2 Section 21f Two On Line Courses Section 21f Two Online Courses Pupils enrolled in a district in grade 5 12 Cyber schools, MCL , are exempt Parent consent or 18 year old pupil request, district must enroll pupil in up to 2 online courses each term, semester, trimester. Legislative intent to increase limit on number of online courses in for pupils who demonstrate success with online courses MCL f(1),(2) f effective date 10/1/13 (MDE anticipated begin second semester) 2
3 Section 21f Online Course Course of study capable of generating credit or grade Provided in an interactive internet connected learning environment Pupils are separated from teachers by time or location or both Certified Michigan teacher determines instructional method, learning needs, assessments, intervention strategies, reporting outcomes and evaluating effectiveness MCL f(12)(a) f Section 21f District Offerings To offer or provide an online course, a district or ISD* must Provide MVU with course syllabus to be included in the statewide online course catalog Provide on the district website a link to the course syllabi for all online courses offered by the district/isd and a link to the statewide online course catalog at MVU Use either an open entry and exit method OR align to semester, trimester or accelerated term format *HB 4295, 2014 PA 116 revises 21f to include ISDs as allowable providers of online courses to align with current MDE guidance. 4 Section 21f Online Course Syllabus A document that includes ALL of the following: State academic standards covered in course Course content outline Required assessments Course prerequisites Expectations for actual instructor contact time with pupil and other pupil/instructor communications Academic support available Learning outcomes and objectives Name of institution/organization providing the online content Name of institution/organization providing the online instructor Course titles assigned by district/isd and NCES SCED title and course codes Number of nonresident pupils that will be accepted Results of quality review using MVU guidelines and model review process MCL f(12)(b) f Section 21f District Offerings To offer or provide an online course, a district or ISD must Provide MVU with course syllabus to be included in the statewide online course catalog Provide on the district website a link to the course syllabi for all online courses offered by the district/isd and a link to the statewide online course catalog at MVU Use either an open entry and exit method OR align to semester, trimester or accelerated term format MCL f(7) f 4
5 Section 21f Provider Capacity Pupil may enroll in online course published in district s catalog or the statewide catalog at MVU. District decides whether it can accept nonresident applicants and how many, district must us random draw system if more nonresident applicants than slots available. MCL f(3),(4) f Section 21f Denials A district may deny pupil enrollment online if: Pupil already has the credit for that course OR The course is not capable of earning credit OR The course is not consistent with remaining grad requirements or pupil s career interest OR Pupil doesn t meet the prerequisites or failed a previous online course in the same subject OR Course is of insufficient quality or rigor (district must make reasonable effort to help student find an alternative online course that is acceptable) MCL f(5) f 5
6 Section 21f Appeals If a pupil is denied enrollment, may appeal by submitting letter to ISD Supt where pupil s educating district is located stating: Reason provided by district for not enrolling pupil Reason why enrollment should be approved ISD Supt must respond within 5 days after receipt and if ISD determines denial doesn t meet one of the 5 reasons, district must enroll MCL f(6) f Section 21f Funding District shall use pupil foundation allowance to pay expenses associated with online course Pay 80% of cost of course on enrollment Pay 20% upon completion as determined by district Not pay more than 1/12 of district s foundation allowance per semester or 1/18 per trimester (presumes 6 class period day) Pupil cannot be counted for more than 1.0 FTE MCL f(8),(11) f 6

8 MVLRI Duty Cont. 2) Provide leadership for state s digital learning education system by Develop and report policy recommendations to Governor and Legislature that accelerate expansion of effective online learning in schools Provide clearinghouse for research reports, academic studies, evaluations, and other information related to online learning Promote and distribute most current instructional design standards and guidelines on online teaching Collaborate with MDE and colleges/universities in state to recommend to State Supt guidelines and standards for new teacher endorsement related to digital learning Pursue public/private partnerships that include districts to study and implement competency based technology rich online learning Convene focus groups and conduct annual surveys of teachers, administrators, pupils, parents and others to identify barriers and opportunities related to online learning Produce an annual consumer awareness report for schools and parents about effective online education providers, delivery models, performance data, cost structures, and research trends Research and establish internet based platform that educators can use to create student centric learning tools and resources and faciltate a user network to help educators use the platform. MVU must work with districts and ISDs to plan to make available online resources that align with Michigan s k 12 curriculum standards MCL , MVLRI Statewide Catalogue and 21f Create and maintain a public statewide catalog of online learning courses being offered by all public schools in the state. Identify and develop list of nationally recognized best practices for online learning and use it to review online course vendors, courses and instructional practices. Provide mechanism for ISDs to ruse identified best practices to review content offered by constituent districts. Review online course offerings of MVU and make results available to public on the statewide catalog. Make sure statewide catalog is on MVU website and linked to each district s website under Section 21f In statewide catalogue must also include 1. Number of pupils enrolled in each online course in Number of pupils who successfully completed online course in Completion rate for each online course MCL (2)(b)(ix), (4), (5) 8
9 MVU & Michigan Virtual School Michigan Virtual School must maintain accreditation for MVU to receive any funding under this section MVU School may offer online courses and place in statewide catalogue: information technology courses, college level equivalent courses, dual enrollment courses, programs and services for at risk pupils, GED test prep courses for adjudicated youth, special interest courses, PD If home schooled or nonpublic student is resident of district that subscribes to services provided by Michigan Virtual School, student can use MVS for same cost district pupil is charged. By Dec 1, MVU report to legislature; a) list of districts served by MVS; b) list of online courses available to districts: c) total number of online course enrollments and information on registration and completions by course; d) overall course completion rate percentage MCL (3),(4), (5),(6) MVLRI Advisory Group Governor may appoint advisory group for MVLRI to make recommendations to Governor, Legislature and MVU Board President that will accelerate innovation in state s education system that will prepare K 12 students to be career and college ready and promote increasing percentage of state citizens with high quality degrees and credentials to 60% by MCL (7) 9

11 Section 21f CEPI Reporting TSDL Virtual courses are treated the same as any other course, except there is an additional option of identifying the teacher as a mentor teacher; mentor teachers must be certified A teacher of record must be reported, if virtual and no teacher of record, then mentor teacher must be reported Online courses may be reported as Virtual Delivery Mentor teacher must hold Michigan teaching certificate and be certified at the grade level. 12 Section 23a Dropout Recovery Programs Section23a Dropout Recovery Program Qualifies for special membership counting provisions under 6(4)(ff) membership 1/12 of FTE for each month district reports pupil was enrolled in program and was in full attendance Not greater than 1.0 FTE Report to CEPI the # of pupils enrolled in program and in full attendance for a month not later than the 10 th of the next month Must not report pupil unless: 1) personalized learning plan in place on or before first school day of month and 2) pupil meets district s definition of satisfactory monthly progress for that month or if not met, then appropriate interventions are implemented within 10 school days after it s determined pupil didn t make satisfactory monthly progress Exempt from days and hours requirement under 101(12) (3) days and hours requirement: 170 days or and 1,098 hours for and 75% daily attendance required (8) calculating FTE based on Oct and Feb count days if.... 13 Section 23a DRP Requirements Enroll only eligible pupils Provide an advocate. Advocate can serve 1 50 pupils, be employed by district or provided by an education management organization partnering with the district. State and federal background check required Develop a written learning plan Monitor pupil s progress against written learning plan Requires each pupil to make satisfactory monthly progress as defined by the district (at minimum, meet statutory definition) Reports pupil s progress results to partner district at least monthly (assumes emo ) Operated on or off a district school campus but if using distance learning online must provide computer and internet access for each pupil Operated throughout entire calendar year If district using an education management organization for dropout recovery program, the emo must be partnering with at least 1 other district MCL (1) Section 23a Definitions Key eligible pupil expelled under the mandatory expulsion laws, OR suspended or expelled under local policy, OR court referred OR pregnant or parent OR previously a dropout OR determined by district to be at risk of dropping out. advocate adult available to meet in person with pupil, as needed, to conduct social interventions, proctor final exams and provide academic and social support to pupils written learning plan written plan developed with advocate that includes start and end dates, courses to be taken, credit to be earned for each course, teacher of record for each course and advocate name and contact information education management company private provide operates 1 or more DRPS in partnership with 1 or more districts MCL a 13
14 Section 23a DRP Satisfactory Monthly Progress A district s definition of satisfactory monthly progress must be consistent with definition provided in law: Satisfactory Monthly Progress an amount of progress that is measurable on a monthly basis and that, if continued for a full 12 months, would result in the same amount of academic credit being awarded to a pupil as would be awarded to a general education pupil completing a full school year. And it may include a lesser required amount of progress for the first 2 months a pupil participates in the program. 15 CEPI Collections Manual Submitting Section 23a Claims Submit an SRM record and include the Section 23a Component The MonthClaimed characteristic within the Section 23a Component is required and must indicate the month and year a student was in full attendance in the program The ProgramStartDate characteristic also required and must indicate month, day, and year of the first day a student participated in the program. Other statutory requirements like eligible pupil, advocate, written learning plan, satisfactory monthly progress, full attendance, calendar year program? GAD (based on pupils reported in the Oct and Feb count, not reported, not included?)? Section 25e (based on pupils reported in Oct, not reported, not included)? 16 Section 25e Pupil Transfer Requests Section 25e Transfer Requests Law CEPI shall work with MDE, districts and ISDs to develop a pupil membership transfer application and a pupil transfer process and CEPI shall complete the application by November 1, 2013 If a pupil counted in membership on the October count day transfers and enrolls in another district between the October and February count days, the new district may report enrollment and attendance information to CEPI thru the pupil transfer process within 30 days after the transfer or within 30 days after the sixth Wednesday after the Oct count day (certification deadline) whichever is later Pupil transfers may be submitted no earlier than the first day after the certification deadline for the Oct count day and before the Feb count day MCL e e effective Oct 1,
17 Section 25e Transfers CEPI App Upon receipt of the transfer information indicating pupil has enrolled and is in attendance in a new district, the pupil transfer process must: Notify district where pupil was previously enrolled Notify the ISD auditing staff of the previous and new district. The ISD auditor must approve or deny the transfer Aggregate the district wide changes and notify MDE for use to adjust state aid payment. MCL e(2) Section 25e Law MDE MDE must Adjust membership calculation so each district receives for each school day, as determined by CEPI Financial Calendar, an amount equal to 1/105 of FTE claimed in Oct count. It s a prorated FTE and adjusted based on state aid act payment and membership provisions Changes in state aid take effect as of the date the pupil becomes enrolled and in attendance at new district. MDE must base all subsequent state aid payments on this recalculation of state aid MCL e(3),(4) 17
18 Section 25e Law Cooperate If pupils enroll in new educating district and district makes Section 25 transfer request, then the count day district and other previous districts that received Section 25 transfer adjustments, and the new district must provide to CEPI and MDE all information they require to comply with this section. educating district district where pupil enrolls after Fall count day where Section 25 transfers are made. 26 NEW Section 25f Strict Discipline Academies Payment Added by HB 4295, 2014 PA 116 From State School Aid Fund, $2m for payments to strict discipline academies SDA must comply with Section 25e and use pupil transfer process for changes in enrollment covered by that section MCL f f effective date April 11, 2014 Section 25f SDA The Law On or before June 30, 2014, strict discipline academy must report to CEPI and MDE, for : 1. The number of pupils enrolled and in attendance at the SDA 2. The number of days each pupil enrolled was in attendance at the SDA, not to exceed 180 days The amount of payment to SDA under this section is the difference between 1/180 per pupil payment multiplied by number of days of pupil attendance minus 1/180 per pupil payment provided by Oct and Feb count days and Section 25e transfers MCL f f 26
27 Section 25f Hold Harmless? It appears that this is a means to protect SDAs from the impact of Section 25e transfers but also provides them an ability to capture funds for students who were not counted or countable on the Oct or Feb counts $2m set aside to pay SDAs if the state aid funding they receive via Oct, Feb and Section 25e transfers (everyone else) isn t as good as what they would receive if they calculated a pupils FTE based on daily attendance.
