2 Duty of disclosure The Insurance Contracts Act 1984 requires us to give you information about your insurance and for you to give complete and accurate information to us. Before entering a contract of insurance with us, and each time you vary or renew your policy, we will ask you a number of specific questions. What you must tell us When answering our questions, you must be honest and you have a duty under law to tell us anything known to you, or which a reasonable person in the circumstances, would include in answer to the questions. We will use the answers in deciding whether to insure you and anyone else to be insured under the policy, and on what terms. Who needs to tell us It is important that you understand you are answering our questions in this way for yourself and anyone else whom you want to be covered by the policy. If you do not tell us If you do not answer our questions in this way, we may reduce or refuse to pay a claim, or cancel the policy. If you answer our questions fraudulently, we may refuse to pay a claim and treat the policy as if it had never existed. If you do not understand If you do not understand your duty, please contact us. Cooling off period When you take out a new policy or renew a current policy with us, we give you a cooling off period of 21 days. The cooling off period starts from: the date and time we issue a new policy to you, or midnight on your renewal date. What you need to do If you want to cancel your policy during the cooling off period, you must tell us you want to do that. If you cancel your policy during the cooling off period, we refund your premium in full (as long as you haven t made a claim). Who issues your policy? RACQ Insurance Limited issues your insurance policy and is responsible for the obligations set out in this Product Disclosure Statement and any Supplementary Product Disclosure Statement. What is your vehicle? page 14 The vehicle that is shown on your Certificate of Insurance. For example, your sedan, wagon, 4 wheel drive or hatchback. As part of the vehicle, we also cover these accessories or modifications that are attached to the vehicle or inside it when the incident happens: Manufacturer s standard accessories for the model and make of the vehicle. Other accessories or extras shown on your Certificate of Insurance. Modifications to the vehicle if they are shown on your Certificate of Insurance. General exclusions The general things we exclude under your policy are known as general exclusions and are shown on pages They apply to all parts of your cover. What is your caravan? page 14 What we pay page The caravan or trailer that is shown on your Certificate of Insurance. As part of the caravan or trailer, we also cover: Fixtures, fittings and appliances (including water tanks and pumps) that are permanently installed or attached. Generator plant and bottled gas cylinders and their enclosures when they are in or attached to the caravan (but we don t cover them for a trailer). Anything fitted by the manufacturer as standard equipment. Any manufacturer optional equipment shown on your Certificate of Insurance. An annexe (but we don t cover loss or damage to an annexe that is more than 5 years old, unless it is made of metal or fibreglass). What we pay for your claim is based on the following: The type of policy you have and whether your policy covers the loss or damage that resulted from an incident or any legal liability directly caused by an incident. Whether any extra benefits or optional benefits apply. Any sum insured that applies as shown on your Certificate of Insurance. For more information on your sum insured, see page 11. Whether any excess applies to your claim and how much your excess is. Any adjustments we make based on your GST Input Tax Credit (ITC) entitlements. Other limits or exclusions that apply to your cover. 7 8

7 1. Policy summary 1 Your policy Type of policy you may choose We offer 4 types of policies. Your Certificate of Insurance shows the type of policy you ve chosen. Table 1.1 summarises the cover we give you under the policy you choose. For full details about your cover, read the sections that apply to your policy. 8 11 What we exclude Make sure you read what we exclude carefully so you know what your policy doesn t cover you for. Our aim is to clearly show you what we do and don t cover so there are no surprises when you need to make a claim. Specific exclusions Specific exclusions apply to certain parts of your cover and are shown as crosses () in the section that sets out the cover that applies to your policy. What is an incident? An incident is an event which you didn t intend or expect. General exclusions The general things we exclude under your policy are known as general exclusions and are shown on pages They apply to all parts of your cover. What we pay What we pay for your claim is based on the following: the type of policy you have and whether your policy covers the loss or damage that resulted from the incident or any legal liability directly caused by that incident whether any extra benefits or optional benefits apply any sum insured that applies as shown on your Certificate of Insurance whether any excess applies to your claim and how much your excess is for more details about the types of excess that may apply and when they apply, see pages any adjustments we make based on your GST Input Tax Credit (ITC) entitlements see page 79, and other limits or exclusions that apply to your cover. See pages for more details about what we pay including how we settle your claim. Your sum insured If you have Motor Comprehensive Insurance, we cover your vehicle up to your sum insured shown on your Certificate of Insurance. Your sum insured is one of these: your vehicle s market value the agreed value, or the lower of the $ amount shown on your Certificate of Insurance or your vehicle s market value. What is the agreed value and market value? The agreed value is an amount that we agree to insure your vehicle for which is shown on your Certificate of Insurance. The market value is determined at the time of the incident by checking against values in your local market and taking into account the age and condition of your vehicle or your caravan and the kilometres it has travelled. If you have Motor Fire, Theft and Third Party Liability Insurance, the sum insured for your vehicle is: the lower of the $ amount shown on your Certificate of Insurance or your vehicle s market value. If you have Caravan Comprehensive Insurance, the sum insured for your caravan is: the lower of the $ amount shown on your Certificate of Insurance or your caravan s market value. Limits under Third Party Liability cover For your legal liability which results from the use of your vehicle or your caravan, we pay the following amounts: if your vehicle was being used to transport dangerous goods, or was attached to or towing Words used in this document To help you understand some of the words we use in this Product Disclosure Statement, see the definitions on pages a vehicle used to transport dangerous goods, then we only pay up to $25,000 less any relevant excess in all other cases, we pay up to $20 million less any relevant excess. Those amounts include any compensation amounts and your legal costs. Please note that we only pay your legal costs if you get our written approval before you incur them. Other limits Other limits apply under any extra benefits, optional benefits and third party liability cover that you may have as part of the policy you have chosen. The limits are shown where we describe the cover that applies to your policy. Policy conditions Contract between you and us Your insurance policy is a legal contract between you and us. We agree to give you the insurance set out in your policy for the premium you pay us. More than one policyholder If more than one person is named as the policyholder on your Certificate of Insurance, then each person is responsible for: the completeness and accuracy of information in any application forms, statements, claims or documents that are provided by any one of them to us, and complying with the conditions of your policy. Your premium Your premium is the amount you pay for the cover we give you under your policy. Your Certificate of Insurance shows your premium amount and whether you are paying annually in advance or by monthly instalments if you choose the Pay by the Month option. If you re registered or required to be registered for GST If you re registered for the Goods and Services Tax (GST) or are required to be registered for GST, then before you lodge your claim you must tell us your Australian Business Number (ABN) and the percentage of Input Tax Credits (ITCs) you are entitled to claim on your premium for the period of insurance during which the incident happened. If you don t tell us the correct percentage of ITCs, you may have to pay GST and interest or penalties under GST law. If you aren t sure what your GST obligations are, or if you re a member of a GST Group, you should talk to your tax advisor. 1 Policy summary 12

9 Amounts shown All policy limits and amounts shown in this Product Disclosure Statement include any government statutory charges, levies, duties, GST and other taxes that may apply. In some parts of this Product Disclosure Statement, we give examples to explain how your policy works. In those examples, the $ amounts we show include any government statutory charges, levies, duties and GST. If we pay a claim similar to one of our examples, then we will reduce the actual amount we pay for that claim by the amount of any ITCs that the policyholder is entitled to claim see page 79. When your policy starts When you pay the annual premium or first monthly instalment, then your policy starts on the time and date shown on your Certificate of Insurance. If you renew your current policy, then your policy for the new period of insurance starts at midnight on the day the previous period of insurance ends. General conditions General conditions apply to your policy see pages for more details. It s important for you to know about these conditions. If you don t comply with any condition or term of your policy, it may affect whether we pay your claim, or, if we decide to pay your claim, how much we pay for your claim. Product Disclosure Statement This Product Disclosure Statement sets out the conditions that apply to your policy including what we do and don t cover, the exclusions that apply under your policy and what we pay when you make a claim. We give you a Product Disclosure Statement with your Certificate of Insurance when you take out a new policy with us. You can download a current copy of our Product Disclosure Statement from Supplementary Product Disclosure Statement If we need to make a change to the Product Disclosure Statement conditions, we may issue a Supplementary Product Disclosure Statement which sets out the change. If we issue a Supplementary Product Disclosure Statement, we will give you a copy. Your vehicle or caravan 1 Policy summary We cover the vehicle or caravan that is shown on your Certificate of Insurance. This section outlines what we include as your vehicle or your caravan under your policy. Your vehicle 13 Documents that make up your policy Your policy includes the following 3 key documents. Those documents show the conditions that apply to your policy. Please read the documents carefully and keep them in a safe place. Certificate of Insurance Your Certificate of Insurance shows the type of policy you have with us and also shows these specific details that apply to your policy: policy number policyholders your vehicle or your caravan details for your vehicle, any non manufacturer s standard accessories that are covered under your policy for your vehicle, any modifications to your vehicle that are covered under your policy for your caravan, any annexe or manufacturer s optional equipment that is covered under your policy listed drivers period of insurance sum insured any optional benefits you ve chosen any financier that you tell us has a security interest in your vehicle or your caravan some limits and special conditions that apply to your policy the excesses that apply to your policy, and the premium for your policy. We give you a Certificate of Insurance when you take out a new policy, renew a current policy or make a change to your policy. When you receive your Certificate of Insurance, you should check the details to make sure they are correct. We cover the vehicle that is shown on your Certificate of Insurance. For example, your sedan, wagon, 4 wheel drive or hatchback. As part of the vehicle, we also cover these accessories or modifications that are attached to the vehicle or inside it when an incident happens: Manufacturer s standard accessories for the make and model of the vehicle. Other accessories or extras shown on your Certificate of Insurance. Modifications to the vehicle if they are shown on your Certificate of Insurance. We do not cover any modifications or accessories other than manufacturer s standard accessories unless they are shown on your Certificate of Insurance so make sure you tell us about them, especially when you buy a used vehicle. Your caravan We cover the caravan or trailer that is shown on your Certificate of Insurance. As part of the caravan or trailer, we also cover: Fixtures, fittings and appliances (including water tanks and pumps) that are permanently installed or attached. Motor Comprehensive Insurance Under your Motor Comprehensive Insurance policy, we provide cover for loss or damage to your vehicle caused by certain incidents and $20 million of third party liability cover. For us to cover you, the incident must happen during the period of insurance. We describe what we cover under your policy on pages In those pages, we show: Yes What we cover. No What we don t cover that is, the exclusions that apply to the cover. We don t cover you under your policy for anything caused by or arising in connection with any of these items, circumstances or events. Limits $ Any limits that apply. 2 Motor Comprehensive Insurance What is your vehicle? We cover the vehicle that is shown on your Certificate of Insurance. For example, your sedan, wagon, 4 wheel drive or hatchback. 11 Summary of your cover Table 2.1 provides a brief summary of the cover we give you if you have chosen Motor Comprehensive Insurance. For full details about that cover and the exclusions and limits that apply, see the relevant pages shown in the last column. Emergency repairs We pay for emergency repairs that need to be done to your vehicle. 20 Hire car after a theft We pay for you to hire a car for up to 14 days if your vehicle is stolen. 21 Keys and locks We pay the costs to replace and recode your vehicle s keys and locks 21 if your keys are stolen. Lifetime repair guarantee We guarantee the quality of repairs we authorised for your vehicle when 22 you made a claim with us if they were completed by an RACQ Insurance Selected Repairer. New vehicle replacement We replace your vehicle that is less than 2 years old with a new one 22 in certain situations. Personal property We pay for loss or damage to personal property in your vehicle that is 23 caused by certain incidents. Salvage rights We let you keep the wreck of your veteran, vintage, classic or historic 23 vehicle if it s a total loss. Selecting your repairer You can choose who you want to repair your vehicle. 24 Towing and storage We pay the reasonable costs to tow your vehicle after an incident and 24 store it for up to 30 days. Trailer or caravan damage We pay for loss or damage to your box trailer or caravan caused by an 25 incident that happens during the period of insurance (we only cover up to $750 under this benefit if you want more cover you need to take out Caravan Comprehensive Insurance). Optional benefits Page Excess free windscreen If you choose this benefit, you don t need to pay any excess the first 26 time you make a claim during the period of insurance for damage to your windscreen or window glass. Hire car after an incident If you choose this benefit, we pay for you to hire a car for up to 14 days 26 if your vehicle is damaged in an incident other than a theft. No claim discount protection If you have a Rating 1, then you may be able to choose this benefit to 27 protect your no claim discount the first time you make a claim during the period of insurance. Third party liability cover Page Third party liability We cover your legal liability to pay compensation to someone for loss 28 or damage to their property or for death or bodily injury which results from an incident that happens during the period of insurance directly caused by the use of your vehicle. Aussie Assist Page Aussie Assist Benefits that are available when you or your immediate relatives are travelling in Australia and are 100km or more away from your home. 31 Your vehicle cover Under your Motor Comprehensive Insurance policy, we cover your vehicle for loss or damage caused by an incident that happens during the period of insurance. For example: your vehicle crashes into another vehicle your vehicle catches fire someone steals your vehicle, or your vehicle is damaged by a storm, hail or flood. Loss or damage to your vehicle Yes Loss or damage to your vehicle that is caused by an incident that happens during the period of insurance. No Loss or damage to the tyres on your vehicle from applying your brakes. Loss or damage caused by: birds, animals or insects biting, chewing or scratching your vehicle structural failure or mechanical, electrical or electronic breakdown or failure, or wear, tear, corrosion, rust or deterioration. Loss or damage to exterior paintwork caused by rain, sand or water over an extended period of time. The cost to fix previous repairs because of poor workmanship. Any reduction in your vehicle s value after it has been repaired. Any indirect loss resulting from loss or damage to your vehicle including: financial loss or damage (e.g. you can t use your vehicle and have to arrange alternative transport or can t go to work), or any inconvenience or other non-financial loss of any kind (e.g. loss of enjoyment from not being able to use your vehicle). However, this exclusion does not stop you from making a claim for any extra benefit or optional benefit you may be entitled to see pages The general exclusions shown on pages Limits $ Up to the sum insured shown on your Certificate of Insurance see page Motor Comprehensive Insurance 17 Exclusions The specific exclusions that apply to your cover for loss or damage to your vehicle are shown above as crosses (). The general exclusions that apply to all parts of your cover are shown on pages We don t cover you for anything caused by or arising in connection with any of these items, circumstances or events. 18

12 Extra benefits We provide a range of extra benefits as part of your Motor Comprehensive Insurance policy. You don t need to pay more for extra benefits we include them as part of your cover. Making a claim for an extra benefit You can only claim for certain extra benefits if we accept your claim for an incident that causes loss or damage to your vehicle. For example, if we pay for the damage caused to your vehicle by a crash, then under the extra benefit Emergency repairs we also pay up to $500 for any urgent repairs you arranged without consulting us. You can claim for other extra benefits even when there is no loss or damage to your vehicle. For example, you can make a claim under the extra benefit Keys and locks on its own. We pay for extra benefits on top of any sum insured that applies to your claim. Baby capsules and child seats We pay for loss or damage to your baby capsules and child seats. You can only make a claim for this extra benefit if we accept your claim for an incident that involves your vehicle. Yes Costs to replace baby capsules and child seats that are fitted to your vehicle and are: damaged, or stolen. No Loss or damage caused by wear, tear, corrosion, rust or deterioration. The general exclusions shown on pages Limits $ Up to $500. Changing your vehicle If you sell your vehicle, we cover your replacement vehicle. You can only make a claim for this extra benefit if we accept your claim for an incident that involves your replacement vehicle. Yes If you sell your vehicle and replace it with a similar vehicle during the period of insurance, then we cover the replacement vehicle for 14 days from when you buy it as long as you: tell us within 14 days from when you buy it, and pay any extra premium that applies. No The general exclusions shown on pages Limits $ Up to the market value of the replacement vehicle. Driver fatality benefit We pay a driver fatality benefit if you or a listed driver dies in certain situations. You can only make a claim for this extra benefit if we accept your claim for an incident that involves your vehicle. Yes We pay a driver fatality benefit if you or a listed driver is in your vehicle and dies: solely and directly as the result of an injury suffered in an incident involving your vehicle, and within 90 days from when the incident happened. No The general exclusions shown on pages Limits $ $7,500 to the estate of the deceased. Emergency repairs We pay for emergency repairs that need to be done to your vehicle. You can only make a claim for this extra benefit if we accept your claim for an incident that involves your vehicle. 2 Motor Comprehensive Insurance Yes Emergency repairs to your vehicle that you arrange without consulting us after an incident happens. You must get our written consent before you authorise any repairs that cost more than $500. No The general exclusions shown on pages Limits $ Up to $

13 21 Hire car after a theft We pay for you to hire a car if your vehicle is stolen. You can only make a claim for this extra benefit if we accept your claim for an incident that involves the theft of your vehicle. Yes If your vehicle is a car, station wagon, van, utility or panel van and it is stolen, we pay for you to hire a car that is chosen by us to replace your vehicle for up to 14 days or until it s recovered (whichever happens first). No Your vehicle is: a veteran, vintage, classic or historic vehicle, or is designed to carry 2.5 tonnes or more. Loss, damage or legal liability which results from you using the hire car. These costs: running and incidental costs for the hire car (e.g. petrol, insurance and tolls) any deposit that needs to be paid to the hire car company, or any insurance excess that may apply to the hire car. The general exclusions shown on pages Limits $ Up to $1,400 in total for up to 14 days of hire. Keys and locks We pay the costs to replace and recode your vehicle s keys and locks if your keys are stolen. You can make a claim for this extra benefit on its own without making a claim for an incident that involves loss or damage to your vehicle. Yes If the keys to your vehicle are stolen, we pay the costs to replace and recode the keys and locks for your vehicle. No Keys you lose or misplace. The general exclusions shown on pages Limits $ Up to $750 after you pay any relevant excess. For example, if it costs $1,100 to replace and recode your keys and locks and your excess is $600, we pay $500. Lifetime repair guarantee We guarantee the quality of repairs we authorised for your vehicle when you made a claim with us if they were completed by an RACQ Insurance Selected Repairer. 14 Personal property We pay for loss or damage to personal property in your vehicle that is caused by certain incidents. You can only make a claim for this extra benefit if we accept your claim for an incident that involves your vehicle. Yes Loss or damage to personal property that belongs to you or someone who normally lives with you that s: inside your vehicle when it s involved in a collision, overturns or catches fire, and damaged as a result of the incident or stolen immediately after the incident happens. No Loss or damage to: jewellery and watches cash, gift cards, cheques and traveller s cheques credit, debit or any other type of financial transaction card stock in trade or any other property used in a business, or motorcycle riding gear (but we do cover motorcycle helmets). The general exclusions shown on pages Limits $ Up to $500. Salvage rights We let you keep the wreck of your veteran, vintage, classic or historic vehicle if it s a total loss. We won t deduct the salvage value from any amount we pay you. You can only make a claim for this extra benefit if we accept your claim for an incident that involves your vehicle. Selecting your repairer You can choose who you want to repair your vehicle. Yes If we accept your claim for an incident that involves your vehicle and we choose to repair it, then you can ask for the repairs to be completed by: an RACQ Insurance Selected Repairer we have a network of selected repairers across Queensland that have agreed to abide by our strict standards for service and quality, or any repairer. No The general exclusions shown on pages Limits $ Up to the amount our assessor approves for the repairs. Towing and storage We guarantee the repairs If you use an RACQ Insurance Selected Repairer, we provide a lifetime guarantee for the repairs they complete on your vehicle see page 22. We pay the reasonable costs to tow your vehicle after an incident and store it for up to 30 days. You can only make a claim for this extra benefit if we accept your claim for an incident that involves your vehicle. Yes If your vehicle is not driveable after an incident, we pay the reasonable costs to: tow your vehicle from where the incident happened or from where your vehicle was recovered to the closest repairer or safe place, and store your vehicle for up to 30 days. 15 25 Trailer or caravan damage We pay for loss or damage to your box trailer or caravan caused by an incident that happens during the period of insurance. You can make a claim for this extra benefit on its own without making a claim for an incident that involves loss or damage to your vehicle. Yes Loss or damage to your box trailer or caravan that is caused by an incident that happens during the period of insurance while: it s attached to your vehicle, or you are in charge of it. No Any insurance policy (including Caravan Comprehensive Insurance provided by us) covers your box trailer or caravan for loss or damage. Your box trailer or caravan is unregistered. Loss or damage to the tyres on your trailer or caravan from applying the brakes on your trailer or caravan or the vehicle towing it. Loss or damage caused by: structural failure or mechanical, electrical or electronic breakdown or failure, or wear, tear, corrosion, rust or deterioration. Loss or damage to exterior paintwork caused by rain, sand or water over an extended period of time. The cost to fix previous repairs because of poor workmanship. Any reduction in your trailer or caravan s value after it has been repaired. The general exclusions shown on pages Limits $ Up to $750 after you pay any relevant excess. For example, if the cost to repair the damage is $1,600 and your excess is $600, we pay $750 towards its cost (you need to pay the extra $250). Exclusions More cover for your box trailer or caravan We automatically cover your box trailer or caravan for loss or damage up to $750. Excess free windscreen If you choose this benefit, then the first time you make a claim during the period of insurance for damage to your windscreen or window glass, you won t need to pay any excess. Yes You don t need to pay any excess the first time you make a claim during the period of insurance for damage to windscreen or window glass. No If the damage to your windscreen or window glass does not extend through the entire thickness of the glass. Damage to any other glass which forms part of your vehicle. Hire car after an incident If you choose this benefit, we pay for you to hire a car if your vehicle is damaged in an incident other than a theft. If your vehicle is stolen, we may pay for a hire car under the extra benefit Hire car after a theft see page 21. You can only make a claim for this optional benefit if we accept your claim for an incident that involves your vehicle. Yes If your vehicle is damaged in an incident other than a theft we pay for you to hire a car that is chosen by us to replace your vehicle until whichever of these happens first: you ve had the hire car for 14 days your vehicle is repaired, or we settle and pay your claim as a total loss. No Loss, damage or legal liability which results from you using the hire car. These costs: running and incidental costs for the hire car (e.g. petrol, insurance and tolls) any deposit that needs to be paid to the hire car company, or any insurance excess that may apply to the hire car. An at fault claim involving your vehicle is one where: we decide the person in charge or control of your vehicle at the time of the incident is partially or wholly responsible for the incident, or someone else is 100% responsible for the incident but you can t give us their correct name and residential address and the make, type and registration details of their vehicle (if another vehicle was involved). Third party liability cover is insurance against your legal liability to pay compensation for causing loss or damage to someone else s property or for causing death or bodily injury. It covers you if someone makes a claim against you or sues you. In this section, we set out the third party liability cover that we provide when you have a Motor Comprehensive Insurance policy. Third party liability Compulsory Third Party (CTP) insurance The third party liability cover you have under your policy is not the same as the CTP insurance that you must get when you register your vehicle. Contact us for more details about CTP insurance. Yes Your legal liability to pay compensation to someone for loss or damage to their property or for death or bodily injury which results from an incident that happens during the period of insurance directly caused by: the use of your vehicle towing a trailer or caravan with your vehicle (including if the trailer or caravan detaches from your vehicle while it is moving) attaching or detaching a trailer or caravan to or from your vehicle something falling from your vehicle or from a trailer or caravan being towed by your vehicle (but we don t pay for damage to the item that fell off), or loading or unloading items from your vehicle or a trailer or caravan attached to it (as long as you are on a public road or any public place at the time). If your vehicle is a tow truck (or is designed to winch on and carry up to 2 vehicles), you use it on a full time commercial basis to tow or carry vehicles and it s registered and based in Queensland, your legal liability to pay compensation to someone for damage to another vehicle which results from an incident that happens during the period of insurance directly caused by that vehicle: being loaded onto or unloaded from your vehicle being towed or carried by your vehicle, or accidentally coming off your vehicle while it is being towed or carried. The same third party liability cover that we give you under this policy we also give to any person driving your vehicle with your prior permission. However, to be covered they must comply with all of the terms of your policy, as if they were the policyholder. 2 Motor Comprehensive Insurance 27 28

17 29 The same third party liability cover that we give you under this policy we also give to your employer, business partner or principal if: you are driving your vehicle as their employee, business partner or agent they are driving your vehicle as your employer, business partner or principal, with your prior permission and for a purpose connected with the business you and they are involved in, or an employee of your business partner or principal is driving your vehicle with your prior permission and for a purpose connected with the business you and they are involved in. However, to be covered they must comply with all of the terms of your policy as if they were the policyholder. The same third party liability cover that we give you under this policy we also give you when you are temporarily using another vehicle instead of your vehicle if: your vehicle is not driveable at the time the vehicle you are using is in your lawful custody or control but you don t own it the vehicle you are using is registered and of a similar type to your vehicle, and no other insurance policy covers your legal liability while you are using that vehicle (if another policy partly covers the claim, we will only cover you for the part that is not covered by the other policy). When you are using another vehicle, all the terms of the third party liability cover we provide under your policy apply to it as if it was your vehicle. No Loss or damage to property that you or anyone covered by your policy owns or is in custody or control of. Death or bodily injury to: anyone who is in charge or control of your vehicle your family or any person who normally lives with you, or any person who is required by law to be insured against death or bodily injury under another insurance policy. Loss, damage, death or bodily injury which arises from the emission of exhaust gases or the use of any chemicals. Loss, damage, death or bodily injury which results from an incident that is caused by or contributed to by a defect in your vehicle. Legal liability for which you or any other person are entitled to be indemnified or covered under a statutory scheme (or would have been entitled to if you had complied with your obligations under that scheme) including legal liability covered by CTP insurance. Any legal liability you took on by agreement, unless you would be legally liable even if there was no agreement. Any other person s interest in your vehicle unless that interest is shown on your Certificate of Insurance. The general exclusions shown on pages Limits $ If your vehicle was being used to transport dangerous goods, or was attached to or towing a vehicle used to transport dangerous goods, then we pay up to $25,000 for each incident (less any relevant excess) to include: compensation amounts, and your legal costs (as long as you get our written approval before you incur them). $ In all other cases, we pay up to $20 million for each incident (less any relevant excess) to include: compensation amounts, and your legal costs (as long as you get our written approval before you incur them). If we pay $20 million for the claims against you arising out of a single incident, then your policy ends and we will notify you in writing. $ The limit applies for each incident regardless of the number of claims which may result from that incident. 18 Aussie Assist Aussie Assist is a group of benefits that we give you if you have a Motor Comprehensive Insurance policy. They are available when you or your immediate relatives are travelling in Australia and are 100km or more away from your home. Aussie Assist does not apply if business use is shown for your vehicle on your Certificate of Insurance or if your vehicle under your Motor Comprehensive Insurance policy is a: motorcycle veteran, vintage, classic or historic vehicle, or motorised wheelchair. You don t need to pay extra for Aussie Assist it is included as part of your cover. Making a claim To make a claim for an Aussie Assist benefit, you need to call RACQ Insurance Aussie Assist on How we manage your claim The Aussie Assist benefits depend on you and your immediate relatives giving us all the information and help we need. That includes giving us consent to discuss the medical condition of the ill or injured person with their treating doctor. We (or any agent who acts for us) decide how we will manage your claim, which includes deciding the most appropriate accommodation or means of transport for you or your vehicle. This may mean that you have to wait for appropriate transport to become available. We won t pay for any expenses you incur before you contact us. The most we will pay for any incident resulting in a claim is limited to the events shown on pages irrespective of the number of Motor Comprehensive Insurance policies held by you and your immediate relatives. If your policy is cancelled or expires, then any Aussie Assist benefit we are providing also ends. Words used in Aussie Assist Immediate relative means any of the following who normally live with you: your legal or de facto spouse or partner, or your or their children. You or your mean the persons shown as the policyholders on the Certificate of Insurance. Accommodation and transportation costs in an emergency If there s an emergency while you or your immediate relatives are travelling, we may pay accommodation and travel costs for you or your immediate relatives and the costs to return any vehicle you or your immediate relatives are travelling in to your home. Yes If you or any of your immediate relatives suffer an unexpected serious or disabling illness or injury while travelling in any vehicle and no one is able to drive the vehicle, we will arrange and pay for: appropriate accommodation for up to 2 nights for the ill or injured person and for you and your immediate relatives who are on the trip the ill or injured person (if they can be moved) and you and your immediate relatives who are on the trip to be taken to your original destination, or back to your home, and the vehicle you or your immediate relatives were travelling in to be transported to your home or its original destination (whichever is closer). If you or any of your immediate relatives are travelling in a vehicle owned by you or an immediate relative and it is stolen, we will arrange and pay for: ground transport for you and your immediate relatives who are on the trip to the nearest place where appropriate transport can be obtained, if it cannot be obtained locally appropriate accommodation for up to 2 nights, if required and appropriate transport is not readily available, and if the stolen vehicle is recovered intact within 35 days from when it was reported stolen to the police, the cost to return the vehicle to your home. If you or any of your immediate relatives suffer an unexpected serious or disabling illness or injury while travelling, but not in a motor vehicle, and the treating doctor decides to hospitalise the ill or injured person for 7 days or more, we will arrange and pay for any one of the following people to travel from anywhere in Australia to join the ill or injured person: their spouse, if the ill or injured person is travelling without them, a nominated person, if the ill or injured person is travelling alone, or a nominated relative, if the ill or injured person is travelling without you or your immediate relative. If you or any of your immediate relatives suffer an unexpected serious or disabling illness or injury while you are travelling, but not in a motor vehicle, and the ill or injured person does not need to be hospitalised for 7 days or more, we will arrange and pay for: the ill or injured person to travel to the place closest to your home where they can get medical care, and you or your immediate relatives that were travelling with the ill or injured person to return to your home. 19 Help with finding spare parts We provide help to try to find spare parts if you or your immediate relatives are travelling in a vehicle and it breaks down. Yes If the vehicle you or your immediate relatives are travelling in breaks down and the parts needed to repair it are not available locally, we will: provide help to try to find the relevant spare parts, and transport parts to the repairer if we can get them faster than the repairer can. No The Aussie Assist exclusions shown on page 35. Help with medical situations We provide help if you have a medical situation while you or your immediate relatives are travelling. Yes If you or your immediate relatives need medical help while you are travelling, we can arrange for a trained nurse or doctor to provide advice and further assistance over the phone. Your vehicle under your Motor Comprehensive Insurance policy is a: motorcycle veteran, vintage, classic or historic vehicle, or motorised wheelchair. You or your immediate relatives are outside Australia or are less than 100km away from your home when the incident that results in the claim happens. Any expense incurred before you contact us. Any costs for: vehicle parts or repairs meals or incidental expenses, or travel tickets or accommodation you have paid for (including cancellation fees or deposits) unless specifically stated or agreed to by us. Transport costs for any caravan or trailer that is not insured with us. Any costs for: medical, surgical, hospital or nursing home treatments or procedures services directly or indirectly connected with medical, surgical, hospital or nursing home treatments or procedures ambulance services, or services that can be claimed from Medicare or from a registered health benefits organisation. Any funeral or cremation costs. Any loss or damage to personal belongings, including lost baggage. Any illness, injury or death caused by you or any of your immediate relatives driving any vehicle if you or they: were under the influence of any alcohol or drug or both had in their breath or blood an amount of alcohol or drug which was equal to or more than the limit allowed by law, or refused to take a legal test for alcohol or drugs. Any illness, injury or death caused by pregnancy or childbirth. Any illness or injury caused by: an act of terrorism which involves biological, chemical or nuclear weapons or devices germ, disease, pollution or contamination caused by or in connection with an act of terrorism war or other acts of foreign enemy (whether war is declared or not), revolution or other civil disturbances the use, existence or escape of nuclear weapons material, or radiation or radioactive contamination from nuclear fuel, nuclear waste or the action of nuclear fission.
