings and walls) within each room that were accessible using non-destructive techniques. The field survey program consisted of the following key tasks: Coordination of site visits through the property managers; Surveys completed by experienced DST personnel; and, Sending bulk samples of building materials for asbestos analysis and paint chips for lead analysis to an accredited laboratory. The inspection team performed the following tasks as part of the surveys: The completion of survey sheets for each room or group of similar rooms within each building; An evaluation of the suspected ACM building materials (e.g. condition and friability); The collection of bulk material samples for the purpose of confirmatory laboratory analysis, where required. Samples were not collected where sampling would have caused excessive damage or posed a potential safety concern to building occupants and/or the public; The visual identification of other suspected designated substances; and The preparation of floor plans showing the location of rooms surveyed and marking sample collection locations. Details regarding the location of ACMs, condition and cost estimates for removal can be found in the database provided in Appendix A. Cost estimates are for complete removal based on unit rates that are typical for the type of material being removed, and do not include contractor mobilization and demobilization. Cost estimates are provided on a room by room basis. Economies of scale may be realized if asbestos abatement is performed in several rooms simultaneously. The laboratory certificates of analysis are presented in Appendix B. Sample locations are indicated on floor plans in Appendix D. Photographs are provided in Appendix E Quality Control A quality assurance quality control (QA/QC) program was implemented for the project to help manage the office and fieldwork programs. All project documentation was maintained and controlled under each specific project QA file with unique project file identifiers. Bulk ACM samples were delivered to a NVLAP (National Voluntary Laboratory Accreditation Program) certified laboratory for analysis using Polarized Light Microscopy (PLM). A copy of the NVLAP Certificate is attached. All building material samples analyzed that were found to contain less than 1% asbestos were further analyzed utilizing a PLM Stratified Point Count (PC) method. This analytical method can obtain a reliable quantification limit of 0.25%. The NVLAP certification number for the laboratory performing the analysis can be found on the laboratory certificates of analysis appended to this report. Lead paint samples were analyzed at a laboratory accredited by the National Lead Laboratory Accreditation Program (NLLAP). These samples were analyzed using atomic absorption spectrophotometry in accordance with ASTM D A and EPA SW846 (7420/7421). The NLLAP certification number for the laboratory performing the analysis can be found on the laboratory certificates of analysis appended to this report. A QA/QC coordinator was assigned to the project to ensure that all samples sent for analysis were properly numbered and labelled. The QA/QC coordinator also completed the chain of custody forms to ensure proper transmittal of samples to the laboratory. All building documentation was reviewed to ensure that the survey forms for each building surveyed were complete. All samples were labelled with unique sample identification numbers. Sample identification numbers were composed of the ORC building number where the sample was collected, followed by an identifier differentiating between asbestos and paint chip samples, and a sequential two-digit numeric identifier for each sample. A single letter suffix was added, corresponding to a duplicate sample collected from a visually homogenous building material as per the requirements of O.Reg. 278/05. Laboratory results for all buildings at a given installation were presented in a single laboratory analysis report named with the 6 character alpha-numeric installation identifier Asbestos-Containing Material Condition Assessment The condition of suspected ACMs was assessed using the following criteria: GOOD Condition Material is completely encapsulated (covered by a jacketing material) and/or shows no signs or evidence of damage or deterioration. No asbestos-containing material is exposed. Includes conditions where the encapsulating material may have minor surface damage (i.e., scuffed or stained), but has not been penetrated (i.e., ripped, torn or punctured). Lead may also be present in the emergency light batteries, in the solder on copper pipes, in the cast iron drain pipe caulking and in the ceramic tile glazing in the MTO Regional Office Installation (N00724) Mercury Mercury may be present as a normal constituent in fluorescent light tubes, thermostats, and thermometers in the MTO Regional Office Installation (N00724) Silica Silica is present as a normal constituent in concrete building materials, brick and mortar, plasters and in ceramic tiles found in the MTO Regional Office Installation (N00724) Benzene Benzene may be present as a normal constituent of the fuel in the emergency generator fuel storage tank in the Regional Office (B11145). 23 Survey Report: Asbestos and other Designated Substances Page 15 MTO Regional Office (N00724), Kingston, Ontario DST File No.: BE-OT March 30, 2008 The following recommendations apply to all observed ACMs and suspected ACMs: Materials must be maintained in good condition. Appropriate work procedures and precautionary measures must be used, as outlined in O.Reg. 278/05, when performing work that may disturb ACMs or suspected ACMs. The condition of material(s) identified in this report must be inspected at least annually, and this record must be updated accordingly. If ACMs or suspected ACMs become damaged and worker exposure to the material is likely to occur, the damaged material must be repaired or removed following work procedures outlined in O.Reg. 278/05. Prior to future construction or renovation projects, additional intrusive investigations will be required to assess site conditions in concealed areas, such as above solid ceilings, in pipe chases, in column enclosures and within shafts, as applicable. Additional sampling and laboratory analysis may also be required for building materials that were concealed or were assumed to contain asbestos and therefore were not sampled during this assessment Lead Lead levels detected in the paint samples analysed were typically low, less than 5,000 ppm. Two lead-based paints were found with lead levels greater than 5,000 ppm, and were found to be peeling. The grey floor paint found in B11146 had a high lead content (160,000 ppm lead) and was peeling throughout the second floor. The exterior green trim on B23496 (7,000 ppm lead) was also found to be pealing. The paint which is readily peeling should be removed following appropriate precautions, and the paint should be sealed with a layer of non-lead based paint. No special lead precautions are typically required when disturbing materials coated with paints containing trace levels of lead (<600 ppm). For paints with concentrations >600 ppm, work procedures outlined in the MoL document entitled Guideline: Lead on Construction Projects should be followed to reduce the exposure to lead when disturbing materials coated with these paints. The Repair Garage (B11146) contained a former Battery Room. The countertops in the Battery Room are constructed of a soft malleable metal, suspected to be lead. Lead may also be present in the emergency light batteries, in the solder on copper pipes, in the cast iron drain pipe caulking and in the ceramic tile glazing in the MTO Regional Office Installation (N00724). The data, conclusions and recommendations which are presented in this report, and the quality thereof, are based on a scope of work authorized by the Client. The sampling program included the collection and analysis of bulk material samples with a frequency compliant with current regulatory standards. There is a practical limitation on the number of bulk samples collected and analyzed in any building. This requires the surveyor to extrapolate observations and analytical results between sample collection locations. The uncertainty, and inherent risk, associated with this necessity increases with the distance between sampling locations. The survey did not include selective demolition of floors, floor finishes, ceilings, or walls to examine concealed conditions. Similarly, window caulking and/or roofing materials may not have been subjected to destructive sampling if it was concluded that this may compromise the integrity of the building envelope components. Note, however, that no scope of work, no matter how exhaustive, can identify all potential contaminants. This report therefore cannot warranty that all conditions on or off the site are represented by those identified at specific locations.
