1 COOL CAMPUS CHALLENGE 2015 I. OFFICIAL RULES 1. Description: The Cool Campus Challenge is an online learning experience and competition between University of California campuses. The goal of this website is to help staff, students and faculty cut greenhouse gas emissions and create a culture of sustainability across the University of California. Participants who take steps by themselves or in groups to reduce their carbon footprints and help the UC system reach Carbon Neutrality by 2025 can compete on behalf of their campus. There is no purchase necessary to enter the Cool Campus Challenge Eligibility: The Cool Campus Challenge is open only to currently registered students, faculty, or staff of the University of California campuses, Lawrence Berkeley Laboratory and Office of the President. Participation constitutes your full and unconditional agreement to these Official Rules and Sponsors decisions, which are final and binding in all matters related to the Contest. 3. Sponsors: The Regents of the University of California, c/o University of California Office of the President, 1111 Franklin St., Oakland, CA Challenge Period: To participate in the Challenge, you must complete the Challenge activities between October 6, :01 a.m. Pacific Time and December 10, :59 p.m. Pacific Time. Any entries received after this period will not be eligible. 5. How to Participate: Go to to register for the challenge. Registration requires a name and a valid University of California address. Participants will be given a variety of ways to learn more about their carbon footprint and to pledge to numerous actions that have a direct impact on reducing energy use. Each week there will be new suggested actions (or pledges) participants can take that will either directly reduce greenhouse gas emissions and/or increase education and awareness about climate disruption. Participants can show their progress by uploading photos and stories to personal Challenge pages. For every action takes, participants can earn valuable points for their campus, and will enter participants in a raffle to win prizes.

2 Sponsors reserve the right to disqualify any entry that, in the sole judgment of Sponsors, is incomplete or ineligible. By submitting an entry, you agree to be bound by the rules of the program and by the decisions of Sponsors. ALL DECISIONS OF SPONSORS ARE FINAL. 6. Copyright: The entrant must be the sole author and owner of the copyright of text, artwork and photos uploaded to the Challenge website. 7. Usage rights: By entering the Contest you agree that any images or other content you submit may be used on the Cool Campus Challenge website, or for the promotion of the Challenge or future challenges by the Sponsor in perpetuity. 8. Winning Campus Selection: Points earned throughout the 10-week challenge will be tracked and viewable real-time and added to each campus total. Points will be tallied up at the close of the Challenge, and the campus with the highest point count will be crowned the Coolest UC Campus. Additional rewards and recognition will be bestowed upon the campuses that are leading the pack throughout the competition. 9. General Conditions: Sponsors reserve the right to cancel, suspend and/or modify the Challenge, or any part of it, for any reason or no reason including, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Challenge, as determined by Sponsors in their sole discretion. Persons found tampering with or abusing any aspect of the Challenge, or whom Sponsors believe to be causing malfunction, error, disruption or damage, will be disqualified. 10. Disputes: As a contestant, you agree that: (a) any and all disputes, claims and causes of action arising out of or related to this Contest shall be resolved individually, without resort to any form of class action, (b) all claims, judgments and awards against Sponsors shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys fees, and (c) under no circumstances will you be permitted to obtain an award for and you hereby waive all rights to claim punitive, incidental, exemplary, indirect, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Contest, shall be governed by and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of California.

3 II. PRIVACY CoolCampusChallenge.org respects your right to privacy. Government Code section provides that all departments and agencies of the State of California shall enact and maintain a permanent privacy policy, in adherence with the Information Practices Act of 1977 (Civil Code section 1798 et seq.), that includes, but is not necessarily limited to, the following principles to protect your right to privacy when viewing pages on our Internet site: a. Personally identifiable information may only be obtained through lawful means. b. The purposes for which personably identifiable data are collected shall be specified at or prior to the time of collection, and any subsequent use of the data shall be limited to and consistent with the fulfillment of those purposes previously specified. c. Personal data may not be disclosed, made available, or otherwise used for a purpose other than those specified, except with the consent of the subject of the data, or as required by law or regulation. d. Personal data collected shall be relevant to the purpose for which it is needed. e. The general means by which personal data is protected against loss, unauthorized access, use, modification, or disclosure shall be posted, unless the disclosure of those general means would compromise legitimate agency objectives or law enforcement purposes. Additionally, California Government Code Section (a)(6) prohibits all State agencies from distributing or selling any electronically collected personal information about users to any third party without the permission of the user. CoolCampusChallenge.org does not sell any electronically collected personal information. Any distribution of "electronically collected personal information" will be solely for the purposes for which it was provided to us. However, CoolCampusChallenge.org may provide or distribute certain lists and statistical reports based on personal information as provided by law, but no personal information is sold or distributed and all relevant legal privacy protections still apply to the CoolCampusChallenge.org websites. CoolCampusChallenge.org does place "cookies" on the computers of visitors to our site but only to improve the site s performance. We do use Google Analytics to monitor the aggregate number of visitors to the different pages on our site and also keep track of the various types of web browsers used by our customers. The cookies placed on your computer by using the website do not contain "electronically collected personal information" and do not compromise your privacy or security. PUBLIC DISCLOSURE In the State of California, laws exist to ensure that government is open and that the public has a right to access appropriate records and information possessed by State government. At the same time, there are exceptions to the public's right to access public records. These exceptions serve various needs including maintaining the privacy of individuals. Both State and federal laws provide exceptions. All information collected at this site becomes a public record that may be subject to inspection and copying by the public, unless an exemption in law exists. PERSONAL INFORMATION AND HOW IT IS USED We do not collect personal information directly from individuals who volunteer to use some of our services. Collection of this information is required to deliver some specific services, but use of these services is voluntary. If you do nothing during your visit to this website but only browse and download information, we automatically collect and store the following information about your visit: 1. The Internet Protocol Address and domain name used, but not your address. The Internet Protocol Address is a numerical identifier assigned either by your Internet service provider or directly to your computer. We use the Internet Protocol Address to direct Internet traffic to you and generate statistics used in the management of this site; 2. The type of browser and operating system you used; 3. The date and time you visited the site; 4. The web pages or services you accessed at the site. Under Government Code , if you choose, you may have any personal information collected about you discarded from CoolCampusChallenge.org systems without reuse or distribution, provided we are contacted in a timely fashion. CoolCampusChallenge.org will not be responsible for information you provide us that is subsequently displayed by Google, Yahoo, or any other search engine. REQUEST FOR ASSISTANCE Any information you provide to us will only be shared with entities involved as necessary. Information you provide may be included with other consumers' information to be used for statistical reporting, trending data, and/or investigative actions. The information is retained in accordance with Government Code IF YOU SEND US You may choose to provide us with personal information, as in with a comment or question.
