Article one : Purpose of the law This law governs healthcare facilities in Rwanda. Article premier: Objectif de la loi La présente loi régit les établissements de santé au Rwanda. 5

6 Ingingo ya 2: Ibisobanuro by amagambo Muri iri tegeko amagambo akarikira afite ibi bisobanuro: 1. Ibigo by'ubuvuzi biterwa inkunga na Leta: Ibigo by'ubuvuzi byaba iby'umuryango utegamiye kuri Leta cyangwa iby'abigenga biterwa inkunga na Leta binyujijwe mu masezerano atuma ibyo bitaro bikurikiza amabwiriza n amategeko agenga ibigo by'ubuvuzi bya Leta. 2. Ibitaro by'intara: Ikigo cy ubuvuzi cyo muri buri Ntara gikora ibikorwa byo kuvura abacyoherejwemo ku rwego rwa kabiri, ibyo bikorwa bikuzuzanya n ibikorerwa ku rwego rw'ibitaro by'akarere. 3. Ibitaro Bikuru: Ikigo cy'ubuvuzi cyigisha, kandi gitanga ubuvuzi buhanitse ku rwego rw'igihugu. Icyo kigo gitanga ubuvuzi buhanitse bwiyongera ku butangwa n'ibitaro byo ku rwego rw'intara. Article 2 : Definition of terms In this law, the following terms shall have the following meaning : 1. Government subsidized healthcare facility: A healthcare facility fully owned by a non-governmental organisation or private entity that is subsidised by the Government through an Agreement subjecting the facility to the standards and operational procedures of a public healthcare facility. 2. Provincial Hospital: A healthcare facility, located in each Province, which provides secondary referral healthcare services complementary to those provided at district hospital level. 3. Referral Hospital: a teaching healthcare facility that provides specialized referral services at the national level. It provides referral healthcare services complementary to those provided at Provincial hospital level. Article 2: Définition des termes Dans la présente loi, les termes suivants ont la signification suivante: 1. Formation sanitaire subventionnée par le gouvernement: Une formation sanitaire entièrement propriété d'une organisation non gouvernementale et subventionnée par le gouvernement à travers un accord liant formellement la formation sanitaire aux normes et aux procédures opérationnelles d une formation sanitaire publique. 2. Hôpital provincial: Une formation sanitaire, située dans chaque province, fournissant des services de santé secondaires de référence complémentaires à ceux fournis au niveau de l hôpital de district. 3. Hôpital de Référence: Une formation sanitaire universitaire ou non des services de référence spécialisés au niveau national. Il fournit des services de soins de santé de référence complémentaires à ceux fournis au niveau de l'hôpital provincial. 6

Ibitaro by'akarere: Ikigo cy'ubuvuzi cyo muri buri Karere kihakorera ibikorwa byo kuvura ku rwego rwa mbere rw ibitaro, gikora ibikorwa byuzuzanya n ibikorerwa ku nzego zinyuranye z'ibigo by'ubuvuzi byo mu rwego ruciriritse. 5. Ibitaro by'icyitegererezo: Ikigo cy'ubuvuzi mpuzamahanga gitanga ubuvuzi buhanitse. 4. District Hospital: A healthcare facility, located at each District, which provides primary referral healthcare services complementary to those provided at the lower levels of the healthcare. 5. Specialized Referral Hospital: A national or international healthcare facility that provides specialized healthcare services. 4. Hôpital de District: un établissement de santé, situés dans chaque district, qui fournit des services de premiers soins référence complémentaires à celles prévues aux niveaux inférieurs du système de santé. 5. Hôpital de Référence Spécialisé: Un établissement de santé national ou international qui fournit des services de soins de santé spécialisés. 6. Ikigo cy'ubuvuzi cya Leta: Ikigo cy'ubuvuzi kiyoborwa na Leta hakurikijwe ibiteganywa n'iri tegeko kandi hubahirizwa amabwiriza n'amategeko agenga ibitaro bya Leta. 7. Ikigo cy'ubuvuzi cyigenga: Ikigo cy'ubuvuzi cy'abigenga kandi cyatangijwe hakurikijwe ibiteganywa n'iri tegeko hamwe n'amabwiriza agenga ibigo by'ubuvuzi by'abigenga byemejwe na Minisiteri y'ubuzima. 6. Public healthcare facility: Is a healthcare facility that is owned by the Government in accordance to provisions of this Law and conforms to norms and standards for Public Healthcare facilities. 7. Private Owned Healthcare Facility: Is a healthcare facility that is owned and established by a private person(s), moral or physical, in accordance to provisions of this Law as well as norms and standards governing private 6. Formation sanitaire privée: Est une formation sanitaire qui est entièrement la propriété d'une (des) personne privée (s), morale (s) ou physique (s), conformément aux dispositions de la présente loi ainsi qu aux normes régissant les 7

Ivuriro ry ibanze: urwego rw ubuvuzi bw'ibanze rukorera ku rwego rw akagari. Hatangirwa ibikorwa by'ubuvuzi byiganjemo ibyo kurinda abantu indwara. 10. Ivuriro: N'ikigo cy'ubuvuzi gitanga ibikorwa byo gukingira, kuvura, gusana cyangwa kunganira umurwayi, cyangwa kigira uruhare mu gusuzuma indwara kandi gifite ibyemezo bitangwa n'inzego zibifitiye ububasha. healthcare facilities approved by the Ministry of health. 8. Health centre: A healthcare facility located in each sector that provides primary healthcare services or a minimum package of activities as defined in the policies and standards determined by the Ministry of Health. 9. Health post: a healthcare facility that provides healthcare services at the lowest level of the community. It provides a community package of services that mainly comprises of preventive care. 10. Healthcare facility: any healthcare entity that provides preventive, curative, rehabilitative and palliative healthcare services to humans, or contributing to the diagnosis of diseases and recognized as such by a competent public authority. formations sanitaires privées agréées par le Ministère ayant la Santé dans ses attributions. 8. Poste de santé: Une formation sanitaire fournissant des services de soins de santé au plus bas niveau de la communauté. Il fournit un paquet communautaire des services comprenant principalement des soins préventifs. 10. Formation sanitaire: Toute entité sanitaire fournissant des soins de santé préventifs, curatifs, de réadaptation et de soins palliatifs aux êtres humains, ou contribuant au diagnostic des maladies et reconnue comme tel par une autorité publique compétente. 8

9 UMUTWE WA II : IMITUNGANYIRIZE N'IMITERERE Y IBIGO BY UBUVUZI Ingingo ya 3: Ubwoko bw amavuriro Ibigo by'ubuvuzi bigizwe n'ibyiciro bikurikira: 1. Ibigo by'ubuvuzi bya Leta; 2. Ibigo by'ubuvuzi biterwa inkunga na Leta, 3. Ibigo by'ubuvuzi by'abigenga. Hashobora gutangizwa ikigo cy'ubuvuzi cy'abigenga kigamije inyungu cyangwa kitagamije inyungu hashingiwe ku mategeko abigenga. Ikigo cy'ubuvuzi cya Leta gicungwa kandi gihabwa ingengo y imari na Leta. CHAPTER II: STRUCTURE AND ORGANISATION OF HEALTHCARE FACILITIES Article 3: Types of healthcare facilities The following are the types of healthcare facilities: 1. Public healthcare facility; 2. Government subsidized healthcare facilities, 3. Private owned healthcare facility. A private owned healthcare facility may be established for profit-making or not-for-profit purposes depending on their legal status. A public healthcare facility is established and financed by the Government. CHAPITRE II: STRUCTURE ET ORGANISATION DES FORMATIONS SANITAIRES Article 3: Types de formation sanitaires Les types des formations sanitaires sont les suivants: 1. Formations sanitaires publiques; 2. Formations sanitaires subventionnées par le Gouvernement 3. Formations sanitaires privées Une formation sanitaire privée peut être créée dans un but lucratif ou non-lucratif selon leur statut juridique. Une formation sanitaire publique est mise en place et financée par le Gouvernement. Ingingo ya 4: Ubusumbane by'ubuvuzi bya Leta bw'ibigo Article 4: Hierarchy of Public Healthcare Facilities Article 4: Hiérarchie des formations sanitaires publiques Ibigo by'ubuvuzi bya Leta bisumbana mu buryo bukurikira: 1 Ivuriro ry'ibanze, 2 Ikigo nderabuzima, The hierarchy of public health facilities is as follows: 1 Health post, 2 Health centre, La hiérarchie des formations sanitaires publiques est la suivante: 1 Le Poste de santé, 2 Le centre de Santé, 3 L'hôpital du district, 9

10 3 Ibitaro by'akarere, 4 Ibitaro by'intara, 5 Ibitaro Bikuru, 6 Ibitaro bikuru by'icyitegererezo. Iteka rya Minisitiri w'intebe rigena imiterere n imikorere y' ibigo by'ubuvuzi bya Leta. Ingingo ya 5: Urwego rureberera ibigo by ubuvuzi bya Leta n icyiciro birimo Urwego rureberera ibigo by ubuvuzi bya Leta n ibyiciro birimo rugenwa n Iteka rya Minisitiri w Intebe. Hagati y urwego rureberera ibigo by ubuvuzi bya Leta n Inama y Ubuyobozi y ibyo bigo, hakorwa amasezerano yerekeye gahunda y ibikorwa agaragaza ububasha n inshingano za buri ruhande mu kugeza ibigo by ubuvuzi ku nshingano zabyo. Ayo masezerano amara igihe gihwanye na manda y abagize Inama y Ubuyobozi kandi hagakorwa igenzurwa rya buri mwaka. 3 District Hospital, 4 Provincial Hospital, 5 Referral Hospital. 6 Specialized Referral Hospital. An Order of the Prime Minister determines the Organisation and Management of Public Healthcare Facilities. Article 5: Supervising authority of Public Healthcare facilities and their categories The supervising authority and the category of Public healthcare facilities shall be determined by an Order of the Prime Minister. There shall be concluded, between supervising Authority of the public healthcare facilities and the Board of Directors of the public healthcare facilities, a performance contract indicating powers, rights and responsibilities of each party in fulfilling the attributions of the public healthcare facilities. Such a contract shall be valid for a period equal to the term of office of members of the Board of Directors and is subject to annual evaluation. 4 l'hôpital provincial, et ; 5 L l'hôpital de Référence. 6 Hôpital de référence spécialisé. Un Arrêté du Premier Ministre détermine l'organisation et la gestion des formations sanitaires publiques. Article 5: Organe Tutelle des Formations Sanitaires Publiques et leur catégories L organe de tutelle et le catégorie des Formations sanitaires publiques sont déterminés par un Arrêté du Premier Ministre. Il est conclu, entre l organe de tutelle des formations sanitaires publiques et le Conseil d Administration des formations sanitaires publiques, un contrat de performance déterminant les pouvoirs, les droits et les obligations de chaque partie en vue de la réalisation de la mission des formations sanitaires publiques avec une évaluation annuelle. Ce contrat est valide pour une durée égale au mandat des membres du Conseil d Administration et doit faire l'objet d'une évaluation. 10

Ingingo ya 7: Ikigo cy'ubuvuzi cyigenga Iteka rya Minisitiri ufite ubuzima mu nshingano ze riteganya ibisabwa kugira ngo ikigo cy'ubuvuzi cyigenga cyemererwe gufungura. Public healthcare facilities meeting the qualifications of a Referral, Provincial or District Hospital are hereby endowed with legal personality, administrative and financial autonomy and shall be governed in accordance with laws governing public institutions. Article 7: Private healthcare facility An Order of the Minister having health in his or her attributions determines the terms and conditions required to operate a private healthcare facility. Les formations sanitaires publiques remplissant les conditions de référence nationale, provinciale ou l'hôpital de district sont dotées de la personnalité juridique, elles jouissent de l'autonomie administrative et financière et sont gérées selon les lois régissant les institutions publiques. Article 7: Formation sanitaire privée. Les modalités et les conditions requises pour accorder l'autorisation d ouvrir une formation sanitaire privée sont déterminées par un arrêté du Ministre ayant la santé dans ses attributions. Gukumira indwara, 3. kuvura, kunganira no gusimbuza CHAPTER III: MISSION OF HEALTHCARE FACILITIES Article 8: Mission of healthcare facilities Healthcare facilities are mandated to: 1. Promouvoir la santé; 2. Prévenir les maladies;

Provide curative, rehabilitative and palliative healthcare services; 4. Collect, analyse and use health related data. 5. Carry out research. Article 9: Supervision of healthcare services Every public healthcare facility is responsible for supervising the healthcare services provided by the healthcare facility in the lower category of its geographical location. 3. Fournir des soins de réadaptation et les services des soins palliatifs; 4. Collecter, analyser et utiliser les données relatives à la santé. 5. Effectuer des recherches. Article 9: Supervision des services de santé Chaque formation sanitaire publique est responsable de la supervision des activités cliniques de la formation sanitaire sous sa tutelle et son espace géographique. Article 10: Healthcare Facility Partnerships A public healthcare facility may enter into partnership with a private healthcare facility intended to promote or improve healthcare services. As part of their mission, a healthcare facility may participate in national or international health related activities with public or private sectors. Article 11: Participation in education and research A public healthcare facility or Government subsidised healthcare facility participates at initial and continuing professional training in various health professions, including offering internship and mentorship programs. For research purposes, healthcare facilities may for clinical or medical, enter into partnerships with recognised medical or health training institutions. Article 11: Participation dans l'enseignement et dans la recherche Les formations sanitaires publiques ou subventionnées par le Gouvernement participent à la formation professionnelle de base et à la formation continue dans différentes professions sanitaires, y compris les stages et des programmes d encadrement. Les formations sanitaires peuvent, à des fins cliniques, médicales ou de recherche, nouer des partenariats avec des institutions médicales ou sanitaires reconnues. An Order of the Prime Minister determines the modalities for Referral Hospital to provide the teaching services. Article 12: Role of decentralized entities in healthcare facilities Decentralized entities are responsible for enforcing health policies and regulations in public or private healthcare facilities in their geographical area of responsibility An Order of the Prime Minister determines roles and responsibilities of decentralized entities in the functioning of public or private healthcare facilities. Article 12: Rôle des entités décentralisés dans les formations sanitaires Les entités décentralisées sont responsables d'assurer la mise en œuvre des politiques et des normes de la santé dans les formations sanitaires tant publiques que privées dans le territoire géographique sous leur responsabilité. Un arrête du Premier Ministre détermine le rôle et les responsabilités des entités décentralisées en ce qui concerne le fonctionnement de ces formations sanitaires. Article 13: Norms, standards and Minimum services provided by Healthcare facilities The minimum package of services provided at the different categories of healthcare facilities are determined by an Order of the Minister having health in his or her attributions. Each healthcare facility must conform to norms and standards in which it falls. An Order of the Minister having health in his or her attributions determines a package of norms and standards for healthcare facilities. Article 13: Les Normes, standards, et les services minimums fournis dans les formations sanitaires Le paquet minimum des services fournis dans les différentes catégories des formations sanitaires est déterminé par Arrêté du Ministre ayant la santé dans ses attributions. Chaque formation sanitaire doit se conformer aux normes et standards dans lesquelles il se retrouve. Un Arrêté du Ministre ayant la santé dans ses attributions détermine le paquet des normes et standards pour les formations sanitaires. 14

Ukomoka kuri ibi bikurikira: 1 ingengo y imari bigenerwa na Leta; 2 inkunga zaba iza Leta cyangwa iz abaterankunga; 3 ibituruka mu mirimo bikora; 4 inyungu ku mutungo wabyo; 5 impano n indagano. Article 14: Charter of Patient rights All healthcare facilities must respect and enforce the charter of patient rights. CHAPTER IV: PROPERTY AND FINANCE OF PUBLIC HEALTHCARE FACILITIES Article 15: Resources of Public Healthcare facilities Assets of a public healthcare facility shall comprise movables and immovables. It emanates from the following sources: 1 State budget allocation; 2 Government or subsidies from partners; 3 incomes derived from hospital services; 4 proceeds from its property; 5 donations and bequests. Article 14: Charte des droits des patients Toutes les formations sanitaires doivent respecter et faire respecter la charte des droits des patients. CHAPITRE IV : PATRIMOINE ET FINANCES DES FORMATIONS SANITAIRES PUBLIQUES Article 15: Les ressources des formations sanitaires publiques Le patrimoine d une formation sanitaire publique comprend les biens mobiliers et les biens immobiliers. Il émane des sources suivantes: 1 l'allocation budgétaire de l'etat; 2 Subventions du Gouvernement ou des partenaires; 3 Les revenus provenant des services hospitaliers; 4 Le produit des biens de la formation sanitaire; 5 Dons et legs. 15

UMUTWE WA V: INGINGO Z INZIBACYUHO N IZISOZA Ingingo ya 18: Igihe cy inzibacyuho Amavuriro n ibitaro bya Leta n ibyigenga bihawe igihe cy amezi cumi n abiri (12) ngo bibe byamaze kuzuza ibigenwa n iri tegeko. Ingingo ya 19: Itegurwa, isuzumwa n iyemezwa ry iri tegeko Iri tegeko ryateguwe mu Kinyarwanda, risuzumwa kandi ritorwa mu Kinyarwanda. Article 16: Use, management and audit of assets of public healthcare facility The use, management and the audit of the property of healthcare facilities shall be carried out in accordance with relevant legal provisions. Article 17: Management of the budget of a public healthcare facility The budget of a health facility is adopted and managed in accordance with relevant legal provisions. CHAPTER V: TRANSITIONAL AND FINAL PROVISIONS Article 18: Transitional period The public and private healthcare facilities have a period of twelve (12) months to comply with this law. Article 19: Drafting, consideration and adoption This law was drafted in Kinyarwanda considered and adopted in Kinyarwanda. Article 16: Utilisation, gestion et audit des biens des formations sanitaires L'utilisation, la gestion et l'audit du patrimoine des formations sanitaires publiques doivent être effectués conformément aux dispositions légales. Article 17: Gestion du budget d une formation sanitaire publique Le budget d une formation sanitaire est adopté et géré conformément aux dispositions légales. CHAPITRE V: DISPOSITIONS TRANSITOIRES ET FINALES Article 18: Période de transition Les formations sanitaires publiques et privées ont un délai de douze (12) mois pour se conformer à cette loi. Article 19: Initiation, examen et adoption La présente loi a été initiée en Kinyarwanda, examinée et adoptée en Kinyarwanda. 16
